BUSINESS DISTRICTS
Section 3.
All under Section 2 and the following:
1. Apartment houses subject to the provisions of Section 14.
2. Retail stores and shops for custom work or for the making of articles to be sold at retail on the premises.
3. Manufacturing clearly incidental to a retail business lawfully conducted on the premises, omitting all that is in any way offensive, hazardous or a nuisance.
4. Offices, business or professional, and banks.
5. Restaurants and other places for serving foods.
6. Place of business of baker, barber, caterer, clothes cleaner and presser, confectioner, decorator, dressmaker, dyer, elec- trician, florist, furrier, hair-dresser, hand laundry, manicurist, milliner, newsdealer, optician, painter, paperhanger, photog- rapher, printer, publisher, shoemaker, shoe repairer, shoe shiner' tailor, upholsterer, blacksmith, builder, carpenter, contractor, mason, plumber, roofer, tinsmith, telephone exchange, under- taker.
7. Theatres, moving picture shows, billiard rooms and similar commercial amusement places, subject to provisions of Section 14.
8. Gasoline and oil stations, subject to provisions of Sec- tions 13 and 14.
9. Garages subject to provisions of Section 14.
10. Salesrooms for motor vehicles, subject to provisions of Section 14.
11. Billboards as regulated by laws and by-laws.
MANUFACTURING DISTRICTS
Section 4.
All buildings and uses permitted under Sections 2 and 3 and, subject to provisions of Section 14, following:
Manufacturing, employing unobjectionable motive power, utilizing hand labor and or quiet machinery and processes free from neighborhood disturbing odors and or agencies.

No use shall be permitted which would be offensive because of injurious or obnoxious noise, vibration, smoke, gas, fumes, . odors, dust or other objectionable features, or become hazardous to the community on account of fire or explosion, or any other cause, and in general, any use shall be prohibited which would prove injurious to the safety or welfare of the neighborhood into which it proposes to go, or destructive of property values, or because of any excessive nuisance qualities.
HEIGHT REGULATIONS
Section 5. Residence Districts.
(a) The limit of height in residence districts shall be two and one half stories, not to exceed thirty-five feet, except that a dwelling house for one family may be three stories, not to ex- ceed forty feet in height.
(b) The limitation of height in feet shall not apply to chim- neys, ventilators, skylights, tanks, bulkheads, penthouses and other accessory features usually carried above roofs, nor to towers or spires of churches and other buildings, if such features are not used for living purposes.
Section 6.
BUSINESS DISTRICTS
(a) The limit of height in business districts shall be three stories, not to exceed forty feet.
(b) The limitation of height in feet shall not apply to such . features as are mentioned in (b) of Section 5.
AREA REGULATIONS
Section 7. Residence Districts.
In residence districts as provided in Section 14, no building or buildings on any one lot, including garages, stables and other accessory buildings shall be constructed, altered, enlarged, extended, reconstructed, raised or moved so as to occupy more

than thirty per cent of the area of the lot, except that a building occupying more than thirty per cent of the area of the lot on which it stands on the date of this by-law may be reconstructed, but not enlarged.
BUSINESS AND MANUFACTURING DISTRICTS
Section 8.
In business and manufacturing districts no building shall be built, reconstructed, extended or arranged so that it covers more than seventy per cent of a corner lot or more than sixty per cent of an interior lot. No lot, or the buildings thereon, as provided in this or the previous section, shall be changed in size so as to violate the provisions of these sections.
YARDS
Section 9.
(a) Front Yards. In residence districts no part of any build- ing structures, except uncovered steps, shall be constructed, altered, enlarged, reconstructed or moved so as to be nearer than twenty feet to any street line.
(b) Side Yards. At each side of every dwelling there shall be a side yard not less than ten feet clear width between the side of the house and the side lot line, except that the property owner's garage may be built on this space.
(c) In the case of a single family house three stories high, the provisions in paragraphs A and B of this section shall be in- creased two hundred per cent.
ACCESSORY USES
Section 10.
. (a) Accessory uses shall be on the same lot with the building of the owner or lessee, and shall be such as do not alter the character of the premises on which they are located or impair the neighborhood.
(b) Garage space for not more than two cars shall be per-

mitted as an accessory use in residence districts, except that in special cases permission for more cars, not to exceed the total of four, may be given by the Building Inspector and /or the Selectmen as provided in Section 14.
(c) Where light manufacturing of any kind is allowed as an accessory use, it shall be restricted to such as is incidental to a permitted use and where the product is customarily sold on the premises by the producer to the consumer.
(d) The use of a room or rooms in a dwelling as an office or studio by a physician, dentist, lawyer, or other professional person resident in the house may be permitted as an accessory use.
(e) Hotels, as distinct from apartment houses, where per- mitted under this by-law, shall contain no arrangements of any description for private cooking or housekeeping.
GENERAL PROVISIONS
Section 11.
Non-Conforming Uses.
(a) No non-conforming use shall be changed, moved, or extended, and no building or structure devoted to a non-con- forming use or uses, in whole or in part, shall be structurally or substantially altered or replaced by a new building or structure.
(b) When upon application to the Selectmen or Building Inspector, he shall find that a proposed change or alteration is reasonably necessary and will not substantially reduce the value of any property within the district, or tend to change the nature of the district, permission may then be given.
(c) Whenever a non-conforming use has been changed to a more restricted use or to a conforming use, it shall not again be changed to a less restricted use.
DISTRICT BOUNDARIES
Section 12.
The district boundaries shall be as shown on the zoning map. When boundaries run between streets and approximately parallel to them, they shall be deemed to follow a mean line between said streets.

AUTOMOBILE SERVICES
Section 13.
Gasoline and oil stations shall hereafter be located twenty feet inside the building line and no filling shall be done except into cars standing on the property of the filling station, and no filling station shall be erected without a permit from the Select- men.
PERMIT BY SELECTMEN
Section 14.
No building hereafter erected or altered shall be erected or altered without a permit from the Building Inspector and /or the Selectmen, except:
(a) A. permit for a one-family house and its accessory uses may be given by the Building Inspector, provided it conforms to the provisions of this by-law.
(b) As a prerequisite to permits, the Selectmen or, when empowered, the Building Inspector shall require the sub- mission of plans and specifications. Any person desiring to obtain the permission of the Selectmen shall make a written application therefor, and the Selectmen shall hold a hearing thereon after such notice as they direct and shall render a decision. They may make rules for such hearings and shall notify all holders of real estate who might be affected. If a permit may be issued with conditions, such as will protect the community, such conditions shall be specified in writing on the permit. If a permit would result in a substantial injury, it shall be refused.
VARIATIONS
Section 15.
In general this by-law is supplementary to other laws. Where this by-law imposes a greater restriction upon the use of build- ings or premises than is imposed by existing provisions of law, the provisions of this by-law shall control.

Section 16.
(a) The office of Building Inspector is hereby created and established, whose duties shall be as prescribed in these by-laws, and such other duties as are customary for this office. He shall be appointed annually by. the Selectmen.
(b) A vacancy occurring shall be filled until the annual election by appointment by the Selectmen.
ENFORCEMENT
Section 17.
This by-law shall be administered by the Building Inspector and Selectmen. They shall approve no application of any kind, plans and specifications and intended use for which are not in all respects in conformity with this by-law. Where a permit may be granted with conditions, such conditions shall be imposed and made part of the record.
APPEALS
Section 18.
(a) A Board of Appeals consisting of three members is hereby established, said Board to be appointed by the Selectmen.
(b) Any person aggrieved by the refusal of the Building Inspector or Selectmen to issue a permit under the provision of this by-law, or any person aggrieved by the issuance of a permit or by a decision of the Selectmen or the Building In- spector, may appeal under the provisions of Sections 27 and 27-A, Chapter 40 of the General Laws.
EXCEPTIONS UNDER SPECIFIC RULES
Section 19.
When in its judgment the public convenience and welfare will be substantially served, and /or where such exception will tend to improve the status of the neighborhood, the Board of Appeals may in specific cases, after public notice, a hearing, and

subject to appropriate conditions and safeguards, determine and vary the application of the district regulations herein es- tablished in harmony with their general purposes and intent as follows:
(a) Permit the alterations of a one-family house or building, existing at the time this by-law is adopted, and wherever located, to accommodate two families.
(b) Permit in undeveloped sections of the town temporary and conditional structures, premises and uses that do not con- form to the regulations herein prescribed, provided that no such permit shall be for more than a one-year period.
AMENDMENTS
Section 20.
The Planning Board upon its own initiative may, and upon petition shall, hold public hearings, fourteen days published notice of which shall be given for the consideration of any amendments to the zoning map or to this by-law, and report to a regular or special town meeting its recommendations as to what action should be taken. No hearing shall be held or appeals considered for any variation in district boundaries except as provided in Section 30, Chapter 40, of the General Laws and in this section.
Section 21.
This by-law shall take effect as provided by law.

REPORT OF CEMETERY COMMISSIONERS
To the Board of Selectmen:
In submitting the following report we beg to say that our work this year consisted of care of lots and general maintenance.
We wish to call the attention of the voters again to a new plan which is badly needed for the older parts of the cemetery.
The boundaries of many lots, avenues and paths have in former years been changed and a correct plan should be made for the use of Town officials and lot owners.
We would recommend an appropriation of $1,500 for general maintenance and $500 for a new plan.

REPORT OF MOTH SUPERINTENDENT AND TREE WARDEN
To the Board of Selectmen:
I hereby submit to you my annual report of the Moth and Tree Warden Departments.
The work in the Moth Department has been carried on as usual. It was not necessary to do much spraying. Almost all the spraying done was private work and was paid for by the property owners.
In November and December a thorough scout was made for gypsy moth eggs. There is quite an increase in the number of these eggs found compared with the last two years. More than sixty-nine hundred clusters were creosoted. This number of clusters would contain over three million eggs. There were no browntail nests found.
It will probably be necessary to do more spraying the coming season than was done in 1925.
We spent during the year a total of $939.15; $664.15 of this was for public work and $275.00 was for private work and was paid for the property owners.
I would recommend that the Town appropriate a total of $1,500.00, $1,000.00 for public work and $500 for private work.
In the Tree. Warden Department a number of dangerous trees have been removed and the balance of the appropriation was spent in trimming trees. Not many bushes were cut on account of lack of funds.
Twenty-eight shade trees were set out in various parts of the town and I recommend that $1,500.00 be appropriated for the Tree Warden Department and $200.00 for the setting out of shade trees.

REPORT OF FIRE ENGINEER
We have had 60 alarms this year-13 chimney, 14 railroad, 16 grass and brush fires, 2 at the public dump, 8 for fires in buildings and 5 false alarms. Two calls to Walpole on forest fires. We had Walpole at one building and brush fire; also Dover at one house fire.
We have purchased 500 ft. of new hose and some new boots and put new tires on the front wheels of the chemical. We think it would be advisable to purchase some waterproof covers to take care of some of the water damage which in many cases amounts to more than the fire damage.
The reservoir at Pound and South Streets should have a larger supply pipe as the present supply is not large enough to be of much use. We reccomend the same appropriation, $3,000.00
