[Abstract.] To all people to whom these presents shall come, greeting, know ye that I, Elias Hand, of the town of East-Hampton, &c., yeoman, for and in consideration of the sum of forty-two pounds to me in hand, paid by Jeremiah Osborn, of the same place, tanner, have granted and sold unto the said Osborn and his heirs forever, all my right at Montauk, it being three pounds estimate, as it now stands, at forty pounds a whole share, to have and to hold the same forever, and do warrant and defend.

Fordham, Ephraim Howel, Edward Topping, Samuel Le- hommedeiu, Thomas Foster, John Russel, Elias Pelletreau, George Mackey, James Haines Jr., William Hallock, Joseph Marshall, Matthew Jagger, of Southampton, and Abraham Gardiner, Stephen Hedges, Abraham Miller, Burnet Miller, Jeremiah Hedges, John Davis, Thomas Wickham, William Hedges and Isaac Barns, of East-Hampton, and William Nicoll, of said county, desiirng the liberty to build a wharf at the place called and known by the name of Sagg Harbor, for the more convenient carrying on of trade and navigation, do fully, freely and absolutely give, grant convey, and unto the above named John Foster, William Jones &c., and to their heirs and assigns forever, full and free liberty to build and maintain a wharf at Sag-Harbor, thirty-five feet wide, beginning at Southampton east patent line where Sonthampton grant for said wharf ends, and to run northeasterly thirty rods, and to have sixty feet of water on each side of the wharf, on these condition only, that said wharf be completely built and finished at, or before the end of three years from the date hereof, and that all persons shall have liberty to pass and repass on said wharf, with their carts or other carriages, they not unnecessarily or obstructing the abovesaid grantees in the free and sole use and benefit of said wharf, always provided said wharf be kept under the follow- ing regulations, (Viz.) that for this present year the committee Burnet Miller, Thomas Sandford, Nathan Fordham, Jr., and Silas Howel shall have the sole ordering thereof, and the pro- tors of said wharf, annually to choose a committee of the most suitable persons of said proprietory grantees, to manage the whole affair of said wharf, and that the fare, custom or wharfage of said wharf shall be according to the custom ot other places, and said wharf to contain forty rights, reckoned at twenty pounds a right. and no person to be allowed as a voter, but what is entitled to a whole share, and that the profit

arising from said wharf shall be divided to each proprietor according to their right, annually or once a year by the per- son that takes the fare, excepting what is wanting to repair said wharf. To have and to hold all the above granted prem- ises, with all the privileges and appurtenances thereunto be- longing under the above conditions and restrictions as above expressed. In witness and confirmation whereof, we, the subscribers, in the name and behalf of the proprietors of the town of East-Hampton, and as Trustees have hereunto set our hands and fixed our seals this 12th day of February 1770.

The commissioners for laying highways, laid out a passing highway from the road or highway that leads from the head of Duck Creek to the head of Hog Creek, turning out and beginning at a hollow near or a little to the westward of the middle of the northwest end of John Mulford's lot, straight down from said hollow to the Flaggy hole. Said highway to be two poles wide, through the land of John Parsons, for which highway the said John Parsons hath received in hand

Whereas there was a high- way allowed Timothy Miller through the land of John Par- sons, about which place it should be in, they disagreed ; we the Commissioners, viz : Samuel Parsons and John Dayton, Jr., have laid out a passing highway across the land of John Parsons, beginning forty poles from the head of John Parsons, beginning forty poles from the head of Hog creek southwest, then to turn northwesterly to the land of said Timothy Miller the same to remain a passing highway for the said Timothy Miller, his heirs and assigns forever as reported, per SAMUEL PARSONS, JOHN DAYTON, JR., Commissioners.
