John Brough having been elected Auditor of State, was, on the fifteenth of March, 1839, granted a leave of absence for the rest of the session, in a set of compli- mentary resolutions.


Another attempt was made to impeach Peter Hitchcock, of the Supreme Court, but a majority of the Judiciary Committee, reported that the charges were ground- less. A still stronger finding in behalf of the accused was filed by Mr. Lowe as a mi- nority report.


Paulding county, previously erected, was organized by the act of March 18, 1839.


The issue of bank bills of a less denomination than three dollars was prohibited after the fourth of July. I839.


The Board of Canal Commissioners was abolished and the Board of Public Works revived by the act of March 5, 1839.


By the act of February 26, 1839, provision was made for the return of fugitive slaves to their masters, upon proof of ownership being duly shown before a judge of a court of record, who was authorized to issue a warrant for the arrest of such fugi- tive. A penalty of not more than $500 fine or not more than sixty days imprison- ment was provided for persons enticing slaves to leave the service of their masters.


The act of March 18, 1838, provided penalties for removing, breaking, displacing or 'otherwise molesting the rails and appliances of railroad tracks, the maximum. punishment being three years in the penitentiary ; and if death ensued, the offender should be deemed guilty of murder in the first or second degree or manslaughter, as the facts warranted, and punished accordingly.


An act to punish for betting on elections made the penalty not less than $5 nor more than $500, but in all cases where the amount hazarded was between $5 and $500, the fine should equal the amount so hazarded.


The following railroad companies were incorporated : The Findlay Railroad, act of March 12, 1839; the Belleville Railroad, act of March 16, 1839; the Wapau- konetta and St. Mary's, act of March 16, 1839; Scioto and Miami, act of March 18, 1839.


Other acts amendatory or reviving dormant incorporations, were also passed.


Timothy G. Bates, Leander Ransom, Win. Wall, Rudolphus Dickinson and Wm. Rayen, were appointed members of the Board of Public Works, in place of the Board of Canal Commissioners, abolished by joint resolution.

employment of a chaplain by the Board of Directors of that institution, and recom- mended the continued employment of that officer as necessary to the moral welfare of the inmates of that institution.


In answer to the inquiries of the committee on railroads the presidents and man- aging officers of the various corporations submitted reports showing the amount of subscriptions, the progress of construction, and detailed statements of expenditures and the acquisition of the necessary real estate by purchase. compromise and con- demnation.


The Governor sent a communication to the Legislature, setting forth the facts connected with the sale of the old penitentiary lots and the application of the proceeds.


The management of the Oberlin Collegiate Institute was the subject of legislative inquiry, and upon investigation was found to be satisfactory. Among the charges preferred against it was one that it had become "a grand depot" for the reception of fugitive slaves. This question was referred for a further legislative inquiry.


Senator David Tod, from the Committee on Public Institutions, made a report highly praising the work of the Ohio Lunatic Asylum, as ameliorating the condition of the unfortunate class receiving its benefits.


Thomas J. Davis was admitted to the bar of the Senate as a newspaper reporter.

Win. B. Lloyd, a member of the House from Cuyahoga county, war expelled from the same on the twelfth of February, IS40, on the charge of di honestly chang ing the accounts in the ledger of Isaac Newton, of Cuyahoga county, after the late of his election to the Legislature. The vote of the House, on the question of hits guilt, was forty-six to twenty-three, and for expulsion, forty . three to twenty five


John E. Hanna, a member from Morgan county, resigned on the twentieth of February, 1840.


The Committee on Banking and Currency made an adverse report on the Jak ject of establishing a State bank to take the place of the local banks.


The select committee to inquire as to what corporations were acting in vulation of their acts of incorporation, reported a number of minor incorporations and the Ohio Railroad Company, but made no recommendation.


Mr. Corwin, from a select committee, to whom was referred the questi n &f re- pealing the law to grant licenses for the retailing of ardent spirits, reported adversely thereto.

Summit county was erected from Medina and Stark by the act of March 3, 1840. The county seat is Akron.


Ottawa county was erected from Sandusky, Erie and Lucas by the act of March 6, 1840. The county seat is Port Clinton.


Lake county was erected from Geauga and Cuyahoga by the act of March 6, 1840. The county seat is Painesville.


An act was passed for the protection of the canals and another to authorize the Commissioners of the Canal Fund to borrow not to exceed $SSo ooo to complete the canals of the State.


By the act of March 29, 1840, the office of Superintendent of Common Schools was abolished and the duties of the office devolved on the Secretary of State, with $400 additional salary.


The act to provide for the erection of a new State House was repealed March 11, 1840. The act to authorize the loan of the State credit to railroad companies was repealed.


Acts were passed amending numerous railroad incorporation acts, and the follow- ing railroads were incorporated : Ashland, Haysville and Loudonville R. R. Co .; the Lexington R. R. Co.


A large number of State roads were established during the session.


A resolution was adopted designating Leander Ransom, Timothy G. Bates and Rudolphus Dickinson as acting members of the Board of Public Works.


A joint resolution authorized the Governor to appoint a State Board of Equali- zation.


A joint resolution was adopted inviting Gen. Andrew Jackson to become the guest of the State of Ohio, July 4, 1840.


John A. Bryan, HI. S. Gillett, John G. Miller and Wm. Penn Clark were admitted as newspaper reporters to the bar of the House. For some violation of the rules of the House the latter, who represented the Cincinnati Daily News, was suspended from his privileges on the fourth of January, IS40.


The two Houses attended the funeral of Geo. W. Shannon, the Secretary of the Governor, January 22, 1840, and on the twenty-eighth of January, the two Houses attended the funeral of Win. Doherty, formerly Speaker of the Senate.


Carter B. Harlan resigned as Secretary of State, and was temporarily succeeded by Win. Trevitt.
