* 15 Samuel3 Barnard was ap. adm. est., Dec., 1715, the wid. Sarah and the eldest living son, (13) THOMAS3 (Joseph3 was dead), having renounced their claim to administer. The other heirs asked, Dec .; 1719, that their bro. Sam- uel be required to distribute the est. of their father. Among the papers is a copy of a deed of gift from Thomas? Sen. and wife Sarah to their son Thomas' Jr., dated Aug., 1712. Mr. Wells appended to it a long deposition, July, 1720, stating that the deed was left in his hands by Thomas2 Sen., "ab. 8 yrs. since," for Thomas3 Jr., who had not demanded it. Thomas? Sen. refused to sign it with the other deeds; but both he and his wife Sarah did sign the deed later. The reason for withholding it seems to have been that Thomas3 Jr. did not sign a certain paper, which per. the other chil. did sign. Mr. Wells wrote a letter to Judge John Appleton, July 30, 1720, now on file, - in reply to one from the judge, - saying that he had no such paper, and never had had. This paper was prob. the obligation which Thomas3 refused to sign. It would appear that the adm., Samuel, demanded such a paper of Mr. Wells, in a manner offensive to the clergyman who had the deed in eharge.
