[470.] For the Regulating of Trueks, Carts &c. within the Town of Boston.
Whereas This Town hath bin at great Charge in Paveing the most of the Streets, & Considerable Lanes there in, And that Great Damage is don to the Pavement, by Reason of the Extraor- dinary Weight bourn in Carts & Trueks, in Some Measure Oc- casioned by the Unsutable Length of Trueks lately made, where by also there is Danger of great Don to Passengers &c in turning of the Trucks in Narrow Streets.
Tis Ordered
That from and after the Expiration of One month next after the Establishment of this Order Whosoever shall drive through any of the Streets, or Lanes of this Town any Trucks whose Sides Ex- ceed the length of Sixteen feet Shall forfeit & pay a fine of twenty Shillings for Every such Offence.
And that whosoever Shall drive any Cart or Trucks through any of the aforesaid Streets or Lanes with more then two Horses at a time Shall pay a fine of five Shillings for every Such Offence.
And that Every Driver who in his Cart or Trucks Shall carry more then One Tun weight at a Load thro' any of the aforesaid Streets or Lanes Shal pay a fine of five Shillings for every Such offence.
And That Every Driver of any Cart, Truck, Dray or Sled Shall while passing through the Streets or Lanes aforesaid, go by the Side of the Thil Horse with his Halter in his Hand, on pain of for-

feiting, of fiue Shillings for every offenee or negleet of attending this order.
And that the Tire of the Wheels of all Carts and Trueks that Shall be made after the Establishment of this order Shall be full four Inehes in Breadth and the Nayles of the Tire to be Flatt, on pain of the forfeiture of the Sum of ten Shillings for every week the Said Cart or Trueks Shall be Improued in this Town. To be paid by the Owner of the Said Cart or Trueks.
Read and Voted, And Ordered to be Presented to the Sessions of the Peace for their Approbation.
[471.] Upon the Petition of the Comittee of the New South Meeting House - Which was Refer'd to a Comittee to make Inquiery into & make there Report, which was
That they had Vewed the Place and Examined the Reeords and Deed given by the Town for Said Land & find, that the Seleet men had power to lay out that Ground for a New Meeting House & Sutable High wayes Round the Same now if the Town See good they may grant fifteen foot of that Way for the Inlargeing of the Meeting House, & there will be near fifteen foot Remaining for a High way, and will be no great Damage to the Ground Possessed by mr Wolf. If the Church Should alow Him or whosoever hath the Right in the Ground fifteen or Twenty Pounds it would be full Satisfaction for that Damage.
Voted the Acceptance of the Report.

Presented their answer. Which was Read & Debated & Voted an Acceptance of the Said Report whis [sic] is on File.
Voted That the Representatives of this Town be Directed, (That if the Petition for Dividing the County of Suffolk Should be at the Ensueing Sessions of the General Conrt again brought forward) To plead that as the Said Petition was directed to the whole Court and the Order to Notifie the Town coming from the House only. The Town cannot So properly make answer thereto.
The Comitte to whome it was left to Consider of the Price of the Several Species that Shall be Sett for the Constables to Receive them at for the Carrying in the Province Tax into the Treasury made their Report and is on file: Read & Voted Accepted.
Upon the Consideration of the affair of the Petition about the New South meeting House after it was Debated
Voted to Chuse a Comitte to Consider thereof, Examine the Grant of the Town, the Deed and the Petition and what may be best to act there upon and Make a Report to the Town at their Next General Meeting.

It is the most Earnest Desire of the free holders & Inhabitants . Lawfully Assembled at their Annual Meeting. That His Majesty's Justices of the Peace within this Town would be Pleased fre- quently to viset the several Bakers within the Town and See that they Conform to the Law Referring to the Assize of Bread, And that the Select men would please to do the Same.
Upon the Memorial of the Constables Praying they may be Alowed three months furter time to Collect and pay in what of the Taxes are behind and unpaid. Over and aboue the Ordinary time Limmeted into them, And That the Gent" Assessors for the Year Past may be Continued and Impowred to make Abatements as Usual.
Voted Provided The Constables pay in two thirds of what is unpaid at the ordinary time which may Intitle them to the Three pence Pr Pound Collecting.

On The Petition of the Comittee of the New South Meeting House.
A Comittee being appointed Nov the 20th 1727.
To Examine into that afair and So what may be best to act there upon And make a Report to the Town at their next General Meeting. Which Comittee make their Report and is as follows vizt.
The Comittee appointed as by the Other side having Examined the Grant of the Town, The Deed and the Petition now depending, Are of Opinion That the Town may without any Inconveniensy Consent That the fifteen feet Petitioned for be Set off to the South Church. But in as much as in the 1715 There was reserved the Priviledge of a Convenient High Way Round the Said Meeting House. We apprahend it Advisable for the Petitioners, in Case they now Obtain the Towns Grant Afterwards to Apply to the General Court for their Sanction.

Which Report was Read and Voted an acceptance of it.
[478.] Voted That the Select men for the time being be Im- powred & Directed to lay out a High way of fourteen feet wide from the land in the possession of mr Wolf near the South meet- ing House And that the Remainder of the Said Land be for the use of the Said Meeting house, as Petitioned for, And that the Select men Give a Deed of all the Towns Right of the Same The Proprietors Saving the Town harmless forever.

At a Meeting of the freeholder Inhabitants of the Town of Boston Duly Qualified being Regurly Assembled in the Town house in Boston in a Freeholders meeting On Fryday march 29ª 1728.
After Prayer by the Revd mr Wm Welsted.
Elisha Cook Esq' was Chosen Moderator for this meeting.
Voted. That the Town will take out the Towns proportion of the Sixty Thousand pounds being Eleven Thousand & One hundred Pounds Granted by the General Assembly.
Voted. That the Trustees now to be Chosen shall be such as have the Highest votes.
Voted. That the Trustees now to be Chosen be and are hereby Directed and Impowred to Let out the Towns Proportion of Said Money in Sums not Exceeding three hundred Pounds, and not under fifty pounds, To the Inhabitants of this Town, Upon Good Fee and free from all Incombrances, worth Duble the value of the Sum Borrowed, without any Consideration for Building or Im- provements, If Personal, The Principle & two Suretys, and of which to haue a Real Estate in fee within this Town of the value of the Sum Borrowed, Exclusive of the Building & Improvements as aforesaid. And that the Trustees for their Service Shall be alowed and Paid out of the Two Pr. Cent, One Sixth part of the neat proceeds of the Intrest Annually. They paying unto the Province Treasurer The Sums So ordered as the Law Directs, And the Remaining One Pr. Cent Intrest into the Toown Treasurer.
And further Ordered and Voted That if any of the Money Shall not be taken up, but Remain in the Hands of the Trustees, After the Expiration of Two Months from the first day of the Trustees Sitting to Let out the Money, which is to be on Wednesday Next.
[479.] That then and in Every Such Case the Trustees may Proceed to let out Such Remainder in Sums not Exceeding fiue Hundred Pounds.
Voted That m" John Hunt, Habijah Savage Esq', m' Andrew Tyler, m' John Baker, and m' Jacob Windal be the Said Trustees.
Then the meeting Adjorned till Monday next the first of April Eight of the Clock fore noon. And mett accordingly & Dis- mist.
The Town being met according to the adjornment.
On the Petition of Joseph Webb late Constable for the alowance of the three pence on the Pound for his Collecting the Rates as other Constables altho he paid not the whole in then by Reason of Sickness.

Job Coit, James Gauden & George Skinner Late Constables appearing and Representing That by Reason of the Taxes Coming out Later than usual They had not paid in the first part of the Rates According to the Time Perfixed That upon their paying the whole at the Time They may be Intitled to the bounty of the Town of three pence on the Pound.

Voted That a Grainery be Built in the Comon near the Alms House, And That the Sum of not Exceeding Eleven Hundred Pounds, To be paid out of the Money to be Raised at the next General Town Meeting.
Voted That mess's Jona" Williams, Andrew Tyler, and Peter Thomas, be the Coinittee for Grain for the year Currant, as the were for the year Past.

Voted That a Comittee be appointed to Inspect the Ruenous Condition the Out wharfs Granted to Several undertakers anno 1673. are in to the Great Damage of the Town and make a Report to the Town at their Next Gen" Town Meeting what they thinke may be Proper for the Town to do to Redress that Grievance.

Voted. That the Town will Support the Charge of another watch house and watch being Set up and Continued at or near the Mill Bridge. The Justices and Select men Agreeing to or appointing the Place as the Law Directs.

Voted That a Comittee be Chosen and Desired to draw up Somthing to Lay before the Town at their next meeting To Pre- vent the great abuse there is in Cord wood not fit for use. And also to Prevent the abuse on the Town in forestalling the Market, or going beyond the place appointed, to buy Provisions; and that also the Said Comittee Project what may be don to Prevent abuses by Doggs, all which to be layed before the Town at their Next meeting as afore Said and That until that time the Comittee make their Report to the Town, The Inhabitants haue full Liberty to go as far as the fortification to buy any Sort of Provisions.
[4S1.] That Nathan" Green Esq" m" James Gouge, and mr John Colman be the Said Committee.
A Comittee having bin Appointed the 29th of March 1728 To Inspect the Ruenous Condition that the out wharfes are in and make a Report to the Town at their next General Meeting what they think may be propper for the Town to do to Redress that Greirance.
The Said Comittee do now make their Report which is as fol- lows viz.
Pursuant to a vote of the Inhabitants of the Town of Boston at their General Meeting the 29th of March 1728 appointed us a Comitte To Inspect the Ruenous Condition of the out wharfes Granted to Several Undertakers in the year 1673.
We haue met and Considered of the Said Grant to the Several Proprietors that Engaged to build the Said Out wharfes and to keep them in Repair, And finding that most of them haue notori- iously Neglected to keep the Same in Repair according to their En- gagement made with the Select men then in being.
Do propose That three years time be alowed them to Rebuild the Said wharfes According to their agreement with the Town And that they who do not build up their Respectiue Parts in Said

Which Report was Read And Voted Aeeepted.
Upon Reading a Petition of Sundry the Inhabitants Respecting Carrying on the Pavement in Orange Street And debate thereon. mess's Thomas Emory & Henry Gibbon Offred and Engaged, That if the Pavement be Continued as far as the Dwelling House of Capt John Bennet. That the one third part of the Land lying before the Pasture Land of the Said John Bennet on the Easterly side of Said way Shall be by them well Paved. The Remaining two thirds well and Sufficiently Repared and a good and Sufficient foot way well Graveld at the Cost & Charge of the Said Emory and Gibbon, Said way to be dou to the Satisfaction of the Select meu. And if the Money apropriated for Pavement being three hundred Pounds at the last march meeting be Insofficient to Effect what is already ordered to be Expended in Paving and Continuing it in Orange Street Southerly as far as the Dwelling House of the aforesaid John Bennet. That then the Said Thomas Emery aud Henry Gib- bon will advauce and pay what falls Short of the Three hundred Pounds upon the Town's Refunding them what the Amount may be the year Coming.
The aboue Proposals being Read, The Vote was Put whether they would order & direet the Pavement in Orang Street to be Continued & Carryed on as far South as the Dwelling House of the Said John Bennet on the west Side of the way.
It Past in the affermative.

At a Meeting of the Freeholders and other Inhabitants of the Town of Boston duly qualified being Regulerly Assembled in a Publiek Town Meeting at the Town House June the 25th 1728.
