The provisions of the following rules and regulations so far as they are the same as those of the existing rules and regulations shall be construed as a continuation thereof and not as new provisions.
The rules and regulations adopted by the State Board of Health under date of July 7, 1904, and of May 5, 1910, are hereby repealed.
1. No cesspool, privy or other place for the recep- tion, deposit or storage of human excrement, and no urinal or watercloset not discharging into a sewer, shall be located, constructed or maintained within fifty feet of high-water mark of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, or within fifty feet of high-water mark of any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond.
2. No human excrement shall be deposited or dis- charged in or into Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, or into any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which

flows directly or ultimately into said Great Pond; and no human excrement shall be kept in, or deposited or dis- charged in or into, any cesspool, privy or other recep- tacle situated within two hundred and fifty feet of high- water mark of said Great Pond, or within two hundred and fifty feet of high-water mark of any open waters, the water of which flows directly or ultimately into said Great Pond, unless such cesspool, privy or other recep- tacle is so constructed that no portion of its contents can escape or be washed into any such waters.
3. No human excrement, or compost containing human excrement, or contents of any privy or cesspool or sewer, or other receptacle for the reception or storage of human excrement, shall be deposited or discharged upon or into the ground at any place from which any such excrement, compost or contents, or particles thereof, may flow or be washed or carried into Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Hol- brook as a source of water supply, or into any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond.
4. No house slops, sink waste, water which has been used for washing or cooking, or other polluted water, shall be discharged into Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, or into any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond; and no house slops, sink waste, water which has been used for washing or cooking, or other polluted water, shall be discharged into the ground within fifty feet, or

upon the ground within two hundred and fifty feet, of high water mark of any open waters flowing as aforesaid into said Great Pond.
5. No garbage, manure or putrescible matter what- soever, shall be put into Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, or into any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond; and no garbage, manure or putrescible matter whatso- ever, shall, except in the cultivation and use of the soil in the ordinary methods of agriculture, be put upon the ground within two hundred and fifty feet of high-water mark of any open waters flowing as aforesaid into said Great Pond.
6. No stable, pig-sty, hen-house, barn-yard, hog- yard, hitching or standing place for horses, cattle or other animals, or other place where animal manure is deposited or accumulates, shall be located, constructed or main- tained, any part of which is within fifty feet of high- water mark of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, or within fifty feet of high-water mark of any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ulti- mately into said Great Pond. No stable or other place, as above enumerated, shall be located, constructed or maintained within two hundred and fifty feet of high- water mark of said Great Pond, or within two hundred and fifty feet of high-water mark of any open waters flowing as afore-mentioned into said Great Pond, unless suitable and and adequate provision is made to prevent

any manure or other polluting matter from flowing or being washed into said Great Pond or such open waters.
7. No interment shall, except by permission in writ- ing by the Board of Water Commissioners of the town of Randolph and the Board of Water Commissioners of the town of Holbrook, be made in any cemetery or other place of burial, within fifty feet of high-water mark of that portion of Great Pond, so called, situated within the limits of the the town of Randolph and used by the towns of Randolph and Holbrook as a source of water supply, or within fifty feet of high-water mark of any reservoir, lake, pond, stream, ditch, water course or other open waters within the limits of the town of Randolph, the water of which flows directly or ultimately into said por- tion of said Great Pond.
8. No lands, which were not under the control of cemetery authorities and used for cemetery purposes on June 15, 1926, from the which the natural drainage flows into Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Ran- dolph and Holbrook as a source of water supply, or into any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond, shall be taken or used for cemetery purposes until a plan and description of the lands which it is proposed to use of such purposes, suffi- cient for their identification, shall be presented to the State Department of Public Health, and until such taking or use shall be approved in writing by said State Depart- ment of Public Health.
9. No manufacturing refuse or waste product or polluting liquid, or other substance of a nature poisonous or injurious either to human beings or animals, or other putrescible matter whatsoever, shall be discharged dir-

ectly into, or at any place from which it may flow or be washed or carried into, Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, or into any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond.
10. No system of sewers or other works for the col- lection, conveyance, disposal or purification or domestic or manufacturing sewage or drainage, or any other pu- trescible matter whatsoever, shall, except in accordance with plans first approved in writing by the State Depart- ment of Public Health, be constructed or maintained at any place within the watershed of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply. No private or separate sewer shall be constructed or maintained, having an outlet upon or in the ground within two hundred and fifty feet of high-water mark of said Great Pond, or within two hun- dred and fifty feet of high-water mark of any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said Great Pond.
11. No public or private hospital, or other place in- tended for the reception or treatment of persons afflicted with a contagious or infectious disease, shall, until the location and construction thereof have been approved in writing by the State Department of Public Health, be located or constructed at any place within the watershed of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply. No public or private hospital, or other place intended for the

reception or treatment of person afflicted with a con- tagious or infectious disease, shall be maintained at any place within such watershed, unless all the provisions required by the State Department of Public Health for the purification or disposal of sewage, drainage or other polluting or organic matter, which may be discharged therefrom, have been complied with, and unless all orders issued from time to time by said State Department of Public Health in relation to the purification and disposal of sewage, drainage and other polluting or organic mat- ter, which may be discharged therefrom, are fully com- plied with.
12. No tannery, currying shop, or other establishment where the skin, wool, hair or fur of any animal is treated, shall until the location and construction thereof have been approved in writing by the State Department of Public Health, be located or constructed at any place within the watershed of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply. animals, and no melting or rendering establishment, shall, until the location and construction thereof have been ap- proved in writing by the State Department of Public Health, be located or constructed at any place within the watershed of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply. No slaughter house or other building for carry- ing on the business of slaughtering cattle, sheep or other animals, and no melting or rendering establishment, shall be maintained at any place within such watershed, unless all the provisions required by the State Depart- ment of Public Health for the purification or disposal of sewage, drainage or other polluting or organic matter, which may be discharged therefrom, have been complied with, and unless all orders issued from time to time by said State Department of Public Health in relation to the purification and disposal of sewage, drainage or other polluting or organic matter, which may be dis- charged therefrom, are fully complied with.
14. No person shall bathe in, and no person shall, unless permitted by a special regulation or by a written permit of the Board of Water Commissioners of the town of Randolph and the Board of Water Commissioners of the town of Holbrook, fish in, or send, drive or put any animal into , that portion of Great Pond, so called, sit- uated within the limits of the town of Randolph and used by the towns of Randolph and Holbrook as a source of water supply, or bathe or fish in, or send, drive or put any animal into, any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into that said portion of said Great Pond. No person other than a member, officer, agent or employee of either of said boards of water com-

missioners, or public officer whose duty may so require, shall, unless so permitted by regulation or permit of said boards of water commissioners, enter or go, in any boat, skiff, raft or other contrivance, on or upon the water of said portion of said Great Pond, or on or upon the water of any reservoir, lake, pond, stream, ditch, water course or other open waters, the water of which flows directly or ultimately into said portion of said Great Pond, nor shall enter or go upon or drive any animal upon, the ice of any said waters.
15. No person shall enter upon that portion of Great Pond, so called, situated within the limits of the town of Randolph and used by the towns of Randolph and Hol- brook as a source of water supply, for the purpose of cutting or taking ice, or cut or take ice from said portion of said Great pond, without a written permit, signed by the Board of Water Commissioners of the town of Ran- dolph and the Water Commissioners of the town of Hol- brook, stating the time and place for which such permis- sion is given.
The granting and withholding of permits required by Rules 14 and 15 is hereby delegated by the State De- partment of Public Health to the Board of Water Com- missioners of the town of Holbrook and the Board of Water Commissioners of the town of Holbrook.
16. All reports which may be made to any board of health, or to any health officer of any town, of cases of contagious or infectious disease occuring within the watershed of Great Pond, so called, said pond being in the towns of Randolph and Braintree and used by the towns of Randolph and Holbrook as a source of water supply, shall be open to the inspection at all reasonable times of the Board of Water Commissioners of the town of Randolph and the Board of Water Commissioners of

the town of Holbrok, or either of them, and of their officers and agents.

The following regulations until further notice, shall be considered a part of the contract with every person who uses water:
1. All applications for use of water must be made at the office of the Water Commissioners, and state fully the purposes for which it is intended to be used. Water will not be introduced to premises except on the written application of the owner thereof, or by a duly authorized agent. The property will in all cases be held responsible for the water rates.
2. All persons taking water must keep their water pipes and fixtures in good repair and protected from the frost at their own expense. They will be held liable for all damages resulting from their failure to do so. They shall prevent all unnecessary waste, and water shall not be left running to prevent freezing. The Water Commis- sioners or their agent may, from time to time, ascertain the quantity of water used, the manner of its use, and whether there is any unnecessary waste. They and their agents shall have free access to the premises supplied, to examine the apparatus, and if any fixtures are found not to be in good order, they shall direct them repaired, and if not repaired within two days the water shall be shut off and not let on again until such repairs are made, and the sum of two dollars paid for shutting off and turn- ing on the water.
3. The occupant of any premises, when unnecessary waste of water occurs, shall be liable to a fine of two dol- lars for the first offence, and four dollars for the second offence during the same year, and shall be notified there- of in writing; and if such waste is not prevented and the

aforesaid paid within two days from the time when the said notice is given, the water shall be shut off the prem- ises, and shall not be again let on for the same occupant until the waste be stopped and the fine paid, together with an additional sum of two dollars for shutting off and letting on the water and in case of a third or subse- quent offence the water shall be shut off, and shall not again be let on except by a vote of the water Commis- sioners and the payment of such fine, not exceeding ten dollars, as the Water Commissioners may impose.
4. Any person supplied with water shall not allow another to take water from their fixtures without the written permission of the Water Commissioners. If any tenant having no fixtures, has any use of such fixtures, full rates will be charged for such use by each tenant.
5. All parties using water in stables, for horses or other animals, will be charged scheduled rates for the same, whether it be carried by hand or through hose.
6. All persons using water for building purposes are required to obtain a permit from the Water Commis- sioners before taking water from any faucet or fixture connected with the water works, and all water takers are warned not to let any party take water from their prem- ises until they show a permit from the Water Commis- sioners. Any person furnishing water in violation of this section will be subject to a fine not less than five nor more than twenty dollars, and if the same when levied is not paid within three days from the time when the notice thereof is given, the water will be shut off from the premises and will not be let on again until such fine is paid.
7. All fixtures and water closets and urinals must be be of a kind and quality approved by the Water Commis- sioners, also a Vacuum Valve must be installed on all

8. No person shall in any case be allowed to open any fire hydrants except by a written permit from the Water Commissioners; but the Engineers of the Fire Depart- ment shall in all cases have control of hydrants at fires and for practice.
9. The Commissioners reserve the right to restrict the use of hose or fountain, to shut off the water in all cases when it becomes necessary to make extensions or repairs, or for violations of any of the regulations, or whenever they deem it expedient.
10. The regular rates for the use of water shall be payable in advance on the first days of January and July of each year, except where water is supplied to manu- facturers by special agreement. In all cases of non-pay- ment of the water rates within ten days after same is due, as well as for any violations of these rules and regu- lations, the supply will be shut off, and payment of the amount due, and payment of two dollars for shutting off and letting on the water.
11. The Water Commissioners reserve the right to change the water rates at any time, except in cases of dwelling houses and established special rates.
12. For business requiring large quantities of water, and all supplies not enumerated in the tariff of rates, special rates will be made.
13. Parties using water for manufacturing or do- mestic purposes can erect hydrants on their grounds or standpipes in their building to be used only as a protec- tion against fire without additional charge for water.
14. All applicants for the introduction of service pipes to premises are required to make written applica- tion therefor at the office of the Water Commissioners. And in no case will the main be tapped more than once
