Proposed By-Laws of the Town of Lynnfield
ARTICLE I.
TOWN MEETINGS
Section 1. The annual town meeting for the election of town officers, and such other matters as may legally come before such meetings, shall be held on the second Monday of March of each year.
Section 2. Notice of every town meeting shall be given by posting a copy of the warrant, calling the same, in at least six public places in the town, and in such other public places as the seleetmen may designate, seven days at least before the time of holding said meeting.
Section 3. All motions shall be reduced to writing by the person making them, when so requested by the Moderator.
Seetion 4. Upon taking the question, if the decision of the Moderator is doubted or a division of the house called for, the Moderator shall request the house to be seated and shall appoint tellers. The question shall then be distinctly stated and those in the affirmative and negative, respectively, shall be requested to rise and stand in their places until they are counted by the tellers, who shall carefully count each side and make report thereof to the Moderator and no person shall be counted who does not occupy a seat, provided that the tellers, under the direction of the Moder- ator, may count the votes of those who are unable to obtain seats.
Section 5. When any legal voter shall move that any question shall be taken by yeas and nays, the question shall be taken in that manner, provided ten legal voters shall so request, and the check list shall be used.

ARTICLE II
FINANCIAL AFFAIRS
Section 1. The fiscal year shall begin with the first day of February in each year, and end with the last day of January, following.
Section 2. The Auditor or town accountant shall, subject to the approval of the selectmen, prescribe the form and manner in which the accounts of the town shall be kept ; and all town officers shall keep the accounts in the form so prescribed.
Section 3. It shall be the duty of the Town Clerk, immedi- ately after every town meeting, to furnish the Auditor or Town Accountant and the Board of Assessors with a statement of all moneys appropriated by the town at such meeting, and of the purposes for which moneys were respectively appropriated.
ARTICLE III
FINANCE COMMITTEE
Section 1. There shall be a Finance Committee consisting of five members who shall be chosen at each annual town meeting as all other officers not elected by ballot. Said Finance Committee shall, within thirty days after the conclusion of the annual town meeting, organize by the choice of a Chairman and a Secretary, and shall cause to be kept a true record of its proceedings.
Section 2. The Selectmen and all Boards, committees, heads of departments or other town officers, authorized by law to expend money shall furnish to the Finance Committee, not less than ten days before the end of the town financial year, detailed estimates of the amounts necessary for the proper maintenance of the department under their jurisdiction for the ensuing year, with explanatory statements as to any changes from the amounts appropriated for the same purposes in the preceding year ; and an estimate of amounts necessary for outlays on permanent improve- ments. They shall also prepare estimates of any income likely to be received by the town during the ensuing year in connection with the town's business or property entrusted to their care. The selectmen shall include in their estimates the salaries and expenses

connected with their office, and the salaries of all other town officers shall be included in the estimates of the office, department or branch of the public service committee to their charge. The Treasurer shall, in addition to his estimate of the amount required for the maintenance of his own office, prepare a separate state- ment indicating the amounts required for the payment of interest on the town debt and for the payment of such portions of the town debt as may become due during the succeeding year, and all officers of the town shall at any time, upon request of said Fin- ance Committee furnish it with facts, figures and any other infor- mation pertaining to their several departments, provided however, that any such information may be withheld when in the opinion of the officer or the Board of Officers so requested, the communi- cation thereof might injuriously effect the interests of the town.
Section 3. It shall be the duty of the Selectmen within three days after drawing a town warrant, to transmit a copy of the same to the Finance Committee and said Committee shall consider all articles under which an appropriation of money may be made and report thercon at the meeting called in the warrant or any adjournment thereof. A public hearing may be given upon such articles and in such case the person whose name appears attached to an article shall be notified of the time and place of hearing thereon.
Section 4. Said Committee shall have power by ballot to fill any vacancies which may occur in its membership by death, resig- nation, removal from town, or other causes, and shall meet from time to time as it or the chairman may deem advisable
ARTICLE IV
LEGAL AFFAIRS
Section 1. The Board of Selectmen shall annually appoint an Attorney-at-Law, to act as Town Counsel, who shall be paid such compensation for his services as the Board may determine.
Section 2. The Town Counsel shall draft all bonds, deeds, leases, obligations, conveyances and other legal instruments, and do every professional act which may be required of him, by vote of the town or any board of town officers. Also when requested

by said boards or any committee of the town, he shall furnish a written opinion on any legal question that may be submitted to him, and he shall at all times furnish legal advice to any officer of the town who may require his opinion upon any subject concern- ing the duties incumbent upon such officer by virtue of his office.
Section 3. The Selectmen shall have full authority as agents of the town, to employ counsel to institute and prosecute suits in the name of the town, and appear for and defend suits brought against it, unless otherwise specially ordered by a vote of the town.
Section 4. Whenever it shall be necessary to execute any deed conveying land, or any other instrument required to carry into effect any vote of the town, the same shall be executed by the Selectmen, or a majority of them in behalf of the town, unless the town shall otherwise vote in any special case.
ARTICLE V
STREETS AND WAYS
Section 1. No person except the Selectmen, the Surveyors of Highways in the lawful performance of their duties, or those acting under their orders, except such other persons as are or may be authorized by statute, shall break or dig up the ground in any street or public way in the town, without first obtaining a written permit from the Selectmen ; and all persons acting under such permit shall put up and maintain a suitable railing or fence around the part of the street so broken up, so long as the same shall remain unsafe or inconvenient for travellers, and he or they shall keep one or more lighted lanterns fixed to such railing or fence, or in some other way exposed, every night from twilight in the evening through the whole night, so long as suchi street or way shall remain unsafe or inconvenient for travelers.
Section 2. Whenever any sidewalk becomes obstructed or made impassable by reason of the erecting or repairing of any building, or of doing any work, the person doing or causing the same to be done shall place a good and convenient walk around such construction.

Section 3. No person shall place or keep on any sidewalk of the town, in front of any building, any awning, shade or other projection less than seven and a half feet above the sidewalk at the lowest part thereof, nor shall any such awning, shade or pro- jection extend beyond the exterior line of the sidewalk.
Section 4. No gate either for the use of persons, horses, cattle, carriages or vehicles of any kind, constructed in any fence abutting in the highways of the town shall open outward over the sidewalk or highway.
ARTICLE VI
POLICE REGULATIONS
Section 1. Appointment of Police Officers.
It shall be the duty of the Selectmen to appoint, annually, one or more police officers, one of whom shall be designated Chief of Police, who shall hold office during the pleasure of the Select- men. Such police officers shall receive such pay as the Selectmen shall determine, unless otherwise specially voted by the town.
Section 2. Disorderly Behaviour in the Streets .
No persons shall assemble in a disorderly manner in any street or near any dwelling house within the town in the night time, and no person shall be guilty of any rude or disorderly behavior, or use indecent, profane or insulting language in any street or near any dwelling house or other buildings, to the an- noyance or disturbance of any person, under a penalty of not less than one dollar, nor more than ten dollars for each offence.
Section 3. Obstructions on Sidewalks and Street Crossings
No person shall stand upon or near any sidewalk or street crossing, so as to obstruct a free passage for foot passengers ; and any person or persons obstructing any sidewalk or street crossing shall move on immediately after a request made by one of the Selectmen, the Chief of Police, or any constable or police officer ; and any person neglecting or refusing to move when so requested, shall be liable to a penalty of not less than one dollar, nor more than ten dollars.

Section 4. Obstructing Passages to Houses
No person or persons shall be or remain upon any doorstep or other projection from any dwelling house or other building within the town, other than the doorstep or other projection from a dwelling house or other building owned or rented by such person or persons, so as to annoy or disturb any person or shall obstruct any passage to the same or the appurtenances thereof and any person so being or remaining as aforesaid when ordered by any constable, police officer, or watchman. or by the owner or occupant of such dwelling house or other building, shall immedi- ately depart therefrom, under a penalty of not less than one dol- lar, nor more than five dollars, for each offence.
Section 5. Obstruction of Sidewalks with Teams or Merchandise
No person shall place or cause to be placed upon any side- walk in the town, a horse, carriage, automobile or any goods'and merchandise, or other obstruction or any team, except for the purpose or loading or unloading the same, or drive or lead any horse or neat cattle thereon, under a penalty of not less than one dollar nor more than five dollars, for each offence. Nor shall any person deposit or carry along on any sidewalk, under like penalty, any swill or offal.
Section 6. Fast Driving Prohibited
No person shall ride any horse, or drive any horse or horses attached to a carriage of any description, either of burden or pleasure, or cause the same to be driven in any'street, lane, alley, or other way, or over any bridge in the town at a faster than eight miles an hour gait, or so as to endanger or expose to injury any person or persons standing, walking or riding in or upon the same, under a penalty of not less than two dollars, nor more than ten dollars, for each offence.
Section 7. Cattle not to go at Large
No owner or person having charge of any horse, cow, swine, sheep, goat, or other grazing animal, shall permit the same to go at large or pasture in any street or way within the town, either with

or without a keeper, under a penalty of not less than one dollar nor more than five dollars for each offence. Provided, that this by- law or regulation shall not affect the rights of any person to the use of land within the limits of such way adjoining his own premises.
Section 8. Filth and Rubbish not to be Deposited in the Streets
No person shall cast at large any hand bills in any street, or put or cause to be put or placed in any street, pond, stream, brook or drain, or any public or private place within the town, any dirt, garbage, carrion, shavings, filth, oyster shells, offal, or any kind of rubbish, except in such places and in such manner as shall be directed or permitted by the Selectmen, or by the Board of Health, on pain of forfeiting and paying for each offence a sum not less than one dollar, nor more than five dollars. And in case any person so offending shall refuse or neglect to remove such matter or thing without delay, after notice is given to him or her by the Selectmen or Board of Health to so remove the same, such person shall forfeit and pay a further sum of not less than two dollars, nor more than ten dollars, for such offence.
Section 9. Bill Posting upon Fences, Walls and Buildings
No person shall post up, or affix, or paint, print or write in any manner a placard, notice, advertisement 'or billl, upon a fence, wall or building in the town unless he has previously ob- tained the consent of the person or persons having possession of such fence, wall or building, under a penalty of not less than two dollars, nor more than ten dollars for each offence.
Section 10. Bill Posting in Public Places, Etc.
No person shall, without first having obtained the written consent of the Selectmen, post up or affix in any manner, a plac- ard, notice or bill, either written or printed, upon a curbstone, sidewalk or tree in a street or public place in the town, or upon a wall, telegraph pole, lamp post, fence or building belonging to the town, under a penalty of not less than two dollars nor more than ten dollars, for each offence.

Section II. Regulations in Regard to Public Buildings
The Board of Selectmen shall have authority to make rea- sonable rules and regulations in regard to the use of all public buildings in the town, such rules and regulations to be printed and posted in conspicuous places in or on said buildings, and any persons violating any rule or regulation made as aforesaid shall be liable to a penalty of not less than two dollars, nor more than twenty dollars for each offence.
ARTICLE VII
PENALTIES UNDER THE BY-LAWS
Every violation not otherwise provided for, of any of the foregoing by-laws, shall be punished by a fine not less than one (1) nor more than twenty (20) dollars, to be recovered by com- plaint before any Court having jurisdiction, and all penalties shall inure to the town.
