Provisions were made in all the charters for the condemning of the right of way and affixing the damage therefor. The tolls for the transportation of freight and passengers was in no case to exceed the tolls for transporting the same on the Ohio canals, except in special cases. The first named road was permitted to charge four cents per mile per ton for freight and three cents per mile for passengers. The fact that the erection of toll houses was provided for, and people were permitted to go over the road "with proper and suitable carriages" of their own, suggests that animal motive power was to be relied on.
In all cases the right to purchase and own said railroads was reserved to the State after from twenty to twenty-five years, at original cost and interest thereon; the charters were perpetual or as long as the corporations as set forth in the charters were maintained separate from and independent of other corporations.
SECOND EXTRAORDINARY SESSION.
The second extraordinary session of the Legislature, as provided for by joint res- olution, convened June 4, 1832, and adjourned June 14, of the same year. It was con- vened to redistrict the State for members of Congress, and nothing else of impor- tance was done. The membership and officers were the same as at the thirtieth legis- lative session.

Retiring Gov. McArthur sent his message to the Legislature, in which har re viewed the progress of the State during the thirty years of its existence and onmeret- ulated the people on existing conditions, and their great improvement within the period. The total aggregate of the State canal debt was $4.834.574.0%, and the net re- ceipts for tolls $104,302.53. He suggested the lessening of the punishment fur nuner offences, to the end that executive clemency should not be so frequently inville de exercised. He deprecated the nullification proceedings of South Car link, and Mrgve the establishment of a safe banking system in view of the expiration uf the charter of the United States bank.
The two Houses met in joint assembly on the sixth of December. And cantusicil the vote for Governor. Robert Lucas received 71,251 votes: Darius Lyman, 61155. and there were 33 scattering votes; total 134 475. Lucas' majority, Sule. Gnec Lucas was inaugurated on the seventh of December, and delivere ! a illtakie address to the two Houses.
Messrs. Joseph Olds. Samuel F. McCracken and Charles Anthony entmisinorre for the purpose reported that they had fixed the site for a proposed paiteotiary og the east bank of the Scioto (its present site), and made numerous suggestions as to the section of buildings.

The Adjutant General reported the strength of the militia as follows: 17 divis- ions, 54 brigades, 178 regiments, 38 battalions, including 16 squadrons of cavalry. Commissioned officers, 6,131 : non-commissioned officers, musicians and privates, 126,030 ; total, 132,161, Armament, 14,591 muskets, 18,550 rifles, 15 pieces of artillery.
Mr. Morris who had been chosen Senator of the United States, offered a series of resolutions commending the position of President Jackson on the action of South Carolina, attempting to nullify the laws of the United States.
Charges having been made that Reuben Wood had been unfairly elected as Su- preme Judge of the State, the Senate appointed a committee of its members to inves- tigate the same, to act in conjunction with a similar committee of the House. After taking testimony they submitted the same to the Senate. The charges were not sus- tained, and the committee was discharged.

There were two contests In the House. George Powers, Jr. of Portage, Farparte the seat of Wm. Coolinan, Jr., on the ground of Irregularity in the return of the election. Mr. Coolman was unseated and the seat was awarded to Mr Powers
Lathrop Seymour contested the seat of John Codding, of Melina, on the ground that the Intter held a lucrative office. The House so found, a vacancy was Arslan and at a special election Duthan Northup was elected thereto.
The Governor's message and the various documents and reports amangansing the same, were, after being submitted and read, appropriately referred.
A strike occurred in the office of the State Printer, and the two Houses addremind certain enquiries to that official, to which he responded nt great length. detailingall the circumstances therewith, and submitting copies of his agreement with his em ployes, claiming that they had violated the same, subjecting him to great Incon- venience and delay in performing the work of the State. So far as appears in the record the matter there rested. The dispute arose over work by the day and piene. the State Printer having adopted the latter. His scale of prices were Pngk werk, twenty cents per one thousand ems; rule work, thirty cents; figure work, thirty cents; rule and figure work, thirty- five cents ; by the week eight dollars for tem- positors and pressmen.
The Deaf and Dumb Asylum reported thirty-two pupils. The total receipt were $7,0SS 36 and total expenditures $3.957.62, leaving a balance of $3. 130 74 in the hands of Gustavus Swan, Treasurer.
On the fifteenth of December, the two Houses met in joint convention to c'est . successor to Benj. Ruggles, Senator of the United States. The election was made un the first ballot, the vote standing :

Provision was made by the act of February 25, 1833, for the election of prosecut- ing attorneys by the people, at the regular elections. They had been previously appointed by the courts. The Court of Common Pleas was authorized to grant licenses and regulate taverns, the price thereof to be not less than two dollars nor more than twenty dollars. Provision was made for the care and control of escheated lands. The establishment of agricultural societies was provided for by the act of February 25, 1833.
A joint memorial was addressed by the two Houses to Congress asking for a settlement of the disputed boundary line between Ohio and Michigan.
A preamble and resolution deprecating the nullification proceedings of the South Carolina Legislature, and endorsing the action taken by President Jackson, were adopted.
Carroll county was erected from Columbiana, Stark, Tuscarawas, Harrison and Jefferson, by the act of December 25, 1832. The county seat is Carrollton. ·
Hardin county, previously erected, was organized by the act of January 19, 1833. The county seat is Kenton.

There was one contest In the Senate. T. Harvey, of Richleni contested the right of Matthew Lind on the ground that he had not paid a State or county tax within two years and that the notice of the time and place of holding the cie tion Way out given as the law required. The Senate did not regard the allegations as stained ky the evidence, and Lind was seated.
Charges affecting the reputation of Senator Crawford, of Delaware Mariem and Crawford were filed with the Senate and referred to a special committee for Investf gation. Subsequently, and upon the unanimous report of the committee the palite matter was expunged from the record.
The Directors of the Penitentiary reported that work on the new tillings bed proceeded slowly owing to outbreak of cholera in the summer of 1833. which ut only scourged a large portion of the country but caused many death in the State Capital. The able- bodied convicts were employed in the erection of the buslines. one hundred of them were stricken with the disease and eleven died. Mechanics and artisans living in Columbus tled to avoid the plague, and work was practically suspended.
The Faculty of the Cincinnati Medical College was investigated on a number af charges among which were: Endeavoring to break up a rival institution giving Dr. Pierson a Chair " purely intellectual ;" countenancing slandernus statenicete con cerning Dr. Henry, and permitting the township trustees to impeach the characters of Drs. Drake and Henry and other professors. After a long investigation the Hnet committee failed to find anything that would warrant legislative interference

Lucas were accompanied by many an ! voluminous documents and correspondence on national topics, res luti ys and pre ceedings of the Legislatures of other States, on the nullification resolutions of South Carolina and similar public questions. Caldwell, 3; scattering, 3. For Sergeant-at-Arms there were seven- teen candidates and seven ballots, Presley Kemper receiving thirty-eight votes, to thirty for Wm. Ferguson on the last ballot with seven scattering.
Subsequently this organization was made the permanent one for the session with- out opposition.
