4th. That the Trustees be authorized and empowered to take such measures as they or a majority of them shall deem proper to ascertain the boundary line between the town and the land of Montauk.
5th. That if any person or persons shall cut or carry off of any of the common land at the east end of Napeague any tim- ber, wood, bushes or grass, he, she or they so offending shall forfeit and pay five dollars for every tree or bush so cut and carried off as aforesaid, and one dollar for every hundred of grass or hay so cut or carried off as aforesaid, to be recovered with costs of suit before any court having cognizance of the same, the one-half to be paid for the benefit of the person or persons who shall prosecute for the same to effect, and the other half for the support of the poor of this town.
6th. That the Trustees erect mile stones on the road from town to Sag Harbor.
7th. That the Trustees be authorized to supply Mr. Beech- er with firewood, by a tax or in such other way as they shall judge equitable.
8th. That all the meadow grass between Indian well and the foot of high land be hired out to mow and not to pasture, and hired it as follows :

Voted by the proprietors of Montauk that the Trustees shall have the management of Montauk the present year as usual.
At a meeting of the proprietors of Montauk held at the town house at East Hampton on Monday the 20th day of July, 1807, previous notice being given by advertisement,
Voted 1st. That Abraham Miller be moderator and Jere- miah Miller, clerk of this meeting.
Voted 2d. That a committee of three be chosen to present the deeds, writings, etc. of the proprietors of Montauk to the commissioners appointed by the legislature of this state to in- quire into the grievances complained of by the Montauk In- dians, and that Abraham Miller, Jonathan Dayton and Jere- miah Huntting be said committee.
Voted 3d. That the Trustees of this town be authorized to make a new agreement with the Montauk Indians respecting their privileges on said land, if they the said trustees shall think proper, subject to the ratification of the proprietors of Montauk.
4th. That a committee of five be appointed, on the part of the proprietors of Montauk, to ascertain and fix the boundary line between the town and the land of Montauk, and that Miller Dayton, Edward Mulford, Abraham Miller, Huntting Miller and Samuel Mulford, be said committee. the subscribers, commissioners of highways of the town of East Hampton, to let them have the two rod highway be- tween this town and Southampton, that runs down to the water in rear of their lots and the lots of others, the boundary line between the two towns running through the middle of said highway, for which they will give to this town a high- way to the eastward of the said two rod highway. We have by the approbation of the Trustees of this town agreed to ex- change with them, and have in conjunction with the com- missioners of Southampton, executed a quit claim to the said Daniel Fordham, Hubbard Latham and Henry P. Dering, for the said highway, and they have executed a deed to this town for a tract of land which they purchased of David Russel, at Sag Harbor, in the bounds of this town, bounded as follows, viz : beginning at a stone set in the ground five feet eastward of the north corner of David Gelston's door yard, and running north sixteen degrees west, eight chains and twenty-six links, to a red cedar post on the beach, thence north sixty-three de- grees west one chain and two links to a stake, thence south seventeen degrees east, eight chains and ninety-one links to a stake, thence north seventy-five degrees east, fifty-five links to the place of beginning, to be and remain a public highway forever.

Book G, page 182 .- This indenture made the fifth day of September, in the year of our Lord one thousand eight hund- red and eight, between Abraham Miller, David Hedges, Isaac Barns, Mulford Hand, Joseph Barns, Miller Dayton, Hunt- ting Miller, Benjamin Miller, Josiah Mulford, David Talmage, Jr., John Strong, Jr., and John Miller, Jr., trustees of the freeholders and commonalty of the town of East-Hampton, in the county of Suffolk and State of New-York, of the first part, and the people of the State of New-York of the second part, witnesseth that the said party of the first part for and in consideration of the sum of one hundred dollars, lawful money, of the United States, to them in hand paid, by the said party of the second part, the receipt, whereof, is hereby acknowl- edged, have granted, bargained, sold, released and confirmed, and by these presents do grant, bargain, sell, release and con- firm unto the said party of the second part, a certain tract or parcel of land covered with water at a place called Sag-Har- bor, in the township of East-Hampton, and bounded as fol- lows : southwardly, upon the end or head of the Sag-Harbor wharf and extending northwardly, from each corner of the end or head of said wharf, three hundred feet parallel with said wharf and extending in breadth sixty feet on the east side and sixty feet on the west side of the above described tract of land covered with water, which said tract of land and water is conveyed to the people aforesaid, for the purpose of making piers, wharves or other accommodations for shipping at the part of Sag-Harbor, aforesaid, in pursuance of the act entitled "an act for making further provisions for improving the navigation between the villages of Troy and Waterford,

and for other purposes, passed March 19th, 1803," to have and to hold the said granted and bargained premises, with the appurtenances, to the said party of the second part, with all the right, title, claim or demand whatsoever, of the said party of the first part, of, in and to the same for so long a time as the said piers, wharves or other accommodations, shall be preserved for the uses aforesaid. In witness whereof, the said party of the first part have hereunto set their hands and affixed their seal of incorporation the day and year first above written.

Miller is to get out of the parsonage wood land, thirty lengths of a two rail fence and put it up on said parson- age at his own cost, and is allowed to get posts out of said woodland to mend the board fence round said parsonage, and when pasturing the pasture land he is allowed to bring his cows home nights, for which he is to carry onto said parson- age lands two loads of dung.
4th. That if any person or persons shall keep any flock of sheep or suffer their sheep to lay on the commons of this town after the twelfth day of this month until the twentieth day of March next, all such sheep shall be liable to be pounded, and the owner or owners of all such sheep shall pay one shilling for each sheep so pounded-Wainscott flock excepted, and they to be under the care of a shepherd approved by the trustees.
5th. That no person or persons shall be permitted to draw a sein or seine in the pond called Alewive Brook pond, unless they shall first obtain liberty of the trustees of this town under the penalty of fifteen dollars for each draft of a seine or seines as aforesaid, to be recovered with costs of suit by any person or persons who shall prosecute for the same to effect before any court having cognizance thereof, the one half of all which forfeitures when recovered to be for the benefit of the person or persons who shall prosecute for the same to effect, and the other half for the benefit of the poor of this town.

Book G, page 192 .- In the name of God, amen, I, William Parsons, of East-Hampton, in the county of Suffolk and State of New-York, being weak in body but of sound and perfect mind and memory (blessed be Almighty God for the same) do make and publish this, my last will and testament, in manner and form following, that is to say : first, I give and bequeath to my son, William Parsons, of Stillwater, in the county of Saratoga, one hundred and twenty-five dollars in cash. And lastly, as to all the rest, residue and remainder of my estate, both real and personal of goods and chattels of what nature and kind soever, I give and bequeath the same to my son, Abraham Parsons, his heirs and assignes forever.
I do further will and ordain that he, my son, Abraham Parsons, pay all my legacies and lawful debts.
I do hereby appoint my son, Abraham Parsons and my
