Motion was made and seconded that a recess be declared un- til 8:25 because of the lack of the necessary quorum. At 8:25 the meeting was again called+and count of voters present still lacked the 158 voters to constitute a quorum. At this time motion was made and seconded to recess until 8:50 o'clock. Count showed 159 voters present at 8:50 when the Moderator proceeded with the business at hand.


Art. I .- To see what sum of money the Town will vote to transfer from Excess and Deficiency to the Rubbish and Garbage account, or take any other action relative thereto.


Voted: That the sum of $3,500 be transferred from the E & D account to the Board of Health account for the collection of rubbish and garbage, with the understanding that the $2,000 recently trans- ferred from the reserve fund to the Board of Health account be re- turned to the E & D account.


Art. II .- To see if the Town will vote to accept Sections 42A to 42F inclusive of Chapter 40 of the General Laws, said sections relating to the application of a lien on real estate as a means for collecting delinquent water charges.


This article was ruled out of order by the Moderator because it conflicted with the town by-laws.


Art. III .- To see if the Town will vote to amend the By- Laws by substituting for the first sentence of Section 10, Article 1, the following sentence. "No vote shall be reconsidered except upon notice of motion for that purpose given within one hour after such vote has been passed; and, after such vote has been passed and af- ter such notice has been given, any person may make the motion to reconsider, which, to prevail, must receive a two thirds vote."

Voted: To amend the by-laws substituting for the first sentence of Section 10, Article 1, the following sentence. WARRANT FOR SPECIAL TOWN MEETING and Action Thereon, November 19, 1953

To either of the Constables of the Town of Tewksbury in said County: GREETING.


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in Town affairs, to meet and assemble at Town Hall in said Tewksbury on Thursday the 19th day of November, 1953 at eight o'clock P.M. to act on the follow- ing articles :


Article 1. To see if the Town will vote to adopt the follow- ing as an addition to Article 1 of the Town By-Laws.


"The annual budget of a town department, when in excess of $20,000., shall be presented to the town meeting in three parts in the table of estimates.


1. Personal Services


2. General Maintenance


3. Capital Outlay


The action of the voters shall be taken on each division sepa- rately.


Article 2. To see if the Town will vote to transfer the sum of $200.00 from the town hall kitchen account and $300.00 from the Planning Board account, or transfer the total of $500.00 from E & D, for the purpose of remodeling and utilizing for office space the area in the lower town hall now used as a coal bin, or take any other action relative thereto.


Article 3. To see if the Town will vote to raise and appro- priate or transfer from E & D the sum of $365.87 to pay John G. MacLellan for oil delivered to the town hall in 1952, or take any other action relative thereto.


Article 4. To see if the Town will vote to raise and appro- priate or transfer from E & D the sum of $163.95 to pay the J. J. Crimmings Company for material delivered to the dental clinic in 1952, or take any other action relative thereto.


Article 5. To see if the Town will vote to raise and appro- priate or transfer from E & D the sum of $666.77 for insurance premiums due this year on town property or take any other action relative thereto.

Article 6. To see if the Town will vote to ratify and confirm a deed dated October 6, 1953, executed in behalf of the Town by Joseph J. Whelan, John D. Sullivan and William B. Carter, Se- lectmen, and by William J. O'Neill, Treasurer, said deed running to Henry Sparkes Trustee under an instrument of Trust dated October 24, 1929, recorded with Middlesex North District Regis- try of Deeds Book 785, Page 167, said deed conveying lots 256 and 257 Lakeside Park Land Company Plan Book 24 plan 42 with said Middlesex North District Registry of Deeds, said lots of land being assessed by the Town of Tewksbury to Annie Cunningham, and said deed being in confirmation of a previous deed by George A. Marshall then Treasurer of the Town of Tewksbury dated Sep- tember 19, 1942, and recorded with said Middlesex North District Registry of Deeds Book 984, page 278.


Article 7. To see if the Town will vote to accept the Report of the School Building Survey Committee appointed under Article 73 of the Town Warrant at the Annual Town Meeting in Febru- ary 1953.


Article 8. To see if the Town will vote to authorize the School Building Survey Committee appointed under Article 73 of the Town Warrant at the Annual Town Meeting in February 1953 to serve as a School Building Committee.


Article 9. To see if the Town will vote to authorize said School Building Committee to employ the professional services necessary to proceed with a School Construction program.


Article 10. To see if the Town will vote to authorize the School Building Committee to obtain plans, specifications and bids for enlarging the North Street School and the new Shawsheen School, to be acted upon at the next Annual Town Meeting, or as soon thereafter as possible.


Article 11. To see if the Town will vote to authorize the School Building Committee to proceed with plans to enlarge the High School.


Article 12. To see if the Town will vote to raise or transfer from available funds the sum of fifteen thousand dollars ($15,000.00) for the necessary plans and specifications to carry out the preceding Articles (7 to 11), or take any other action rela- tive thereto.


And you are directed to serve this warrant by posting up attested copies thereof, one at the Town Hall, one at each of the Post Offices and copies shall be left at the Town Hall and at the

SPECIAL TOWN MEETING


Town Hall, Tewksbury, Mass. November 19, 1953.


The meeting was called to order at 8 o'clock P.M. by James J. Gaffney, Jr., Moderator.


Tellers, Malcolm Buchanan and Harry Treadwell were sworn by the Moderator and reported 82 voters in the hall. The required quorum being 158 it was moved and seconded that a recess be held until 8:30. However, at 8:30 a quorum was still lacking and a recess until 8:50 was voted. At 8:50 the count showed 128 vot- ers present.


It was moved and seconded to adjourn until Tuesday evening at 8 P.M. on November 24th.


Meeting adjourned at 8:52 P.M.

It was moved and seconded that the meeting stand adjourned for lack of the necessary quorum.

ANNUAL TOWN ELECTION


Tewksbury, Massachusetts, February 25, 1953.


At a meeting of the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, held this day at the Town Hall and the Shawsheen School, the following business was transacted.


Warrant was duly read by presiding officers in Precincts 1 and 2. Registers in ballot boxes showed 0000 and check lists were in order. Polls were officially opened at 10 o'clock A. M. and closed at 8 P. M. There were 1,175 votes cast in Precinct 1 and 532 in Pre- cinct 2, a total of 1,707 votes.


Election officers were as follows: Precinct 1 - Harry A. Tread- well, Warden: Malcolm D. Buchanan, Deputy Warden, Rose J. Mc- Coy, Clerk: Louise H. Morris, Deputy Clerk: Catherine L. To any of the Constables of the Town of Tewksbury, in said County:


Greeting:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in town affairs, to meet and assemble at Town Hall in said Tewksbury on Wednesday, February 17, 1954, at 7.30 o'clock P. M., to act on the following articles, except Article 1, and you are also hereby further required and directed to notify and warn the said inhabitants of the Town of Tewks- bury, who are qualified to vote on elections and town affairs therein, to assemble subsequently and meet in town meeting at the polling places in said Town of Tewksbury, on Wednesday, February 24, 1954, at 10:00 o'clock A. M., then and there to act on the following Article 1.


The polls for the election of Town Officers to be opened at ten o'clock A. M. and to be closed at 8:00 P. M.


ART. 1. To choose all necessary Town Officers, to choose by ballot one Selectman for three years, one member for Board of Health for three years, one member for Board of Welfare for three years, one Assessor for three years, one member for the School Committee for three years, one Water Commis- sioner for three years, two Trustees for the Public Library for three years, one Road Commissioner for three years, one Park Commissioner for three years, one Trust Fund Com- missioner for three years, one Moderator for one year, one Auditor for one year, three Constables for one year, one mem- ber of the Planning Board for five years, one Town Clerk for three years, one Treasurer for three years, one Town Collec- tor for three years, and one Tree Warden for three years.


ART. 2. To hear reports of Town Officers and committees and act thereon.


ART. 3. To see what sums of money the Town will vote to raise by taxation to defray necessary expenses for the current year and make appropriations for the same.


ART. 4. To see if the Town will vote the money arising from licensing dogs, for the ensuing year to aid in support of the Public Library.


ART. 5. To see if the Town will vote to authorize the Town Treasurer, with the approval of the Selectmen, to borrow

money from time to time in anticipation of the revenue of the financial year beginning January 1, 1954, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


VOTED: That the Town Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1954, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws ..


ART. 6. To see what sum of money the Town will vote to raise and appropriate for a Reserve fund under Section 6 of Chap- ter 40 of the General Laws, or take any other action on same.


ART. 7. To see if the Town will authorize the Selectmen to in- stitute suits on behalf ,of the Town or defend any suits that are, or may be brought against the Town, and to sign any contracts or agreements in behalf of the Town.


ART. 8. To see if the Town will vote to authorize the Board of Selectmen and the Treasurer to foreclose either through the Land Court or by affidavit of the Commissioner of Corpora- tions and Taxation, any Tax Title held by the Town for more than two years, and see what sum of money the Town will vote to raise and appropriate therefor or take any other action relative thereto.


ART. 9. To see if the Town will vote to authorize the Selectmen to sell, after first giving notice of the time and place of sale by posting such notice of sale in some convenient and public place in the town fourteen days at least before the sale, prop- erty taken by the town under tax title procedure provided that the selectmen or whosoever they may authorize to hold such public auction may reject any bid which they deem in- adequate, or take any action relative thereto.


ART. 10. To see if the Town will vote to petition the General Court to enact legislation that will enable the Town to pro- vide for limited Town Meetings in the Town of Tewksbury, similar to the Standard form of representative Town Meet- ings set forth in Chapter 43A of the General Laws, or take any other action relative thereto.


ART. 11. To see if the Town will raise and appropriate the sum of $900.00 for the purpose of obtaining Land Court certifi- cates for forty-eight parcels of registered land on the River- view Plan, or take any other action relative thereto.

ART. 12. To see what sum of money the Town will raise and appropriate to publish a real estate valuation book as re- quired by Section 11 of Article 2 of the Town By-Laws.


ART. 13. To see if the Town will vote to authorize the Select- men to appoint a Town Accountant in accordance with the provisions of Section 55, Chapter 41, General Laws, and to abolish the office of Town Auditor upon the appointment of a Town Accountant and to apply any unexpended balance of the salary account of the Auditor to the salary account of the Town Accountant, or take any other action relative thereto.


ART. 14. To see if the Town will vote to accept Sections 42A to 42F inclusive, of Chapter 40 of the General Laws provid- ing for the collection of delinquent water charges through the application of a lien on real estate.


ART. 15. To see what sum of money the Town will vote to authorize the Assessors to use from the E. & D. account in setting the 1954 Tax Rate.


ART. 16. To see if the Town will vote to authorize the Road Commissioners, with the approval of the Selectmen, to pur- chase gasoline for all town-owned vehicles, on a contract ba- sis, to establish and maintain a suitable storage and loading location, and to maintain accountability for all gasoline dispensed.


ART. 17. To see what sum of money the Town will vote to raise and appropriate to carry out the preceding article.


ART. 18. To see if the Town will vote to ratify and confirm a deed dated October 6, 1953, executed in behalf of the Town by Joseph J. Whelan, John D. Sullivan and William B. Car- ter, Selectmen, and by William J. ART. 22. · To see if the town will vote to instruct the Board of Selectmen to have the annual reports printed in the manner used previous to 1947, giving in detail the way in which mon- ey was expended in all departments except those under the control of the Board of Public Welfare. To see if the Town will vote to instruct the Board of Selectmen to include in the annual report the balance sheet accompanying the report sent them as a result of any audit made by the Bureau of Accounts during the previous year, and any letter making suggestions or criticism of methods fol- lowed in this town which they may have received during the previous year. To see if the Town will vote that all money collected by the Town Collector for the installation of water pipe on private land be used to provide funds for payment of interest on original loan for water installation, such money to be kept in a separate account. The town treasurer is hereby ordered to certify to the Board of Assessors the amount available in this fund and the Board of Assessors are directed to raise by taxation the balance necessary to pay said interest as provided by Section 6 of Chapter 61 of the Acts of 1951. Above said certificate to be furnished on request of the Board of As- sessors before the date of the fixing of the annual tax rate. Everett H. King
