FIRES IN THE OPEN AIR.
Opinion of Town Counsel, Charles S. Davis.
Chapter 209 of the Acts of 1908 pro- vides in part:
"No fires shall be set in the open air between the first day of April and the first day of December except by written permission of the forest warden; pro- vided, that debris from fields, gardens and orchards, or leaves and brush from vards may be burned on ploughed fields by the owners thereof, their agents or lessees, but in every case such fire shall be at least two hundred feet distant from any sprout or forest lands, and shall be properly attended until it is extinguished."
It is my opinion that written permis- sion from the Forest Warden must be obtained for all fires which are not on ploughed land whether or not they are more than 200 feet from forest or sprout lands. If a fire is not on ploughed land it makes no difference whether it is in the open or near houses. In any case permission must be obtained from the Forest Warden. If a fire is built on ploughed land and is more than 200 feet from forest or sprout lands, it may be built without the Forest Warden's per- mission. His opinion that such a fire is dangerous to the woods is not material. Wisely or unwisely, the legislature has decided this question for him. It has judicially determined that a fire which is built on ploughed land more than 200 feet from sprout or wood land and
which is properly guarded is not a menace to the woods. The only risk which the builder of such a fire runs is for failing to guard it properly. I am able to think of only one situation where the duties of a Forest Warden in this particular are doubtful, and that is the case of a fire which is built on the edge of ploughed land slightly more than 200 feet from the woods with dry grass between the fire and the woods. If in fact, however, there was ploughed land on all sides of the fire I think that even in this case the Forest Warden would not be warranted in interfering.
2. WHAT CONSTITUTES FOREST LANDS.
Clumps of trees or small groves can- not be called forest or sprout lands.
3. BURNING OF HOUSE REFUSE.
The statute of 1908 is general in its terms and applies to fires of every character with the exception of those which are specified in the act. A. man
who relies on being within the exception to the statute must actually come with- in the language of that exception. The exceptions stated to the act are "debris from fields, gardens and orchards, or leaves and brush from yards." These words are evidently intended to cover only the waste vegetable products of fields, gardens and yards, and they do not include the burning of paper, boxes and trash from houses. Persons who desire to burn these articles in the open air between the first of May and the first of December must have written permission to do so from the Forest Warden.

The Deputies are authorized to issue permits but are instructed to use great caution in granting them and always to have them contain the name of the man who is to be personally responsible for the care and extinguishment of the fire. When a deputy considers that extra precaution is necessary he will provide apparatus and help, at the expense of the person wishing the fire. At times of severe drought the Forest Warden will notify the Deputies to give no per- mits.
The Selectmen have appointed all of the Deputies as Special Police officers in accordance with the advice of State Forester Kane.
