David Hedges and Samuel Dayton, therefore we, the sub- scribers, commissioners of highways for the town of East- Hampton, in the County of Suffolk, having viewed and ex- amined the said highway and deem it necessary and proper that the same should remain, and continue as a public high-

way in pursuance of the act entitled "an act to regulate highways," passed March 19th, 1813, beginning at the Fire- place highway and running between the land of Capt. David Hedges and that of Samuel Dayton on the south, and the land of Samuel Parsons and Jeremiah Dayton on the north, the said highway to be and remain four rods wide the whole length of the same. And we, the commissioners, do hereby authorize the Town Clerk of the said town to make a record hereof, according to law.

2d. That seven hundred dollars be raised by tax for the support of the poor of this town for the year ensuing.
3d. That Nathaniel Dominy be sealer of weights and meas- ures for this town, agreeablp to a statute of this state in such case made and and provided.
4th. That the trustees hire out the pews in the meeting house and the money arising therefrom be applied towards the payment of Mr. Phillips' salary.
5th. That if any person or persons shall keep any flock of sheep, or suffer their sheep to be on the commons of this town, or on the highways of the same, after the twentieth of this month until the twentieth day of March next, all such

sheep shall be liable to be impounded, the owner or owners of such sheep to pay one shilling for each sheep so impound- ed, Wainscott flock excepted, and that to be under the care of a shepherd, to be approved of by the trustees of this town.
6th. That all horses and neat cattle that shall be found grazing or running at large on Napeague, or on any of the beaches on the south side from the hither end of Montauk to the western bounds of this town at any time between the sixth day of May and the twelfth day of September next en- suing, shall be liable to be impounded, the owner or owners of such neat cattle and horses to pay fifty cents per head for all such cattle or horses so impounded.
7th. That if any person or persons shall hire out or give liberty to any other person or persons not inhabitants of this town nor having any right in the commons of the same. any privilege or liberty to dig, catch or take any clams, fish or eels, in any of the bays, creeks, or ponds, belonging to this town, he, she or they so offending shall forfeit and pay for every such offense, the sum of five dollars, to be recovered with costs of suit in any court having cognizance thereof, and one dollar per bushel for every bushel of clams so dug or caught, the one half of which forfeiture when recovered shall go to the person or persons who shall prosecute the same to effect, and the other halt to be paid to the overseers of the poor of this town for the use of the poor of the same.
Sth. That the bill which Dr. Abel Huntington has against Edward Bennet, Jr., and Nancy Bennet, deceased, for medi- cal services, be paid by this town.
9th. That all the meadow grass between Indian Well and the foot of Highland be hired out for one year, to mow but not to pasture, and also the meadow grass at Georgica, and the same was hired out as follows, and payment to be made for the same on the first day of September next ensuing.

Scoy and James Hand, be the said committee.
5th. That the money now in the hands of the overseers of this town unappropriated, or so much thereof as may be nec- essary to procure the standard of weights and measures from this county for the use of this town, shall be applied for that purpose.

That the subject of the supposed land enclosed by Mr. Jonathan Mulford, Jr., belonging to the meeting house, be referred to the committee appointed to ascertain the quantity, situation and estimate the value of the common lands belong- ing to this town, and in case the said committee after investi- gation are of the opinion that the land in question belongs to the said Mr. Mulford, they are hereby authorized to purchase the said land of him, after a fair valuation of the same is made by persons indifferently chosen by the said committee and Mr. Mulford.

3d. That four slips be hired out in addition to those already hired out, (which was accordingly done) and the money for which they are hired, be applied towards painting the meet- ing house.
4th. That a committee of three be chosen to procure the standard of weights and measures for this town, and Samuel Miller, Nathaniel Dominy and Abel Huntington be, and they are hereby appointed the said committee.
5th. That Joshua Penny be allowed the use and privilege of the sedge which he set out on the flat, near the mouth of Three Mile Harbor, during his residence in this town.
6th. That Abraham Parsons, Jr., be authorized to repair the pound, and keep it in repair, for the year ensuing, at the expense of the town, and that money be levied and collected in the same manner that other money is levied and collected for other contingent charges of the said town.
7th. That the yards of Lewis Edwards, Nathaniel Hand, Jr., and Elisha Osborn, Jr., be public pounds.
Sth. That lots numbers 7 and 8 on Napeague, or the glades so called, which have heretofore been hired ont, be referred to the trustees to proceed, in relation to the same, as they may deem expedient
9th. That the width and boundaries of the town street be ascertained, in order to know whether encroachments have been made on the same or not.
10th. That the trustees be requested to take care of the meeting house and see that no injury be done it, and prose- cute all persons who shall do any injury to the said house in any way or manner. Also employ some suitable person to attend to the shutting of the doors and windows of the same, after meetings.
11th. That if any person or persons shall keep any flock of

sheep, or suffer their sheep to be on the commons of this town, or on the highways of the same, after the twentieth day of this month, until the twentieth day of March next, all such sheep shall be liable to be impounded, the owner or owners of such sheep to pay one shilling for each sheep to pay one shilling for each sheep so impounded, Wainscott flock excepted, and that to be under the care of a shepherd approved of by the trustees of this town.
12th. That all horses and neat cattle that shall be found grazing or running at large on Napeague, or any of the beaches on the south side from the hither end of Montauk to the western bounds of this town at any time between the sixth day of May and the twelfth day of September next en- suing, shall be liable to be impounded, the owner or owners of such horses and neat cattle to pay fifty cents per head for all such horses and neat cattle so impounded.
13th. That all the meadow grass between Indian Well and the foot of Highlands, be hired out to mow for one year, and not to pasture. Also the meadow grass at Georgica, and the sedge flat at Acabonac, and the same was hired out accord- ingly, and in the following manner, and payment to be made on the first day of September next.
