Book G, page 224 .- At a meeting of the Commissioners of Highways of the town of East Hampton, in the county of Suffolk, held in said town on the seventeenth day of June, in the year 1848, all the said commissioners having met and de- liberated on the subject of this order, it appearing to the said commissioners that the road in the said town used as a high- way commonly ynown at the present time as Dayton's Lane, has been used as a public highway for twenty years, and upwards, next preceeding the twenty-first day of March, 1797, and which has been worked and used as such constantly for the last six years, but has not been recorded, it is ordered by the said commissioners that a part of the said road be ascertained, described and entered of

record : and the said commissioners do further order that the description, courses and distance of the said part of the said road be according to a survey which they have caused to be made of the same, a plot of which survey is hereunto an- nexed, and referred to in this order as follows :


Beginning at a stone at a corner called Giles' corner, on the said plot marked by the figure 1, running thence, north 71 degrees east 4.60 chains, and passing near to a wind-mill now owned by David A. Hedges, to a stake and stones on the said plot marked by the figute 2, thence north 75 degrees east 12.81 chains to a stake and stones on the said plot marked by the figure 3, thence north 782 east 10.35} chains, passing the house of Capt. Edward M. Baker through a post at the north-east corner of a door-yard in front of the said house, and extending to a stone placed in the ground four links northerly from the north-east corner of a barn belonging to the said Edward M. Baker, on the said plot, marked by the figure 4; thence the survey is continued at a right angle with the last mentioned line across the road hereby in part ascer- tained, 1.97 chains to a stake and stones placed in the line of tle land of David Baker, on the said plot marked by the figure 5, running thence south 70 deg., west in front of the house of the said David Baker, S.6S chains, to a post in the fence, 16 links southerly from the southeast corner of the house of David A. Hedges, marked on the said plot by the figure 6, thence south 772 deg., west 3.49 chains to the corner of said David A. Hedges' land, marked on the said plot by the figure 7, thence south 80 deg. west 4.50 chains to a post fourteen links southerly from the southeast corner of the house of Henry D. Stratton. marked on the said plot by the figure 8, thence south 722 deg. west passing in front of the house of Jacob Hedges 7.02 chains to the corner of the said Jacob Hedges' land, near the blacksmiths shop of Sidney Stratton marked on the said plot by the figure 9, thence south

Book G, page 227 .- At a meeting of the Commissioners of Highways of the town of East-Hampton, in the County of Suffolk, held in the said town at the office of the town clerk on the twenty-sixth day of December, in the year 1848, (all the said commissioners having met and deliberated on the subject of this order) it appearing to the said commission- ers that a road in the said town used as a highway, and leading from Northwest to a turnpike, which is known as the East-Hampton and Sag-Harbor turnpike, has been used as a public highway, for twenty years and upwards, next preceed- ing the 21st. day of March, 1797, and has been worked and used as such constantly for the last six years but has not been recorded, it is ordered by the said commissioners, that a part of the said road be ascertained, described and entered of record.


And the said commissioners do further order that the de- scription, courses and distances of the said part of the said road, be according to a survey which they have caused to be made of the same, a plot of which survey is hereunto annexed and referred to in this order as follows :

Voted that the sum of fifteen hundred dollars be raised for the support of the poor, and one hundred and twenty dollars for the contingent expenses of this town for the year ensuing.


Voted that the meadow grass and the Jeremiah Loper Mon- tauk be hired out this day at auction and the money arising for the hire of the grass be paid to the supervisor, and that for the Montauk to the overseers of the poor, before the 1st day of September next.


Voted that any fence equal to two rails with posts that are three feet eight inches high in the clear shall be considered a sufficient fence.


Voted that the same number of pews and slips, etc., as in 1846.


Voted that all sheep found grazing or running at large on any of the streets, highways, common lands or town commons of this town at any time during the year ensuing shall be liable to be impounded, the owner or owners of such sheep to pay 25 cents per head for every sheep so impounded to be recov- ered with cost of suit in any court having cognizance thereof, by the person or persons impounding such sheep who shall be entitled to one half of the money when recovered, and the other half to be paid to the overseers of the poor for the ben- efit of this town's poor.

Voted that all horses or neat cattle that shall be found run- ning at large on the commons of this town from the time they are brought from Montak in the fall until they go on again in the spring shall be liable to be impounded, the owner or owners of all such horses or cattle to pay one dollar per head to be recovered with cost of suit by the supervisor, the one half of the money to be paid to the complainant and the other half to the overseers of the poor for the benefit of the town poor.


Voted that all horses or neat eattle that shall be found graz- ing or running at large on Napeague or any of the beaches on the south side from the hither end of Montauk to the western bounds of this town at any time between the 6th day of May next and the 12th day of September ensuing, shall be liable to be impounded, provided there be a sufficient fence, the owners of such horses or cattle to pay 50 cents per head for each horse or neat beast so impounded, the whole of the money to go to the person or persons impounding such horses or cattle.


Voted that no persons shall be entitled to seaweed or drift in consequence of heaping it on any of the shores of this town.


Voted that no person or persons shall rake, pick or gather any cranberries on any of the lands or meadows belonging to this town at any time before the second Monday of Septem- ber next, at sunrise, and that every person so offending shall forfeit the sum of ten dollars for every such offence, and the further sum four dollars per bushel, or at that rate, for a smaller quantity, for all cranberries so gathered, to be re- covered with cost of suit before any court having cognizance therof which forfeiture when so recovered to belong to the person who shall prosecute for the same, and the Trustees of the town be particularly instructed to carry this motion into effect.

town shall be permitted to rake, pick or gather any cranber- ries or beach plums on any of the lands, beaches or meadows belonging to this town, and that every person so offending shall forfeit ten dollars for every such offense and the further sum of four dollars per bushel, and at that rate for a less quantity of cranberries or beach plums so gathered, to be re- covered with cost of suit before any court having cognizance thereof, which forfeiture when recovered to belong to the per- son or persons who shall prosecute for the same.


Voted that no person shall be allowed to turn out or allow any stone horse over one year old to run at large in this town at any time during the year ensuing, under penalty of ten dollars for every such offence.


Voted that overseers of the poor be authorized to purchase a suitable place for the accommodation of the town's poor, and to collect the debts due the town and appropriate the money towards the payment thereof and to hire more mor ey on the towns credit if necessary in order to pay the whole purchase.
