The following pro tempore organization was made on the first day of the Fewiums Speaker, Thomas Kirker; Clerk, Thomas Scott: Doorkeeper, Adam Beta.


On the tenth of December, this organization was made permanent, a farmi vou for Speaker showing seventeen for Kirker, and one each før Bigger, Ehett Com. Scofield and McArthur.


On the seventh of the month acting Gov. Kirker sent a brief toewware te tis Legislature, announcing that John Smith had resigned his office in United States Selv- ator. Also that Wm. Creighton, Jr., had resigned the office of Secretary of Suor Also that he had received and accepted the resignation of a number of Apodite Judges, and requesting the Legislature to fill the vacancies, as required bes law.


On the tenth the returns of the election were canvased by the two Hnweek end the following result announced : For Governor; Samuel Huntington. Frombull,

Samuel Iluntington was accordingly declared elected and was duly installed in office in the presence of the two Houses on the twelfth, and delivered a lengthy address, full of pertinent suggestions.


Two impeachments were reported by the House to the Senate and tried by that body, during the session. They related to the Judiciary. Calvin Pease, President Judge of the Third Circuit, and George Tod, of the Supreme Court were arraigned on formal articles of impeachment.


The same charge was made against both-"high misdemeanor and wilful, corrupt and wicked disregard of the Constitution" in declaring null and void an act of the Legislature extending the jurisdiction of Justices of the Peace.


Both cases were tried upon the judicial records and the construction of the powers of the Courts to pass upon the validity of the acts of the Legislature. The Senate voted in both cases fifteen to nine in favor of finding the judges guilty. This being one less than two-thirds of the Senators they escaped conviction.


In the case of l'ease those voting in favor of conviction were Senators Abbott, Barrere, Bryan, Curry, Dillon, Elliott, Kinney, McArthur, McConnell, MeLaughlin, Sharp, Smith, Price, Wood and Kirker (Speaker). Against-Bigger, Burton, Bureau, Cone, Cooper, Foos, Irwin, Massie, Scofield. .


In the case of Tod, Senators Abbott, Barrere, Bryan, Curry, Dillon, Elliott, Irwin, McArthur, McConnell, Mclaughlin, Sharp, Smith, Price, Wood and Kirker (Speaker). Against-Bigger, Burton, Bureau, Cone, Cooper, Foos, Kinney, Massie, Scofield. Irwin and Kinney changed on the last vote.

Two ballots were taken for Speaker pro teth as follows 1 bell, IS; Joseph Kerr, to; James Pritchard, S; Matthias Corwin, : . Campbell 25; Kerr, 4; Pritchard, S; Corwin, 1.


On the tenth of December Campbell was chosen permanent Speaker an Didlemsi Campbell, 33; Kerr, 10; Pritchard, :. Hlinde was unanimously chegtel Clerk, and the vote on Doorkeeper resulted : Adam Betz, 21, Levia Hl Pest, 10.


Acting Governor Kirker addressed a brief message to the two Heont os its seventh, calling attention to certain official vacancies to be filled by them

On the same day the two Houses met and elected a United States Senatur, view John Smith, resigned, and for the full term of six years from March 4, 1 mg Alp a Secretary of State, vice Wm. Creighton, Jr., resigned.


The ballot for the vacancy was: Return Jonathan Melgs, Jr . 43, Nathaniel Massie, 22; Alexander Campbell, 3; James Pritchard, 2. For the full term, Melles 49; Campbell, 17; Pritchard, 4. Mr. Meigs was declared elected to both the vacancy and the full term.

Darke county was erected from Miami. by the act of January 3, 1809, but to re- main attached to Miami until the Legislature thinks proper to organize it. County seat is Greenville.


By the act of February 11, 1809. All that part of Jefferson lying west of the fifth range, was attached to Tuscarawas.


By the act of February 20, 1809. All that part of Ashtabula county lying south of Township No. 9, was attached to Trumbull.


By the act of February 17, 18og. All that part of Franklin county lying north of Delaware was annexed to that county.


Iluron county was erected by the act of February 7, 18og, out of the Connecticut Western Reserve. embracing all that portion of the same known as the "Fire Lands," to be organized at the pleasure of the Legislature.


During the session acts were passed incorporating banks at Marietta and Chilli- cothe: elaborating the judiciary act: relating to the settlement of estates of deced- ents : equipping the militia : enlarging and modifying the act defining and punishing crimes : to provide for the leasing of Section 16 in certain localities, and for the es- tablishment of numerous schools, academies, colleges and church societies.

On the eighth of December Mr. Morris resigned the one al Clerk pro inm. and Carlos A. Norton was chosen in his stead. On the twelfth the Senate of ted Mr. Norton as permanent Clerk, and Me Sherlock was ont net jeiman ( !) keeper.


On the seventeenth the Senate elected a permanent Speaker. Duncan Me Arthur of Ross, was chosen by a unanimous vote.


At the preceding election, L'airfield and Licking counties laid Saun to an aldi tional Senator, and Miami claimed a Senator Independent of Montgomery Cunas quently elections were held for Senators in these three counties, an ! William Trimble was certified up as elected from Fairfield and Licking, and Armstrong Bramdmn was returned as elected from Miami.


After thoroughly considering all the claims set up, the Senate Committee he Privileges and Elections reported that neither of the gentlemen was entitled toa meet since there was no authority of law for their election, and the report was adopted


The Goyernor's message and the detailed reports of the State Freashrer sod Auditor were received on the sixth.


The removal of the seat of Government temporarily, to Zanceville, and . .. mission to locate a permanent seat of Government, were provided for during the session.


The Senate met the House in joint convention for the election of Unite ! St wu Senator and State officers, on December 12, 18, and February 15 and 20.


Edward Tiffin resigned as Senator, and Gov. Huntington appointed Staniey Griswold, of Cuyahoga county, a- Senator ad interim, until the assembling of the Legislature.

There being a quorum present, the House made a temporary organization, as follows : Speaker, Alexander Campbell, of Adams; Clerk, Thomas S. Hinde ; Door- keeper, Adam Betz.


The permanent organization was effected on the twelfth of December, on which day Alexander Campbell, who had been chosen Speaker pro tem., resigned from the House to accept the office of United States Senator, to succeed Edward Tiffin, who had resigned that position and had been elected to the House, and who was elected Speaker of the House to succeed Mr. Campbell. Two ballots were had as follows :


1. Tiffin, 20; Pritchard, 15; Corwin, 4; Shepherd, 2; Looker, 1; Jackson, 1; Samuel Dunlap, 1. 2. Tiffin, 24: Pritchard, 19; Shepherd, 1 ; Looker, I.


Hinde, as Clerk, and Betz, as Doorkeeper, were continued in their respective positions permanently.


Wm. Russell was subsequently elected to fill the vacancy from Adams, caused by the resignation of Campbell.


Thomas G. Jones, of Trumbull, contested the seat of Robert Hughes, and Hughes was seated.


John Gallaher, of Warren, filed a protest against the seating of Michael H. John- son, on the ground that he held a lucrative office when elected. The protest was not sustained with the necessary proof, and Johnson was seated.


On the twelfth of December the two Houses met in joint assembly to elect a United States Senator, vice Edward Tiffin, resigned. The ballot was: Alexander Campbell, 38; Richard S. Thompson, 29; Thomas Worthington, I ; James Pritchard, 1; David Findlay, 1.


The two Houses also elected David Findlay an Associate Judge for Muskingum county.


On the eighteenth of December the two Houses met and elected Jeremiah Mc- Lene, Secretary of State, and Benj. Hough, Auditor of State.


On the tenth of February the two Houses met and elected Thomas Scott, Wm. W. Irwin and Francis Dunlavy, Judges of the Supreme Court.

Among the acts passed were those relating to the foreclosure of murtgreps os off and counter claim ; fully defining the constitution of Boards of Commumloger In counties ; providing how public buildings might be erected ; making instruments in writing negotiable; regulating the entries of judgments and true id executivey: providing for the recording of deeds and mortgages and the appointment of Recorders by the Court of Common Pleas, and the issue of licenses for taverpr, pures ani ferries. The marriage laws were also further amended, requiring fften days public written notice of an intended marriage under the seal of a Justice of the Praca, tu is posted in the most public place in the township where the woman ruled. The license fee was fixed at seventy . five cent -.


Laws were passed to authorize a lottery for the purpose of creating a lieldge across the Miami river at Tror, as well as similar enterprises elsewhere. to provide for the poor, and steps were taken to codify the judiciary laws and thele relating to land taxes.
