Voted. That the Bridg over the Creek in Ann Street, be made a Sufficient Fast Bridg for the future, for the better Security of Passengers, and the persons Obiged to build the Same be notified thereof by ye Seleet men.

Ordered. That no Huekster or other person whatsoever dwell- ing or Resideing within this Town of Boston, Shall by themselves or others Buy, Contract or bargain for, any Sort of Provisions, of what nature or Kind soever, brought or bringing to Town for Sale, except for their own families use, untill three of the Clock after noon, on penalty of Forfeiting and paying the Sume of Twenty Shillings for every Transgression of this order.
[324.] Ordered. That no Wharfinger or any other person dwelling or Residing within this Town, Shall Suffer or permit any Sort of Fire-wood to be carted or any wayes carryed off their Wharfes or Lands except for their own use untill it hath been first measured or Corded by a Sworn Corder, or other wise veiwed by any other Officer or Officers, appointed by ye Sel: men for the time being, and found Measure, according to the direction of the Law in that case made and provided On penalty of Forfeiting and paying Twenty Shillings for every Transgression of this Order.
Voted. That the two fore ging orders be and coninue in Force for the year ensueing, untill the Inhabitants Shal hereafer by their Vote Repeal the Same or ether of them.

The draught of a Deed in writing for the Sale of the Blue Hill Lands at Brantrey being presented by the Select men & dis- tinctly Read to the Inhabitants at this meeting.
Voted. That it be thereon Endorsed in the words following vizt.
(The within Written Indenture of Bargain and Sale made by the Seleet men, appointed and impowered by the Town a Committee for tliat purpose, was presented & Publiekly Read in a Generall Town Meeting, Orderly Assembled at the Town House in Boston, upon Lawfull warning the 9th day of May 1711. And the Sª Deed was Voted by ye Freeholders and other Inhabitants duly qualified as the Law direets present at the Sd Meeting, Approved & Confirmed by yim as well in the Grant as Warranty.)
Voted. That the Sume of Thirteen hundred pounds, part of the Purchase money for the Towns Land in Brantrey, Sold to Menas- sah Tueker &c, of Milton, by ye present Select men appointed and impowered a Comittee for that purpose, to be paid by Several pay- ments into ye Town Treasury, according to the Tenor of the Con- ditions of Certain Bonds or writeings Obligatory by them passed to Joseph Prout Gent. present Town Treasur or his Suecessor in that Offiee (Together with the Two hundred pounds already re- eeived towards the Sd purehaee) Be Invested and Layd out in Some Real Estate for the use of the Publiek Lattin School, by the aforesaid Comittee of the present Select men, or any five of ym, pursuant to the Towns Vote of the 13th of March past, or by Sueh other Comittee as the Town may hereafter raise and Substitute for that Serviee.
The aforesaid money when in the Treasury, to be drawn forth by order of the Comittee, and by them invested and Layd out [325.] As aforesaid, Provided the Town be Advised with before the disposal thereof, The Annual Rent and Ineomes of Such Investiture to be imployed to and for the Support of the Publiek Grammar School, the principall Stock not to be deminished.
Voted. That the Town will at this meeting, proceed to ye Con- siderati of the Petition of Capt Ephraim Savage &c. Requesting an abatement of the Conditions enjoyned on them in the Town Vote the 12th of March Last, abt Laying out a New Street.
Voted. That it be left with the Seleetmen to make Some reasonable abatement of the Sd Petitioners Charge in paveing which was by the Sd former Vote enjoyned on them, Provided they Lay open the Sª way within ye Space of Six moneths next.
Upon Reading the Report of the Committee appointed to enquire after a Sutable Spot of Land for Enlarging the burying place at the North end of the Town vizt.
That they had Treated wth the Honble Sam" Sewall Esq". To purchase part of his Land Adjoyning to the present Burying place, of the dementions expressd in the Sª Report for that use, at the Priee of one hundred and Twenty pounds.
Voted. That the Sd Report be accepted, And a proper Deed be made and Excuted for the Sd Land, to be paid for within twelve moneths next eomeing.

Esq' for Sale of a parcell of Land for Enlargeing ye North burying place, at the price of One hundred and Twenty pounds, to abate Seventy pounds of the Said purchase money, So that ye Town please to Release an Annual Quit claim of Forty Shillings. Issue- ing out of a Ceader Swamp in his possession, Scituate iu Brook- lyne. Appropriated to the use of the Grammar School Reported by the Committee. Be accepted. And that the Said Quit Rent of Forty Shillings p' Annum be abated.
The afore said Sume of Seventy Pounds to be drawn out of of the Town Treasury, and Invested in Some Real Estate, or other- wise improved by the direction of ye Select men for the time being, The yearly Rent or Profit thereof to be appropriated to the use of the Free Grammar School, in liew of the afore said Quit Rent.
Voted. That it be left wth the Selectmen to draw up & Offer to the Town Such proposalls as they Shall thinck proper, in order to an appropriation of the Townes Wharfe & Dock at Merryes point, ye Rent of Winisimit Ferry & the wharfe at ye end of Cross Street, For the Support of a Free School or Schols at the North end of the Town.
[326.] Voted. That it be left to the Select men to Sell the Townes Lands at Muddy River Alies Brooklyne, and that they have full power to make and Execute proper Deeds for the Same, Saveing and Reserveing to the Inhabitants of Brookline a propor- tion thereof according to their Rates to this Town,
Voted. That it is left to the Select men to graut, Sell & dispose of the Townes Land on each Side of the High way on the Neck from the place where the Fortificatiou formerly Stood, as far as the halfe way Pond, either by Lease for term of years, or by Grant of the Fee thereof. as they Shall think best ; In order to Secureing the High way there, ( wch is proposed to be left of a considerable breadth). Reserveing a Space of about One hundred yards in breadth, a cross from Sea to Sea, Sutable for a Fortification or any other use for the Service & benefit of the Town, Reserveing also a Space for a Cross High way next to the Land formerly Granted to Cap Oliver Noyes & Compa, and ye Sd Select men are fully impowered to make and Execute proper Instruments or Deeds for ye Same.
Voted. That it be left to ye Sel: men to provide a Sutable number of halfe bushells, made conenient in order to prevent fraud in measure.
Voted. That it be left to the Selectmen to direct to Some proper methode ether by Cart or other wise to remove and Carry away the Dirt & Trash out of ye High wayes wth in ye Town.
Upon Reading the Petition of the persons who Served as Con- stables in the year 1710. Voted. That it be left with the Select men to make Such further abatements to the Sª Constables as Shall be needfull.
Saveing that this vote be not a president for future Constable.
Voted. That the Gentlemen that Represent this Town in the G & Gen" Assembly be desired to move, That the Rule for ap- portioning the Town & County Assessments for Boston may be

Thomas Wallise is Chosen to Serve as Constable for the year ensueing in the Room of Daniell Loreing who iu the moncth of March Last was Chosed to yt Office, & liath refused to Serve.
M' Authony Stoddard is Chosen to Serve as Overseer of the Poor, for the year ensueing in the room and Staad of mr Charles Chauncey deceaced.
Voted. That the Consideration of the Bridg in Anne Street be deferred untill the Next Publick meeting of ye Inhabit8.
The Select men have Ordered that the Order, Or By Law agreed unto by ye Inhabitants as mentioned in page 310, and Since that finished So as to be put in practice be now here [327.] Recorded, and is as followeth vizt.
At a meeting of the Free holders and other Inhabitants of the Town of Boston, duly qualified and warued according to Law, be- ing convened at the Town-House the 13th of March 1709 / 10.
Ordered, That the Select men of this Town for the time being do from time to time Appoint Sntable persons to be Chimny Sweepers, and to agree with them for the Sweeping the Same, not exceeding the Rates hereafter mentioned vizt.
For each Chimny of five Storyes high eighteen pence, of four Storyes High fourteen pence, of three Storyes high ten pence, and of all other comon Chimnyes eight pence.
And if any person whomsoever who is not So appointed as aforesaid, Shall presume either by himselfe or Servant, to under- take the Sweeping of any Chimuy in this Town, except Snch Chimny or chimnyes wch are under his or their own improvement, Shall forfeit aud pay the Sume of Twenty Shillings for every Such Offence.
And it is further Ordered that every person or persons So appointed by the Select men, to be under takers for Chimuy Sweeping, Shall be free men, and they Accepting the Same, Shall be Obliged within forty eight hours after Notice giveu them, ether by themselves or some other person to be approved by the Select meu duly to attend the Sweeping of Such Chimny, On penalty of forfeiting the Sunie of ten Shillings for every Such Neglect.
And it is further Ordered. That upon Complaint made to any of the Select men, either by the Chimny Sweepers, or by any other of the Inhabitants of this Town against any person, or persons Neglecting to have their Chimneyes Swept being foule, that in every Such Case, the Select men or any two of them, are hereby impowered to Inspect & Veiw the Said Chimny or Chimnyes Com- plained against as aforesaid, and if they judg the Said Chimnyes or any of them unsafe, to make or keep fire therein by reason of their being foule, and want of Sweeping, and Signifie the Same to the person or persons, then in possession of ye Tenement to which Such Chimny doth belong, That then and in every Such Case, the Occupier of every [328.] Such House or Tenement Shal forfeit and pay the Sume of five Shillings, for every day in which fire Shall be Kept in Such Chimny, untill the Same Shall be Sufficiently Swept.

And it is further Ordered, That if any Chimny Shall take Fire, and blaze out at the Top within fifteen dayes after its being Swept, through foulness or defeet in Sweeping, That in every Such case the person who last Swept the Same, Shall Forfeit and pay the fine of ten Shilling, which by a former Law or Order was imposed on the Occupier of a House, in Case of Chimnyes takeing Fire.
And it is further Ordered, That the Select men are hereby im- powered, to Appoint persons to Inspect, and Inform against the breach of these Orders, and to Allow them a Sutable Recompence for Such their Service.
The Sd Orders w' Agreed to and Voted by the Inhabitants of the Sd Town at their Meeting ye day & year afore mentioned.

[329.] At a Meeting of the Free-holders and other Inhabitants of the Town of Boston, duly qualified and warned according to Law, being convened at the Town House the 3ª of August 1711.
Voted. That Sam" Sewal Esq be ye Moderator for this meeting. Voted. That a line of Defence be forthwith made, across the neck between Boston and Roxbury.
Voted. That a Convenient Number of Great Guns, as Shall be thought needfull by the Comittee that the Town Shall chuse, be planted in the Sd line of Defence.
Voted. That a Committee be chosen to manage the affaire of makeing the Sd line of Defence, and that the Sª Committee Consist of five in Number.
Voted. That Collº Gyles Dyer, Capt Timothy Clark, Mesucs Richard Draper, Joseph Wadsworth & Joshua Gee be the Said Comittee.
Voted. A grant of one thousand pounds for defraying the charge of makeing the Sª line of Defence, to be improved for that and no other use, and to be drawn out of the Treasury by the Sd Committee.
Voted. That the Treasur be desired, upon the Credit of the aforesd grant of one thousand pounds. to borrow money of the In- habittants, for a present Supply for ye Speedy Carrying on of ye Sd worke.
Voted. That the aforesaid Committee wth the Select men be desired to waite on his Exceley the Gov, for his countenance and Authority, to begin and Carry on the Said worke.
Voted. That the Field Officers of the Melitia in this Town, be desired to Consider of what is farthar wanting for the Defence of the S' Town, and to waite on his Excey the Gov", desireing his direction for what is needfull.

Voted. That Dear John Marion be ye Moderat' of this meeting. The qustion being proposed? Whther the Town will purchace Land of the Proprietors of the New Settlements on the Neek, for Erecting a line of Defence there. Voted in the Negative.
Voted. That the Town will make an Addition of two in Numbr to the Committe appointed at the Last meeting, to make the Line of Defence on ye Neck.
Voted That Elisha Cook Esq' & Thomas Brattle Esq" bc the per- sons Chosen to that Servce.
[330.] And whereas Capt Timothy Clark who was before Chosen to be One of the Sd Committee, declarcs that he cannot at- tend the Same, for as much as he must Attend the worke of an Assessor. Voted that mr. William Antram be joyned wth the Sd Committee in the Room of Capt Clark.
Voted. That the Said Comittee be desired to Consider of what they Shall think proper to Lay before the Town Relating to the Sd line of Defence and to make an Estemate of the Charge there of, and to Lay the Same before the Town at their meeting on Fryday the 31st of August Currt.
Voted. An Adjournment of this meeting to Fryday the thirty first of August Curt at nine of the Clock in the fore noon.
August ye 31th the Inhabitts being Assembled According to their Adjournment.
Voted. That the line of Defence be forthwith made within or About Two hundred feet to the South ward of m' Sam11 Phillips his Land on ye Neck.
Voted. That the Comittee forthwith proceed on the affaire above mentioned and to build ye Sª line as they have already pro- posed Viz. To face the Same with Stone from the bottom of the Ditch to ye highth of the Rampart, and the Parapet to be of Sod- 1 . worke.
Ordered. That it be an Instruction to ye Comittee for the lne of Fortification &c to Enquire into and recover the Stones of the Town®, that have been taken away from off the Neck and Flatts, and that the persons who took them away be Obliged to return them to the place from whence they took them or be Obliged to pay and Satisfy the Charge of bringing them back againe to their proper place.
Voted. That the Select men, when and So often as they are In- formed that it is, or likely to be a time of Great Scarcity of Graine or other provisions that they Address the Govt and Couneill to p'vent the Exportation thereof, or provide Such other remedy as Shall be thought proper & cffectuall that So the Town may be Supplyed.
Ordered. by the Select Men for the year 1711. That the follow- ing Transactions of the Perambulators be here Recorded, and is as followeth Vizt.

Be it Known unto all whom these presents do or may Concern, That in pursuance of the Law Intituled an Act for Regulating of Town ships &c wherein is directed, That the Bounds Between Town & Town [331.] be ran Once in three years. Upon the Eighteenth day of April Anno Dommi 1711. At the Sign of the Lamb in Rumny Marsh Addington Davenport and Edward Hutch- inson Two of the Select men of the Town of Boston being Aceom- panied by Elisha Tuttle, John Brentnal, Thomas Berry, and Edward Tuttle all Inhabitants within the Township of Boston aforesaid, did meet with Messes Edward Baker, Thomas Cheever and Ebenezar Beleher, a Committee in behalfe of the Town of Lynn, And haveing Shewed to each other their Respective Orders for Running the Bounds betwist the Said Towns of Boston and Lynn they proceeded to the Said worke. and began at Bride Brook where it runs aeross the Road and from thens went on a N N W course neerist by the Compass to an heap of Stones on a Roek in Widdo Edmunds& Land, From thenee to the Stump of an Old Walnut Tree on the West Side of a Little hill where was an heap of Stones to which more were Added. From thenee to a Small Black Oak in Mariams Land marked B L and an heap of Stones Round it, From thenee to an Oak Tree Standing on Sarah Pauls Land, being Marked B L and an heap of Stones, Round it : From thenee to a Crotcht Tree in William Boardmans Land Marked B L with Stones ronnd it, at this Tree by a Pocket compass it was found that the line Runs aeross the River, and So through the Staek of Chimnyes in the Now Dwelling-House of the House of the Said Bordman, From the Sª Tree Across the River to the Body of a Walnut Tree now Dead Marked XX/ ||| with an heap of Stones Round it From thence to a Large Old Oak on the South Side of an Hill MarkedXX|||| and B L and an heap of Stones Round it, From thence to a Walnut Tree marked B L with a heap of Stones About it. From thence to an heap of Stones on a Roek, Then to an heap of Stones on the Brow of an hill, There were three or four more Trees well marked with B L and heaps of Stones round them, between the before mentioned Heap of Stones and the large decayed White Oak which is Marked B L and Surrunded with an heap of Stones, abt four Rodd & an halfe from the Sª Tree, and on the line first Mentioned is the Great heap of Stones Called the Three County heap, to wch a Considerable Addition was now made, That being the Boundary between the Townes of Boston, Lynn and Reading. It was this day Aso Agreed to, be- tween the Sª Select men of Boston and the Comittee of Lynn, That Bride-Brook on the Easterly Side of the Road as it has alwayes been Esteemed, Should be the Stated bounds between the Said Townes untill it Runns into the Salt water Creek, In Testi- mony of What was now done, the Said Select men and Committee have here unto Subscribed their names. Addington Davenport Edward Hutchinson, Edward Baker, Thomas Cheever, Ebenezar Belcher.

Memorandum It is judged Advisable that a Surveyor bc had to run ye line before meutioned, from the first to the Sixth Bound marke. to increase the number of Bound markes, in regard that as now they be, they are at too great a distauce one from the other.

John Flag is chosen to Serve as Constable in the room of Sam" Moor who was before Chosen to that Office aud Sinee that is gone out of this Town.
Voted. An Acceptance of the Select mens Sale of the Townes Lands at Brooklyne according to the Deed of Sale thereof made and Executed by them being now read, and Ordered that it be thereon Endorsed in the words following Vizt.

The before written Indenture of Bargaine and Sale made by ye Select men, in pursuance of a Vote of the Towu the Ninth of May Last past, was presented and Publiekly read in a General Town Meeting orderly Assembled in Boston upou Lawfull warning the 16th day of November 1711. And the Said Deed was Voted by the Free holders and other Inhabitants duly qualified as the Law directs present at the Said meeting, approved and Confirmed by them, as well in the grant as Warranty ; And further the Above mentioned Vote of the Ninth of May relating to Brooklyus proportion, was Explained to extend only their proportion of the money that the Land Should be Sold for.
Voted. A Concurrenee with the proposalls made by the Gen" Assembly Abt building a House in or neer the place where the Old Town House Stood, for the uses there in Mentioned with an Addit- tion of these words (and all other Town affaires) as part of the uses there of.
Voted That Thomas Brattle Esq', and mr. William Payn be the persons nomintated & Chosen by this Town to joyn wth the Comittee Raised by the Gen" Court to manage that affair.
[334.] At a Meeting. of the Free holders and other Inhabi- tants of the Town of Boston duly qualified and Warned According to Law, being Convened at the Revd mr. Colmans Meeting- House in Boston Aforesaid, on Monday the 10th day of March 1711-12.
