ANNUAL TOWN MEETING


Town Hall, Tewksbury, Mass., February 15, 1950


The meeting was called to order by the moderator at 7:30 P. M. with John Gleason and Walter Wilson, Jr. acting as tellers. Rev. S. Nelson Ringsmuth, pastor of the North Tewksbury Baptist church, opened the meeting with a prayer, after which the assem- bly stood in silent prayer in memory of the town officials Who had passed away during the past year: May L. Larrabee, George A. Marshall, Harry P. Nash, Alice L. Sturtevant and Ross E. Sargent.


It was moved and seconded that the reading of the articles be omitted and that articles in wararnt be referred to by their sub- ject matter.

Voted: That the town treasurer, with the approval of the selectmen, be and hereby is authorized to borrow money from time to time in anticipation of the revenue of the finan- cial year beginning Jan. 1, 1950, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Sec. 17, Chap. 44, G. L.


Art. 6. Voted: To transfer $10,000 from free cash for a reserve fund under Sec. 6, Chap. 40, G. L.

Art. 8. Voted: To raise and appropriate $300 to foreclose any tax title held by the town for more than two years.

Art. 16. Voted: To raise and appropriate $1,125 to buy new fire hose to replace that burst through operation.


Art. 17. Voted: To continue the Highway Machinery Fund as established at the last annual town meeting and to appropriate an additional sum of $1,800 plus unexpended balance of $541.27 to be added to $5,689.25 already accredited to this Fund for Highway Machinery purposes.


Art. 18. Voted: To appropriate $8,030.27 from the Highway Ma- chinery Fund for the purchase, repair and maintenance of road machinery equipment for 1950.


Art. 19. Voted: To raise and appropriate the sum of $1,000 for the Maintenance of Chap. 90 "Highways"; said money to be used in conjunction with any money which may be allotted by the State and County or both.


Amendment. That the town transfer from unappropriated available funds in the treasury a sum equal to the amount that is allotted to the town by the State and County, as their share in highway work done in conjunction with the town, to meet the State and County's share of the work, the reim- bursement from the State and County to be restored upon their receipt to unappropriated available funds in the treasury.


Art. 20. Voted: To raise and appropriate $3,500 for the improve- ment of Whipple Road, said money to be used in conjunction with any money which may be allotted by the State or County. Amendment. To transfer from unappropriated available funds in the treasury a sum equal to the amount that is allotted to the town by State and County as their share in Highway work done in conjunction with the town, to meet the State's and County's share of the work, the reimbursement from the State and County to be restored upon their receipt to un- appropriated available funds in the treasury.

Art. 35. Voted: That the town establish a Public Dump for the use of residents of the town on any town owned land, or any other land which may be offered to the town for such use. This land to be designated by the Planning Board.


Art. 36. Voted: To raise and appropriate the sum of $500 for the Memorial Day exercises and that the moderator appoint a committee of three.

The adjourned Town Meeting was called to order at 7:30 P. M. by the moderator and was adjourned for a half hour because of

the lack of a quorum. At 8 P. M. the meeting was resumed with Edward B. Stevens and Thomas J. Berube acting as tellers.


Art. 37. Voted: To raise and appropriate the sum of $200 for fill to cover and clean the closed dump on School St. and Glen- wood Rd., South Tewksbury.


Art. 38. Voted: To indefinitely postpone this article.


Art. 39. Voted: To raise and appropriate the sum of $423 to buy a Respirator to be placed either at the Police or Fire Station.


Art. 40. Voted: To raise and appropriate the sum of $300 to purchase a power chain saw.


Art. 41. Voted: To raise and appropriate the sum of $200 for control of Dutch Elm Disease under Chap. 761, G. L., Acts of 1949.


Art. 42. Voted: That the rate of compensation for the Tree Warden and employees of the Tree Dept. be $9.00 for supervision, $8.00 per day for tree climbing and $7.00 per day for general labor and work.


Art. 43. Voted: That Assessors be paid at the rate of $7.00 per dav.


Art. 44. Voted: That the town raise and appropriate the sum of $6,700 to be used for Hot Lunch Projects in the Public Schools.


Art. 45. Voted: To include the appropriation of funds for the Hot Lunch Projects in the public schools in the annual school appropriation beginning in 1951.


Art. 46. Voted: That the matter of the old Spaulding School lot be referred to the Board of Selectmen.

Art. 46. Voted: To raise and appropriate the sum of $120 to pay George R. Gray for the care and disposal of dogs for the year 1948.


Art. 49. Voted: To amend section 3 of article 4 of the Town By- Laws by inserting after the words "Chief of the Fire Dept,' the words, "Chief of the Police Dept."


Art. 50. Voted: To raise and appropriate $49 to pay Henry M. Patenaude as the balance due him for care and disposal of dogs during 1949.


Art. 51. Voted: to reject this article regarding amending Sec. 2 Art. 1 of the Town By-Laws by striking out the words "500 extra copies" and inserting "100 extra copies" and leaving out all after the words "Town Hall."

Art. 52. Voted: To amend Sec. 12 Art 1. of the Town By-Laws to read as follows: "The proceedings of the meeting shall be governed by Roberts Rules of Order," except as follows, "when several different sums of money have been proposed, the smaller shall always be voted on first." Unanimous vote.


Art. 53. Voted: To raise and appropriate the sum of $500 and the present 1949 cruiser for a 1950 Ford Tudor, this sum of money will also cover the rebuilding of the present generator to meet with changes on the 1950 model Ford, and transfer radio, and that the Chief of Police be authorized to carry out this article. Unanimous vote.


Art. 54. Voted: To reject this article to amend sec. 5 of art. 1 of the Town By-Laws, by striking out the words "5% of the registered voters" and in serting "4% of the voters, voting at the last last Town Election."


Art. 55. Voted: To reject this article to eliminate sec. 10 of art. 1 of the By-Laws.


Art. 56. Voted: To indefinitely postpone this article regarding expenses of Inspector of Buildings.


Art. 57. Voted: To indefinitely postpone this article regarding compensation of Inspector of Buildings.


Art. 58. Voted: That the subject matter of this article be referred to the Planning Board for recommendation at the next annual town meeting.


Art. 59. Voted: To return to the Town Treasury the balance of money raised under Art. 22 at the 1949 Annual Town Meet- ing. $987.50.


Art. 60. Voted: To raise and appropriate the sum of $600 to be used in Dental Clinic in the public schools, and that this sum" be administered by the Board of Health.

Art. 63. Voted: To abolish the office of the town auditor upon the establishment of the town accountant and to apply any unexpended balance of the salary account of the auditor to the salary account of the town accountant and that the newly elected auditor shall be the accountant.


Art. 64. Voted: To raise and appropriate the sum of $1,110 to pay the City of Lowell for Vocational School tuition for 1949.

Art. 65. Voted: To raise and appropriate the sum of $25.65 to pay the City of Haverhill for Vocational School tuition for 1949.


Art. 66. Voted: To adopt this article on street lights and refer to the selectmen and they take individual action on every light.


Art. 67. Voted: To indefinitely postpone this article to amend Art. 1 Sec. 1 of the Town By-Laws.


Art. 68. Voted: To adopt this article authorizing a committee consisting of six members, two members each to be elected respectively by the Planning Board, Finance Committee, and the School Committee, to investigate the general school build- ing situation, and to report to the town as soon as possible on the following:


1. The advisability of replacing the Foster School on the present or a new location.


2. The advisability of adding on to the Shawsheen School.


3. The advisability of a central grade school.


4. For the recommendation of an architect for the project recommended by this committee.


5. Any other subject relative to this general condition.


6. What sites are available for the proposed building; the advantages, disadvantages and probable cost of each site.


7. That the report be in writing and filed with the Town Clerk at least two weeks before the Town Meeting. Committee appointed under this article is as follows: Dana F. Perkins, Allen C. Wilson, Ralph S. Battles, Edward B. Stevens, Arthur W. Wells, Jr., Harold Vinecour.


Art. 69. Voted: To raise and appropriate the sum of $5000 for any necessary expenses of the committee under the preceding article, with the understanding that any money for preliminary sketches or drawings will be considered part of the architect's fee on any building project that may be voted by the town upon recommendation of this committee.


Art. 70. Voted: To raise and appropriate the sum of $1,100 for repairs and painting of the Town Hall.


Art 71. Voted: To instruct the selectmen to sell the obsolete police radios.


Art. 72. Voted: To direct the moderator to appoint a committee of three to investigate the feasibility of setting up plans for Veterans Housing, and to further instruct the committee that if in their opinion such plans are feasible to draw up a tentative plan along with an alternate plan and submit them upon com- pletion to the town.

Tewksbury, Massachusetts, February 23, 1950


At a meeting of the inhabitants of the Town of Tewksbury, qualified to vote in Town Affairs, held this day at the Town Hall and the Shawsheen School, the following business was transacted.


Warrants were duly read by presiding officers in precincts 1 and two. Election officers were:


Precinct 1. Harry A. Treadwell, Warden; Malcolm D. Bu- chanan, Deputy Warden; Rose J. McCoy, Clerk; John B. O'Loughlin, Deputy Clerk; Jessie A. Davis, Gladys O'Connell, Mamie Dugau and Ellen Crowley as Inspectors.


Precinct 2. Jesse J. French, Warden; Gordon L. Jackson, Deputy Warden; Helen L. Morris, Clerk; Florence Richards, Deputy Clerk; Bertha B. Benner and Margaret E. Ryan, Inspectors.

In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Tewksbury, qualified to vote in Town affairs, to meet and assemble at Town Hall in said Tewksbury,

ART. 1. To see if the Town will vote to appropriate the sum of $9,500.00 to take care of Articles 13, 14, 15, in the Warrant of the Annual 1950 Town Meeting or take any other action relative thereto.


ART. 2. To see if the Town will vote to raise the money appropri- ated under Article 1 in the following manner. $2,500.00 be ap- propriated from Available Funds in the Treasury, and that the balance of $7,000.00 be borrowed under authority of Section 7 of Chapter 44 of the the General Laws, payable over a period of five years, as follows:

To see if the Town will authorize the expenditure of $6,500.00 from overlay reserve, for a survey by a recognized public water system engineer, of a proposed public water system for the town-said survey to furnish all of the necessary information, estimates of cost and probable revenue for the Town to consider the advisability of providing a town water supply and distribution system at the next regular town meet- ing, or take any other action for the same purpose.


ART 5. To see if the Town will authorize its District State Repre- sentative to present a bill before General Court for the acquisi- tion of State Land in the Town of Tewksbury for the purpose of School Building Construction or take any other action relative thereto.

The Meeting was called to order by Moderator James J. Gaffney, Jr., at 8 o'clock with a quorum present. Lawrence R. McGowan and John F. Gleason were sworn in as tellers and the following business was transacted.


ART. 1. Voted: To appropriate the sum of $9,500.00 to take care of articles 13, 14 and 15 in the warrant of the annual 1950 town meeting. This was a unanimous vote.


ART. 2. Voted: To take the money appropriated under Article 1 from surplus funds and that the committee appointed to in- vestigate the purchase of this fire equipment be retained to purchase same under this article.


ART. 3. Voted: To appropriate the sum of $250 from Free Cash for necessary office equipment for the town accountant.


ART. 4.
