TOWN OF NORWELL ARTICLES FOR WARRANT FOR SPECIAL TOWN MEETING ON MONDAY, DECEMBER 13, 1948


Plymouth, ss.


To either of the Constables of the Town of Norwell, in said County of Plymouth and Commonwealth of Massachusetts. Greeting:


In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Norwell, quali- fied to vote in elections and Town affairs to meet at the Cushing Memorial Town Hall, in said Norwell, on


Monday the thirteenth Day of December, 1948 at 7:30 P.M., then and there to act upon the following articles, to wit:


ARTICLE 1. To see if the Town will vote to hold a Town Forum on the Sunday afternoon immediately prior to Town Meeting; the purpose of said Town Forum being to openly discuss the articles in the Town Warrant, or act on anything relative thereto.


Requested by: William R. Jordan, Theodore M. Dyer, Ralph L. Ripley, Emily S. Ripley, Benjamin Stetson, Gertrude L. Dyer, Vincent L. Cohee, Beryl N. Cohee, Ruth S. Merritt, Miriam G. Jordan.


ARTICLE 2. To determine whether the Town will raise and appropri- ate the sum of two hundred and fifteen thousand (215,000) dollars or such other amount as may be determined upon at the meeting for the purpose of establishing a water system for supplying itself and its inhabitants with water pursuant to chapter 496 of the Acts and Resolves of 1947 and to determine whether the town in order to meet this appropri- ation will authorize the Town Treasurer with the approval of the Select- men, to borrow the sum of two hundred and fifteen thousand (215,000) dollars or such other amount as may be determined at the meeting and issue bonds or notes of the town therefor payable in not more than thirty (30) years any amount herein authorized to be in addition to the sum of one hundred and thirty-five thousand (135,000) dollars heretofore raised, appropriated and authorized to be borrowed for the purposes of a water system.

ARTICLE 3. To consider whether the Board of Water Commissioners shall be authorized on and in behalf of the town to establish a water supply system in the town in addition to the water supply system authorized by vote dated December 15, 1947. Such new system to be laid in such areas of the town as may be determined by the Board of Water Commissioners and to include such well fields or other sources of water supply and such pumping and storage facilities as may be necessary or appropriate in connection therewith and to consider whether the Board of Water Commissioners shall be further authorized to eliminate such part or parts of the water supply system heretofore authorized as may no longer be needed by reason of the establishment of the well fields and pumping system herein authorizd.


ARTICLE 4. To consider and act upon any matter that may properly come before the meeting.

SPECIAL TOWN MEETING DECEMBER 13, 1948


The meeting was called to order at 7:30 P. M. by the Moderator, Herbert A. Lincoln. The Town Clerk read the Warrant, omitting by vote of those present, the reading of the articles until taken up for action.


The Moderator announced that as the required 200 for a quorum at a Special Town Meeting was not present, the only motion he could entertain was one for adjournment.


A motion made for adjournment indefinitely was lost by a stand- ing vote.


A motion to recess until 8 o'clock was carried also by standing vote.


The meeting reconvened at 8 o'clock still lacking the required 200. A motion to adjourn until the regular March meeting was also lost by a standing vote whereupon a motion to recess for 15 minutes was carried.


At 8:20 the meeting was called to order after which Earl F. Allen and Louis Osberg were appointed tellers and were sworn in by the Moderator.


Action on the articles of the Warrant was as follows:


Article 1. A motion that "The Selectmen shall be authorized and instructed to hold a Town Forum at 2:30 P. M. on the Sunday afternoon immediately preceding each and every regular and special Town Meet- ing for the purpose of discussing the articles in the Town Warrant" was amended by adding: "At all such forums it will be mandatory for all Selectmen and Committeemen to be present for the purpose of an- swering any and all questions asked by any qualified voter."


It was voted "That the Selectmen shall be authorized and instructed to hold a Town Forum at 2:30 P. M. on the Sunday afternoon immedi- ately preceding each and every regular and special Town Meeting for the purpose of discussing the articles in the Town Warrant: At all such

forums it will be mandatory for all Selectmen and Committeemen to be present for the purpose of answering any and all questions asked by any qualified voter."


Article 2. Preceding discussion on Article 2, Water Commissioner Richard H. Brooks explained what had been accomplished by his Board since the Special Town Meeting of December 15, 1947 and asked that the privilege of the floor be given to Howard E. Bailey, consulting en- gineer for the Board. The privilege was granted and Mr. Bailey explained the plan covered in Article 2 and answered questions.


Water Commissioner Lloyd S. West moved "That the Town raise and appropriate the sum of two hundred and fifteen thousand ($215,000.) dollars for the purpose of establishing a Water System for supplying itself and its inhabitants with water pursuant to Chapter 496 of the Acts and Resolves of 1947 and also authorized the Town Treasurer with the approval of the Board of Selectmen to borrow the sum of $215,000. and issue bonds and/or notes therefore payable in or not more than 30 years. This motion was duly seconded and put to vote.


The vote was 71 for and 123 against.


Article 3. It was unanimously voted to lay Article 3 on the table. It was unanimously voted to adjourn.
