BOSTON TOWN RECORDS, 1712.


See Cause may now pass a Vote, Setting a time be yond which they will not receive any Such persons into ye worke-House.


2. As to the prevention of Poor from other places Obtruding themselves on ye Town. They are of Opinion the Laws of the Province Already made would greatly prevent that inconveniency, if the Same were duly Attended, and a proper person or persons were Sutably encouraged to give notice to the Select men of any breach upon the Sª Laws.


What may be thought further necessary to be Offered to ye next Gen" Court, the Sel: men can give directions to ye Representitives of the Town to use their Endevours that the Same may pass into a Law, and they are of opinion that Some of our former By-Laws may be instructive on this head.


[344.] Voted. an Acceptance of the fore going report wth the Thanks of this Town to the Gentlemen of the Said Comittee for their care and Trouble therein, and that they be desired further to Assist in forming an Act proper to be Offered to ye Gen" Court, in order to prevent Forraign Poors obtruding themselves on this or any other Towns.


Voted. That in Case the Gen" Court Shall See Cause to pro- ceed, to the Establishment of a Light-House for the Accomoda- tion of Vessells passing in and out of this Harbour, That then the Select-men or the Representitives of this Town be desired to move to the Sª Court, That the Town of Boston as a Town may have the prefference before any perticuler persons in beinging Concerned in the Charge of Erecting & maintaining the Same, and being Intituled to the Proffits and Incomes thereof.


Coll° Townsends business calling him to be absent. Voted. that Paul Dudley Esq' be desired to Officiate as Moderator in what remaines to be done at this meeting.


For Cleaning of ye Streets


Voted.


1. That there be Eight Scavingers for eight Several parts of the Town, and their perticular distinct Precint be under the Reg- ulation of the Select men.


2. That the Scavinger be impowered to Hire or furnish at the Cheapest Rates they Can, a Man or men wth Horses & Carts to rake up and Carry a way. as often as ye Scavingers See Cause, the dirt so raked up in all paved Street Lanes or High wayes.


3. That the Charge for Rakeing up and Carrying the Said dirt away, be paid out of the Town Treasury from time to time. by order of the Sel: men, the wch Rules are to be Attended for ye year ensuing.


Voted. That Mesues Jeremiah Allen & Thom® Smith do Serve as Overseers of the Poor ; in the room and Stead of Mesues Wel- steed & Lyndall who were chosen to y' office in March Last and have declined y& Service.


Voted. That m' John Gibbins and m' Charles Morrise do Serve as Clerks of the market for the year ensuing, in the room and Stead of Mesue Plummer & Butcher who were Chosen to that Office in March Last and have refused to Serve.

At a Meeting of the Free-holders and Other Inhabitte of the Town of Boston duly qualified and Warned, being Regularly As- sembled at the Town-House, the 8th day of March 1713. 14. And Coninued by Adjournmts to the 16th & 17th dayes of the Same.

Voted. That the Town will ehuse 7 Assessors.


Mesues Daniel Powning, Anthony Stoddard, Ezekiel Lewise, Samuel Marshall, John Kilby (the weh 5 refused to serve).


Capt Elisha Bennet & David Farnum are Chosen to Serve as Assessors of the Rates and Taxes for ye year Ensuing.


John Oliver one of the Late Constables haveing by his Petition Signified to the Town that he hath been obliged to pay unto the respettive Treasurers in his own wrong, the Sume £3. 8. 6. being So much ineluded in the Lists of Rates Comitted to him, and as- sessed on Several persons of whom it was not possible for him to get in. Praying the Town to Order that the Same may be repaid to him out of ye Town Treasury.


Voted. That it be Left to the Seleet-men to Consider thereof, and at their diseretion to Allow unto the Sd John Oliver, all or So mueh of the Sd Sume as they Shall think just and reasonable.


Voted. a choyee of Collectors of the rates and Taxes for ye year ensuing, at Least two in number, of Such persons as the Seleet-men Shall nominate and agree with, and that those who Shal under take yt Service, Shall give Security for the sumes to them comitted. And that three penee on the pound be allowed to the Collectors for Collecting the Sd Rates.

[347.] For Keeping the Streets and High wayes Clean.


Voted. That every Free-Holder or Inhabitant in the Town of Boston be obliged to Sweep or Rake up the Dirt into heaps be- fore their respective Houses or Lands, Abutting to the paved Streets, Lanes, or Alleys, being ordered there unto by the Seavin- ger ; And upon his Cy their Negleet or refusall, the Seavinger be direeted forthwith to employ a meet person to Sweep or Rake up the Same, paying him therefor, And the person So negleeting or refusing be Obliged to pay double the Charge, and to be recovered being eonvieted by the Oath of the Seavenger and One Evidenee, before any of Her Majties Justices of the Peace in the Town.


It is Ordered. That for the More Effectuall Keeping of ye Streets & Wayes Clean, Any Seavenger in the Town be directed & Impowered to Imploy or Impress any Cart or Carter, to Carry away ye dirt out of the Respective Streets and wayes, being Raked up in heaps, paying hin for the Same, the value of one Shilling p Load, and upon his or their refusall or Neglect the Sd Carter for- feit for every Offenee, the Sume of Ten Shillings, one halfe the value for ye Seavenger to be recovered as aforesaid, and the other halfe to wards paying the charge of eleaning the Streets.


Mesues Henry Hill, Jonathan Williams, (ye wch 2 refuse to serve) Jonathan Loreing Gyles Fyfield & Sam" Greenwood, are chosen to Serve as Assessors of the Rates & Taxes for ye year ensuing.


Voted. That ye Sel: men together with the Reverend Ministers of this Town be desired to be the Inspeetors of the Free Gram- mar Sehools for the year ensuing.


Voted yt Thomas Palmer Esq', Capt Edward Martyn, Capt Gil- bert Bant, Mesues William Harrise and Daniel Oliver, or any three of them are desired to Audit the Treasurer's Aeeots for ye year ensuing.


Pursuant to the Report of a Comittee appointed the 10th of Mareh Last and their reeturn under their hands dated the 17th of Aprill 1713 being now read.


Voted. A grant unto Joseph Prout the aditional Sume of Forty pounds for his Service as 'Treasurer for ye three former years aeeord- ing to ye Comittees Report.


Voted. A grant unto Joseph Prout the Summe of Twenty pounds for his Serviee as Treasurer for ye year Last past.

Voted. Thanks of this Town to m' John Cole for his past ser- vice as Master of a Free writeing Scholl in this Town.


Voted. That m' Jacob Sheafe be introduced into the writeing- School in Queen Street in the room of m' John Cole who hath Sig- nified his desire to be dismist from that Service: And that the S' nı' Sheafe be Allowed Seventy pounds for his Service as Master of the Sª School for one year next ensuing.


Voted. That m' John Barnerd be Continued as Master of the Grammer School at the North. And that he be Allowed Eighty pounds for his Sª Service for one year next ensuing.


Voted. That the Return of the Comittee appointed the 9th of March Last relating to a writeing School at the North, be re- ferred to the Consideration of the Sel: men and the Sd Comittec, who are desired to make report of what they Shall think proper therein unto the Town at their next meeting.


Voted. That the Overseers of the Poor be directed to receive no person into the Alms House to be Subsisted there, other then Such as are proper Objects of the Charity of this Town.


Voted. An Adjournmt of this meeting to tomorrow the 17th Instant at three of ye Clock in ye Afternoon.

Voted. That the Town will re-Consider their Vote Abt Sup- plying the Inhabit's with graine.


Voted. That the Town will make provision for ye Laying in a Stock of Graine.


Voted. That five thousand bushalls of Indian Corn be pur- chaced and Layd up in Some Convenient place or places.


Voted. That It be Left with the Sel: men to purchace & Lay in the Sª quantity of five thousand bushalls of Indian Corn, not exceeding the price of three Shillings and Six pence p bushel. And (if need be) they are Impowered to take up money at Intrest to purchace ye Same


Voted. That the Town will procced to grant money to be Layd out in paveing.


Voted. A grant of Three hundred pounds to be layd out in paveing in the Highwayes within this Town, perticulerly in School Street wch Leads to ye burying places, and at North Street nigh unto the New Meeting-House (provided the persons whose Lands are there Abutting do agree to defray the Charge of paveing each Side of the respective Streets, according to the Accustomned pro- portion, and that the whole affaire relating to the Laying out of ye Sª Suine be left to the discretion and direction of the Select mcn.

Voted. That the Town will be at the charge of Erecting and Supporting a Third Watch-House and Watch, at Sueh place or part of ye Town as the Seleet-men Shall direet.


Voted. A grant of three hundred Seventy five pounds for the Support of the Watch for one year ensuing.


In the room of Mesues Henry Hill & Jona Williams who refuse Capt Edward Martyn & m" John Marshall are Chosen to Serve as Assessors of the Rates & Taxes for ye year ensuing (ye Sª 2 refuse)

That the Sel: men be desired to Consider of Some Expedient to Oblige all persons who shall entertaine in their Houses or Tenemts, any Stranger comeing into this Town to reside, to give Speedy notiee there of, to ye Sel: men or T. Clerk, in writeing und' their hands and to make report to the Town, at their next meeting of wt they Shall think proper relating thereto.


m' William Antram is Chosen to Serve as an Assessor of the Rates and Taxes for the year ensuing.


At a meeting of the Free-holders and other Inhabitants of the Town of Boston duly qualified, being Regularly Assembled in a Publiek Town Meeting at the Town-House the 17th of May 1714.


Mª John White is Chosen to Serve as Moderater for this meeting.


Voted. That the Town will proceed to the ehoyee of four Representitives - John Clark Esq", Capt Thoms Hutchinson, Capt Oliver .Noyes, Coll. Adam Winthrop are by ye Major part of the Voters present Chosen to Serve as Representitives agreeable to the wart.


The Petition of John Greenough and Assosiates referring to the Stateing a Ferry place at the end of North Street is by a Vote of the Inhabitts dis approved.


Voted. That the proposal of Major Gen" Winthrop, relating to the Exchange of a peiee of Land, be referred to ye Consideration of the Sel: men, who are desired to prepare and offer to ye Town at their next meeting what they Shall think proper relating thereto.

BOSTON TOWN RECORDS, 1714.


Pursuant to a Return of the Committee appointed by the Town to Inspect the North Writeing School.


Voted. That it be left with the Selectmen to purehace a peiec of Land Sutable to Sett a School House on there, in Case any Snch Should be Offered to Sale on reasonable terms.


Pursuant to a Report made to the Town by the Select men, and Fire Wards, in Order to make provision for putting a Stop to the Spreading of Fire.


1. That there be provided and Lodged in Several parts of ye Town, Six Large hooks on poles, for the pulling down of Houses, with double that number of Smaller ones, sutable to to be Applyed to the Same use.


2. That ten or twelve Sntable and able men, whose dwellings are neer the same, be Appointed to Attend the Service of each of the three water Engines, and that at all times, both in Winter & Summer there be free Aeeess to the Severall Engine Houses, and that the passage thereto be not obstructed.


3. That two good Axes be provided & Lodged wth each Engine.


4. That Some Sutable Casks of powder well bound & cased with Leather, well fitted for blowing up of Houses, be lodged in Several Convenent places of the Town, And yt Sutable persons be appointed to [350.] Attend and Carry the same, in Case of the breaking ont of Fire.


Voted. That it be left wth the Select men to make Provision as afore said. And to take care that the Town order or by Law abt provideing of Ladders be duly Attended.


Voted. That it is the Opinion of the Town. That Snch per- sons as Shall be imployed in Blowing up of Houses in Case of Fire, Should have a Competent reward for Snch Service and that the Town will take the Same into Consideration after Such an Oeeation Shall hapen for the future.


For Preventing annoyanee to the Streets &c by ye Irregular Conveyanee of Water from Off Honses.


Whereas it hath been found by long Experience, that the Comon nsage of Conveying Watter by Tronghs, or Gutters from the Eves of IIonses in this Town, So as to drop the Same into Sneh parts of the Streets or High wayes, where the Inhabit's & others do usnally pass & repass hath been a great annoyanee, espeshally in Stormy wether & dark nights.


It is therefore Ordered. That from and after ye Publieation of this Order, No person whatsoever, Shall be permitted to make or Sett up any Such Gutter, or to Continue any Such, being already made and Sett up, for the conveying of water, from any of their Honses to fall into any of the Streets. Lanes, or Highwayes of the Sd Town other then Such, as Shall be So made, as to convey the water thro drop-gutters or Trunks, Close to their respective Houses (in the best manner the Circustanee of the place will admit) So as to deliver or Cast the Same, not exceeding four feet distant above the Surface of the Earth, and at the Edge or Side of the respective Street or Highway.


And it is further Ordered; That from and after the tenth day

of March next ensuing the Publication of this Order, Every Such owner, or Occupier of any House or Ediffice in this Town, who shall Suffer or Continue any Trough or gutter, to abide upon or joyn any of their respective Houses or Ediffices, So as to Convey water into any of the Streets or Highwayes of this Town, to the Annoyance of passengers, and Contrary to the true intent and meaning of this Order, Shall forfeit and pay the Sume of Twenty Shillings for every Such Transgression of this Order.


For preventing of Strangers, Comeing from other places and And obtruding themselves on this Town.


Whereas. It hath often So hapened, That Strangers have Sheltered themselves as Tennants, Lodgers or Inmates with Some of the Inhabitants of this Town, The Select-men not haveing had Seasonable Knowledge thereof, the which in many Instances, hath been the Occasion of Bringing Charge upon the Town.


It is therefore Ordered. That no person Inhabiting in this Town, Shall Receive, Admit, or Entertaine, in any of their Houses or Tenements, either as Tennants or Inmates, any person being a Stranger, or New Comer here, not being Admited by the Select men as an Inhabitant of this Town, other then Such Strangers as become Apprentices to any of the Free-holders of the Same, without giveing Notice in writeing under their hands [351.] within the Space of Thirty dayes next after their So receiving or entertaining Such Stranger or New Comer, Unto any one of the Select men of the Sª Town, or Town Clerk, of the name of Such Stranger or New comer, with the time when they Came first to be So entertained by them, and the place from whence they Last came, and their Circumstances as neer as may be And that every Such person Inhabiting in this Town who Shall refuse or neglect to give Such Notice as foresaid, Shall forfeit & pay the Sume of Twenty Shillings for every Such Transgression of this Order.


And it is further Ordered, That no person whatsoever, Comeing from any other Town or place to dwell or Reside in this Town at any time hereafter, Shall upon any pretence whatsoever presume to open any Shop, or to Exercise his or her Trade in this Town, without first Obtaining a Certificate under the hand of the Town Clerk, of his or her being admitted by ye Select men, So to reside or dwell here, On penalty of forfeiting and paying the Sume of Twenty Shillings for every Such Transgression of this Order.


Voted. That it be left with the Select men, at their discretion to dispose of the Indian Corn, (Lately ordered to be layd in) and at Such time, and in Such manner as they shall think convenent.


In answere to the Petition of m" Richard Henchman.'


Voted. an Addition to his Sallery the Sume of Twenty pounds for the year ensuing So as to make the whole, Sixty pounds.


Voted. An Addition of Forty Shillings' p' annum be allowed him so as to make up the Rent of his School-House Six pounds p' annum.


In answere to the Petition of m' John Cole.


Voted. a grant to him of the Sume of Ten pounds and Sixteen Shillings in Consideration of what he formerly pd for the Rent of

Voted. That the Sel: men be desired to prepare a penal Order or By-Law as they Shall think proper to regulate Such as Shall Sell to Hucksters.


Voted. That the Town will come into the charge of paveing in Anne Street. to the Northward of the Bridge there.


Voted. The granting of money to defray the other Charges of the Town be deferred to the next meeting.


At a meeting of the Free-holders and other Inhabits of the Town of Boston, duly qualified being Regularly Assembled, in a Publick Town Meeting, at ye Town House the 4th of June 1714.

M' Edward Hutchinson is by the Majority of the Voters present, Chosen to Serve as Representitive. for this Town, in the Room of the Honble Thomas Hutchinson Esq", who was before Chosen, and Since that Elected and Called up to Serve at ye Council Board.


[352.] Upon the pleas of excuce made by the 8 Constables.


Voted that the Sel: men be directed to withdraw ye Complaint made & given in to Justice Dudley against them.


Voted. That the Town will come into the Charge of Carrying away the Dirt ordinarily made in the paved Streets of this Town, after the Same is raked up.


For Cleaning. and Keeping clean the Strects Lanes and High- wayes within the Town of Boston.

That when and So often as the Inhabitts of ye Sª Town, Shall agree to bear the Charge of Carrying away the dirt and Trash out of the Sª Streets : It Shall and may be Lawfull for Such persons, who are or Shall be chosen to Serve as Scavengers for the time being, And they are hereby directed, as often as they Shall think needfull, to warn and give notice to all and every person wth in their Respective Wards who are or Shall be hereafter the Occupiers, of any Houses Lands or Tenements, Abutting on any of the paved Streets Lanes or Highwayes aforced, to Rake up in heaps, all the Dirt and Trash, lieing or being in the Sª Streets or Highwayes, before or against their respective Houses. Lands or Tenements., in Such manner, and proportion, as the Scavinger or Scavingers for each respective Ward Shall order and direct.
