Voted that whearas att a metting November 27th 1732 it was voted by the Towne that a Rate Should be made for the fencing of the parsonage but nott Knowing how much money it would take because the length of the fenc was not assertained which Sinc is Don by the Committie ap- pointed by the town for that purpose and by their measure & Estemation it amounting to the sume £112- 19-0 it is also voted that the Rate Made by the Selectmen the 21st Sep" last amounting to the Same Sum Shall be all collexted & paid in to the town Treasury for Defray- ing the Charg is of fencing the parsonage according to town vote. As also votted that Every person Ratted in the tax that Shall make up their proportion of fenc in a good stoan wall

Voted that whereas the Selectmen of Wenham laid out a privat or particuler way for Ebenezer Batcheller over the land which the Town had of Asstian Kilkam by Exchange on the account of the sd Kilkams reserve of a passage way to the country road - which land Jonathan Porter had fenced a crofs and incumbred . which way the said Town confirmed at their last March meeting - but sinc haveing settled and ended the controuvorcy with the sd porter by staking and recording the bounds of the Towns right and part of that Land that thay so had of the said Killum Exclusive of the sd Killum or Batchellers right of a way over it and whereas the way laid out for Eben- ezer batcheller doth not by adjoyning to the Towns land for their meeting-hous accomodation the whol length of it and so is more prejudicial than if it were on the out- side of the sd portors land it is theirfore ordered that the said way laid out as above said shall be and is made Null and voyd - and as to any further provision for a way for the said Batcheller or his Sucsossos is left untill he or they shall want and the town see need forclouses them- Att a meeting of the Selectmen of Wenham March 5th 1735/6-

habitants in the way besides the said Batcheller. the Town refused to Confirm the said way att there March meeting when it was laid before them - and whereas the necessity of fixing of a way to som cartain place for the said Ebenezer Batcheller as he holds his place in the right of Asetin Killam which conveighed the land to the Town with the reserve of a way to pass over the said land to the highway or Cuntry Road as appear's on Town Rec- ord . we have on the Day of the Date hereof laid out and fixed the paseag way Contracted for between the Town and the said Killum for the said Batcheller and such as may suckcead him in that living that formerly was the sd Killame and we have stated it one pole wide beginning at Ebenezer Batchellers own land and bound on the Northeast by the west-End of the fairfields and Batchellers Stable or hors-house standing in the vally near the place of Asetin Killame Bar's att which place he reserv :d to pass out) and on the Southwest side it bounds on the End of one pole from the said Stable and att Southwest End the way is bounded on one west side with that peice of land which the Town granted to Mr Antipas Newman for an inlargement to his yard in the year 1659 which was to come so far'r' downe as not to prejudice the Cun- try Road at which place the Cuntry Road measur'es three poles and one half from mr Jonathan Kimballs fence on the other side of the Road against Jonathan porters yard formerly m" Antipas Newmans as above said . and on the North East side of the aforesaid way Laid out it bounds at the End of one pole from the End of porters yard above mensioned which Ends at the post standing in the End of the second length of fence on the North side of Jonathan porters yard and from that post said way hath its breadth North East coming out into the Cuntry Road all which way we have laid out on the Towns own land (although of Late it hath bin freequently incumbrod by Left John Porter and his sons, and the Town molested in the use of it) for the use of Ebenezer Batcheller and such as may suckceed him in Asetin Killams right agreed for as above said and in Confirmation of all above writ-
