On the ninth of December, a permanent organization war mele, Elwar! King of Ross, being elected Speaker, and the rest of the temporary organization sind made permanent.


There was one contest in the House. Hugh Glenn, an electr of Hamlitan county, contested the right of Eli ah Hayward to a seat, on the ground that he Bel not fulfilled the constitutional requirement by paying a State or county av willis the year. The committee found that Mr. Hayward had paid a tax of five dulwcs assessed by the Court of Hamilton county against attorneys, physiciani ant iurgente, which tax was required to be paid into the State Treasury, and while there might be some doubt as to the validity of the law, he had neverthelel complied with it requirements. He was declared eligible to the seat.


The election of a United States Senator, to succeed Benjamin Ruggles, was the most animated so far in the State's history. The two Houses met on the twentieth of January, IS27, and took fifteen ballots as follows .

The joint resolution convening the two Houses in joint session for the prime of electing a Senator, made no provision for a second session, and when the jaist session dissolved. it became necessary to call them again in session. The act of December 28, 1826. declared more explicitly the meaning of the act of January, 1827, attaching a part of the sixth and seventh ranges of townships to Jeffer- son county.


The act of . January 22, 1827, detached certain territory from Clark and attached it to Madison, and detached an equal amount from Madison and attached it to Clark, for the purpose of rectifying a boundary line.


lhe act of January 29, 1827, declared the north and south lines of Ashtabula, Cuyahoga, Geauga and Lorain as extending due north from the shore of Lake Erie to the northern boundary line of the United States.


The act of January 29, 1827, established the boundary line between Madison and Union counties.


The act of January 29. 1827, attached . all that part of Medina county west of the sixteenth range of townships together with township four in range sixteen of town- ships, to Lorain: that part of township six, in sixteenth range belonging to Lorain, to Cuyahoga ; township three, in sixteenth range to Medina, and more clearly defined the western boundary of Portage county.


The principal legislation of the session was of a local and special character out- side of appropriations and fiscal measures previously noted.

There were two contests in the Senate. George Jackson, Robert Fultim and Ler) Whipple, electors of Muskingum county contested the right of John Hanem to a seat, on the ground of irregularity in the returns. He was seated.


William Lowry, an elector of Jefferson county contested the or of Howrythmes H. Leavitt, on the ground that he held the office of prosecuting atturter when elected. The Senate found that he had subsequently resigned the position and seetel kin.


The Governor's message was devoted to internal improveneste, the fieslirage ment of domestic manufactures and the promotion of education


He also presented the first report of the Trustees of the Deal Mite Asylan, give ing in outline the plan for instituting the same and erecting the necessary Imlidings.


The voters within the Virginia Military District decided, by a vote at the podle in October, to sell the Military School Lands within the district, and apply the pro ceeds to the maintenance of schools.


The Canal Fund Commissioners reported that they had negotiated a third loen of $1,200,000 six per cent. bonds, payable after 1850, on which a premium of $;1, 5064; was paid by the lenders.


The Canal Commissioners submitted their report showing the progress of the work and giving the receipts and expenditures in detail.


The total number of free white male persons twenty-une years and over was reported by the Auditor as 145.745.


On the sixth of May, 1827, the State Treasury was entered and robbed of $1201718. of which $11,627.66 was subsequently recovered, leaving the actual lors, $1,30.33 Treasurer Brown asked the Legislature to investigate the robbers, and the Spounittre found him blameless, and attributed the robbery to the unsafe condition of the treasury vault, and insufficient safeguards, and recommended that the treas irer Im acquit af the loss and allowed $46.50 by him expended in apprehending the thiet and reunver- ing the money. The name of the thief is not of record.


On the first of February, 1828, the House and Senate is a tady, attende! the funeral of James W. Lathrop, a member of the House from Stark county, which took place from the hotel of Mr. Browning. Afterward suitable resolution were adapted! by the two Houses.

Contests, as follows, were disposed of : Samuel Crull contested the seat of Isaac Bonsor, from Pike, Scioto and Lawrence, on the ground that all the votes cast for him had not been returned. The House found this to be true and unseated Bonsor, giving Crull the seat, from the district


Robert HI. Culbertson contested the seat of William Fielding, of Miami, Shelby and Allen, on the ground of irregularity in the election returns. The House con - firmed Fielding's right to the seat.


James H. Godman was admitted to a seat in the bar of the House as a reporter for the Ohio State Journal and Gazette, and Samuel Bigger to a like position for the same paper.


A memorial from Bushrod Washington, President of the American Colonization Society, with reference to the colonization of emancipated negroes in Liberia, was transmitted by the Governor to the two Houses and were favorably reported on by them, and the scheme recommended to the philanthropic public.


Mr. Nye, from the Committee on Judiciary, made a report on the subject of im- prisonment for, debt, expressing the opinion that it was inexpedient to change the law in that regard.

When the Senate met at 10 A. M., Monday, December 1. it proceeded to a tempo- rary organization by electing Samuel Wheeler, of Geauga, Speaker; David Collins, Clerk, and Horace Wolcott, Sergeant-at-Arms. This was later made the permanent organization.


David Smith was admitted to a seat within the bar as a reporter for the Monitor.


Mr. Morris, from a select committee, called attention to the enforced absence of Andrew Mack. a Senator from Hamilton, who was held within the jail bounds of that county on two attachments in favor of the Bank of the United States, issued upon two several judgments. On the second of December, the Senate took action declaring the detention to be a violation of legislative privilege, and adopted, by a vote of seventeen to sixteen, a resolution instructing Senator James B. Gardiner to proceed to Hamilton county and notify Mack that his presence was required in the Senate. On the sixth of December, Mr. Gardiner, as the Senate's special messenger, made report that he had served the notice on Mr. Mack, and that he was in the Senate ready to take his seat, the writs of detention having been annulled.


On the second of December, the two Houses met jointly, canvassed the votes and announced the result of the election for Governor. Allen Trimble received 53,970 votes ; John W. Campbell, 51,195, and there were 112 scattering votes ; total vote 105,277 ; Trimble's majority, 2,673. He was accordingly declared elected, and on the tenth of December duly inducted into office in the presence of the two Houses.


In his annual message Gov. Trimble discussed the subject of canals and other in- ternal improvements, recommended the encouragement of domestic manufactures and education, and such a revision of the laws as might be conducive to good order.


He also announced the resignation of William Henry Harrison as United States Senator, and urged the Legislature to elect his successor as speedily as possible.


The House adopted a resolution on the fourth that the two Houses meet on the eleventh and elect a Senator. The Senate failed to adopt the resolution. A call of the Senate was demanded, and it was developed that fourteen Senators were absent. A quorum of two-thirds not being present, the Senate adjourned, This is the first record of a quorum of cither House being purposely broken.


Subsequently, the two Houses agreed upon a resolution, fixing 3 P. M., of the tenth of December as the date for electing a successor to Gen. Harrison. At that hour the two Houses assembled jointly and elected Jacob Burnet, of Hamilton county, to the United States Senate. The Journal of neither House records the vote, and he was, presumably, elected without opposition.


The question of organizing a State bank, was brought up in the Senate by a joint . resolution offered by Mr. Hale, of Greene.


The Canal Fund Commission reported an additional loan of $1,200,000 at six per cent., payable after 1850, on which a premium of $48,S40 was received.


The Canal Commissioners also made their regular report, showing rapid and fa- vorable progress in the work of construction, and giving in detail the various Items of expenditures.

The subject of sheep raising was up for discussion and legislative action, includ- ing the improvement of breeds and their protection from the ravages of wolves and dogs


The better regulation and support of common schools received due attention. The question of selling section 16 of the school lands of the State had been submitted to a vote of the people, but the result was not wholly satisfactory, and Auditor Osborn suggested sundry amendments to the law to make the matter more definite and certain.


The legislation at this session, like that of those immediately preceding, was largely of a special and local nature, many divorces being granted, names of individ- uals changed and personal relief granted to local officers and others. During the session, the two Houses met in joint session and elected the following officers :

There were contests in effecting the temporary organisation when the Senate met on Monday, December 7.
