By virtue of this warrant I have notified and warned the inhabitants of the Town of Medfield, qualified to vote in elec- tions to meet at the time and for the purpose named by posting attested copies of the warrant in five public places in the town at least seven days before the time of holding the meeting.

SPECIAL TOWN MEETING February 20, 1950
Pursuant to the foregoing warrant the meeting was called to order at 7:30 P. M. by Mr. Frank G. Haley, Moderator Pro- tem, and after the warrant was read the following action was voted on the articles therein.
Article 1. Voted to authorize the Selectmen to accept in behalf of the Town a gift by deed from Norman H. Carlson a certain right of way or easement for the drainage of water on Adams Street bounded and described with conditions of said gift as follows:
Beginning on the Westerly side of Adams Street, at land of Sheldon R. Carlson and Norman H. Carlson, said point being five hundred eighty (580) feet, more or less, northerly of Dale Street, and bounded: SOUTHERLY by land of Sheldon R. Carlson, two hundred (200) feet; Westerly by Norman H. Carl-

son, ten (10) feet; NORTHERLY by land of said Norman H. Carlson, two hundred (200) feet; and EASTERLY by Adams Street, ten (10) feet; all as shown upon a plan, "Town of Med- field plan Showing Location of Drain Easement from Adams Street, Westerly on Land of Norman H. Carlson, October 26, 1949, Scale 1 in .- 40 ft., Charles C. Cain, Engineer," and to be recorded herewith.
The above right of way is granted for the purpose of dis charging surface water from said Adams Street so that said water will be discharged through a pipeline through the de- scribed premises and as more particularly shown on said plan. The grantee shall have the right to enter upon said premises from time to time as may be necessary to repair, relay or maintain said right of way for the purpose of discharging said surface water as herein mentioned.
Article 2. Voted to authorize the Selectmen to accept in behalf of the Town a gift by deed from Byron E. and Esther B. Bristol as joint tenants, a certain right of way or easement in the following described lands for the purpose of constructing a street drainage outlet necessary to dispose of the natural land and highway drainage, and include the right to construct, maintain, operate, repair, renew and replace a mian drain with man holes and other appurtenances in, through, over and under certain parcels of land situated between South and Philip Streets, Medfield, Massachusetts, and shown upon a plan show- ing location of Drain Easement between South and Philip Street, by Charles C. Cain, Engineer, dated January 28, 1950, and to be recorded herewith, bounded and described as follows, viz:
The center fine of said easement begins at a point on the Northeasterly side of South Street, said point being one hun- dred fifty three and 2/10 (153.2) feet, more or less, south- easterly of land of Henry C. and Mary E. Bridge; thence running N 46-59-10 E. a distance of one hundred twenty-three and 7/100 (123.07) feet by the said center line of said easement to an angle: thence N. 79-16-20 E. a distance of three hundred thirty and 76/100 (330.76) feet by said center line of said easement to an angle; thence S. 35-44 E., a distance of one hundred seventy-three and 46/100 (173.46) feet by said center line of said easement to an angle; thence S. 39-04-50 E., a distance of two hundred thirty-four and 20/100 (234.20) feet by said center line of said easement to an angle; thence S. 85-13-20 E. a distance of one hundred two (102) feet, more or less, by said center line of said easement to Hamant's Brook, so called.
This easement, so granted, being of a uniform width of ten (10) feet, five (5) feet on each side of the above described center line.
The surface of the above described premises shall, upon completion of any work, be restored, as far as can reasonably

be done, to the condition at the date of the commencement of said construction and may be used thereafter by the owners of the fee, their heirs and assigns for all legal purposes not inconsistent with the construction, maintenance, operation, re- pair and renewal of said drain.
Article 3. Voted that the Selectmen be and hereby are authorized on behalf of the Town of Medfield to execute in proper form a deed to Byron E. and Esther B. Bristol as joint tenants, without consideration, all the right, title and interest in a certain right of way in, through, and under the land in said Medfield situated on the Northerly side of South Street, and bounded and described as follows:
Southerly by said South Street, Easterly by Philip Street, Northerly by and in direction of the existing brook. Westerly by land of one Bridge; and releases and discharges all rights in said way for the purpose of discharging surface water as more particularly referred to in a deed from Susie A. Tibbetts et als to the grantor by deed dated September 29, 1939, and recorded with Norfolk Deeds Book 2261, Page 41.
Voted that the meeting be dissolved.

Article 6. To see if the Town will vote to authorize the Treasurer with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1950, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Chapter 44, Section 17, General Laws.
Article 7. To determine in what manner the taxes shall be collected for the ensuing year; also determine what per- centage shall be allowed the Collector for the ensuing year.
Article 8. To see if the Town will authorize the Collector to use all means in the collection of taxes as the Treasurer might if elected to that office.
Article 9. To see if the Town will vote to authorize the Selectmen to appoint one of its members as Clerk of the Highway Department, or do or act anything in relation thereto-
Article 10. To see what compensation the Town will allow the Clerk of the Highway Department for the ensuing year.
Article 11. To see if the Town will vote to raise and ap- propriate a sum of money for the improvement of Chapter 90 Roads, said money to be used in conjunction with any money alloted by the State or County or both for this purpose, or do or act anything in relation thereto.
Article 12. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Highway Operating Account to defray the expenses of the operation and maintenance of Highway Machinery.
Article 13. To see if the Town will accept Chapter 265 of the Acts of 1947 entitled "An Act Authorizing the Closing of Public Offices in Cities and Towns on Saturdays."

Article 14. To see if the Town will vote to raise and ap- propriate a sum of money to remodel and repair the old Legion Room to make it available for a General Welfare Office, or do or act anything in relation thereto.
Article 15. To see if the Town will vote to raise and ap- propriate a sum of money for making necessary repairs to the Town Offices, or do or act anything in relation thereto.
Article 16. To see if the Town will vote to raise and ap- propriate a sum of money for the purpose of repairing the Town Clock, or do or act anything in relation thereto.
Article 17. To see if the Town will vote to raise and ap- propriate a sum of money to defray the cost of land damages awarded by the County Commissioners in the taking of land for the relocation of North Street, or do or act anything in relation thereto.
Article 18. To see if the Town will vote to raise and ap- propriate a sum of money to defray the cost of land damages awarded by the County Commissioners in the taking of land for the relocation of Spring, South and High Streets, or do or act anything in relation thereto.
Article 19. To hear and act on the Tercentenary Com- mittee appointed under Article 42 of the Annual Town Meeting.
Article 20. To see if the Town will vote to raise and ap- propriate a sum of money for the proper observance of the 300th Anniversary of the Incorporation of the Town of Med- field, or do or act anything in relation thereto.
Article 21. To see if the Town will vote to raise and ap- propriate a sum of money to reconstruct the sidewalk on the West side of Pleasant Street, from Main Street a distance of approximately 625 feet, or do or act anything in relation thereto.
Article 22. To see if the Town will vote to raise and ap- propriate a sum of money to construct a cement sidewalk on Main Street in front of St. Edward's Church Rectory for a distance of approximately 96 feet, or do or act anything in relation thereto.
Article 23. To see if the Town will vote to raise and ap- propriate a sum of money to reconstruct the sidewalk around Sauer's Block for a distance of approximately 190 feet, or do or act anything in relation thereto.
Article 24. To see if the Town will vote to raise and ap- propriate a sum of money to construct an asphalt sidewalk on the north side of West Main Street from the NY NH & H RR Co. to a stone bound on the property of Philip & Violet Gove, or do or act anything in relation thereto.

To see if the Town will vote to adopt the fol- lowing By-Law: "No person or corporation shall construct a building or make any exterior structural changes in a building nor change a single family dwelling to a multiple family dwel- ling without first notifying the Board of Selectmen or do or act anything in relation thereto. Article 28. To see if the Town will vote to adopt the fol- lowing Earth Removal By-Law: "The removal of sod, loam, sand, gravel or stone from single or general residence districts of the Town of Medfield shall be deemed non-conforming use of premises. Such uses shall be permitted only after Special permission of the Selectmen, and under such conditions as the Selectmen shall impose. The Selectmen shall grant no such permits as would, in their opinion adversely affect the scheme of growth laid down in the Zoning By-Law or elsewhere, or the economic status of the Town or tend to impair the beauty of the Town or of the district most immediately affected, or develop health or other hazards. Conditions deemed by the Selectmen as tending to protect the Town and the district, shall be imposed where needed and made a part of the permit. No permit for the excavation or removal of material shall be granted by the Selectmen for a period of more than seven (7) days from the date of issue but may be extended for additional seven (7) day periods at the discretion of the Selectmen. Per- mit issued by the Selectmen shall only be issued to an owner of record and shall not be transferable. (Park and Planning Board)
Article 29. To see if the Town will vote to raise and ap- propriate a sum of money for the purpose of providing instruc- tion and facilities for recreational and physical exercises, or do or act anything in relation thereto.
Article 30. To see if the Town will vote to raise and ap- propriate a sum of money to lease land for an open bathing place, equip it with requisite fitting and conveniences and provide instruction in swimming, or do or act anything in relation thereto.
Article 31. To see if the Town will vote to authorize the Tree Warden to dispose of the old sprayer by sale or other- wise, or do or act anything in relation thereto.

Article 49. To see if the Town will vote to raise and ap- propriate a sum of money for tuition to State Aided Voca- tional Schools, or do or act anything in relation thereto.
Article 50. To see if the Town will authorize the Assessors to use a sum of money not to exceed $20,000.00 from free cash in the Treasury for the reduction of the 1950 tax rate.
Article 51. To see if the Town will vote to release and discharge a certain right of way or easement in certain land adjacent to South and Philip Street and more particularly described in a certain deed from Susan A. Tibbetts, et als, to the Town of Medfield and recorded with the Norfolk County Registry of Deeds, Book 2261, Page 41, or do or act anything in relation thereto.

Pursuant to the foregoing warrant the meeting was opened at 6:00 A.M. by the Moderator and after reading the warrant the polls were declared open. The ballot box had been examined and found in good working order, instructions to voters posted and specimen ballots displayed at the entrance and within the polling place. The following persons were sworn in and assigned to their duties: Mary Hardie and Alice Ripley distributing ballots, Anita Ofria, Cora Beaton, Edward Sweeney, William Owens, Beatrice Bangs, Winifred Greene, Helen Kennedy, Mary Horgan as tellers, Frank Kennedy and Abigail Sheahan checking at the ballot box and Coleman Hogan in charge of the ballot box.
The polls were closed at 2:00 P.M.
