REPORT OF THE TOWN CLERK
ANNUAL TOWN MEETING
March 5, 1962
A legal meeting of the inhabitants of the Town of Scituate qualified to vote in Elections and Town Affairs was held at the Scituate Junior High School Gymnasium on Monday, the fifth day of March, 1962, at 7:00 o'clock p.m. The meeting was called to order by Moderator Robert C. Haufler.
The warrant was read by Town Clerk William M. Wade.
The check list was used. Checkers were: Grace B. McPherson, Amy C. Bates, Elizabeth Y. Robbins, Daniel J. Queeney, Elden M. Meyers, Helen G. McDonald, Alice S. Torrey, Marjorie A. Gately, Catherine E. Levangie, Thelma L. Snow, Lillian M. Robinson and Frances E. McMorrow.

ARTICLE 2
To choose all the necessary Town Officers other than those elected by ballot, viz: Surveyor of Lumber, Measurer of Wood and Bark, two or more Field Drivers, one Poundkeeper.

To see if the Town will authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1963, and to issue a note or notes there- for payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Sec. 4 and 17, Chapter 44, G.L.

Will the Town vote to have all the income from the Water Department paid to the Town Treasurer, and estimated receipts used by the Assessors in fixing the tax rate for the current year.

ARTICLE 15
Will the Town vote to authorize the Board of Selectmen to establish reasonable fees for inspection by the Building Inspector, the Electrical Wiring Inspector and the Gas Inspector for the purpose of defraying the cost to the Town of providing the services of said Inspectors.

ARTICLE 16
Will the Town approve the recommendation of the Personnel Board to amend the Classification and Salary Plan, to be effective as of January 1, 1962, as follows: Deleting the present Section 17. SICK LEAVE and substituting: Section 17. SICK LEAVE
a. No sick leave with pay shall be granted during the first 3 months of em- ployment. After 3 months continuous full time employment and up to 1. year, any employee absent because of his own sickness shall be entitled to sick leave with pay for time absent not in excess of 6 work days. After 1 year of continuous full time employment, the period in any year for which employees shall be paid while absent because of personal sickness shall be 12 work days, plus the amount of any accrued and unused sick leave in previous years, not in excess of a total, however, of 90 work days.
b. In the event of loss of time directly attributable to injury incurred while performing assigned duties, an employee who is entitled to a sick leave allowance under this section shall be paid the difference between any payments made to him under Workmen's Compensation insurance and his regular rate until he has been paid an amount hereunder equal to his regular rate times the number of days of sick leave to which he is en- titled under paragraph a.
If the amount of sick leave allowance provided under sub-section a. has been, or is about to be exhausted, due to an injury incurred while per- forming assigned duties, an employee may apply to the Personnel Board for an additional allowance. The Personnel Board shall grant such ad- ditional allowance as the Board determines to be equitable after reviewing all of the circumstances.

In order to be eligible to receive benefits under this section, any em- ployee shall comply with any rules or regulations reasonably established by the department head as to substantiation of illness and in any event, any employee who has been absent from work for five or more consecu- tive working days shall be required to submit a physician's certificate establishing such absence was due to illness during this period.

To see if the Town will vote to amend the Water Department section of the Classification and Salary Plan under Schedule II by deleting W-12, W-16, W-18, and W-20 of Schedule II and substitute therefore a new W-12, W-16, W-18, and W-20 of Schedule II to be effective as of January 1, 1962, as follows:

ARTICLE 20
To see if the Town will vote to raise and appropriate, or transfer from avail- able funds in the Treasury, such sums of money as may be necessary to defray expenses estimated for the year 1962 and make appropriations for the following departments, said appropriations to be subject to such limitations and conditions as to the expenditure thereof as the Town by its vote shall determine and direct.
VOTED: That the Town raise and appropriate the amounts recommended by the Advisory Committee, as amended, each amount as a segregated and separate amount, and except as specifically voted by the Town, that no transfer shall be made from any such segregated and separate amount to any other amount either within or outside of the amounts allocated to the same Department; and, further, that no amount shall be payable to any person hereunder for expenses except on presentation of a voucher signed by such person and itemizing such expenses, with the condition that the expenditures for drainage projects under budget items 32d and 32g be expended only on those projects enumerated and identified in the schedule appearing in the Advisory Committee Report, and that each such project be made subject to the provisions of the Betterment Act (G.L.C. 80).

"No person being in possession or control of property abutting or adjacent to public ways within the Town shall permit any hedge, tree, bush, fence, wall or similar object standing on said property to obstruct the view of either pedestrian or vehicular traffic at any intersection of such ways in such a manner as to create a traffic hazard. The Chief of Police and the Board of Selectmen shall be responsible for the enforcement of this By-Law. The determination of the Chief of Police that such an object creates or does not create a traffic hazard shall be binding and conclusive on all persons. Any person violating this section, after being notified of such determination by the Chief of Police by registered mail addressed to his last known address, shall be subject to a fine not to exceed $20.00. In addition to criminal re- medies, the Selectmen may bring a bill in equity to enjoin the maintenance of any object in violation of this By-Law."

ARTICLE 30
To see if the Town will vote to amend its By-Laws by repealing the By-Law voted under Article 58 at the Annual Town Meeting in March, 1960, and approved by the Attorney General on May 24, 1960, and enact the following By-Law in lieu thereof:
SCITUATE HARBOR BY-LAW
Section I - In construing this By-Law the following words shall have the meaning herein given unless a contrary intention clearly appears.
"Scituate Harbor" - are the waters between the flashing red light on Cedar Point breakwater and the lookout tower on the Scituate Coast Guard building on First Cliff and all the waters inside this line.
"Harbor Master" - shall mean harbor master and assistant harbor masters duly appointed by the Selectmen.
"Boat" - includes every description of watercraft - other than a seaplane on the water - used or capable of being used as a means of transportation on water. "Persons" - shall include individuals, corporations, societies, associations and partnerships.
"Skin Diver" - shall include swimmers using fins and/or mask and/or snorkel tubes as self-contained underwater breathing devises.
Section II - No master or person acting as master, owner, custodian, or other person shall moor any boat within the limits of Scituate Harbor without first ob- taining a permit to moor said boat from the Harbor Master. Such permit must

be obtained for each calendar year. The application for such permit shall be made to the Harbor Master on a form prescribed by the Selectmen. The applica- tion shall set forth the name and address of the owner, the size and type of boat to be moored, the size and type of the mooring, and if the mooring is already in the water, the location thereof with sufficient details to enable the Harbor Master to locate it.
