ARTICLE 36.


Following the reading of a report by the Plan- ning Board, it was voted unanimously that the Town amend that part of clause (g) of Section 4 of the Zoning By-Laws which specify the distance required for Limited Business, General Business and Commercial Zones, by striking out the pres- ent requirements in the table for said zones and substituting the following distances:

ARTICLE 37.


Voted that the Town accept a gift by deed from Melch Bros. Corp. of certain land in Lynnfield, Massachusetts for proposed playground area as follows:


Parcel 1 containing 198700 square feet of land and Parcel 2 containing 10325 square feet of land all as shown on "Plan of Land in Lynnfield, Mass. for Proposed Playground area, dated Sep- tember 21, 1959, George E. Hayes, Civil Engi- neer".


A motion to reconsider Article 35 was made at this time but was defeated by a voice vote.


ARTICLE 38.


This article, as amended, was voted unani- mously, namely:


"that the Town of Lynnfield hold the follow- ing described parcels of land to which the Town holds title by virtue of acquisition for non-pay- ment of taxes, for the purpose of a wildlife sanc- tuary:


1. A piece of meadow land situated in Lynn- field in Reedy Meadow, so called, containing two

acres, more or less, and bounded as follows: Be- ginning at the northerly corner of said land at a stone post by the upland of Elethia L. Bancroft, now or formerly, thence running southerly by meadow land now or formerly of E. A. Batchelder about eighty rods to Beaver Dam Brook a few rods northerly of the junction of said brook with the Saugus River, thence southeasterly by said brook four rods to meadow land now or former- ly of the said Bancroft, thence northeasterly by said meadow land now or formerly of said Ban- croft about eighty rods to a stone post on the up- land, thence northwesterly by the upland four rods to the point of beginning, being the first par- cel described in the deed from J. M. Danforth, to J. Rourke, et. al. recorded in Essex South District Registry of Deeds, Book 1807, Page 90.


2. Also, a certain piece of swamp land in said Lynnfield situated southerly from the above des- cribed lot and westerly and near the junction of Beaver Dam Brook and Saugus River and bound- ed easterly by said Brook, southerly and westerly by said River and northerly by swampland for- merly of John Danforth, being the second parcel described in said deed from J. M. Danforth to J. Rourke, et al., except so much thereof as is situa- ted in the Town of Wakefield. For title to the first and second parcels herein described, see Es- sex South District Registry of Deeds, Book 3085, Page 301, and Book 3436, Page 9.


3. A certain parcel of land containing eight and one-half acres, known as Dark Swamp Island, and being the same land described in an instrument of taking by the Collector of Taxes for the Town of Lynnfield, dated August 30, 1951, and recorded in Essex Registry of Deeds, South District, Book 3854, Page 264, said land being a portion of the fifth parcel described in a deed from Eli P. Has- kell to J. D. Henderson and W. D. Parker, dated December 28, 1914, and recorded in said Registry, Book 3609, Page 543: meaning to convey so much of said fifth parcel as was situated in the Town of Lynnfield on the date of said Haskell deed. For further reference, see Book 4038, Page 13 in said Registry.


4. A certain tract of meadow land containing about eight acres, more or less bounded as fol- lows: Southerly or southeasterly on Saugus River; westerly or northwesterly on meadow of Andrew Mansfield (now or late of Lawrence) by a ditch to a stake; northerly or northeasterly by land of William Mansfield and Eli Upton (now or late of J. T. Bancroft) ; easterly or southeasterly by meadow of Elijah Hewes (now or late of Her- rick). Being the same premises conveyed to the Town of Lynnfield by Tax Collector's Deed dated October 19, 1923, recorded in Essex Registry of Deeds, South District, Book 2573, Page 103. For further reference, see Treasurer's Deed recorded in said Registry at Book 3124, Page 41. Also see Book 2203, Page 492 in said Registry.


ARTICLE 39.


Voted unanimously to indefinitely postpone action on this article, namely:


"To see if the Town will vote to use the sum of money labeled "Surplus War Bonus Fund and Accumulations" together with the interest there- on, (which money was returned to the Town un- der the provisions of Chapter 480 of the Acts of 1924, and which was voted under Article 29 of the warrant of the Annual Town Meeting of March 9, 1925 to be expended for the acquisition of land for a Memorial Building which, when built, would be known as a Memorial to the Soldiers and Sailors of Lynnfield, and could contain quarters for Lynnfield Post 131 of the American Legion) for the construction or acquisition of a building to be known as a Memorial Building to honor those from Lynnfield who served our country in all branches of the Armed Forces, which building shall contain quarters for Lynnfield Post 131 of The American Legion, said money to be expended by a committee composed of the officers of said Lynnfield Post 131 of the American Legion."


ARTICLE 40.


Voted unanimously that the Town abandon an easement, acquired for the purpose of establish- ing a public way over a portion of Knoll Road, as originally laid out over certain land shown as Lot 3 and Lot 4 on a Plan of Land in Lynnfield, Mass., dated May 23, 1959, George E. Hayes, C.E., which said parcels are more particularly bounded and described as follows: Lot 3:


Northwesterly by Lot 1, as shown on said plan, eighty-one and 32/100 (81.32) feet;


Northeasterly by Lot 4, as shown on said plan, forty-one and 75/100 (41.75) feet;


Southeasterly as shown on said plan, one hun- dred two and 84/100 (102.84) feet; and


Southwesterly by land of the Town of Lynn- field, forty-one and 72/100 (41.72) feet. Lot 4:


Northwesterly by Lot 2, as shown on said plan, ninety-two and 16/100 (92.16) feet;


Northerly as shown on said plan, ninety-five and 34/100 (95.34) feet;


Southeasterly as shown on said plan, one hun- dred sixty-six and 73/100 (166.73) feet; and


Southwesterly by Lot 3, as shown on said Plan, forty-one and 75/100 (41.75) feet.


and to authorize the Selectmen to execute, ac- knowledge and deliver a deed, release or other in- strument to convey and transfer to Melch Bros. Corp. any easement, right of way or other interest the Town may have therein.


ARTICLE 41.


Voted unanimously that the Town deed and transfer to Melch Bros. Corp. the fee in a certain parcel of land off Knoll Road, shown as Lot No. 2, containing 2,278 square feet, on a Plan of Land in Lynnfield, Mass., dated May 23, 1959, George E. Hayes, C.E., which plan is duly recorded with Essex South District Registry of Deeds, and which parcel is more particularly bounded and des- cribed as follows:


Being a triangular piece of land bounded:

Northerly and Southwesterly by Lot No. 1, as shown on said Plan, one hundred seventeen and 84/100 (117.84) feet, and fifty-one and 61/100 (51.61) feet respectively;


Southeasterly by Lot No. 4, as shown on said Plan, ninety-two and 16/100 (92.16) feet


and to authorize the Selectmen to execute, ac- knowledge and deliver a deed or other instrument to convey and transfer the fee in said parcel to Melch Bros. Corp., and in consideration there- for and in exchange therefor, to receive a deed from said Melch Bros. Corp. to the Inhabitants of the Town of Lynnfield, transferring the fee in a certain parcel of land off said Knoll Road, in said Lynnfield, shown on Lot No. 3, containing 3683 square feet, on the above mentioned Plan, and which said Lot No. 3 is more particularly bounded and described as follows:


Northwesterly by Lot 1, as shown on said Plan, eighty-one and 32/100 (81.32) feet;


Northeasterly by Lot 4, as shown on said Plan, forty-one and 75/100 (41.75) feet;


Southeasterly as shown on said Plan, one hun- dred two and 84/100 (102.84) feet; and


Southwesterly by land of the Town of Lynn- field, forty-one and 72/100 (41.72) feet.


ARTICLE 42.


Voted unanimously that the Town accept as a public way Carpenter Road, as approved by the Planning Board and laid out by the Board of Se- lectmen as follows:


Running northwesterly from the northerly side of the Newburyport Turnpike (Broadway) for a distance of 900 feet, more or less, to a dead end, and for a width of 50 feet, as shown on a plan by John W. Parsons, C.E., dated July 27, 1953, said plan having been approved by the Lynnfield Planning Board on November 3, 1953.


ARTICLE 43.


Voted that the Town accept as a public way Beaver Avenue (Portion), as approved by the Planning Board and laid out by the Board of Se- lectmen as follows:


Running in a northerly direction from that por- tion of Beaver Avenue previously accepted as a public way, for a distance of 220 feet, more or less to Grayland Road, and for a width of 40 feet, as shown on a plan entitled "Subdivision, Beaver Avenue and Grayland Road, Henry A. Peterson, Engineer, June 14, 1954", which plan was ap- proved by the Lynnfield Planning Board on June 21,1954.


ARTICLE 44.


Voted unanimously that the Town accept as a public way Herrick Lane, as approved by the Planning Board and laid out by the Board of Se- lectmien as follows:


Running from the southerly side of Gerry Road, for a distance of 400 feet, more or less, and for a width of 40 feet, as shown on a plan by War- ren Mirick, C.E., dated April 28, 1953, as approved by the Lynnfield Planning Board on October 4, 1954, and covering that portion of the street shown on said plan from Lot 31 to Lot 56 inclu- sive.


ARTICLE 45.


Voted that the Town accept as a public way Melch Road (Portion), as approved by the Plan- ning Board and laid out by the Board of Select- men as follows:


Running from the westerly side of Summer Street, in a southwesterly direction for a distance of 1015 feet, more or less, and for a width of 40 feet, as shown on a plan by Edward S. Averell, C.E., entitled "Huckleberry Hill, Section 3, Aug- ust 1, 1954", as approved by the Lynnfield Plan- ning Board on September 27, 1954, and covering that portion of the street shown on said plan from Sumner Street to and including Lots 35, 34.


ARTICLE 46.


Voted that the sum of $4,000. be raised in the tax levy and appropriated for the repaving and repair of Melch Road (Portion) under the direc- tion of the Road Commissioner.


All articles in the Warrant having been acted upon, the meeting was declared adjourned "Sine Die" by the Moderator.

sented a check in the amount of $60,000 to Town Treasurer Harry W. Higgins. Present for the occasion were Selectmen Richard L. Hobbs, Mason J. Condon and Chairman Proctor A. Coffin.
