Do you approve of a law summarized below which was disapproved in the House of Represen- tatives by a vote of 73 in the affirmative and 132 in the negative and was approved in the Senate by a vote of 21 in the affirmative and 17 in the negative? Summary The proposed measure provides that every former public employee, other than a judge, who is pensioned or retired for disability, shall report to his retirement authority, annually, his earnings from gainful occupation during the preceding year; and that, if such earnings, plus the pension, exceed the regular compensation of the position formerly held, the pensioner shall refund that portion of his pension equal to such excess or the entire pension if such excess is greater than the pension. A refund, if required, shall not include any part of a pension represented by salary deductions from or special purchase by the former employee. The requirement of a refund is not applicable to income received in or prior to 1958.

The amendment being seconded and voted, the original motion as amended was voted on and passed, unanimously.
Following the completion of action on Article 5, the following motion was voted; That this Annual Town Meeting be suspend- ed until action has been completed on the Articles appearing in the Warrant for the Special Town Meeting, called for 9 P.M. on Monday, March 10, 1958, in the Junior High School Auditorium, and the Gymnasium if. necessary. At this time the Moderator called for a recess until 9 P.M.

ARTICLE 1
Motion made and seconded, that the sum of $635,000.00 be raised and appropriated, or appropriated by transfer, or both, and added to the amounts previously appropriated for the purpose of constructing and originally equipping and furnishing a New Elementary School Building on Town owned property off Summer Street, and that to meet said appro- priation the sum of $35,000.00 be transferred from available funds in the Treasury, and that the Treasurer, with the approval of the Board of Selectmen, be and hereby is au- thorized to borrow the sum of $150,000.00 under authority of Chapter 44 of the General Laws, and the sum of $450,000.00 under au- thority of Chapter 645 of the Acts of 1948 as amended, and to issue bonds or notes of the town therefor payable in accordance with provisions of Chapter 44 of the General Laws so that the whole loan shall be paid in not more than twenty years from the date of is- sue of the first bond or note. Be it further voted that the School Building Committee be and hereby is authorized to enter into all contracts and agreements necessary to con- struct, equip, and furnish said New Elemen- tary School Building. Following a lengthy discussion a motion was made, seconded and voted, by a count of 463 in the affirmative and 34 in the negative to limit further dis- cussion of the article, and vote on the origi- nal motion. Tellers were appointed and a counted vote taken by a raising of hands, showed 317 in favor and 221 opposed, and this not being at least two thirds in favor,
the Moderator declared the Article defeated.
Following a motion made and seconded, it was voted to adjourn the Special Town Meeting to 8 P.M. March 17, 1958, at the Lynnfield Junior High School, and Gymna- sium.
ADJOURNED SPECIAL MEETING March 17, 1958
Meeting called to order by the Moderator at 8.15 P.M., followed by a motion duly sec- onded, to reconsider action on Article 1, which was defeated at the Special Town Meet- ing of March 10, 1958.
After a voice vote was doubted the Mod- erator appointed tellers and a vote taken by the showing of hands, the result being 526 in favor, and 239 opposed. Action now re- verted to the original motion. Following a lengthy discussion, a motion was made and seconded, that a vote be taken by secret ballot. This motion was declared defeated following a voice vote.
A motion was now made and seconded, to act on the previous question without further debate. A counted vote showed 553 in favor, and 153 opposed. Being more than the neces- sary two thirds, the motion was carried.
A vote now taken by a showing of hands, and counted by tellers, had 509 voting in favor of the original motion, and 275 opposed. Once again, not being the necessary two

thirds in favor, the motion was declared de- feated. The count being doubted, another count was taken with 517 voting in favor and 285 opposed and again the motion was de- clared defeated.
ARTICLE 2
Voted by a vote of 316 in favor and 23 op- posed to authorize and instruct the Board of Selectmen TO PURCHASE A LOT OF LAND ON TRICKETT ROAD, from Realty Construc- tion and Engineering, Inc., to provide access to the proposed Huckleberry Hill School from Trickett Road, said lot being bounded and described as follows:
The land on Trickett Road, Lynnfield, Massachusetts, the same being lot no. 145 on plan of land entitled, "Plan Show- ing Revision of Lots in Section 12, Glen Meadow Park, Lynnfield, Mass.", Owner: Realty Construction and Engineering, Inc., dated April 25, 1955, Warren M. Mirick, Reg. Surveyor, recorded with Essex South District Registry of Deeds as Plan No. 46 in Plan Book 86, bounded and described as follows:
Northwesterly by Trickett Road, by three lines, a curved line, thirty-nine and 27/100 (39.27) feet, a straight line, seven and 64/100 (7.64) feet and another curved line, ninety-six and 9/100 (96.09) feet; Northeasterly by lot No. 144. one hundred seventy-seven and 3/100 (177.03) feet; Southeasterly by land now or for- merly owned by John and Doris Gayth- waite, eighty-eight and 45/100 (88.45) feet; Southerly by land now or former- ly owned by James E. and Margaret L. Rich, one hundred fifty-nine and 35/100 (159.35) feet; Southwesterly by Proposed Road, one hundred twenty- six and 17/100 (126.17) feet; containing 30,400 square feet, more or less, and raise and appropriate the sum of five hundred dollars for the purchase of the same.
