ARTICLE 86. To see if the Town will vote to accept as a gift from Joseph J. and Lillian J. Semensi the conveyance of land at #12 South Main Street, Randolph. For a more particular de- scription, reference is made to deed to Joseph J. Semensi, re- corded Norfolk Registry of Deeds, Book 4052, Page 397, said land to be perpetually under the jurisdiction of the Board of Selectmen, as petitioned for by Joseph J. and Lillian J. Semensi.

ARTICLE 87. To see if the Town will vote to approve the re- quirement of a permanently installed heat activated fire detection alarm system in all buildings built with combustible materials.


The rules and regulations shall be in conformance with those set up by the chief of the Fire Department, Inspector of Buildings and Inspector of Wires under the authority of a vote of the Town meeting, Article 58, 1960, as petitioned for by the Chief of the Fire Department and the Inspector of Buildings.

To see if the Town will authorize the Board of Assessors to appoint one of their members to another office or position under their control, and fix the salary of such person in accordance with the provisions of Chapter 36, Acts of 1929, or take any other action relative thereto, as petitioned for by the Board of Selectmen.

ARTICLE 93. To see if the Town will raise and appropriate or transfer from available funds a sum of money to red lead, paint, repair the fence and flag pole also pointing of the flag stones. All located at the Randolph Veterans Memorial Park as petitioned for by the Board of Selectmen.

ARTICLE 94. To see if the Town will vote to establish a local council for the aging. This would be established under the provisions of Chapter 405 of the Acts of 1956 and under Chapter 361 and Chapter 4-6 of the Acts of 1957. (Chapter 40 S 5 para- graph 49) for the purpose of carrying out programs designed to meet the problems of the aging in co-ordination with the State Council (Massachusetts Council for the Aging-167 Tremont St., Boston), as petitioned for by Alan Taylor and others.


ARTICLE 94. Not recommended by the Finance Committee. Mr. Curran moved an amendment that the article be accepted as printed. Mr. Curran's amendment VOTED by a voice vote.


ARTICLE 95. To see if the Town will vote to amend the By- laws by adding: Land which contains an accumulation of rock, stone, gravel, sand, or other earth material above the surface of the ground in such a manner so as to be dangerous to the property or person of anyone shall be deemed a nuisance and may be abated by the Board of Selectmen in the following manner:


(1) Any individual, or the Board, itself, may initiate a petition to the said Board stating the nature of the nuisance complained of and apply for abatement thereof whereupon the Board shall view the premises. If the Board is of the opinion that the pe- tition should be granted, it shall set a time and place for hearing, giving notice thereof to the petitioners, to the person whose land it may be necessary to enter upon to abate the nuisance, and to any other person who may be damaged or benefited by the proceedings. Such notice shall be given in writing and may be served by any person authorized to serve civil process or by registered or certified mail.


(2) However, if the land is unoccupied and the owner or agent unknown or out of the Commonwealth, the notice to such own- er may be served by posting upon premises or by advertising in one or more newspapers in such manner as the Board may

order. At the time and place appointed therefor the Board shall hear the parties and thereafter may cause such nui- sance to be abated by entering upon any land and making such excavation as it shall deem necessary and it shall also deter- mine at whose expense the improvements shall be kept in re- pair and award the damage sustained by and benefits accruing to any person by reason of said improvement. The Board shall forthwith give notice of its decision by filing with the Town Clerk and by mailing a copy, postage prepaid, to the owner of the premises and the petitioners, unless the peti- tioner is the Board itself. The expense of making and keep- ing such improvements in repair shall be assessed by the Assessors upon the person benefited thereby as ascertained by said decision and shall be included in their taxes. This shall be a lien upon the land benefited thereby and shall be collected in the same manner as other taxes upon land.


(3) A person who is aggrevied by the decision of said Board may appeal therefrom to the Superior Court if within seven days after decision he files decision with Superior Court stating the grievance and action of said Board Thereon.

Meeting was called to order by Moderator Lombardi at 8:00 o'clock P.M. Motion was made, seconded and VOTED that the meeting be adjourned until 8:15 P.M. A quorum being not pres- ent, meeting was again called to order by the Moderator at 8:15 P.M. Motion was made, seconded and VOTED that the meeting be adjourned until 8:40 P.M. A quorum being present, meeting was called to order by the Moderator at 8:40 P.M. Mr. Lombardi led the meeting in prayer and a minute of silence was observed in honor of Mr. Walter Stephens, a former town official, now de- ceased.


Town Clerk, Edward T. Clark, read the return of service and Moderator Lombardi appointed Messrs. Swartz, Mullay, and Dolan as tellers.


ARTICLE 1. To see if the Town will vote to raise and appro- priate or transfer from sewer revolving fund and/or borrow under Chapter 273, Acts of 1955, a sum of money for the following pur - poses: to provide funds for the construction of a trunk line and laterals to extend the sewer system from Pleasant Street to Memorial Parkway, at North Main Street, in order to expedite development of the Shopping Center to be erected between Mem- orial Parkway and Diauto Drive and to provide sewers for prop- erties adjacent to the extended system as well as the Randolph High School. And that any funds remaining after the proposed work under Article 69, Annual Town Meeting of 1963, has been completed, shall be transferred to this project for the completion of trunk lines and laterals, as petitioned for by Robert L. Schnei- der, Chairman of the Business and Industrial Commission and others.


ARTICLE 1. Not recommended by the Finance Committee. VOTED No Action, unanimously.


ARTICLE 2. To see if the Town will vote to appropriate a sum of money received or to be received for the following pur- pose: to provide funds in conjunction with any transfer, appro- priation or borrowing for the construction of trunk lines and laterals to extend the sewer system from Pleasant Street to Memorial Parkway at North Main Street in order to expedite dev- elopment of the Shopping Center to be erected between Memorial Parkway and Diauto Drive. To see if the Town will vote to rezone from res - idential to industrial use a parcel of land bounded and described as follows: Easterly by the westerly side of South Street, a distance of 132 feet, more or less, thence Northerly by land of MacDonald and Ruth Sprague, a distance of 198 feet, more or less, thence Westerly by land of Randolph Manufacturing Company by 3 courses measuring 66 feet, more or less, 22 feet, more or less, and feet, more or less, thence Southerly by land of Elmer L. French, 198 feet, more or less. Being Lot A containing 26,830 square feet of land, more or less. All as shown on a Plan of Land, Ran- dolph, Mass., Paul R. Johnson, Engineer, dated July 5, 1963 on file at the office of the Planning Board, all as petitioned for by Harold J. McDonald and others.

ARTICLE 7. Recommended by the Finance Committee that upon payment of $200.00 by Stivaletta Corporation, the Town shall abandon that part of Old Canton Street which runs from Rid- ley Road to Canton Street, Randolph, through land now of Stiva- letta Corporation and being shown on plan entitled "Plan of Land in Randolph", dated March 16, 1961 by Ernest W. Branch, Inc. C. E.'s filed with the Land Court as plan #31117 or take any other action pertaining thereto. VOTED by a unanimous voice vote.


ARTICLE 8. To see if the Town will vote to transfer from the Hospitalization Account of the Board of Health budget to the Dump Account of the Board of Health budget the sum of Three Thousand Seven Hundred Fifty ($3,750.00) Dollars as petitioned for by the Board of Health.

ARTICLE 9. To see if the Town will vote to transfer from available funds the sum of Two Hundred ($200.00) Dollars for the expense account for the use of the Council for the Aging, as peti- tioned for by Alan H. Taylor and others.

ARTICLE 10. To see if the Town will vote to transfer from available funds the sum of Twenty-three Thousand ($23,000.00) Dollars to the Veterans Benefits Account, as petitioned for by William S. Cole, Director Veterans Services.


ARTICLE 10. Withdrawn by petitioner.


ARTICLE 11. To see if the Town will vote to transfer from available funds the sum of Three Hundred Fifty ($350.00) Dollars to the Veterans Administration Expense Account, as petitioned for by William S. Cole, Director of Veterans Services.


ARTICLE 11. Recommended by the Finance Committee that the Town vote to transfer from the Insurance Account the sum of $255. 94 to the Veterans Administration Expense Account. VOTED by a unanimous voice vote.


ARTICLE 12. To see if the Town will vote to accept Dennis Avenue as laid out on a drawing entitled "Plan of Land in Ran- dolph, Mass." dated August 26, 1952, by R. S. Slayter, C. E., re- corded at the Norfolk Registry of Deeds in Book 3042m page 65m as petitioned for by the Board of Selectmen.
