And then the Questian was put whether the Town would make Choice of a Committe to prepare a Draught of an Humble Address to be layd before His most Excelent Majesty to Show forth the Duty Loyalty & affection the free holders and Inhabitants of this Town haue & Bare towards His Majestys Person His family & Government and how Sincerely they are attached to the Succession in the most Illustrious House of Hanover, in order to Sett at nought the Groundless aspertions east upon the People of this Town in His memorial.


Voted in the affermative.


Voted to Chuse fiue Person to be of the Said Committe.

The Committe Chosen to Enquire into the affair of the Land of the Towns at the South Seons in Boston &e. made this Return.


Persuant to the aboue Vote we the Committe therein Named haue bin on the Spott of Land & viewed the place where the abouesaid Ship Stands and find it to be part of the Land that was lately Inelosed to the Seons and that the Ship in part Stands on the very Spott that the Great Artillery Stood on, we also find that the fenee & Gate is also pulled or Cutt Down, and Remoued, by which the Said Scons and the Stores were Inelosed, but by whom we know not.


[430.] We haue also made diligent Search into the Records of the Town in the Town Books, and made other Striet Inquiry and ean not find the Town of Boston haue any wayes divested them Selves of their Originall Right to Said Land, nor any part thereof, neither by Grant, Deed, Possession on any Condition whatsoever, But haue alwayes bin in the Possession and Im- provement of that Same Spott of Land.

To the Kings most Excelent Majesty. The Humble address of the Select men free holders and other Inhabitants of the Town of Boston, in your Majestys Province of the Massachusetts Bay in New England Assembled in the Town Hall on Monday the Thirteth Day of Decembr 1723 . .


May it Please Your Majesty


We Your Majestys Most Loyal and Dutyfull Subjects humbly beg leave to Prostrate our Selves at your Royal feet, on the Account of a Memorial Lately presented by His Excellcy Samuel Shute Esq. Wherein We are accused of being under no Mages- tracy, By want of which many of the Inhabitants become too much Disposed to a Levelling Spirit, & too apt to be mutinous and Dis- orderly, and Ready to Support the House of Representatives in any Step they take towards Eneroching on the Prerogative of the Crown &c.


We crave leave Humbly to lay before Your Majesty the mistake of that Representation both as to the Number and Government of the Town and Especially as to their being under no Magestracy, where upon we would humbly Shew forth (that besides Sixteen or Eighteen Justices of the Peace Commitioned by His Excellency who are Inhabitants) we doe Annually make Choice of Sundry [431.] Persons for Select men, and other Officers, who haue the Prudentiall Affairs of the Town Committed to them, according to the Constant usage and agreable to the Laws of the Province made for that purpose, and this as well as other Towns of the Province are Impowered to make By Laws and Orders for the Better Regulating the affairs & Inhabitants of the Several Towns, Which good an wholesome hath bin by this Town duly Observed and keept ever since our present Hapy Constitution.


We would therfore in all Humble wise presume to Say that those Aspertions are groundless, far from the tember and Inelina- tion of Your Majesty® good Subjects the Inhabitants of this Town, or from being at any time practised among us. We always make it our Study and Care to Chuse Such Persons, to Represent us in the Generall Assembly as are truly Loyal and Sincerely Desirous of Serving Your Majestys Intrest, and if the Governor has at any time Negatived Some of them when the Generall Assembly thought them qualified to be of His Majestys Council, we are of opinion that Negatiue did not abridge the Town of their freedome of Electing them to Sit in the House of Representatives as They had don before His arival among us.


We take this Occasion to Assure your Majesty that we are Sincerely Attached to your Royal Person and Gouernment, which has bin So wonderfully mild and Just as to give us a Sensable Pleasure under your Hapy Administration, That we highly dis- aprove of any Encroachment upon your Royal Prerogative, and are hereby encoraged humbly to Pray for the Continuance of those favors we have to Our great Satisfaction hitherto Enjoyed under your Auspicious Reign, and that you would be gratiously pleased to Accept this Our Humble Address.

[437.] Voted the Select men for the time being be & hereby are Impowred to agree with any Person or Persons for any Sum or Sums of money, Due on areers on James Johnsons Lease, and also to agree with the Said Person or Persons for Such Sum or Sums of money as the Said Select men or the major part of them Shal think Reasonable for a quitt Claim of the Annual quit Rent due on Said Lease, and on Receipt of Such Sum or Sums of money to make and Execute proper Instruments to the Said Per- son or Persons for Remiseing Releasing and Quitt claiming to them their Heirs and assignes forever the Said Annual Quitt Rent. The money so Received to be lay'd out in Some Real Estate for the use of the Town.


And the Said Select men are also alike Impowred to Sell the other Smal Perpetual Quitt Rents and Pass Deeds for the Same and the money to be Improved as aforesaid.


Voted a grant of three Thousand Pounds to be Raised on the Inhabitants & Estates within this Town for Releif of the Poor defraying the Charg of the Watch and other neccessary Charges arising within and for the Said Town for the year Ensuing.

Voted that it be left with the Selectmen to Buy what grain they find needfull out of the money appropriated for that use.


The Comitte appointed the 9th of March last past to draw up Something Relating to Tything men & to lay it before the Town at their next Meeting.


Make their Report vizt.


The Comitte having met and Considered the Objections made by Persons chosen to that Office against taking the Oath by Law Prescribed, & the Main Difficulty pretended being the Tything mans Obligation to Inform against all Persons Selling drink with- out Licence. Are of Opinion that a later Act having put that matter into the hands of a comitioner of Excise Spesially ap- pointed thereto.


It be humbly offered to the Generall Assembly at their Next Session that the Tything men, (by an act made for that Purpose) may be eased of that trouble and their power further Inlarged as to other disorders & misdemeniars, So that they may haue have Equal Power with Constables to Suppress Tumults & disorders, & to arrest & Carry before the next Justice of the Peace any affrayers, Prophaners Cursers, Swarers &c.

For the more Peacable Reguler & Easy. Proceeding in Town Meetings.


Voted that the Constables of this Town or So many of them as the Selectmen from time to time Shall appoint (and by the waiter notified) Shall attend at Town Meetings with their Constables staves, and Observe the Orders of the Moderator on a Penalty not Exceeding Twenty Shillings


Voted That the Honoble Samuel Seawall, Thomas Fitch, Daniel Oliver Timº. Clark Esq's with m' Thomas Cushing the only Sur- viving Persons of the united Comitte of the Town & Proprietars have Liberty & be desired to lay out so much of of the Money in their Hands as Shal be needful to Erect a building on the Land before the Ston wall near m' Belknaps as may be most benifisial -


[443.] The Income and Rent thereof to be paid into the Town Treasury Annually for the Support of the Writing Schools in this Town -


For Preventing the many Irregularities & Inconveniences that may happen through the Mutiplicity of Comon Crycrs, every one that pleases takes upon him to Cry Lost and Stolen Goods &c.


It is therfore ordered


That no person whatsoever presume to be a Comon Cryer, or Cry any Sort of Goods wares or Merchandize Lost or Found or Stolen goods, Strays, Publick Sales &c, within any of the Streets Lands, Alleys, or Market place or places of this Town, on Penalty of ten'Shillings for every offence, Except only Such Person or Persons as Shall be Licenced by the Selectmen, And every Person so Licenced Shall keep a true and perfect List of all matters and things by him so Cryed, and give into the Town Clerk once every month a true and perfect copy therof with the things by him Cryed, and the names of the Person that ordered him to Cry the Same, And if the Cryer or Cryers Shall Cry any vain foolish pro- phain or Obscene matter, He Shal forfeit and pay Ten Shillings fine, and be Discharged from his Place or Office, And the Person that ordered the Crying thereof, Shall pay a fine of Twenty Shil- lings : Voted and that it be presented to the Sessions for Appro- bation -
