Said Jacob's Trail will be 40' in width.


Said Prouty Avenue will be 40' from Jacob's Trail to Duncan Drive and 30' to land of Hynes.


Said Duncan Drive will be 30' in width.


Said way or ways are more particularly shown on a plan entitled 'Plan of Part of Jacob's Trail, Prouty Avenue and Duncan Drive, Nor- well, Massachusetts' by W. G. Ford, C. E., Marshfield, Mass., dated Octo- ber 20, 1947, scale 40 feet to an inch, a copy of which is on file in the office of the Town Clerk.


Said ways are to be known as Jacob's Trail, Prouty Avenue and Dun- can Drive.


Lacking one vote of being unanimous, it was voted that the layout of certain town ways pursuant to petition of Bertha A. Kees and others made by the Selectmen and filed in the office of the Town Clerk (from A. in preceeding article) be and hereby is accepted and the Selectmen be and they hereby are authorized in the name and behalf of the town to take by eminent domain, or accept deeds of the fee in the land in- cluded within the way or ways to be known as Jacobs Trail, Prouty Avenue and Duncan Drive.


Article 2. To see if the town will raise and appropriate the sum of $500. to put the ways described in Article 1 in condition to plow, said sum to be spent under the direction of the road surveyor, or act on anything relative thereto. Approved by the Advisory Board.

Article 3. To hear and act upon The Report of The Water Com- mittee. A motion was made, seconded and put to vote to accept the Report of the Water Committee. The Moderator declared the voice vote in favor of accepting the report. Seven voters doubted this decision, whereupon a poll was taken, with the following result.


277 voted to accept and file the Report of the Water Committee.


9 voted not to accept and file the Report of the Water Committee.


Article 4. To determine whether the town will accept Chapter 496 of the Acts and Resolves passed by the General Court of Massachusetts during the session of 1947 and approved June 4. 1947. being an act entitled "An Act to Authorize the Town of Norwell to Supply Itself and Its Inhabitants with Water."

Article 5. To determine whether the town will authorize the incur- ring of debt in the amount of three hundred and fifty thousand ($350,- 000.) dollars or such other amount as may be determined upon at the meeting for the purpose of supplying itself and its inhabitants with water and for the other purposes set forth in Chapter 496 of the Acts and Resolves passed by the General Court of Massachusetts during the session of 1947 being an Act entitled "An Act to Authorize the Town of Nor- well to Supply Itself and Its Inhabitants with Water" and for the pur- pose of establishing or purchasing a system for supplying the town and its inhabitants with water, for taking or purchasing water sources, or water or flowage rights, or for taking or purchasing land. for the pro- tection of a water system, two hundred and fifty thousand (250,000) dollars of such indebtedness to be incurred from time to time pursuant to the provisions of Chapter 496 of the Acts and Resolves of 1947 afore- said and the balance thereof to be incurred from time to time pursuant to the provisions of G.L. (Ter. ed.) Chapter 44 Sec. 8 Clause (3); and to provide for the repayment thereof; and to determine whether the town will authorize the town treasurer with the approval of the selectmen to issue from time to time, notes or bonds of the town in such amount or amounts and upon such terms and conditions as may be determined by the town treasurer with the approval of the selectmen for the purposes of pursuant to and consistently with the statutes aforesaid and the other applicable provisions of G.L. (Ter. ed.) Chapter 44 but not to exceed in the aggregate the sum of three hundred and fifty thousand (350,000) dollars or such other amount as may be determined at said meeting, such notes to be payable not more than thirty years from the issue thereof and in such annual payments to begin not later than three years after the date thereof as will extinguish such loan or loans at maturity or as may otherwise be authorized or required by law.

To raise and appropriate $135,000. for the purpose of establishing a water supply system as authorized by Chapter 496 of the Acts of 1947 and to meet said appropriation, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow $135,- 000. and issue bonds or notes of the town therefor, payable in not more than thirty (30) years in accordance with the provisions of said Chapter 496 of the Acts of 1947.

Article 7. To determine whether the town will until further vote of the town rescinding, amending or otherwise modifying its action here- under, vote to authorize the board of selectmen acting as a board of water commissioners until a board of water commissioners is elected and takes office and thereafter the board of water commissioners to per- form all acts and do all other things for and in behalf and in the name of the town or otherwise that may be necessary or proper for the estab- lishment of a water supply system for itself and its inhabitants pursuant to and conformably with Chapter 496 of the Acts and Resolves passed by the General Court of Massachusetts during the session of 1947 being an act entitled "An Act to Authorize the Town of Norwell to Supply Itself and Its Inhabitants with Water" and to confer upon the board of selectmen acting as a board of water commissioners until a board of water commissioners is elected and takes office and thereafter upon the board of water commissioners full power and authority to act for and in behalf and in the name of the town or otherwise under said Act and to vest in said board or boards as aforesaid all the authority con- ferred upon the town by said Act including specifically full power and authority to make any taking or taking and to enter into any agreements or contracts they deem necessary or appropriate under said Act.

Hanover or either of them for the purchase and sale of water and the establishment by Scituate in Norwell of a water supply and distribution system and to do all other things and perform all other acts and take any action and enter into any agreement or agreements that they deem necessary or appropriate pursuant to and under the authority of Chapter 263 of the Acts and Resolves passed by the General Court of Massachu- setts in the year 1943 being entitled "An Act Authorizing the Town of Scituate to Acquire Additional Water Supply" as most recently amended by Chapter 481 of the Acts and Resolves passed by the General Court of Massachusetts in the year 1947 being entitled "An Act Relative to the Acquisition of Additional Water Supply by the Town of Scituate" for and in behalf and in the name of the town or otherwise to do any and all other things and to enter into any or all contracts and agreements which the town may lawfully do under said acts or either of them or any other statute, act or acts relating to water supply.


Unanimously voted that until further vote of the town rescinding, amending or otherwise modifying this vote, the board of selectmen until a board of water commissioners is elected and takes office and there- after the board of water commissioners be and hereby is authorized to enter from time to time into an agreement or agreements for and in behalf and in the name of the town or otherwise with the towns of Scituate or Hanover or either of them for the purchase and sale of water and the establishment by Scituate in Norwell of a water supply and distribution system and to do all other things and to perform all other acts and take any action and enter into any agreement, pursuant to and under the authority of Chapter 263 of the Acts and Resolves passed by the General Court of Massachusetts in the year 1943, being entitled "An Act Authorizing the Town of Scituate to Acquire Additional Water Supply" as most recently amended by Chapter 481 of the Acts and Resolves passed by the General Court of Massachusetts in the year 1947 being entitled "An Act Relative to the Acquisition of Additional Water Supply by the Town of Scituate" and for and in behalf and in the name of the town or otherwise to do any and all other things and to enter into any or all contracts and agreements which the town may lawfully do under said acts or either of them or any other statute, act or acts relating to water supply.


Article 9. To determine whether the town will elect at the next annual town meeting, a board of water commissioners, one for three years, one for two years, one for one year and one for three years each year thereafter or act on anything relative thereto.


Unanimously voted that there be elected at the next annual towil meeting a board of three water commissioners pursuant to and conform- ably with Section 8 of Chapter 496 of the Acts and Resolves of 1947 and that the Selectmen, The Town Clerk, or such other town officer or officers as may be appropriate or any of them be and hereby are author- ized to do all acts and take all steps they may deem appropriate and necessary in order to provide for the election of a board of water com- missioners as aforesaid.


Article 10. To determine what other action, if any, shall be taken or authorized with reference to water supply or a water distribution system or to the authorization of incurring of indebtedness and the issuance of bonds or notes in connection therewith.

Article 11. To see if the town will vote to allow the Fire Engineers to dispose of obsolete or unusable fire department equipment and ap- paratus after adequate replacements have been provided, or act on any- thing relative thereto.
