James Barnes w' chosen to serve as Representitives for this Town at the next Gen" Assembly to be held the 26th May Currt & so De Die in Diem, the beiug chosen by the majority of the Elec- tors present.
Elisha Cook Esq', John Foster Esq", Thomas Brattle Esq', Capt Thomas Fiteh & Pen Townsed Esq' or any three of them meeting to attend the said Service are appointed a committee to Andit the Treasurers aecots for this present year.
Voted that it be left with the Selectmen to give a deed of Sale (for & in bchalfe of this) Town to m' Elisha Cook Jun' & his as- sosiats of & for the Land granted to them at a meeting of ye Inhabitants the 8th of March Last past, agreeable to the Teuonr of ve sª Grant.
Voted that the Motion made by m' Joshna Ges & company about the Town Slip at the Lower end of Wood Lane, be considered by Je selectmen, & what they shall thiuck proper to be done therein, to be laid before the Town at their next meeting.
[29S.] At a meeting of the Free holders and othe Inhabi- tants of the Town of Boston duly Qualified and warned acecrding to Law being Convened at the Town House the 27th day of Deeem- ber Anno Dommi 1708.
Voted, That Deacon John Marrion be the Moderator for this present meeting.
The Sclect men haveing offered to this meeting the following proposalls as followeth vizt.
That the Orders and By-Laws of this Town already mad: for the directing, Ordering and Manageing of the Prudential Affaires thereof, have not answered the ends for which they were made, and the principall eause thereof is a General defect or Negleet in the Execution, without which the best Laws will signifie little, And one great reason why they are no better Executed, is the want of a proper head. or Town offieer or officers impowered for that pur- pose, the Law haveing put the Execution of Town orders into ye hands of the Justices only, who are not Town but County offieers. And it cannot be expected that they Should take the Tronble and care, or make it so much their business, as a Town Officer or Offi- cers pertieulerly Appointed or chosen thereunto must Needs do, and indeed for any Body or Society of men as a Town is, to be . Vested with Power to make Rules and By-Laws for their own good Regulation, and not to have power to chuse and appoint the Head Officer or Officers who shall have power to Execute their own orders and By-Laws Scems Incongruons, And good Order is not to be expected while it remaynes so, For as a Town grows more Populus it will stand in need of a more Strict Regulation.
The said Selectmen do therefore propose that this Town do now Chuse a Committee of a Considerable number of the Free holders and other Inhabitants of the Town to draw up a Scheme or draught of a Charter of Incorporation for the Inconrragement and better government of this Town in the best methodes as they Shall think

The Return of the Committee appointed the 8th of march Last past, to treat with Sundry persons abt the wast Lands at Brantree being read as followeth vizt.
Whereas the Town of Boston at a generall Meeting (Law fully warned) convened the 8th of March 1707/8 did nominate and appoiut a committee in behalfe of the Town to treat with Sundry persons, about the wast Lands in Brantree Aeeording to a memo- rial given in at Sª meeting, Pursuant to ye Said Vote, Wee the Subseribers being the Said Committee do Signifie to the Town, . that agreeable to the memorial wee have treated with the Com- mittee of those that Esteem themselves Proprietors of the wast Lands in Brantree belonging to. the Town of Boston, about the five hundred pounds, the sume they sold the Land for, and eame to this unanimos agreement, that the income of the five hundred pounds be forever impropriated and improved for a School or Sehools for writeing and Arithmetiek, and that some part of Gods word be read by a Sehollar or Sehollars by turns at the diseretion of the master. And that farther According to the Sd memorial wee had Several meetings with the committee of tlie purehasers of the aforesaid Wast Lands, And at Length did

agree with them to offer it as onr Advice to the Town of Boston, That for the future peace of the Town and the Consideration of the Snine of five hundred pounds being Impropriated and improved for ve Pnblick good of the Town forever, and in Consideration of [300.] Of twenty pounds to be paid to the Town for the use aforesd by the Said Purchasers. That the Town do give a quit claim to the Sd Purchasers with a reservation of the Land at Blue hills now in the Townes possession, as by a plan of ye Same on the Townes Records taken 1651 / 4 by m' Joshua Fisher Surveyor, and the Selectmens addition exprest by Said plan to run a Straight Line from A B to the top of Blue hills, And that the Town im- power a Comittce to give a quit claim accordingly And that agree- abl: to the directions of the Town and Sd Memorial wee Applyed ourselves to the Gentlemen the purchasers of the Committee of those that claim &c about the two hundred pounds the Sume Sd Lands Sold for more then the first Cost, m' Sergant, m' Hutchinson & Madm Sprimpton did declare that whereas they did not intend a personal advantage in the purchase, So they freely gave their parts of the two hundred pounds to ye Town, deducting ye charges for the use aforesaid the committee offers to ye Town to Accept the Same with thier thanks to them for ye Same. Mr. Gee at present refuses to give his part to ye Town.

That the Sª Committee be further continued & fully im- powered in the name and behalfe of ye Town, to pursue and finish what remaines to Compleat and perfect the afore recited offer and proposalls accordingly. And to seal, Execute, and Acknowledge a deed of Release and Quit claime of the Said Lands in due form of Law. to and for the use of the Purchasers, Inhabitants of Bran- trec &c. agreeably, under the exception and reservation of the Blne hill Land to Boston as Sett forth in the Sª Committees return.
Voted. That the thanks of this Town be given to Peter Sergeant Esq' Eliakim Hutchinson Esqr & Mad" Shrimpton upon their giveing the Town their parts of the Said two hundred pounds.
Voted, That the Thanks of this Town be given to the aforesaid Committee for their well management of y! Treaty wth the Severall Gentlemen abt the S' Wast Lands.
Voted, That the Selectmen being at the time when the Same Shall be Transacted are impowered to Lease out the blue hill Lands for a Term of years.
Voted, that the same be lett out not exceeding the term of Twenty-five years.
It being represented to this meeting by Some of the Inhabitte That the Townes being often Alarmed by Chimnyes takeing of Fire is ocationed in a great Measure by ye Careless & negligent per-

formance of the worke of Such who undertake the worke of Chimny Sweepers, And that there is no person here who hath Served a time to that Mistery or Trade, or professes ye Sª Im- ployment, but the Sam is (for the most part) performed by care- less & unfaithfull Slaves, in Such manner yt chimnyes have taken fire Soon after they have been Swept to the Great Surpriz: and [301.] Terror of the Inhabitants, and great hazzard of the Town when at the Same time Such of the Inhabitants whose chimnyes tak: fire and blaze out are liable to a fine of ten Shillings, although for their money they could not procure their chimnyes to be well and faithfully Swept.
To the intent therefore that Such defect & danger may be the more effectually Remidyed for the Future.
Voted, that the Town will take it into their own hands to pro- vide Chimny Sweepers, and that the Selectmen are desired to take yt matter into their Consideration, and make Sutable provision for the Town in that respect, and draw up rules and orders proper to redress Such Inconvenience & danger.
Mareh 14. At a meeting of the Free holders and other Inhabi- tants of the Town of Boston duly qualified and Warned Aeeording to Law, being convened at the Town Hous the 14th day of March Anno Domi 1708 /9.
Voted, That the Inhabitants will now proceed to the choyce of a moderator by Votes in writeing.
Voted, that the ehoyee of a moderator for this meeting Shall be determined by the greatest number of Votes and not confined to the majority of Voters.
Voted that Mr. Henry Dereing be the moderator for this meeting.
The question being put whether Assessors for the year ensuing Shall be Chosen distinct from the Selectmen, Voted in the nega- tive.
Voted, That Nine Select men Shall be Chosen to Serve for the year ensueing. Messu's Isaiah Tay, Jonas Clark, Joseph Prout, Samuel Marshall, James Barnes, Daniel Powning, Daniel Oliver, Richard Draper, and Capt Timothy Clarke are now chosen to Serve as Seleetmen for ye ensueing year.
Voted, thanks of this Town to the Gentlemen who Served as Seleet men in the year past for their Service therein.
Whereas the Committee chosen and appointed thereto, at a meeting of the Inhabitants of this Town the 27th day of De- eember Last past, Have now presented to this meeting a Scheme or draught of a Charter of Incorporation for this Town, by them Considered and drawn up, with their proposall for the further prosecution thereof, in case it be acceptable to the Inhabitants.

That the Select men do make Application to Her majes Justices at their Next Gen" Sessions of the Peace holden for the County of Suffolke, praying for some order and direction that the House of Correction may be put into Such posture and Methode, and So regulated as may Serve the ends for which it was designed, and perticulerly to promote the good order of this Town.
Voted. The Grant of One Thousand pounds to be raised for defraying the Necessary Charges Arriseing wthin & for this Town for the ensueing year.
