Book G. page 145 .- September the twenty-fourth in the year of our Lord one thousand seven hundred and thirty-five it was agreed by the Commissioners of the Town of East- hampton, for the laying out of highways in Easthampton, that there is and shall be a highway consisting of two rods wide through the land that was laid out to Benjamin Os- born in Acabonick neck along down by the southwest side of Aron Fithian's land down to the northwest end of Josiah Miller's meadow, and from thence to consist of one rod and a half wide through Aron Fithian'sland is the usual place down to the meadow of John Davis, they the said Aron Fithian and Benjamin Osborne or their assigns always the said Aron and Benjamin Osborne and their assigns have liberty for to set up each of them a swinging gate for the preservation of their grass and corn, alwaysprovided that the said Benjamin Osborne or his assigns do clear the said two poles highway, that it is sufficient and suitable for riding or carting from the meadows the said highway or if otherwise the common passing or path to be used as formerly allowing the old path to consist of two rods wide as abovesaid and the same to remain a highway forever. Book G, page 148 .- Know all men by these preseuts that I, Benjamin Osborne of Easthampton, in the County of Sut- folk and Province of New York, Yeoman, have assigned, or- dained and made and in my stead and place have put and constituted my trusty and well-beloved friend William Hedges Jr. of the Town, County and Province abovesaid to be my true and lawful attorney for me and in my name and to my use to sell, alien, convey and confirm unto any person or per- sons whatsoever, all my housing, lands and tenements and edifices in or about the Town of Easthampton, and to make such deeds and conveyances as shall be needful for the same, and to sign, seal and deliver such deed or deeds as fully, amp- ly as I myself could do if I were personally present, giving and granting unto my said attorney by the tenor of these presents my full and whole power, strength and authority in aud about the premises and all and every other act and acts, thing and things, device and devices in the law whatsoever needful and necessary to be done in, and about the premises for the disposal and sales of any such lands, tenements, and edifices aforesaid for me and in any name to do, execute and perform as fully and largely and amply in every respect to all intents, constructions and purposes as I might or could do if I were personally present, ratifying, allowing and holding firm and stable all and whatsoever my said attorney shall lawfully do in or about the premises by virtue of these presents, in witness whereof I, the said Benjamin Osborne have here mto set my hand and fixed my seal this twentieth day day of No- vember 1735, and in the ninth year of the reign of our sover- eign Lord George the second &c.

Book E, page 12 .--- The proprietors of Meantauk being legally warned and met together February the 27th 1735-6 and did then agree by major vote to leave the whole manage- ment of Meantauk for the term of one year from the date above said to five men namely Capt. Matthew Mulford Eliph- elet, Stretton, Daniel Osborne, Lion Gardiner and John Merry, and what the said committee or the major part of them shall do as above said shall be good and effectual as if the whole had done the same. The proprietors of Meantauk being met and assembled on the day above said and did then agree by major vote that all horse kind that shall be found grazing on Meantauk for the time and term of one whole year from the date abovesaid not having right or not being duly entered or listed according to order of said committee shall and are liable to be impounded the owner or owners of all horse kind so impounded paying five shillings current money for each horse kind so impounded as above said.
Also agreed by major vote that it is and shall be lawful to impound all neat cattle that shall be found grazing on Mean- tauk not having right for the same for the time of one whole year from the date above said according as it shall be stinted the owners of all such cattle so impounded paying five shill- ings for every neat beast so impounded.
Also agreed on by major vote that it is and shall be lawfull to impound all swine that shall be found grazing on Meantauk for the time of one whole year from the date above said the owners of all swine so impounded paying three shilling for each swine so impounded the Indians swine only excepted they not exceeding their number.
Also agreed by major vote that it is and shall be lawfull to impound all sheep that shall be found grazing on Meantauk for the time of one whole year from the date above said not having right for the same according to the stint the owners paying six pence for each sheep so impounded.

And the same penalty for impounding each horse kind neat beast sheep or swine that shall be found grazing in the fatting field or sheep pasture not having right for the same or with- out liberty from the committoe above said and two shillings for impounding each weaned calf out of the fatting field aud the same penalty for impounding each neat beast or weaned calf not being duty entered according to the order of the committee above said.
Also agreed on by major vote that the fence at the hither end of Meantauk to begin at common high water at the south side or sea and so to run across to the north side or sound the said fence to be three fert and ten inches high from the south side to the north side and to run iuto the north sea or sound until the water is three feet deep at the end of the said fence shall be a sufficent and Lawfull fence.
Also agreed on by major vote that the fence that is near Clabord hill is to run from the clift or bank on the south side to be four feet high from the said clift across to the north side or sound and to run into the said sound until the water is two feet deep at the end of said fence shall be a sufficient and lawful fence.
Also afireed on by major vote that the fatting field fence shall begin at highwater mark at the south sea and continue four feet high to the other end of the same shall be a lawful fence.
Also agreed on by major vote that all small stone horses run- ning or at Meantank having two winters past over them are and shall be liable to be gelt by the 25th day of April after the date above said the owner or owners of all such horses so gelt paying according to the act of assembly made for that intent.
Also agreed on by major vote that four weaned calves shall be equal to one neat beast in the common pastures or in the fatting field.

shall cut down or any ways destroy or carry off any timber or any fencing stuffon or off of Meantauk from the time of one whole year from the date above written on the penalty of paying for the same according to the act assembly made and provided on respect without liberty from the committee above said.
Page 122, -- Also agreed on by major vote of the proprietors of Meantauk February the 57th 1735-6 that, if any horse kind neat cattle sheep or swine be found grazing in the Indian field after the said field is shut up until the fatting cattle be put into the said field excepting the Indians own Creatures not exceeding number may and are liable to be impounded the owners of all such horse kind neat cattle sheep or swine pay- ing five shillings for each horse kind or neat beast so im- pounded and three shillings for each swine and six pence for each sheep so impounded such creatures being only excepted having liberty from the commitee also agreed on by major vote on the day above said that the committee above said may sue such persons as have their creatures on the land of Mean- tauk without liberty, if not impounded.
Also agreed on by major vote that if any horse kind be legally impounded off of Meantauk at any time of one whole year from the date above said and the owner or owners there- of cannot be found within forty-eight hours after they are impounded or no person will appear in that time and pay the poundage as above said that in such case all such horse kind so impounded may be sold at a public outcry and after the poundage with all damage and charge of sale be deducted the over-plus to be returned to owner if he can be found: or if any person have notice given him of their horse or horse kind being impounded and will not appear and pay the poundage in forty-eight hours after notice given him may be sold in man! ner as above said.

Also agreed on by major vote that all horse kind that shall be found grazing on Meantauk after the 25 day of De- cember to the first day of March in the year 1736 shall be and are liable to be impounded the owner or owners of all horse kind so impounded paying five shillings for each horse so impounded.
Also agreed on by major vote that seventy neat cattle shall be the whole number to pasture one whole share on Mean- tauk for the year above said and that seven sheep shall be the number to go on the land in the room of one neat beast and one horse kind in the room of two neat cattle. Also agreed on by major vote that the committee have full power to agree with John Merry to keep the sheep flock at Meantauk for the time and term of five years and to allow him the use of some land for his so doing as they shall think convenient. Also agreed by major vote that the committee have full pow- er to put a man at the fatting field for the term of one year and no longer.

Book G, 145 .- Whereas there was an act of General Assembly made in this colony in the year 1732 for the clear- ing and laying out of public highways in the County of Suffolk and whereas in one clause of said act it is expressed that no highway shall be laid out through any particular man's land without the consent of the owner of the said land or paying all damages that the owner of said land shall suffer by the said highway being laid out through his land and whereas we the commissioners for the Town of Easthampton did lay out a highway in Acabonick neck through the land of Benjamin Osborne and through the land of Aron Fithian down to the meadow of John Davis without the consent of the owners of said land contrary to the said act of Assembly the said highway bearing date September the 24th, 1735, as you may see here under written, and now for the preventing of any contention or trouble that may hereafter arise concerning the said high- way, we the Commissioners underwritten do make void and null the said highway with every article therein contained as absolutely as if we had never done the same, as attest our hands the sixteenth day of March 1735-6.

It being our election day and were then chosen for Trustees as followeth, viz. twelve Trustees two Constables and two Assessors : Daniel Miller, Joseph Conkling, Edward Jones, John Hedges, Jr., Thomas Mulford, Nathanies Baker, Capt. Page 133 .- At a town meeting held in East-Hampton April the 6th 1736. It was then agreed on by major vote of pro- prietors of all undivided land in this town that there shall be a division of land in this town consisting of ten acres to one acre commonage on the north side in Acabonick Neck, Ayle wife Brook Neck or else where on the North Side to be laid out each neck in a division and that the trusteas have full power for to lay out the same as they shall see cause and to get men to assist them as they shall have occasion.
Notwithstanding the above written signifies two divisions it was and is by the vote to be understood to be but one di- vision in the whole. The abovesaid vote was deliberately read in the town meeting and past in the affirmative as attest CORNELIUS CONKLING, Town Clerk.

vote of the proprietors of East-Hampton then met together that all horse kind that shall be found grazing in or on this town commons westward of Meantauk not being sufficiently side fettered shall be hable to be impounded the owners of all such horses so impounded paying one shilling for each horse so impounded.
Book E, page 14 .- At a legal town meeting held in East- Hampton April the 6th 1736.
It was then agreed on by major vote of the proprietors of all undivided land belonging to this town that there shall be a division of land laid out in this town consisting of ten acres to one acre commonage on the north side in Acnbonick Neck and in Aylewife Brook Neck or elsewhere on the north side to be laid out and that the trustees of this town have full power to lay out the same and to get men to assist them in the do- ing of the same as they may have occasion and to be laid out in one division. The proprietors of the land abovesaid being met together April the 12th 1736. And did then agree by major vote that the said division of land abovesaid all shall be laid out in thirteen acre lots of Commonage so that there will be at least one hundred and thirty acres in one lot and where- as some of the lots may not be so good land or not be so well timbered as the best of them are, then and in such case the per- sons that lay out the said lots shall make additions to the poor lots by laying out or adding more land to them to mike them equal with the best and whereas there will be several men's proportion of land laid out in one of said lots that he that hath the greatest quantity in said lot shall draw a lot for the whole lot and if the persons concerned in such lots can agree to di- vide the same within two months after the lots be laid out well. But if they cannot agree to divide the said lots then the trustees or the persons that laid out the same have full power to subdivide the said lot or lots allowing to each man con-

cerned in the same their part and proportion in quantity and in quality according to the best of their power.
The abovesaid votes are a true record as it was voted on the day abovesaid none opposing or voting to the contrary.

The abovesaid division of land was laid out by the order of the trustees of the freehoiders and commonalty of the town of Easthampton by Nathaniel Dominy Junior and several other men assisting him in laying out the same and the proprietors of this town common or undivided land being lesally met to- gether June the fourth day 1736 and did then draw lots for the same and it came out as followeth : John Davis with his partners being the first lot in Acabonick Neck.
1. John Davis 66 acres 19-4 p. Jonn Evans, 11 acres 2-30 p. Lion Loper, 10 acres. John Merry, 41 acres 2-10 p. This first lot is bonnded northerly, eastwardly and westward- ly by highways, and southerly by William Hedges lot.
2. William Hedges, 130 acres, bounded eastwardly and westwardly by highways and southerly by the third lot and Northerly by the first lot.
3rd-lot. Ananias Conkling, 25 acres 10 p. John Parsons, the 4th, 90 acres 2-10 p. Nathan Miller, 14 acres 4-30 p. This lot is bounded eastwardly and westwardly by highways and southerly by the fourth lot and northerly by the second. lot.
4th lot. 10th lot. Nathaniel Baker Jr., 164 acres. This lot is bound- ed westwardly and eastwardly by highways and northerly by the ningh lot and southerly by the thirty-ninth lot.
11th lot. At Hog Creek from said creek to the flaggy hole. Thomas Ewards, 123 acres and ¿. Isaac Barnes 50 acres and 2. The proprietors, 2 acres and }. Thomas Brown 2 acres and . Thomas Edwards eastw ard by the Hog Creek Isaac Barnes next to him, the proprietors next, Thomas Brown next and joining to the flaggy hole. Bounded in general by said creek and the clift northerly and westerly and partly by a highway. Next the lots layed out in Aylewife Brook Neck from Sedar Point eastward to the Hands Creek.

13th lot. William Edwards and Ebenezer Edwards, 60 acres. Giddion Hedges and his mother both together, 70 acres. This lot is bounded westwardly by the twelfth lot and and eastwardly by the fourteenth lot and northerly by the cliff and southerly by the highway.
Book E, page 15 .- 14th lot. Seth Parsons with part of the pond, SS acres. John Parsons with part of the pond, 32 acres. Noah Barnes 20 acres. This lot is bounded west- wardly by the thirteenth lot and eastwardly by the fifteenth lot and northerly by the cliff and southerly by the highway.

Seth Parsons twenty-one poles wide by the front and so comes to nothing, a half mile long from the front bounded southerly by a highway, easerly by Thomas Talmage and westerly by the fourteenth lot and northerly by by the cliff this last above Seth Parsons bought of George Smith Thomas Talmage part and the heirs of Capt. Talmage both together in this lot is 120 acres. Cornelius Conkling thirty three poles. 16th lot. Mr. Nathaniel Hunting 130 acres. This lot is bounded westwardly by the fifteenth lot and southerly by a highway, northwardly by the cliff and eastwardly by the seventeenth lot.
17th lot. The heirs of Capt. Talmage deceased, 65 acres. Widdow Catterine Talmage, 10 acres. Daniel Petty, 2 acres and a half. The proprietors 2 acres and a half. John Hed- ges 50 acres. This lot is bounded westward by the sixteenth and southwardly by a highway, northerly by the cliff and eastwardly by the eighteenth lot.
