Article 22. Voted unanimously to construct, originally equip and fur- hish an Elementary School Building.


Article 23. Voted 416 for and 5 against, that the sum of $375,000 be raised and appropriated for the purposes of constructing a school building and originally equipping and furnishing said building, and that to meet said appropriation the sum of $50,000 be appropriated from available funds in the treasury, the sum of $15,000 be appropriated from the Post-War Rehabilitation Fund, the sum of $10,000 be raised in the tax levy of the current year, and the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $200,000 under authority of Chapter 104 of the Acts of 1948 and the sum of $100,000 under authority of Chapter 44 of the General Laws, and to issue bonds or notes of the town therefor payable in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than 20 years from the date of issue of the first bond or note.

Article 25. Voted unanimously to accept the provisions of Chapter 588 of the Acts of 1948, an act authorizing Increases of the Amounts of Pen- sions Payable to Certain Former Retired Public Employees.


Article 26. To see if the town will give instructions to its elected town officers.


Motion made to instruct the Selectmen to appoint a committee of five to make a preliminary survey of the school system of the town of Norwell and report at the next Town Meeting, without pay. An amendment that "personnel of committee be citizens who are not connected in an official capacity with the town" was amended by "that a committee of five appointed by the Moderator" be substituted for "to instruct the Selectmen to appoint a committee of five." It was voted unanimously to accept the amendments.


Voted unanimously that a committee of five appointed by the Moderator, make a preliminary survey of the school system of the town of Norwell and report at the next annual town meeting said committee to serve without pay; personnel of which to be citizens who are not connected in an official capacity with the town.

Sale of Fish Rights-Two fish rights were sold at auction. Frank W. Rounds purchased one fish right for $1. Peirce Fuller purchased one fish right for $1.

Subsequent meeting for election of officers in Town Hall, Saturday, March 12, 1949 at 11 A.M., then and there to act on the following article:


Article 27. To bring to the Election Officers their votes, all on one ballot, for the following named officers, to wit: one Selectman for three years, one Assessor for three years, one member of the Board of Public Welfare for three years; Town Treasurer, Highway Surveyor, Tree War- den and Moderator for one year; one member of the School Committee for three years; one member of the Board of Health for three years; one Trustee of the William J. Warrant for Special Town Meeting


Plymouth, ss.


To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts. Greetings:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, quali- fied to vote in elections and Town affairs to meet at the Cushing Memorial Town Hall in said Norwell, on Monday, the Nineteenth Day of September, 1949 at 7:30 p.m. then and there to act upon the following articles, to wit:


ARTICLE 1. To see if the town will raise and appropriate or trans- fer from available funds a sum of money to complete the installation of the Water System in accordance with the vote of the town at a meeting held on December 15, 1947, or take any other action relative thereto.


ARTICLE 2. To determine whether the Town will raise and appro- priate the sum of two hundred and fifteen thousand (215,000) dollars or such other amount as may be determined upon at the meeting for the pur- pose of establishing a water system for supplying itself and its inhabitants with water pursuant to chapter 496 of the Acts and Resolves of 1947 and to determine whether the town in order to meet this appropriation will authorize the Town Treasurer with the approval of the Selectmen, to bor- row the sum of two hundred and fifteen thousand (215,000) dollars or such other amount as may be determined at the meeting and issue bonds or notes of the town therefor payable in not more than thirty (30) years any amount herein authorized to be in addition to the sum of one hundred and thirty-five thousand (135,000) dollars heretofore raised, appropriated and authorized to be borrowed for the purposes of a water system.


ARTICLE 3. To consider whether the Board of Water Commissioners shall be authorized on and in behalf of the town to establish a water sup- ply system in the town in addition to the water supply system authorized by vote dated December 15, 1947. Such new system to be laid in such areas of the town as may be determined by the Board of Water Commis- sioners and to include such well fields or other sources of water supply and such pumping and storage facilities as may be necessary or appro- priate in connection therewith or act on anything relative thereto.


ARTICLE 4. To consider and act upon any matter that may properly come before the meeting.


And you are directed to serve this warrant by posting attested copies thereof seven days at least before the time of said meeting as directed by vote of the town.


Hereof fail not and make return of this warrant with your doings thereon to the Town Clerk at the time and place of said meeting.

SPECIAL TOWN MEETING - September 19, 1949


Pursuant to a Warrant duly executed and return thereof made to the Town Clerk by Lloyd B. Henderson, a duly appointed Constable of Nor- well, the qualified voters met at the time and place and for the purpose therein stated and took the following action.


The meeting was called to order by the Moderator, Herbert A. Lin- coln, with 236 registered voters checked in before the meeting was called to order.


The Town Clerk read the Warrant, omitting by vote of the meeting the reading of the articles therein until each was taken up for action.


The Moderator announced that a request had been received from the Selectmen to allow a representative of that Board to explain the articles of the Warrant. The request was granted and Mr. Coleman made the ex- planation.


Article 1. Following the reading of the article, Mr. James Hall asked for a report from the Water Commissioners of the reason for the request for additional money to complete the work authorized at the Special Town Meeting held December 15, 1947.


Water Commissioner Brooks made the report and told of the work accomplished by his Board since that meeting. His report was supple- mented by one from Commissioner Allen, who told of the building of a reservoir in Blue Hill Reservation by the Metropolitan Water System and urged the voters to defer action on water until more facts and figures were available.


Mr. James Barnard moved "To indefinitely postpone action on Article 1." This motion was seconded and put to vote.


It was voted to indefinitely postpone action on Article 1.


Article 2. After the reading of Article 2 by the Moderator, the Se- lectmen were asked to explain how the amount already appropriated

had affected the finances of the Town, which Mr. Coleman answered.


Mr. Ross of the Finance Board also gave a detailed report of the out- standing debts and their effect on the Town, whereupon the motion "to indefinitely postpone action on Article 2" was made and seconded. Voted to indefinitely postpone action on Article 2.


Article 3. Motion made and seconded "to indefinitely postpone action on Article 3". Voted to indefinitely postpone action on Article 3.


Voted to adjourn.

BY-LAWS OF THE TOWN OF NORWELL Approved June 1, 1949


ARTICLE I General Provisions


Section 1. The By-Laws contained in the following articles are to be designated as the Revised By-Laws of the Town of Norwell.


Section 2. Wherever the provisions of these revised By-Laws are the same in effect as those of any existing By-Laws, they shall be con- strued as the continuation of such By-Laws. All provisions of previously existing By-Laws and all votes heretofore in force, other than acts of the General Court previously accepted, inconsistent with these Revised By- Laws of the Town of Norwell are hereby repealed and nullified.


Section 3. The invalidity of any Article or Section of these By-Laws shall not affect the validity of any Article or By-Law otherwise valid, and these By-Laws shall remain in effect as amended from time to time except for those Sections or Articles or parts thereof which are determined to be invalid.


ARTICLE II Town Seal


Section 1. The Town Seal shall be circular in shape and of a design as imprinted herein. This device shall be considered The Town Seal of the Town of Norwell, effective whenever used as required.

ARTICLE III Town Meetings


Section 1. The constables or the persons to whom the Warrant calling any Town Meeting is directed shall give notice of such meeting by posting copies of the same in at least five public places in the Town, in addition to the publication of said notice in a newspaper published in a town adjoining Norwell and circulated in the Town of Norwell.


Section 2. The Selectmen shall prepare a report setting forth the articles in the Warrant, together with recommendations of the Advisory Board, copies of which either shall be mailed to all registered voters, or they shall cause to have a copy left at each dwelling house or apartment, at least seven days before the meeting.


Section 3. The Annual Meeting shall be held at 7:30 P.M. on the first Monday in March of each year, and Special Town Meetings may be held at such times as the Selectmen may order. At least seven days before the Annual Meeting a published complete annual report of all town officers, boards, committees, departments, town meeting, elections, births, deaths and marriages shall be left at each dwelling house or apartment.

Section 4. Two hundred voters shall constitute a quorum to open any Town Meeting, but a lesser number may adjourn the same.


In the event a quorum is not present the meeting may be adjourned to a later time or date by a majority vote of those present. The Select- men shall post notices of the adjourned meeting in five public places in the Town.


Section 5. All Town Meeting votes, unless otherwise provided for by law shall at first be taken by a "Yes" and "No" vote. If the Moderator is in doubt, or if seven voters immediately question the vote, the Moderator shall call for a standing vote, taken by sworn tellers.


Section 6. The duties of the Moderator and the Government of the Town Meeting, not provided for by Law or By-Laws, shall be determined by the rules of practice contained in Cushing's Manual as far as they are adapted to the conditions and powers of the Town of Norwell.


Section 7. A meeting subsequent to the Annual Town Meeting shall be held the following Saturday in March for the purpose of the election of Town Officers and the determination of such matters as shall properly be placed on the official ballot and shall be conducted as prescribed by law between the hours of 12 o'clock noon to 8 P.M.


ARTICLE IV Selectmen


Section 1. The number of Selectmen shall be fixed at three and their term of office shall be three years.
