The director shall also have authority to appoint district co- ordinators and may receive, on behalf of the town such services, equipment, supplies, materials or funds by way of gifts, grants or loans for purposes of civil defense, offered by the federal government or any agency or officer thereof or any person, firm or corporation, subject to the terms of the offer and the rules and regulations, if any, of the agency making the offer which- has been accepted by the selectmen on behalf of the town. The director shall cause appropriate records to be kept of all matters relating to such gifts, grants or loans.


Section 3. Civil Defense Advisory Council. There is hereby established a civil defense advisory council (hereinafter called the "council"). Said council shall serve without pay and shall consist of the director of civil defense, such other department heads and such other persons as the board of selectmen may deem necessary. Such member of said council as said board of selectmen shall designate shall serve as chairman of said council. Said council shall serve subject to the direction and

control of the board of selectmen and shall advise said board of selectmen and the directors on matters pertaining to civil defense.


Section 4. Police aid to other cities and towns in event of riots or other violence therein. The police department is here- by authorized to go aid another city or town at the request of said city or town in the suppression of riots or other forms of violence therein.


Section 5. Termination of by-law. This by-law shall remain in force during the ffective period of Chapter 639, Acts of 1950 and any act in amendment or continuation thereof or substitu- tion therefor.


Section 6. Definition. All references to Chapter 639, Acts of 1950, as now in force, shall be applicable to any act or acts in amendment or continuation of or substitution for said Chapter 639.

SPECIAL TOWN MEETING

The meeting was called to order at 8 o'clock P. M. by Moderator James J. Gaffney, Jr. Norman DeMarais and Maurice D. Condrey were sworn in as tellers and the necessary quorum was found to be present. The following business was transacted.


ART. 1. Voted: To adopt this article. The vote was 96 in favor and 61 against.


ART. 2. Motion made and seconded that the reading of this article by the moderator be waived.


Voted: To adopt this article regarding Civil Defense. This was a unanimous vote.

SPECIAL TOWN MEETING


Town Hall, Tewksbury, Mass., March 8, 1951


A special town meeting was called to order at 7:30 P.M. by Moderator James J. Gaffney, Jr. Earl A. Lye and William H. Mc- Gowan were sworn in as tellers by the moderator. The necessary quorum was found to be present and the following business was transacted:


ART. 1. Voted: To adopt this article and accept Chapter 61 Acts of 1951 of the General Court, known as "An Act authorizing the Town of Tewksbury to supply itself and its inhabitants with water.


ART. 2. Motion-That the Town raise and appropriate $1,650,000.00 for the purpose of establishing a water supply system as authorized by Chapter 61, Acts of 1951 of the General Court, and to meet said appropriation, that the Treasurer with the approval of the Selectmen, be and hereby is authorized to borrow $1,650,000.00 and issue bonds or notes of the Town therefor, payable in not more than thirty years. $1,100,000.00 of the loan hereby authorized is under the authority and in accordance with the provisions of Chapter 61, Acts of 1951 of the General Court, and $550,000.00 of said loan is under authority and in accordance with the provisions of Chapter 44, General Laws.


Voted: That the Town raise and appropriate $1,650,000.00 for the purpose of establishing a water supply system as author- ized by Chapter 61 of the Acts of 1951 of the General Court. and to meet said appropriation that the Treasurer, with the approval of the Selectmen, be, and he hereby is authorized to borrow $1,650,000.00 and issue bonds or notes of the Town therefor, payable in not more than thirty years, $1,100,000.00 of the loan hereby authorized, to be raised under the authority and in accordance with the provisions of Chapter 61 of the Acts of 1951 of the General Court, and $550,000.00 is to be raised under authority of and in accordance with the provisions of Chapter 44 of the General Laws.


Under this article the standing vote was 321 in favor and 14 against.


ART. 3. Voted: To elect by ballot three persons to constitute a Board of Water Commissioners, one until the expiration of three years, one until the expiration of two years, and one until the expiration of one year from the next succeeding Annual Town Meeting.

SPECIAL TOWN MEETING


Town Hall, Tewksbury, Mass., March 30, 1951


A special meting was called to order by the moderator at 7:30 P. M. at which time Mr. Gaffney announced that he would delay until such time as the constable in charge declared all voters in line had checked in.


For the first time in the history of the town both upper and lower halls were used, the meeting being conducted by means of an electric speaking system with John J. Gleason acting assist- ant moderator in the lower hall.


The following election officers were in attendance: Malcolm D. Buchanan, Mamie A. Dugau, Ellen A. Crowley and Jessie A. Davis in the upper halll. Jesse J. French, Bertha B. Benner and Florence Richards in the lower hall. Checkers at the door were: Harry A. Treadwell, Rose J. McCoy, Gladys L. O'Connell, Gordon L. Jack- son, Margaret E. Ryan and Helen L. Morris.


ART. 1. Motion was made and seconded that a ballot vote be taken on this article.


Voted: That the town accept Chapter 61 Acts of 1951 of the General Court, known as "An Act authorizing the Town of Tewksbury to supply itself and its inhabitants with water.

Motion: That the sum of $1,650,000 be appropriated for the purpose of supplying the Town and its inhabitants with water, that to meet said appropriation the Town Treasurer with the approval of the Selectmen be and he hereby is authorized to borrow said sum and to issue and sell serial coupon bearing bonds of the Town therefor, as hereinafter provided:


$1,100,000 aggregate principal amount of bonds shall be issued under and pursuant to the provisions of Chapter 61 of the Acts of 1951, shall be dated May 1, 1951 and shall be pay-

able $40,000 on the first day of May in each of the years 1954 to 1961, inclusive, and $39,000 on the first day of May in each of the years 1962 to 1981, inclusive:


$550,000 aggregate principal amount of bonds shall be issued under and pursuant to the applicable provisions of General Laws (Ter. Ed.) Chapter 44, shall be dated May 1, 1951, and shall be payable $20,000 on the first day of May in each of the years 1954 to 1971, inclusive, and $19,000 on the first day of May in each of the years 1972 to 1981, inclusive: all of said bonds shall be signed by the Town Treasurer and contersigned by a majority at least of the Selectmen, shall bear the town seal and the coupons to be appended shall bear the facsimile signature of the Town Treasurer and except as otherwise herein provided or as shall be required by law said bonds shall be in such form, shall contain such provisions and shall be issued and sold in such manner as shall be determined by the Town Treasurer with the approval of the Selectmen.

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of said Town, qualified to vote in elections and in Town affairs, to meet at the Town Hall in said Tewksbury on Wednesday the Twenty-fifth day of July 1951, at eight o'clock in the afternoon, then and there to act on the following articles:


ART. 1. To see if the Town will vote to ratify and confirm an agreement entered into the second day of July, 1951, by the Board of Selectmen and Board of Water Commissioners, with Butler Ames whereby easements for a reservoir and rights of way thereto are granted to the Town, in exchange for services, in accordance with the duplicate of said agreement, now on file at the office of the Town Clerk, or take any other action in relation thereto.


ART. 2. To see if the Town will vote to grant permission to the Water Department to construct, erect, operate and maintain a building for Water Department Purposes on Lot "E," as shown on a plan entitled "Plan of Lot E in Tewksbury, Mass. surveyed

for the Tewksbury Water Board, July 10, 1951, Dana F. Perkins & Sons," now on file at the office of the Town Clerk, or take any action in relation thereto.


ART. 3. To see if the Town will vote, if the action of the Town under preceding article is in the negative, to grant permission to the Water Department to construct, erect, operate and main- tain a building for Water Department Purposes, on a portion of the present Foster School premises now used for a play- ground or take any other action relative thereto.


ART. 4. To see if the Town will vote, if the action of the Town under the two preceding articles is in the negative, to grant permission to the Water Department to construct, erect, oper- ate and maintain a building for Water Department Purposes on the Spaulding School House Lot or take any other action in relation thereto.

To see if the Town will vote under the provisions of Chapter 61 section 9, of the Acts of 1951 that the income of the Water Works be appropriated to defray all operating expenses, interest charge, and payments on the principal as they accrue upon any bonds or notes issued under the authority of said Act and if there should be a net surplus remaining after providing for the aforesaid charges, said income may be appro- priated for such new construction as the Water Commissioners, with the approval of the Town, may determine upon, and in case a surplus should remeain after payment for such new construction the water rates shall be reduced proportionately or take any other action relative thereto.


ART. 6. To see if the Town will vote to ratify and confirm the final bid or bids for the construction of two school buildings, accepted and recommended by the School Building Committee, appointed under Art. 68 of the Warrant of the Town Meeting of Feb. 15, 1950 and as authorized under Art. 38 of the Town Meeting of February 21, 1951, or take any other action relative thereto.


ART. 7. To see if the Town will vote to raise and appropriate a sum of money for the purpose of acquiring by purchase or by taking by right of eminent domain under Chapter 79 of the General Laws, the following described parcels of land;


Parcel No. 1 .- Land belonging to the Commonwealth of Massachusetts located on the southerly side of North Street, in said Tewksbury, containing seventeen acres, more or less, and being more particularly described by metes and bounds in Senate Bill No. 667, dated May 24, 1951, which is incorporated herewith by reference.

Parcel No. 2-Land belonging to Madeline Bonugli, located northeasterly of, but not adjacent to Salem Road, in said Tewksbury, containing 4.78 acres, more or less, as shown on a plan of land entitled "A Plan of land in Tewksbury, Massachu- setts owned by Leo M. Bonugli, scale one inch equals 40 feet, June, 1951, Fred Stowers, Reg. Surveyor, Methuen, Massachu- setts," to be recorded at the Middlesex North District Registry of Deeds,


and for constructing thereon two elementary school buildings; and for originally equipping and furnishing the said buildings; determine whether the money shall be provided for by appro- priation from available funds in the treasury including the Post-War Rehabilitation Fund and/or the Sale of Real Estate Fund, by Taxation, or by borrowing under the authority of Chapter 44 of the General Laws and Chapter 645 of the Acts of 1948, as amended by Chapter 528 of the Acts of 1950; or take any action in relation thereto.


ART. 8. To see if the Town will vote to authorize the Present School Building Committee to supervise, execute or perform any duties necessary or desirable to carry out the action voted by the Town under the preceding article, calling for the con- struction of school buildings and the acquiring of land, in- cluding the execution of all legal documents and contracts and approval of all expenditures and vouchers for services ren- dered or materials supplied, or take any action in relation thereto.


ART. 9. To see if the Town will vote to approve the land located on the East Side of South Street, between Main Street and Salem Road, owned by Leslie Weiner, as a site for a fire station or take any action in relation thereto.


ART. 10. To see if the Town will vote to appropriate or raise and appropriate, the sum of $3,500.00 to purchase the land desig- nated in the preceding article or take any action relative thereto.


ART. 11. To see if the Town will vote to raise and appropriate the sum of $100.00 to take care of the legal expenses in con- nection with Article 10 or take any action relative thereto.


1 ART. 12. To see if the Town will vote to authorize the Board of Selectmen to sell at private sale on whatever terms they deem to be in the best interest of the Town, the following described parcel of land now owned by the Town of Tewksbury;


A parcel of land approximately one-half acre in size, con- veyed to the Town of Tewksbury in a deed from Frank H. Farmer recorded April 13, 1904, and bonded and described as follows: beginning at a point 555 feet from East Street on the

East Side of Lee Street; thence easterly, 107 feet to an iron bolt; thence southerly, 184.7 feet to a ditch; thence westerly, 117.2 feet along said ditch to Lee Street; thence 224 feet, northerly along Lee Street to the point of beginning and being the former site of the Town Barn recently torn down; or take any action relative thereto.


ART. 13. To see if the Town will vote to transfer from available funds in the treasury, the sum of $17,000.00 to construct and erect an addition to the proposed Water Department Building and for originally equipping the same, for a garage and office space or take any other action in relation thereto.


And you are directed to serve this Warrant, by posting up attested copies thereof at and upon the Town Hall and in each of the Post Offices, and at least five hundred extra copies shall be left at the Post Offices and at the Town Hall in said Town, eleven (11) days at least before the time of holding said meeting.
