be improved for the reliefe of the poor and the defraying other necessaryes ariseing in and for Sª Town.


John Tuthill Sent. is chosen to Serve as Constable for the dis- triet of Rumuy Marsh for the year ensucing in the room of Ilugh Floyd, who being befor chosen to that Service was excused.


Upon a motion of Severall persons who have formerly Served as Select men of this Town given in writing and being read, re- qusting that the Inhabitants of this Town, and the Gentlemen of the Committee for the persons claiming propricty in the Blue Hills & wast Lands at Brantrec, would agree unto the choycc of a competent number of Indifferent and juditious persons to be a committee to hear and Consider of what may be Alledged on the behalfc of of the Sª persons claimcing propricty and also on the behalfe of all the Inhabitts of Sª Town relateing to their claime unto the afore S' Lands, and to give their councell and advice in order to the putting an Isue to all controversies abt the Same, and to present Such their advice to the next Town meeting.


Voted an agreement that Such Committee be chosen.


Voted that it be left wth the Select men on the behalfe of this Town to agree with the Sª Gentlemen in the choyce of Such com- mittee as aforesaid.


Voted that the Sum of fifteen pounds be paid out of the Treas- ury unto Joseph Prout for his Service as Treasurer in the Last year.


Elisha Cook Esqr. John Foster Esq. Thom& Brattle Esqr. Mr. Willm Harrise & Capt. Thomas Fitch, or any three of them meeting to attend Sª Service, are appointed a Committee to audit the the Treasurs. accots for this present year.


At a meeting of the Free holders and other Inhabitants of the Town of Boston, duly qualified and warned according to Law be- ing convened at the Town House the 29th day of Decembr 1707, did then and there agree Vote and chuse as followeth vizt.


Voted that Elder Joseph Bridgham be ye Moderator of this meeting.


Voted that five Trustees be chosen to joyn wth the Comissioner for makeing a valuation of the Ratable Estate of this Town as the Law directs.


Voted that Elisha Cooke Esqr. be the Comisioner to Attend the Sª Servicc.


Voted that Mr. John Mico, Capt. Thoms Fitch, Mr. Samuell Marshall, Mr. Samuel Johnson & M". Sam" Plumar be the Trus- tccs to joyn with the Sª Comisioner in the aforcsaid Servicc.


Voted that the Select men are desired to prepare a List of all the Rents belonging to the Town with the names of the persons to whom any of the Townes Lands &c are Lett, & the time when their respective Leases will Expire, and also of any Lands &c blonging to the Town in the Occupation of any perticular person who doth not pay yearly rent for the Same.


Voted that it be left with the Select men to treat wth Such per- sons who Shall Offer to take the Land & Secure and maintaine the high way on the Neck lieing between Mr. John Benncts Pasture

Joseph Pront is granted the Sume of fifteen pounds for his Ser- vice as Treasurer in ye year Last past.


It being represented to this Meeting that over and above the fifty pounds ordered to be laid out in Fortifications iu the year 1704, there was expeuded there on Twelve pounds eight Shill & four pence more, ineludeing £11: 11: 0 due to M'. Nathan11 Oliver for bred & beer, Voted that the Same be payd out of ye Town Treasur.


[290.] Capt. Thomas Hutchinson haveng Signified unto the Inhabitts at this Meeting iu Manner following vizt.


Whereas there has been dispute for Several years relateing to the Wast Lands at Brantree between Several Gentlemen, who Es- teem themselve Proprietors of Said Lands. And this Town of Boston as a Town. Said lauds haveing been long Siuce Sold p a Committee of the Said Proprietors to Severall Gentlemen in Town for the Sume of Five hundred pounds and has been Since Sold p them to other persons mostly of the Town of Brautree for the Sume of Seven hundred pounds, but the Town Esteeming the Lands to be their Right have ofteu passed votes relating to that matter, which votes have never yet produced auy good Effect, but

only has bread dissentions in the Town, which dissentions 'tis be- leived might easily be composed, and a Satisfactory Accomodation accomplished, if only by a very Small Concession the Town would pass a Vote that a Committee Should be chosen to treat with the Proprietors, that the Five hundred pounds for which the Lands were first Sold might be appropriated and imployed for the good of the Town, in Some good Methode whereby the Stock may not be Exhausted, and that it might be left to the Comittee chosen by the Town in Conjunction with a committee of the Proprietors to appoint what Methode the money may be improved, and Some Such methode of accomodation no doubt the Proprietors will assent to Some of the Principall of them haveing Expressed themselves to Such effect. And it's Supposed that upon very easie Application to the Gentlemen who were the first purchasers, they will give to the Towns use the Two hundred pounds which the Lands were Sold for more then the first purchace (excepting what charge they have been out about it) which Severall of them have exprest a willingness to. And the Brantree men have Offer'd that for the Sake of a peaceable Accomodation, and to Obtain a quit claim from the Town to all the wast Lands and Blue hills, ex- cepting the grant of Two thousand five hundred Acres, which they are willing Should be laid out in any one part, either of that that is called the Wast Lands. or of the Blue hills, which the Town of Boston Shall esteem best. they will give One hundred pounds to the use of the Town,


upon the reading of the above said proposall and in answere there unto, it was voted vizt.


1. That the Town will proceed to the choyce of Such commit- tee.


2. That the Sª Committe Shall consist of five in number.


[291.] Messu's Daniel Oliver, Capt. Timothy Clark, Capt. Thomas Fitch, Thomas Cushing, Capt. Oliver Noyes were chosen a Committee in the behalfe of this Town, to Treat as is mentioned in the foregoing memorial.


Proposalls of Sundry Gentleman being before p'used & Ap- proved by the Select men & now offered to the Town are as fol- loweth viz.


Whereas at a meeting of the Freeholders and others the In- habitants of the Town of Boston on the 29th day of December 1707. It was y! Voted that it Should be left with the Select men to treat wth Such persons who would Offer to take the Land & Secure and maintaine the Highway on the neck, lieing between Mr. John Bennets Pasture and the Old Fortification, and to hear and Con- sider of the proposalls on which they will undertake the Same and to make report thercof at the next meeting.


Wherefore wee the Subscribers Some of the Inhabitants of the Town of Boston do hereby promise & Ingage that wee will from time to time and at all times forever hereafter Sccure and Keep off the Sea, from both Sides of the aforesaid Highway begining at the northerly end of the pasture Land now or late John Bennets which he purchased of Samuel Lynde of Boston Esq". on the Easterly Side. And the Land of Daniel Eppes of Boston afore-

said Clothier, on the westerly Side thereof, and extending as farr Souther-ly Leading to wards Roxbery as Twenty-four foot beyond the New pavement on Se way as it now is and that wee prevent the Tides flowing over, comeing to or in any wise hurting or damni- ficing the Highway from the One end thereof to the other, and that the Said Highway Shall be Forty-eight foot in breadth.


And farther that when and as Soon as the Town of Boston Shall See cause to carry on the pavement the Same breadth the other is, and bring it up to the Land of the aforesaid John Bennet & Daniell Eppes, That wee the Subscribers at our own proper cost and charge, will pave the remainder on each Side.


In Consideration whereof the Frecholders and other the In- habitants of the Town of Boston Shall and do give grant, bar- gain, enfeoffe and Confirm unto us the Subscriber onr heires and Assignes & Associates for ever, All the upland, Beach, fflatts and Meadow ground on both Sides of the Highway (to be Seenred as aforesaid) down to Low water marke, with all the Liberties, Priviledges, Comodities, and Appurtenances whatsoever there unto belonging, to our only proper and Absolute use and behooff for ever more And that the Town of Boston Shall allwayes de- fend ns in the Possession and peaceable Improvement of the granted premisies, And wee do Ingage to finish the Seenreing [292.] of the Said Highway within Two years & an halfe from the date of the grant. In witness whereof wee have hereunto put our hands this first day of March in the Sixth year of Her Majties Reign Annoqs Dom' 1707.

Voted a grant of the afore said Land beach & fflatts nnto the Several Gentlemen above named as Subscribers their Heires As- signes & Associates for ever on the conditions mentioned & Set forth in ye Sª proposalls.


Voted that the Town will proceed to grant money to carry on the pavement at the South end of the Town.


Voted a Grant of two hundred pounds to be layd ont at the South end of the Town, in addition to the pavement there.


Voted a grant of fifty pounds to be laid out in paveing at the north end of the Town, partly towards paveing the Street Lead- ing from Scarlets wharfe to M'. Jonas Clarks & the rest in Sneh place as the Select men Shall direet.


Voted a grant of Three linndred pounds for the Support of the watch for the ensueing year.


Voted a grant of Nine hundred pounds for defraying the Sev- erall other necessary Charges of the Town for the year ensueing, as Sett forth & mentioned in ye Treasurers Computation.

David Jefferyes, Thomas Banister, Edward Martyn, Joseph Parsons, Samuel Greenwood, Nathaniel Henchman were Chosen to Serve as Assessors for the year ensue- ing in the room of Messu" Thomas Walker, James Barnes, Richard Draper. Cap. Thomas Hutchinson. Sam" Marshall, Jonas Clark, & Robert Cumbey, who being at the Last meeting chosen to that Service and have neglected and refused to undertake in the Sª Service.


Mesu's John Smith, William Clark junr. Peter Butler, John Olton were chosen to Serve as Constables for ye year cnsueing in the room of Mesurs Spencer Phipps. William Hutchinson, Robert Hilton, & William Foy who being before chosen to Sª Office have refused to Serve.


[293.] Mr. William Jepson was chosen to Serve as Constable for the year ensucing in the room of mr. John Smith who being before chosen to that Service doth declare his refusall to Serve therein.


At a meeting of the Frce holders and other Inhabitants of the Town of Boston duly qualified and warned according to Law, being convened at the Town House the 12th day of Aprill 1708.

Mr. William Harrise & Mr. Will" Paine Merchts are chosen to Serve as Assessors for the year ensueing in the room of Mr. Joseph Parsons and Mr. Thomas Banister who being at the Last meeting chosen to that office have refused to Serve.


Mr. Nathaniell Lindall is chosen to Serve as Constable for the rear ensueing in the room of Mr. William Jepson who being at the Last meeting chosen to that Office hath refused to Serve.


Mr. Jeremiah Condey is chosen to Serve as Constable for the year ensueing in Stead of M'. Nath" Lendall who refuseth to Serve.


Mr. Jonathan Williams is chosen to Serve as Constable for the year ensueing, who upon pleas by him made is by a vote of this meeting excused from Sª Service for this present year.


Mr. William Cleer is chosen to Serve as Constable for the year ensueing in the room of M'. Jonathan Williams who is excused.
