The Record Commissioners herewith submit the eighth volume of the records which they have been empowered to print. It makes the third volume of the records of the town of Boston, the previous ones being the second and seventh volumes in the series. This volume ends with the meeting for September 30, 1728, -a date which has been fixed upon arbitrarily, inasmuch as it is at the close of one of the bound volumes of the original records in the City Clerk's office.


The "Index of Places and Subjects," for this book has also been prepared by Mr. John T. Priest, Assistant City Clerk, as its insertion in the seventh volume was so gen- erally approved. .


The Commissioners have now in press a Ninth Report, which will contain Births, Deaths, and Marriages in Boston prior to A.D. 1700, from the town records, and the Bap- tisms from the First Church records ; a Tenth Report com- prising Miscellaneous Papers, dated prior to A.D. 1700, from the State archives and other sources; and they are reprinting the Third and Fourth Reports, which were out of print.


Copies of the First, Second, and Seventh Reports, which relate entirely to the history of the old town of Boston, can still be obtained on application at City Hall.

[233.] 1700. March 11th.


It was voted that there shall be Overseer of the poor.


It was voted that there should be but Seven Selectmen.

It was voted that the Town should be at no Charge, To the maintaining the Water ways, Over at Winnicimet Ferry.


On the Consideration of mr. Taylors Serving of the Town in the "place of Town Treasur Eight years to the month of march Last past, & never Charged the Town any more then five pounds a ycar, for the same, & being far less, then really the Service is worth. Upon the Consideration forementioned.


It was Voted, That the Selectmen should Cause a piece of Plate to be made to the Value of Twenty pounds, & present the same to the sd. mr. James Taylor as a small retaluation of his Service & Kindness to the Town.


And It was further Voted, That sd. Taylor for his Service, in sd. office the year past, shall be allowed Ten pounds.


m' Simcon Stoddard being Imployed, by the Selectmen, to buy Twenty Barrels of powder for the Town use, & m" James Taylor being Ordered by sd. Selectmen as he was Treasur of the Town to reecive 'sd. powder, into his Custadie and Care, affirms he never recd any more then fifteen barrels of them, nor could never under- stand what was become of the Other five.


Therefor it was Voted, sd. James Taylor as Treasur of the Town should sue sd. Simeon Stodderd, for the five barrels of the Town powder weh is yet wanting.


Vpon the Petition of the Inhabitants of muddiriver, To be a Dis- trict or Hamlet Seperate from the Town, for those reasons follow- ing, Namely the remoteness of their Situation, wch renders them uncapable of Injoying Equal Bennifit & advantage wch other of the Inhabitants, of Publick Schools, for the Instruction of their Chil- dren, Relief of their poor, & repairing of their high ways.


Their petition being read, & the reasons given theirin Debated. It was Voted in the negative, & That tho" they had not for some years, been rated in the Town rate yet for the time to come the Selectmen should rate them in the Town Tax, as the other inhab- itants, & as formerly they use to be.


And for their Incouragement, It was Voted, that the Selectmen should provide a schoolmaster for them, To teach their Children to read, write, and cypher, & order him his pay out of the Town Treasury.


Some of the Inhabitant of the North end of the Town, stood up & requested that they might have the Libertie of a free school, for the Teaching to write & cypher.


It was voted in the affirmative, That the Selectmen, should agree wth a Schoolmaster for them, & order him his pay out of the Town Treasury.


The Inhabitants of Rumney Marsh Standing by and seeing the Town in so good a frame, also put in their request yt. a frec School might be granted them to Teach to Read, Write & Cypher.


It being put to the Town to know their minds, It was Voted, in the affirmative, with this proviso, That it did appear to the Select- men, yt there were a Sutable Number of Children to Come to the School, Then the Selectmen Should agree with a School master to Teach their Children to read, Write, & Cypher, for wch Service he should be payd out of the Town Treasury.

[234.] Vpon the Petition of Joseph Buckminster of muddi- river for a Committee to to be Chosen by the Town, to Lay out a high way to his Land. he hauing no high way there to, by Virtue of a Town Order. That all proprioters of Lots of Lands wthin The Town & precinct thereof, wch haue no high way Layd out to thier Lands, shall haue a high way Layd out thereto by a Committee Chosen and authorized by the sd. Town for that Purpose.


Sd. Buckminster Petition was read. & It was Voted, That


Capt. Theor. Frary mr. JJohn Bennet mr. Joseph Prout


Should he a Committee. to view sd. Buckminsters Land, & make reports to ye Town, the next Gen". Town meeting what may be proper to be done.


Vpon the Consideration of the great Charges this Town is at vearly from the Growing numb. of poor amonge us & the great num- ber Come in amonge us wch has been occasioned by the Eastern warr wta. the Indians, & other poor and Vild persons, yt. has come in amonge ous, from other Towns. Our Town being so populous and they shifting from place to place, so long before they be descouered, that the law makes them Inhabitants. now these things do presage great poverty to be hastening upon this Town if some Sutable methods be not timely Taken to prevent the same. Vpon the Con- sideration of the things for mentioned,


It was Voted. That there be five hundred pounds raised upon the Inhabitants of the Town of Boston, To be Layd out and improved, by the Overseers of the poor & such others wch. shall by the Town be added to them. as a stock to be imployed, for the procuring materials, & Tools, To Sett and Keep the poor people and Ill persons, at work. as the Law Directs.


It was Voted, That two hundred Sixty-five pounds be raised upon the Inhabitants of the Town of Boston, for the Defraying the Charge of the watch from the Twentieth of June Last past, to the 20". June Comeing.


It was Voted. That there be four hundred pounds raised upon the inhabitants of Boston for the relief of the poor.


It was Voted. That there be raised upon the Inhabitants of Bos- ton three hundred pounds, for the payment of Schoolmasters, fit- ting ye house of Correction, repairing of the fortifications, & all other necessary Charges of sd. Town.


Whereas there was a Vote, the 18th April 99. For the raising five hundred pounds, for the repairing of the Neck & no other use,


It is now Voted, that sd. Vote be nuld, and two hundred pounds be raised for the same use, and no more, nor no Other use.


It was Voted. That all the land on both sides of the way between the oak and Walnut & the Fortification, The Town's Right and Title therein be given to such p'son or persons, as shall under Take sufficiently to make & maintain the highway for Ever, not Less then fifty foot Wide : and that Sam" Lowell Esqr. & Capt. Bozoon Allen, be a Committee to agree wth. persons accordingly ; and to make Application to the proprietors for their Approbation and Consent.

Elisha Cook Esqr., Isaae Adington, Sam11. Sewell Esqr., Penn. Townsend Esqr., Capt. Sam11. Cheekley, Were by a Vote of the Town, Chosen a Committee, To Draw up instructions for the Seleet- men, and Overseers of the Poor, and p'sent the same to the Town (the next Gen1). Town meeting) for their Approbation.


and It was further Voted, That the same Committee, Together wth the Selectmen shall Consider about repairing, or Building, or hiring a House for m'. Ezek1. Cheever wch. they Judge may be best.


It was Voted, That when there shall be any Oeeasion for the Town Treasur to sue any p'son or p'sons in behalf of the Town. It shall be always with ye Advice and Consent of the Seleetmen.


Whereas there was formerly a Vote, of the Town ye 14th. mareh 1698, That when the Town met together to Chuse Jurymen, It should be out of the p'sons present as well as those absent.


It was Voted, That they would go on in the practice of the fore- going Votes In the Choice of Jurymen, of those yt. are p'sent, as well as of those wch. are absent, and that non should mention any more then one p'son at atime, to be put to ye Vote.


April 8th. At Publiek Town meeting of the Inhabitants of Bos- ton, Upon Publiek Warning, aceording to Law.


It was Voted, That they would haue no Other, assessors, But ye Seleetmen.


mr. James Barnes & mr. Robert Gibbs, Were Chosen Seleetmen, in the room of mr. Isaiah Tay & mr. Obadiah Gill, Who were Chosen Seleetmen ye 11th mareh Last past, but refused to Serve in that offiee.


Sam11. Bridge, Richard Christopher, Joseph Williams, at the same time were Chosen Tythingmen But upon their pleas made to the Town at this meeting, Were by a Vote of the Town, Dismissed from that Offiee.


Sam11. Sewell Esqr., Capt. Bozoon Allen, mr. Sam11. Lynde, Capt. Natha. Byfield, majr. Thos. Savage, Were by a Vote of the Town Chosen a Committee, To audit the Towns aeet. with ye Treasur. for the year Ensuing, Notifying the Seleetmen when they meet to be wth. them. The major part present to do the work.


[236.] Upon the return of the Committee wch Were Chosen by the Town ye 11th. mareh Last past, To take a View of the Land of Joseph Buek master of muddiriver, and to Judge what might be Done, wth. respect to the Laying out of a High way there to, aeeording to an an Antiant record of the Town, That Every Alot- ment should haue a way Laid out to it by a Committee Chosen and authorized by the Town for yt. Purpose


The return of sd. Committee was, That they Judged sd. Buek- minsters Ought to haue a high way Laid out to his Land.


Upon wch. returne, By a Vote of the Town, the former Com- mittee with the addition of Thomas Gardener & Sam11. Aspenal were Chosen and Impowered to Lay out a High way to sd. Buek- master's Land.


It was Voted, That the Seleetmen Do Consider, and agree, of a

Body of by Laws yt. may be proper and Benificial for the Towns good, & present the same to the nex Gen". Town meeting there to be read for the Town's Appropriation.


May 14th. At a Gen1. Meeting of the Inhabitants of Boston. Upon Publick Warning according to Law, were chosen for Repre- sentatives. Viz. Capt. Timº. Clark, mr. Natha Oliver, mr. Isaiah Tay. mr. James Barnes.


m'. Nathª. Oliver Refused to Serve in the place of a Represent- ative up wch. Refusal the Town Emediately Applyed themselves to a new Choise, and Chose Capt. Bozoon Allen in sd. Olivers Room.


Where as provision is made by a Vote of the Town, for the Support of the wateh as is now is untill the 20th. of June Next, and not Longer.


The mind of the Town is Desired to be Signified by their Vote, Whether sd. watch shall be Continued for another year, & that they will support the Charge there of. and that they will grant the Sume of Two hundred Sixty five pounds to be Leveyed on the Inhabitants for y. End. It was Voted in ye affirmative.


Majr. John Wally, Collo. Pen Townsend, Capt. Byfield, m'. Nathª. Oliver. Capt. Sam". Chickley, Capt. Theo. Frary Were by a Vote of the Town Chosen a Committee, to Joyne with ye Select- men to give instructions to the Representatives.


[237.] Whereas on the 8th of April Last past a Committee was Chosen and Impowered to Lay out a high way for Joseph Buckminster of muddirivr. to his Land he hauing yet had no high war Laid out thereto.


Sd. Committee mett together and Layd out a high way through Josiah Winchesters Land, To Sd. Buckmasters Land, and sd. Winchester being Dissatisfyed with what was done presented bis Petition to the Town, To Desire that Other meet p'sons might be Chosen by sayd Town, to take a View of what is done & to make a report of the same to the Town, his Petition being read & Con- sidered. Capt. Natha. Williams and m'. Isaiah Tay were Chosen by a Vote of the Town, to Joyne with the former Committee to In- devor the Settlement of that Concerne.

Voted, That a House be Built for Old mr. Ezek. Cheever the Latine Schoolmaster, and it was further Voted that the Seleetmen to Take Care about the Building of it.


Voted, That the Raising of money, for Defraying of Town Charges, to be referred to the Gen11. Town meeting for the Choise of Representatives.


Voted, To Chuse nine assessors.


.Voted, That the Request of mr. Eze1. Lewis for an Addition to his Salary, be referred to the next Gen11. Town Meeting.


Voted, That whereas a motion has been made by mr. John Ar- nold. That a windMill be set upon fort Hill, by privet persons. It is Left to ye Seleetmen to Inquire into ye Formes & Cireom- stanees of the Thing & make Report to the Town, thereof, the next Gen1. Town meeting.


Voted, That the reading ye Towns by Lawes, be referred to the next Gen11. Town meeting.


The Petition of Bethiah Fuller, was read to the Town, & was Voted that the Seleetmen should inquire what has been Expended on her father & make report to the Town the next Gen11. Town meeting.


Voted, That the Seleetmen should agree wth. a person about Diging of Graves in this Town.

BOSTON TOWN RECORDS, 1701.


[240.] May 12th. 1701. Att a Publick Meeting of the Inhab- ittants of this Town being this day convened at the Town House in Boston upon Lawfull warning.


Nathaniell Byfield Esq'. chosen Moderator.


Mr. John White, Cap. Sam". Legg, Mr. Natha. Oliver, Capt. Andr. Belcher, were chosen to serve for them as Representitives in Gen11. Court to be held the 28th. of May.


Mr. John George, Mr. Gyles Dyer, Mr. Richd. Draper, were cho- sen to serve as Selectmen in the room of messrs. Tay, Holyoke, and Oliver.


Mr. Samull Holland was chosen & Sworn Constable in ye rom of Mr. F1ª. Clark.


Mr. Thomas Walker, Capt. Benja. Davise were chosen overseers of the Poor in the room, of Coll. Hutchinson and Capt. Samuell Checklev.


Whereas M. Ezekiell Lewis Assistant to M'. Chever in the Government of the Lattin free School, hath represented unto the Town that the Sum of forty pounds, p. annum, is not Sufficient for his coumfortable Subsistance. The Town by thier Vote have granted that hence forward he be Allowed Forty five pounds p. annum, dureing his being Continued in that Station.


Whereas the Comittee appointed by the Town the tenth of March last together with the Selectmen, to consider of a sutable methode for the management of the watch who haveing agreed as followeth viz *.


That ten watchmen, two of them as Overseers be continued as formerly.


That every of them be enjoyned to be upon duty from ten of the Clock untill broad day light, from the tenth of March unto the tenth of September. And from the tenth of Septembr. to the tenth of march to be and continue upon duty from nine of the clock untill day light.


That two at the least of Said Watchmen Shall from each of the two watch Houses, Keep walking their rounds by turns through thier severall districts dureing the whole night, and each Rounds to return to their respective watch house, (as neer as may be) within the Space of one hour, and the next Rounds to go out imediatly upon their comeing in.


That besides the aforesayd Rounds, those watchmen whose turns are to be Off from the Same, Shall by turns take Short Rounds in Some of the principall Streets and places within thier inspection takeing perticuler care of the ware houses about ye Dock.


That the Rounds walk with watch bills, Silently forbearing to use any bell, and that no watchman Smok tobaco while walking thier rounds, And where they see Ocation they are to call to persons to take care of thier lights.


[241.] Voted that the Watch be continued according to the for- going proposalls, and to be under such farther regulation as the Select men shall direct. And to continue for the year Ensueing, excepting any part of said year in which a Millitary watch shall be kept within the Town.


It was voted that One Thousand and fifty pounds be raised upon

the Inhabittants and Residents of this Towne for the defraying the necessary charges of the Town for the year Ensueing, viz. for the relief of the poor Schoolmasters Saleryes &c. the charge of the wateh, the building a House for the Lattin School-master, and the charge of Representitives, Seleet men, &c.


At the same Meeting Mr. Joseph Bridgham was chosen to serve as Moderator to Transact in the remayning affaires of this meeting in the room of Nath11. Byfield Esq". whose ocations requirs his being absent.


Pen Townsend Esqr., Jeremiah Duiner Esqr., Major Thomas Savage, mr. Elizur Holyoke and mr. Danill Oliver, are chosen a Comittee to audit the Treasurers aceo's. for the Ensueing year, or the Major part of them being present to do the worke.


Voted that Mr. John Arnold & Compa. are alloweeid to Erect Windmill upon the Towns Land on Fort Hill, he or they paying a Quit rent for the Same. And it is left to the Select men to agree upon the terms therof, and to grant a Lease of the Same.


The Comittee formerly appointed to lay out a way to the land of Joseph Buckmister have given in the following return the Same being read in the Publick Town meeting vizt.


Wee the Subseribers being appoynted a committee by the vote of the Town of Boston, past the 8th. day of Aprill 1700, to lay out a highway to the land of Joseph Buckminster of Muddy River.


Aeeordingly we did on the 30th day of Aprill Stake out a high- way of twenty-four foot in breadth through the Land of Josiah Winehester viz. Runing from the South Side of a white oak tree standing in the Countrey Road, upon a direet line to the brow of the Hill neer Said Buckminsters Land, & thenee winding down the Hill Som thing Southerly to the aforesd. Buckminsters Land.

July 31th. 1700. The persons appointed as a comittee by the vote of the Town of Boston dated the 14th of May last past [242.] all of them being present (except Samull Aspinall) at Muddy River upon the Spot do give thier Opinon that the way Stated by the Comittee on the 30th of Aprill last from Joseph Buekminsters land, through the land of Josiah Winehester, ought to be continued. Said Buekminster being present haveing prom- ised to mak Sufficient Gates at each end of Sayd way with all convenient Speed, And Said Winchester being present doth Engage forever hereafter to maintain and uphold that Gate at the Northerly end next the highway-and Said Buckminster engages to uphold and maintaine that Gate next the Said Buckminsters land, from time to time, each of them for themselves their heires Excecu- tors and Admns, and so Engageing eaeh to other, In Testimoney whereof Said Buekminster and Winchester have hereunto Set thier hands and Seales the day and year above said.

BOSTON TOWN RECORDS, 1701.


May 12th. The Town by their Vote do manifest their Appro- bation of the Comittees return of a way laid to Joseph Buek- minsters land, together with Joseph Buckminster & Josiah Win- ehester thier agreement thereto.


At a meeting of the ffreeholders and Inhabitants of the Town of Boston duly Qualified to act and Vote in Town affaires being Orderly warned and Assembled the twelfth day of May Anno. Dom. 1701.


The severall Rules, Orders and By-laws were then Openly and distinctly read over, voted, made and Established by the afore- said ffreholders & Inhabitants of the Said Town to be Observed and Kept by all persous inhabiting in or within the said Town (for the year ensneing and nntill the ffreeholdrs and Inhabitants thereof. shall hereafter by their Vote & Order deelare, repeale, and make vord the Same or any of them) under the several and respective paines and penaltyes to them or any of them annexed and preseribed.
