1927 Town Meeting Warrant

To either of the Constables of the Town of Randolph, in said County, Greeting :


In the name of the Commonwealth of Massachusetts you are required to notify and warn the inhabitants of the Town of Randolph qualified to vote in Elections and Town Affairs to assemble at

Then and there to act on the following articles, viz:


Article 1. To choose all such Town officers as are required by law to be chosen by ballot, namely: A Mod- erator for one year; a Town Clerk for one year; a Town Treasurer for one year; three Selectmen and Overseers of the Poor for one year; one Member of School Commit- tee for three years; one Trustee of Stetson School Fund for three years; a Collector of Taxes for one year; one Assessor for three years; one Water Commissioner for three years; three Auditors for one year; one Tree War- den for one year; one Highway Surveyor for one year; seven Constables for one year.


Article 2. To see if the Town will authorize the Treas- urer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the

financial year beginning January 1, 1927, and to issue a note or notes therefor, payable within one year, any debt or debts incurred under this vote to be paid from the revenue of said financial year.


Article 3. To see if the Town will appoint the Select- men to be the agents and attorneys of the Town to prose- cute, defend and compromise any and all suits in which the Town may be in any manner interested as a party or otherwise, except so far as the same relate in any manner to the water supply, and to employ counsel if necessary.


Article 4. To see if the Town will authorize and ap- point the Water Commissioners to be the agents and attorneys of the Town, to prosecute, defend, compromise and settle any and all suits and proceedings in which the Town may be interested as a party or otherwise so far as the same in any manner relate to the preserving, taking and use of the water of Great Pond, or to the construction of the water works, either jointly or sepa- rately, as authorized under Chapter 217 of the Acts of 1885, and to employ counsel if necessary.


Article 5. To see if the Town will rescind its vote under articles 36 and 37 of the 1926 Annual Town Meet- ing Warrant authorizing the Treasurer to issue notes for $11,000 to pay for High School equipment and vote to raise $11,000 by current taxation. (Recommended by State Examiner.)


Article 6. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to refund any or all of the revenue notes issued in anticipation of revenue of the year 1927, in accordance with the pro- visions of Section 17 of Chapter 44 of the General Laws;

any debt so incurred to be paid from the revenue of 1927. (Recommended by State Examiner.)

. ; and notes issued under this section and sections four, five and six for a shorter period than one year may be refunded by the issue of other notes maturing within the required per- iod; provided that the period from the date of issue of the original loan and the date of maturity of the refunding loan shall be not more than one year; and provided, further, that no notes shall be refunded under this section except under authority of such vote as is required for the original borrowing."

RESERVE ACCOUNT

Article 8. To see if the Town will create a Reserve Fund for extraordinary or unforeseen emergencies as per Section 6, Chapter 40, General Laws, and raise and appro- priate money therefor. (Recommended by State Exam- iner.)


Section 6, Chapter 40. "To provide for extraord- inary or unforeseen expenditures, a town may at an annual town meeting appropriate a sum not exceeding five per cent of the tax levy of the preceding year, to be known as the reserve fund. No direct drafts against this fund shall be made, but transfers from the fund may from time to time be voted by the finance or appropriation committee of the town, in towns hay- ing such a committee, and in other towns by the selectmen; and the town accountant in towns having

such an official, and in other towns the auditor or board of auditors, shall make such transfers accord- ingly."


Article 9. To see if the Town will adopt a by-law providing for the appointment of a Finance Committee to control the Reserve Fund, as per Section 16, Chapter 39, General Laws, and appoint such Committee there- under. (Recommended by State Examiner.)


Section 16, Chapter 39, G. L., as amended by Chap- ter 388, Acts 1923, is as follows: "Every town whose valuation for the purpose of apportioning the state tax exceeds one million dollars shall, and any other town may, by by-law provide for the appointment and duties of appropriation, advisory or finance commit- tees, who shall consider any or all municipal questions for the purpose of making reports or recommendations to the town; and such by-laws may provide that com- mittees so appointed may continue in office for terms not exceeding three years from the date of employ- ment."


Article 10. To see if the Town will accept Section 55, Chapter 41, General Laws, and will authorize the Select- men to appoint a Town Accountant thereunder, and will raise and appropriate money for his salary. (Recom- mended by State Examiner.)


Section 55, Chapter 41. "Any town may authorize the selectmen to appoint a town accountant, who shall perform the duties and possess the powers of town auditors as defined in sections fifty to fifty-three, in- clusive. In towns so authorizing the appointment of town accountant the office of town auditor may if the town so vote, be abolished. In towns which have ac- cepted chapter thirty-one or corresponding provisions

of earlier laws, the appointment of the town account- ant shall be subject to the civil service rules. The town accountant shall be sworn to the faithful performance of his duties, shall hold no other town office involv- ing the receipt or disbursement of money, shall receive such salary as the town shall vote, and shall hold office for three years and until his successor is qualified; provided, that the town clerk, if he holds no other office involving the receipt or disbursement of money, may be appointed town accountant."


Amended as follows: By Section 8 of Chapter 486 Acts 1921, "Section fifty-five of Chapter forty-one of the General Laws is hereby amended by striking out the words "shall receive such salary as the town shall vote," in the tenth and eleventh lines.

Article 24. To see what action the Town will take in regard to raising and appropriating money for the em- ployment of a district nurse, as provided for by Chapter 40, Section 5, General Laws, as amended by Chapter 371, Section 1, Acts of 1921.


Chapter 40, Section 5, G. L., "A town may at any town meeting appropriate money for the following purposes : ... (21) For the employment of district or other nurses; but not more than two thousand dol- lars shall be appropriated for such purpose in any year. Such appropriation may be expended by the selectmen or by the board of health when so author- ized by the selectmen."


Chapter 371, Section 1, Acts of 1921. "Section five of Chapter forty of the General Laws is hereby amended by striking out sub-section twenty-one and inserting in place thereof the following:

Article 33. To see if the Town will raise and appro- priate the sum of sixty-six dollars for four (4) electric lights on Old Street between Canton and North Main Streets, as petitioned for by Albert H. Williams, L. B. Prime, Alf Hansen and others.

Article 34. To see if the Town will raise and appro- priate the sum of $3,000 for the completion of the con- struction of South Street from the residence of Joseph J. McMahon to the Holbrook line, under the direction of the Highway Surveyor, as petitioned for by George Har- ris, Roger T. Perkins, Joseph J. McMahon and others.


Article 35. To see if the Town will raise and appro- priate the sum of $1,500 to complete the rebuilding of Centre St. as petitioned for by Leon E. Clifford, L. B. Sanborn, Clarence Rowe and others.

Article 39. To see if the Town will raise and appro- priate the sum of $1,500 to rebuild the street and side- walk of Mt. Pleasant Square and drain the same, as peti- tioned for by Arthur Howard Holbrook, Talmage Mor- row, Thomas Whitty and others.


Article 40. To see if the Town will vote to repair Highland Avenue from junction with Warren Street, 1,000 feet in southerly direction, as petitioned for by Joseph W. O'Mahoney, Fred Herrick, John P. Hanley and others.


Article 41. To see what action the Town will take relative to rebuilding Lafayette Street and raise and ap- propriate the sum of $1,800 for the same, as petitioned for by Chester L. Paine, Harold W. Macauley, Frank N. French and others.


Article 42. To see if the Town will vote to finish Canton Street from where they left off to Canton Line and raise and appropriate the sum of $15,000 with like amounts each from State and County, as petitioned for by C. Wm. Gabel, Charles Beattie, William Sargent and others.


Article 43. To see if the Town will raise and appro- priate a sum of money to permanently construct Pond Street on the lines laid out by the County Engineer and approved by the Norfolk County Commissioners, as peti- tioned for by F. J. Schulz, Frank M. Downes, Frederick Trofatter and others.
