Report of TOWN CLERK


Record of Action Taken at Annual Town Meeting Held March 8, 1954


Meeting called to order at 8:05 P. M. by Moderator Gordon Millar who read the call for the meeting and the Constable's Return.


On motion duly made and seconded, it was voted to dispense with the reading of the Articles until taken up for action.


At this time Mr. Ferren, Chairman of the Planning Board re- quested permission of the Moderator to read the following:


Mr. Moderator:


The Planning Board has asked me to present a resolution for the consideration of the people of Lynnfield.


As you all know, after many years of active and unselfish service Mr. Louis B. Tuck has retired from his position as Chair- man of the Planning Board - a position he has held for many years.


After so long a period of conscientious service, we think the Town should note its appreciation by adopting the following resolution:


"Be it resolved that the Town of Lynnfield extends its sincere and heartfelt appreciation to Mr. Louis B. Tuck on the occasion of his retirement from active participa- tion in Planning affairs. The Town is especially grateful for his loyal and conscientious service in carrying out the responsibilities of the office to which he has been re- elected for so many years. "


I respectfully request, Mr. Moderator, that the sentiments of the Town be expressed by a standing vote.


ARTICLE 1. Voted, unanimously, on motion duly made and seconded, that the following Town Officers not required to be chosen by ballot be appointed as follows:

ARTICLE 2. Voted, unanimously, on motion duly made and sec- onded, that the Reports of Town Officers and Special Committees be accepted as published.


ARTICLE 3. Voted, on motion duly made and seconded, that the Town AMEND the BUILDING LAWS of the Town of Lynn- field by striking out Sections 12 and 13, and substituting in their


place the following:


"Section 12. All installations of plumbing shall be in ac- cordance with the Plumbing Ordinance of the Town of Lynnfield. "


"Section 13. All garages joined to a dwelling or con- nected by a roofed passageway shall be plastered with cement plaster or sheathed with non-combustible material. Any doorway leading from a garage into a dwelling shall be equipped witha self closing metal covered door. The door frame on the garage side to be metal covered. "


A two-thirds vote being required tellers were appointed by the Moderator who returned the following count.

ARTICLE 4. Voted, unanimously, on motion duly made and seconded, that the Town authorize the Board of Selectmen to ap- point a committee of five members to study the desirability of es- tablishing a DEPARTMENT OF PUBLIC WORKS in the Town of Lynnfield, as authorized by the Acts of 1953, Chapter 101, said committee to report its findings to the Board of Selectmen in writing not later than September 1, 1954.


ARTICLE 5. Voted, unanimously, on motion duly made and seconded, that the Town authorize the Board of Selectmen to ap- point a committee of five members to study the INSURANCE NEEDS of the Town of Lynnfield, said committee to submit its findings to the Board of Selectmen in writing not later than Sep- tember 1, 1954.


ARTICLE 6. Voted, unanimously, on motion duly made and seconded, that the Town authorize the Board of Selectmen to ap- point a committee of five members to study the desirability of establishing a STABILIZATION FUND for the Town of Lynnfield, said committee to report its findings to the Board of Selectmen in writing not later than September 1, 1954.


ARTICLE 7. Voted, unanimously, on motion duly made and seconded, that the Town raise and appropriate the sum of $600. 00 to purchase a NEW CRUISING CAR for the use of the Police Department. This car to be purchased under the supervision of the Board of Selectmen and the Chief of Police Department, and this committee to be permitted to dispose of the present cruising car, and to use the proceeds toward the purchase price of the new vehicle.


ARTICLE 8. Voted, unanimously, on motion duly made and seconded, that the Town raise and appropriate the sum of $35, 802. 46 for the general expense of the POLICE DEPART- MENT, said sum to be allocated as follows: Salary of Chief $ 4,485.80

ARTICLE 29. Voted, unanimously, on motion duly made and seconded, that the Town raise and appropriate the sum of $ 8, 000. 00 for the development of a PLAY AREA AT THE SOUTH SCHOOL.


ARTICLE 30. Voted: on motion duly made and seconded, that the Board of Selectmen be, and it hereby is, authorized and in- structed to acquire by purchase, by eminent domain, or other- wise, for school and playground purposes, land now or formerly owned by Ida M. Pope and Helen L. Westover described as fol- lows:


Starting from a point at Summer Street bounded by the Ida M. Pope and Marion A. De Wilde properties and proceeding 1029.74 feet in a northeasterly direction to a point on a stone wall at in- tersection of Ida M. Pope, Marion A. De Wilde and Helen West- over properties; thence turning and running along the said stone wall 576. 87 feet in a northwesterly direction to a stake; thence turning and running 705. 64 feet in a southwesterly direction to the southeaster ly corner of the Ernest E. Lockhart property; thence proceeding along the southerly boundary 200 feet of said Ernest E. Lockhart property to an iron pipe on the easterly line of Sum- mer Street; thence turning and running along said line of Summer Street 106. 39 feet in a southeasterly direction to the intersection of the Helen Westover and Fred Perrin properties; thence turn- ing in a northeasterly direction 120 feet along the northerly boundary of said Fred Perrin property; thence turning and running in an easterly direction along the easterly boundary of the said Fred Perrin property 120 feet; thence turning and running in a southwesterly direction along the southeaster ly boundary of said Fred Perrin property 120 feet to a point on the easterly line of Summer Street; thence turning and running along said line of Summer Street in a southeasterly direction 258.58 feet to the point of beginning, and containing 11.2 acres, more or less, and as shown on a plan entitled "Plan of Land in Lynnfield, Massa- chusetts to be conveyed to the Inhabitants of the Town of Lynn- field, " dated January 1954 and drawn by H. ARTICLE 31. Voted, on motion duly made and seconded, that the sum of $25, 000. 00 be, and the same hereby is transferred from the Excess and Deficiency Account and appropriated for the following purposes:


(a) A sum not exceeding eighteen thousand ($18, 000. 00) dollars for the payment of the land damages or purchase price of the land buildings now or formerly owned by Ida M. Pope; (b) A sum not exceeding three thousand($3, 000. 00) dollars for the payment of the land damages or purchase price of the land now or formerly owned by Helen L. Westover; All of said property being described in the vote under Article 30 of this Warrant, which description is incorporated herein by this reference and made a part hereof; and (c) A sum not exceeding four thousand ($4, 000. 00) dollars for the payment of legal, engineering and other services and expenses incidental to taking or purchase of said property; Said sums of money to be expended under the direc- tion of the Board of Selectmen. ARTICLE 32. Before voting on this article a map of the pro- posed location was shown, to the voters.


Voted: That the Board of Selectmen be, and it hereby is, authorized and instructed to acquire by eminent domain, or by purchase, for school and playground purposes, the land now or formerly owned by Allene H. Rideout situated southeasterly of Main Street, acquired by her under Parcel No. 2 of a deed from Susan B. Taylor et al. dated September 5, 1946 and recorded with Essex South District Registry of Deeds in Book 3477, Page 352, which land is bounded: Southwesterly by land now or for- merly of Warren Newhall about 400 feet; Southeasterly by land formerly of the Danvers Railroad about 90 feet; again South- easterly by land of Julius B. and Lillian S. Rombult, formerly of J. M. Danforth, about 775 feet; Northeasterly by other land of Allene H. Rideout (shown as Lot B on plan recorded with said deeds in Plan Book 49, Plan No. 5), formerly of Mary U. Nash, about 313.5 feet; Northwesterly by a brook at other land of the Town of Lynnfield about 300 feet; Southwesterly by other land of the Town of Lynnfield about 60 feet; and Northwesterly by other land of the Town of Lynnfield about 650 feet; together with a right of way 50 feet wide from said land to Main Street.


ARTICLE 33. Voted, on motion duly made and seconded, that the sum of $7, 000. 00 be, and the same hereby is transferred from the Excess and Deficiency Account and appropriated for the following purposes:


(a) A sum not exceeding $3, 500. 00 for the payment of the land damages or purchase price of the land now or formerly owned by Allene H. Rideout and described in the vote under Article 32 of this Warrant, which description is incorporated herein by this reference and made a part hereof; and (b) a sum not to exceed $3, 500. 00 for the payment of legal, engineering and other services and expenses incidental to taking or purchase of said land; said sums of money to be expended under the direc- tion of the Board of Selectmen.

ARTICLE 34. Voted unanimously, on motion duly made and seconded, that the Town authorize the Board of Selectmen to ap-

point a SCHOOL BUILDING COMMITTEE of seven citizens; said committee to obtain preliminary plans and sketches, and es- timates of cost for the construction of an elementary school building. Provided, however, that the plans and sketches be submitted to the following Boards and Committees:


1. Board of Selectmen


2. The School Committee


3. The Finance Committee


4. The Planning Board


and the approval of at least three of these Boards or Committees


of the plans to be secured before estimates are obtained; and the said School Building Committee to report to the Town at or be- fore a Special Town Meeting in November, 1954.


ARTICLE 35. Voted, unanimously, on motion duly made and seconded, that the Town raise and appropriate the sum of $5, 000. 00 to procure preliminary plans and sketches for a new elementary school, by the School Building Committee authorized under the preceding article.


On motion made by Mr. Condon, duly seconded it was voted to adjourn the meeting until March 15, 1954 at 8:00 P. M.

The meeting was called to order by the Moderator, Gordon Millar at 8:05 P. M. with approximately 464 present.


ARTICLE 36. Voted, unanimously on motion duly made and seconded, that the Town authorize the Board of Selectmen to ap- point a committee of seven citizens to act as the FUTURE SCHOOL PLANT PLANNING COMMITTEE. Said committee to study the future school plant needs of the Town of Lynnfield.


ARTICLE 37. Voted, unanimously on motion duly made and seconded, that action on this article be indefinitely postponed.
