ANNUAL TOWN MEETING FOR THE ELECTION OF OFFICERS


March 5, 1951


Pursuant to the foregoing warrant the meeting was opened at 6:00 A.M. by the Moderator and after reading the warrant the polls were declared open. The ballot box had been ex- amined and found in good working order, instructions to voters posted and specimen ballots displayed at the entrance and within the polling place. The following persons were sworn in and assigned to their duties: Mary Mair Etienne and Anne Young, distributing ballots; Susan Kennedy, Helen Kennedy, Margaret Kennedy, Alice Ripley, William Owens, Beatrice Bangs, Mildred Lombard and Mary Horgan, as tellers; Abbie Sheahan and Frank Kennedy checking at the Ballot Box and Coleman J. Hogan in charge of the ballot box.


The polls were closed at 2:00 P.M. and the ballots were counted in open meeting. The results as shown by the final tabulation were as follows:

Article 6 Voted to authorize the Treasurer with the ap- proval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1951, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Chapter 44, Section 17, General Laws.


Article 7. Voted that the taxes shall be paid in two equal payments, July 1, 1951 and October 1, 1951, and the Collector shall receive 1% for the 1951 taxes.


Article 8. Voted to authorize the Collector to use all means in the collection of taxes as the Treasurer might if elected to that office.


Article 9. Voted to authorize the Selectmen to appoint one of its members as Clerk of the Highway Department.


Article 10. Voted that the Clerk of the Highway Depart- ment shall receive $25.00 per week.


Article 11. Voted to raise and appropriate the sum of $700.00 for the improvement of Chapter 90 Roads, providing the State or County, or both allot like amounts for this purpose.


Article 12. Voted to transfer the sum of $400.00 from the Road Machinery Fund to the Highway Machinery Operating Account to defray the expenses of the operation and maint- enance of Highway Machinery.


Article 13. Voted to raise and appropriate the sum of $50.00 for the salary of an inspector of wires under the pro- visions of Chapter 529 of the Acts of 1949.

Article 26. Voted that this article be dismissed wherein acceptance of an "Act relative to granting vacations for mem- bers of the regular or permanent Police and Fire forces" was asked.


Article 27. Voted to authorize the Selectmen to appoint a committee of five World War II veterans to prepare pre- liminary plans, specifications and estimated costs of a proper memorial for the Veterans of World War II.


Article 28. Voted to raise and appropriate the sum of $300.00 to provide a swimming place with requisite fittings and conveniences and instruction in swimming.


Article 29. Voted to raise and appropriate the sum of $200.00 to provide instruction and facilities for recreational and physical exercises.

Article 44. Voted to dismiss the petition for $1,000.00 to hard surface the avenues of Vine Lake Cemetery.


Article 45. Voted that a committee of five American Le- gionnaires be appointed to make arrangements to spend money appropriated under Article 4 for the observance of Memorial Day.


Article 46. Voted to raise and appropriate the sum of $2,500.00 for the purchase of a new truck for the water de- partment and authorize the sale of the old truck.


Article 47. Voted to raise and appropriate the sum of $600.00 for the purpose of cleaning the pond in the Vine Lake Cemetery.

TOWN WARRANT Commonwealth of Massachusetts


NORFOLK, ss.


To either of the Constables of the Town of Medfield, in said County, greeting:


In the name of the Commonwealth you are directed to notify and warn the inhabitants of the Town of Medfield, qualified to vote in elections and in town affairs, to meet at the Town Hall, in said Medfield on Wednesday the 11th day of July A.D. 1951 at 7:30 P.M. then and there to act on the following articles:


Article 1. To see if the Town will vote to appropriate the sum of $2600.00 as compensation to Madeline M. McCarthy for land damages in the matter of relocation of North Street in a settlement for suit of damages brought against Norfolk County by a Superior Court petition together with a further sum of $150.00 incurred as expense of said suit; also to deter- mine whether the money will be raised by borrowing or by an appropriation from available funds in the Treasury.


Article 2. To see if the Town will vote to transfer a sum of money from the Road Machinery fund to the Highway Operating Account to defray the expense of the operation and maintenance of highway machinery.

Article 3. To see if the Town will vote to appoint a committee to meet with the Department of Mental Health for' the purpose of arranging a new contract for the purchase of water, or do or act anything in relation thereto.


Article 4. To see if the Town will vote to adopt a By- Law which will be known as the Medfield Building Law as prepared by the Park & Planning Board in accordance with Chapter 143 (Ter. Ed) and subsequent amendments.


Article 5. To see if the Town will appropriate from available funds in the treasury the sum of $600.00 to cover expenses of administering the Building Code, including salary of building inspector, or do or act anything in relation thereto.


Article 6. To see if the Town will vote to adopt the following Earth Removal By-Law; "The removal of sod, loam, sand, gravel or stone from single or general residential districts of the Town of Medfield shall be deemed non-conforming use of premises. Such uses shall be permitted only after special permission of the Selectmen, and under such conditions as the Selectmen shall impose. The Selectmen shall not grant such permits as would, in their opinion adversely effect the scheme of growth laid down in the Zoning By-Law or elsewhere, or the economic status of the Town to tend to impair the beauty of the Town or of the district most immediately affected, or de- velop health or other hazards. Conditions deemed by the Selectmen as tending to protect the Town and the district, shall be imposed where needed and made a part of the permit. No permit for the excavation or removal of material shall be granted by the Selectmen for a period of more than seven days (7) from the date of issue but may be extended for additional seven (7) day periods at the discretion of the Selectmen. Permit issued by the Selectmen shall only be issued to an owner of record and shall not be transferable.


Article 7. To see if the Town will vote to re-zone to industrial use a section bounded as follows; on the northwest, by the railroad tracks of the Woonsocket Division of the New York, New Haven & Hartford Railroad from the intersec- tion of the Woonsocket Division with the Mansfield and Fram- ingham branch of the New York, New Haven & Hartford Rail- road 700 feet in a northeasterly direction; bounded on the southeast by a line running parallel to the Woonsocket Division for a distance of 1000 feet from the Mansfield and Framingham branch in a northeasterly direction; bounded on the northeast by a line drawn from this point to the end of the present industrially zoned property on the northeast line of the Woon- socket Division; bounded on the southwest by the Mansfield and Framingham branch of the New York, New Haven & Hart- ford Railroad a distance of 1000 feet (Park and Planning Board).

SPECIAL TOWN MEETING July 11, 1951


Pursuant to the foregoing warrant the meeting was called to order by the Moderator at 7:30 P.M. and the following action was taken on the articles in order;


Article 1. Voted to appropriate from available funds in the Treasury the sum of $2,750.00 as compensation to Madeline M. McCarthy in the sum of $2,600.00 for land damages in the matter of relocation of North Street in a settlement for suit of damages brought against Norfolk County by a Superior Court petition and $150.00 for the Expense of said suit.

Voted unanimously to adopt the following By-Law which will be known as the Medfield Building Law (with the exception of the two changes noted therein) as pre- pared in a printed booklet form by the Park and Planning Board in accordance with the Provisions of Chapter 143 (Ter. Ed.) and subsequent amendments, said booklet to be incor- porated in the Town Records.


TOWN OF MEDFIELD MEDFIELD BUILDING LAW


ARTICLE I


Title


This By-Law shall be known and cited as the Building By-Law.


ARTICLE II Authorities


Inspector, Appointment, Salary etc.


Section 1. The Board of Selectmen shall, annually in April, appoint a building inspector and plumbing inspector who shall hold office for the term of one year or until such time as their successors are appointed. Their appointments shall continue during good behavior and satisfactory service. The Board of

Selectmen shall have power to discharge the Inspector for failure to perform his duties, and to fill any vacancy in his office. They shall not be removed from office except for cause after full opportunity has been given them to be heard on specific charges.


Section 2. The building inspector shall be an architect, or a structural engineer, or a builder who has had 5 years or more experience in construction of buildings or in supervising construction of buildings. If the inspector appointed by the Selectmen shall engage in the construction or alteration of any building coming under these By-laws, the Selectmen shall appoint an acting building inspector to act in such cases who shall have the qualifications required of Inspector of Buildings.


Wherever the word Inspector occurs in this By-law without further addition, it shall mean the Inspector of Buildings.


Section 3. The Inspector of Plumbing shall be a Master Plumber. If the Inspector of Plumbing, appointed by the Selectmen, shall engage in plumbing coming under these By- laws, the Selectmen shall appoint an acting Inspector of Plumbing to act in such cases.


Section 4. Acting Inspectors. In case of the absence or disability of either Inspector, the Selectmen shall appoint an Acting Inspector who, during such absence or disability of that Inspector, shall possess all the powers and perform all the duties of the Inspector and who shall have the qualifica- tions required of such Inspector.


Section 5. Their compensation shall be regulated by the Selectmen unless determined by a vote of the Town.


DUTIES of Building Inspector


Section 6. He shall keep a record of all business of the Department, which record and all other books and papers relating to the transaction of the department shall be open at all times to the inspection of the Selectmen, and he shall submit them a yearly report on such business and such other reports as they may require.


He shall receive applications and issue permits for the erection and alteration of buildings as hereinafter described and shall keep detailed and sufficient records of such appli- cations and permits. He shall not give a permit for the erec- tion or alteration of any building until he shall have care- fully inspected the plans, specifications and premises, and ascertained that the building as proposed will conform to this By-Law. He shall, as often as practicable and necessary to secure compliance with this By-Law, inspect all buildings in the course of construction or alteration and shall make
