And during Sd Term he is to find the Said Mary Harriss and her child with Sufficient meat drink washing and Lodging with all neesaries, eccepting doctoring and nursing, in case of Sickness in Consideration Aforesd : and what labour the Said Mary Can do in Said Term.

We the Selectmen of Wenham Have this day Met to- gether in order to Consider of & Act upon the Petetion of Edward Waldron of Sd Wenham the Prayer of which is that A Private Cart way be laid out to him the Said Waldron at his cost & charge . from the way Leading from Wenham to Manchester Thro" the Land of Caleb Coye of Sd Wenham to his woodlott at the East End of Coye's Pond, by Manchester line. Do upon veiwing the

Ground Judge, and Determine if Nesesary & Reasonable that the Prayer of the Sd Edward be Granted. And Ac- cordingly in our Sd Capacity have Acted thereon as fol- loweth viz. begining at A Small Pine Tree Standing in the Land of the Heirs of Deacon Ebenezer Waldron De- ceas'd by the Cartway in the Edge of yee Swamp, and runing from thence Westerly to said Coye's Causeway and A Cross the Same to the Northwesterly Side of the Same and So along on the Northwesterly & Northerly Edge of Said Causey untill it Cometh to yee up land of the Said Coye, on the Southerly Side the Sd Pond and So Runining along betwixt the upland & Swamp on the Northerly Side of the Cart way to A Gulf: then Rising the brow of ye upland ACross the Said Gulf, half a pole to the South of A Bunch of Apple Trees, that Stands by the Edge of Said Swamp & Pond, So Northwesterly on the Edge of the Brow of the Hill untill it Cometh to yee Hollow Opposite to Said Coy's Barn - by the Road Afores'd at the Westerly Corner of his field behind his House. - Then turning Southerly and Runing to the Northward of Sd Coys fence that Incloseth his field Afores'd, untill it Cometh to the Highway Afores'd about four feet to yee Northward of Sd Barn Laying to the Said Waldron a way one Pole in wedth to the South ward of all the Bound afores'd allowing him free Egress & Re- gress to Pass to & from his Said Lott with Cart & Slead to him his Heirs & Assigns forever, with Privilege to Repair the Same as he Shall Think Necessary from Time to Time Provided he the said Waldron Shall well & truly make and Maintain two Pair of Barrs. That is to say One pair at the Highway Afore s'd the Other pair at the Enterance into Sd Coy's Lanes out of the Land of the Heirs of Deacon Ebenezer Waldron Deceas'd and the Same Carefully Put up after his Passing as aforesd Or Othervise Gates in Like manner.


And in Consideration and Confirmation of all above writ- ten we have hereunto Set Our hands The day & year Above Said.

The Subscribers being Respectively Appointed by the Selectmen of Wenham and Beverly in the County of Es- sex to Preambulate on the line and renew The Bounds between the Sd Towns. Have Accordingly met on this 14th day of April Anno Domini 1766 : Beginning At the white Oak Standing in the Wall between the land of Nathaniel Brown Esq" : Now in the Possession of Eben- ezer Porter, And by land of Cornelus Baker mark'd W : B: & D. Thence . Southeasterly to a heap of Stones in Josiah Herricks Orchard about Seven feet Eastward of an Apple Tree Mark'd W: & B: Thence Northwesterly to A Stone Set in the Ground-mark'd W: & B: In the field now under the Improvement the Above Named Ebenezer Porter The heap of Stones in Meachams Pas- ture not being Renewed : but Refer'd To be Determined by the Towns. Wall between Porter, & An- drew's land. At A Town Meeting of the Inhabitants of Wenham Regu- larly Assembled at our meeting House on Fryday the twenty third Day of May Anno Domini 1766: in Order to Choose a Representative and Other Town Business as may more fully appear by the Warrants for Calling Sd Meeting, on File.


1ly Proxes were brought into the Box Several Times, for the Electing A Representative : untill an Election Ap- pear'd altogether improbible, then the Town, unanimously Desisted, and Proceeded to Other Business of Sd meeting. 2ly Made Choice of Mr Benjamin Kimball for a mod- erator to finish the Remaining Business.


3ly Voted that the List of Juriers Presented before the Town at their Meeting be accepted, and that the Select- men be impowered to Seperate Sd list, and Put the Names into the Respective Boxes.


4ly it was Put to vote whittier the Report of the Com- mittee impowr'd to Sell Some Strips of Common land be accepted, and it Pass'd in the Negative; by Reason of a Dispute Rais'd by Capt Brown who Contended for a piece of land included in Sd Report.

5ly Voted that Nathaniel Brown Esq" M" Benjamin Fairfield and Edward Waldron, be a Committee im- power'd by the Town to Draw up the Town's Reasons ; and Prefer them in writting to the General Court, why the Petetion of Procter, Pier point, and Others belonging to Danvers, Respecting the Bridge Over Water's River in Sd Danvers, Should not have the Prayer thereof Granted. - and then M' Moderator Declar'd Sd Meet- ing to be Dissolved, and it was Dissolved accordingly Att A Meeting of the Selectmen of Wenham August yee 25th 1766. Then agreed with Mr Benjamin Edwards Jun" To keep Elisabeth Severy the Term of one year from the date hereof for Sum of Six Dollars: during which Time he the Said Edwards is to find the Sd Severy Suf- ficient Meat drink washing and lodging Suitable to her Circumstances and to Make her Cloaths as good as the years End as they are when he Takes her, And in Case of Sickness the Town to Pay Doctr & Nursing. 2ly voted that the Sum of One hundred and forty Pounds be Raised by a Tax on Polls and Estates of the Inhabi- tants of Wenham & Lands lying within the Same for dis- charge of yee Town debts as set forth in yee warrant afor :sd.


3ly voted that Nath11 Brown Esq" Lieut Josiah Herrick & Ensign John Friend be Invested with full Power as a Committee in the Name of the Town of Wenham to Settle the Boundaries with Beverly Respecting the line between Sd Wenham & the Town of Beverly afore sd. And make report of their doings in Sd Capicity as soon as soon as they can with Conveniency.


The last Article in Sd warrant Respecting the Revª M" Joseph Swain's memorial After Reading Sd Memorial the Town Thought Proper to Dismiss it, without acting any thing upon it. And then M' moderator Declared Sd meeting to be Dissolved and it was Dissolved Accordingly

Articles of Agreement Made and Concluded by and be- tween Thomas White of Wenham in the County of Essex, in his Majesty's Province of the Massachusetts Bay in newEngland yeoman on the one part, and walter Fair- field and Nathaniel Fairfield yeomen, on the Other part, both of Wenham Above Sd Witnisseth That whereas we have built a Sawmill on the Old Dam in Sd Wenham ad- joining to the land of Sd White, on the one Side, and on Sd Fairfield on the Other Side. the Said White Owning the one half of said Sawmill, and said Fairfield the other half. Wee do for our Selves our heirs Successors, & assigns Covernant & agree futher Concerning the Build- ing of a Grist or Corn Mill to be set on the Old Dam in Wenham aforesd as near the Sd Sawmill as shall be Con- veniant and the Said Thomas White Shall have the one half of sd Grist or Corn mill & Sd Walter Fairfield and Nathaniel Fairfield Shall have the other half .- First it is Agreed that Each one of us the Above Named Part- ners According to his share And interest in Said Mills As is above Expressed Shall in all things do and pay both to the Carpenter for his work and for the providing, and for the Providing All things Necessary for the Carrying on the work to the finishing thereof. -


2ly That the Partners above named Shall Each of them keep particular Accoumps of what they do Concerning the Building or Repairing of Sd Mills. -


3ly Each one of us the Sª Partners Shall keep a Plain & particular accompt of all the work that he Shall do in Drawing the Timber for the Sd Mill or Providing or Procuring any other thing which doth belong to us as partners for the finishing of the Sd Mills.


4ly It is further Agreed that in Case any of the afore- mentioned Partners Shall Neglect to do his duty by not

Paying his Share and Proportion, or not Procuring Such things as are Necessary for the Carrying on of his Part, so that his Partners are forced to be at Cost for the Carry- ing on of his Part which doth Neglect. his Partner or Partners which are at Cost to do any of his duly, Shall keep atrue accompt thereof, and Shall have his Just Cost of him that Neglects his duty in that Case. - - - -


bly It is agreed by and between Sd Partners that when the said Mills are - Finished or fitt to go they are to have an Equal Privilege by the use of Said Mills accord- ing to their interest therein. The Said Thomas White to have the use of the Said Mills two weeks through out the Prefixt Season hereafter herein Agreed on. And Said Walter Fairfield One week and the Said Nathaniel Fair- field one week thro' out the prefixt Season as is Above Exprest. - 6ly it is Agreed by said Partners that when foever


The - Mill or mills shall want Repairing the Part- ners on whome the Turn is when wanting shall give notice to the Other Partners of what is wanting & of the Sd Partner or Partners shall Neglect to Amend or Re- pair Said Mill or mills then the Sd Partners who doth amend said mill or mills It shall be at the Cost of ye Said Partner. -


7ly It is further Agreed by & between Sd Partners, that at any time whilst the said Mill or Mills Remaineth in Partnership between us whensoever there Shall want Earth to Mend the Said Dam belonging to Sd Mills the Partners have liberty to Dig earth and Carry at the Pit in Sd Walter Fairfields land to Mend the Dam on his Side Sd Mill or River and Likewise they have liberty to dig Earth & Carry Earth to Said Dam from Said Thomas Whites Pit in Said Whites land to mend Sd Dam on his Side of Said Mill, or River and from Time to Time as there shall be Need.


8ly It is further Agreed by Said Partners that if there be not Time in the later End of the Season to have Each there full Term as is above Exprest Then the odd Time to be divided in an Equal Proportion according to their interest.

gly it is further Agreed by Said Partners to Stop the Water by Shutting the Gates Down at the Said dam the Twentieth day of October yearly, and not keep up the Water longer than the first day of April yearely or as the Major Part of the Propriety Shall Agree.


10ly It is further Agreed by the Partners above men- tioned that the sd Walter Fairfield Shall allow a High- way from the Country Road over his land to Said Mills from Time to Time for the use of Said Mills and Also Sd Thomas White Shall allow a highway thro' his land to Said Mills from Time to Time for the use of Sd Mills, and also Each to allow a Landing Place for Timber & boards at Said Mills from Time to Time and that Each Partner Shall Amend Sd highways as there shall be Oc- casion in an Equal Proportion According to their interest in Sd Mills.


11ly It is further Agreed by Sd Partners that the water shall not be Drawed down lower than six inches upon the breast beam at the End of Each turn. And in Confirma- tion of what is herein written we have hereunto Set our hands & Seals this fifth day of June in the tenth year of his Majestys Reign, And in the year of our Lord one thousand Seven hundred twenty & four.

At a meeting of the Selectmen of Wenham March 9th 1767:


Then Appointed Mr Amos Batcheller, to Procure a Stan- dard, half Bushel Measure, & A Peck, & half Ditto, for the Town's use.


At the above Meeting Agreed with Thomas Senter To Keep his Mother the year to Come, for the Sum of Eight Pounds. + And to Perform the Service of Sexton yee En- suing year for Two pounds with the Priviledge of diging Graves : he being faithfull therein, and Demand but the Lawfull fees for Sd Service ++ Exclusive of Doctor, & Nurses Bills in case of Sd Mothers Sickness.


Also at the before mentioned meeting of the Selectmen the Thirty Pounds lately voted to the use of the Schools in this Town the year Currant was Apportioned to the Several Districts within the Same Accordingly to their Tax Persuant to Sd vote by which vote the East district

At a meeting of the Selectmen of Wenham March yee 24th 1767 Then Appointed Ebenezer Kimball, to the Ser- vice of Pound-Keeper the year Ensuing for the Lawfull fees : And at the Same Time Agreed with him that he Should Pasture the Burying place the Ensuing Season with Sheep or horses; for the Sum of Five shillings & four pence
