Voted Ist. That six hundred dollars be raised and levied for the maintenance of the poor of this town for the ensuing year.


2d. That the yards of Samuel L. Mulford, Baldwin C. Tal- mage and Elisha Conklin be pounds.


3d. That the front slip on the south side of the meeting house be granted to the use of Mr. Phillips, and that the same number of pews and slips be hired out as were the last year, and the money arising therefrom be applied towards the payment of the salary of Mr. Phillips, after paying out of the same the necessary expenses of the meeting house, and those expenses to be under the direction of the trustees.


4th. That the trustees be requested to take care of the meeting house and prosecute all persons who shall do any in- jury to the said house in any manner whatever, and also employ some suitable person to shut the doors and windows of the same and ring the bell.


5th. That the fence viewers be entitled, as a compensation for their services, a dollar per day.


6th. That if any person or persons shall keep any flock of sheep or suffer their sheep to be on the commons or high- ways of this town after the twentieth day of this month until the twentieth day of March next, all such shall be liable to be impounded, Wainscott flock excepted, and that to be under the care of a shepherd approved of by the trustees.


7th. That all horses and neat cattle that shall be found grazing or running at large on Napeague or any of the beaches on the south from the hither end of Montauk to the western bounds of this town at any time between the sixth day of

May and the twelfth of September next ensuing, shall be liable to be impounded, provided there be sufficient fence, the own- er or owners of all such neat cattle or horses to pay fifty eents per head for all such neat cattle and horses so im- pounded.


8th. That if any person or persons not inhabitants of this town shall be detected in catching eels in any of the bays, harbors, creeks or ponds of the same, he, she or they so of- fending shall, for every such offense, forfeit and pay the sum of ten dollars and eighteen cents for each and every dozen so caught, to be recovered with costs of suit in any court having cognizance thereof, by any person or persons who shall prose- cvte the same to effect, the one-half of which forfeiture, when recovered, to be paid to the overseers of the town for the use of the poor of this town, and the other half to the person or persons who shall prosecute for the same, as aforesaid.


9th. That the horses and sheep be permitted to run at large on the commons and highways of this town as they have heretofore done.


10. That the cattle be prohibited from running at large on the commons and highways of this town, from the time that they are brought from the land of Montauk in the fall or win- ter of the year until they are permitted to go on the said land again in the spring.


11. That the highways of this town be repaired by esti- mate.


12. That all the meadow grass between Indian well and the foot of highland. Also three other lots of meadow grass to the eastward of highland on the south side of the Montauk road, the meadow grass at Georgica and the sedge flat at Accabonac, be hired out at vendue, and the said grass was hired out accordingly, in the following manner, and the pay . ment to be made on the first day of September next.

Josiah Mulford, William Hedges, Zephaniah Hedges, and Samuel Miller, Trustees of the Freeholders and Commonalty of the town of East-Hampton, the receipt whereof I do here- by acknowledge, have bargained. sold, and quit-claimed, and by these presents do bargain, sell and quit-claim unto the said Trustees of the Freeholders and Commonalty of the said town of East-Hampton, and to their successors in office for the use and benefit of the Freeholders and Commonalty of the said town of East-Hampton, all of my right, title, interest, estate, claim and demand, both in law and equity and as well in possession as in expectancy of, in and to that certain tract or parcel of common land situate and lying in the said town of East Hampton, at a place known and distinguished by the Northwest landing, bounded as follows, to wit: southwest- wardly partly by the meadow land of the said David V. Scoy and partly by that of John Terry, northerly and westerly by the waters of the inlet of Northwest creek, northerly or east- erly by the highway, as may more fully appear by a diagram of the highway leading from Powder or Mile Hill down to the said landing place, the southwestwardly boundary of the said common land between the meadow of the said David V. Scoy and that of the heirs of John Terry, being a certain range or line of stakes fixed by the said Trustees and assented to by me the said David V. Scoy as hereafter to be a permanent line or boundary between the common land of the Freeholders and Commonalty of the town of East-Hampton and the meadow land of the said David V. Scoy, as may appear by the above- said diagram, recorded in the Town Clerk's office of this town, with all and singular the hereditaments and appurtenances thereunto belonging or in anywise appertaining.

Scoy, his exec- utors, administrators and assigns, from the within date, for and during the full end and term of twenty years, from thence next ensuing and fully to be complete and ended, yielding and paying therefore yearly and every year during the said term unto the said Trustees and their successors the sum of one cent, provided always, nevertheless, and it is the true in- tent and meaning of these presents and the parties hereunto, that the said Freeholders and commonalty of the said town of East-Hampton shall have liberty to cart wood over and lay wood on the said common land and use the same in any man- ner and way that the said Freeholders and Commonalty of the town shall deem proper (except to mow the grass pro- vided any should grow thereon) without let, molestation, suit, trouble, eviction, expulsion or interruption of or by him the said David V. Scoy, his heirs or assigns, or by any other person or persons claiming or to claim, by, from or under him, them or any of them, but in case any grass shall grow on the said common land, against the land of the said David V. Scoy, then and in that case the said David V. Scoy, his executors, administrators or assigns shall have the exclusive right and privilege of mowing the grass that shall grow on the said common land without let, molestation, suit, trouble, eviction, expulsion, or interruption of any person claiming or to claim under the Trustees of the Freeholders and Common- alty of the said town of East-Hampton for and during the term of twenty years from the twentieth day of October, one thousand eight hundred and twenty-eight.
