2 Voted that the Town Treasr be Desired to bring a Process against the Pew Comtee for the moneys that are yet Due to the Town for the Pews if they neglect or Refuse to Pay him when it is Demanded of them by him 3 Voted that mr Joseph Swain have the Benefit of the Personage the year currant if he accepts of the Late Call of the Church and town to be their Pastor and if not the Selectmen to Improve it for the Towns use
June 25 1750 At a meeting of the Selectmen of Wen- ham they then agreed with Benja Bragg to Keep School in the Town for the space of three months from this Date to teach children to Read and write for which Service he is to have Reasonable Satisfaction from the Town

Wenham July ye 24th 1750 Whereas the Church in This Town of Wenham have Lately made a unanimous Choice of me to be their minis- ter and the Town have also unanimously Concured there- with and Inasmuch as both Church and Town are now convened Together I Take this opportunity to give my answer
I acknowledge with Thankfullness the unanimous Call you have given me to Settle with you in the work of the ministry and for what you have Done Respecting my Settlement and maintenance and I now Declare my Will- ingness to accept of your Call and being Sensible of my own Insufficiency and Depending upon Divine aid and assistance I Purpose so far as God shall enalle me to be faithfull in the weighty and Important Trust which shall be Committed to my Charge I ask your Prayers for me yea I Beseech you Brethren for the Lord Jesus Christs Sake & for the Love of the Spirit that you Strive together with me in your Prayers to God for me and I wish you all Peace and Prosperity and great success in attendance upon all Gospel ordinances and administrations for this Cause I Bow my Knees unto the Father of our Lord Jesus Christ that he would grant you according to the Riches of his Glory to be Strengthened with might by his Spirit in the Inner man that Christ may Dwell in your hearts by faith that ye being Rooted and Grounded in Love may be able to Comprehend with all Saints what is the Breadth & Length & Depth & height and to know the Love of Christ which Passeth Knowledge that ye may be filled with all the fullness of God now unto him that is able to do Exceeding aboundantly above all that we ask or think according to the Power that worketh in us unto him be Glory in the Church by Christ Jesus through all ages world without end - amen Joseph Swain

Sept 11 1750 At a meeting of the Inhabitants of the Town of Wenham Regularly warned and Convened Capt Thos Tarbox being Chosen moderator it was Voted as follows
1 That Wednesday the 24 Day of October next be the
day for the ordination of mr Joseph Swain
2 Voted that the Salary Lately voted for m" Swain Be- gin on the first Day of July 1750 and the one half there- of to be Paid the first Day of January following and the other half at the Expiration of the year and so to Con- tinue During his Continuance in the ministry among this People
3 Voted that m' Sam" Gott m' Josiah Herrick and m™ David Batcheller be a Comtee to affix the Boundiarys of the Buring Place with the adjacent Proprietors and make Report at next meeting
4 Voted that m' Benja Edwards Dea Eben" Fisk & m" John Kimball be a Comtee to make Provision for the En- tertainment of those gentlemen who may be Invited to assist at the ordination of m' Joseph Swain
5 Voted the sum of Eighty five Pounds Lawfull money be Raised to Defray Town Charges the Ensuing year And at the abovesaid meeting the Comtee Chosen to settle all accounts with mrs Eliza Warren as she was Adminis- tratrix to the Estate of her husband the Late Revd m" John Warren Decd was Presented which is here Recorded as Followeth namely - The Report of the Comtee that was Chosen to adjust all accts with mrs Elizabeth Warren administratrix on the Estate of y Rev m' John Warren Late of Wenham Deceased Report as followeth viz That they Cannot find by Strict Examination into the affair that there is one Penny Legaly Due from the Said Town of Wenham to the Said Estate aforesd But that the said Town hath Granted from time to time the Sum of Four Hundred & ninty five Pounds old Tenor more than the Depreciation according to Contract During the Revd m" Warrens Continuance in the ministry with the said Town neither Doth sd admtrix Demand one Farthing but fur- ther Saith She will give the Town a Discharge from said Estate Provided they will Defray the Remainder of the

We whose names are underwritten Being a Comtee to Settle the Boundaries of our Burying Place with the adjacent Proprietors and in order hereunto we applied our selves unto the Town Book for some Record or grant made unto the Town but we could find none at all there- for we being at a Loss how the Town Came by it Where- upon we applied ourselves unto Leiut Porter and others and by Inquiery we could not get any Intilageable ac- count of the Boundaries and therefore were very much Dissatisfied and therefore upon the whole think it not Proper to Proceed in the affair at Pressent but to Lay the affair before the Town to act their Pleasure There- upon ) Sam" Gott

The Selectmen of Wenham Rec'd from Nathanael & Samuel Poland of Ipswich the following Petition viz - To the Selectmen of the Town of Wenham Gentlemen Whereas your Pet's have Lands Lying in the Town of Wenham and have no way thereto without Tresspassing in Passing over other mens Lands for to Improve those Lands for which we Pay yearly Taxes to sd Wenham your Petitioners Pray therefore that you would at their own Cost & Charge Lay out them their Heirs and As- signs a way for to Pass and Repass at all times for the Improvment of their Lands as aforesd as in Duty Bound your Petitioners Ever Prays

Upon the Prefering the above Petition the Selectmen Complyed with the Request of Said Nathanael & Sam11 Poland in manner Following viz - Wenham April 1st 1751 We the Subscribers the Selectmen of Wenham be- ing met Together in order to Lay out a Private Way for Mess's Nathanael & Samuel Poland of Ipswich and to their heirs and assigns to a Certain Piece of meddow of theirs in Said Wenham in answer to their Request as above Proceeded on the Day above sd to do it in the fol- lowing Manner namely Begining at the SouthEastwardly Corner of James Dodges home Lott we Laid out a way one Pole wide against the wall that Stands between said James Dodges Land and John Killams the Length where- of is about twenty Poles for which way the sd Dodge Recd of the Said Polands full Satisfaction on the Day above said

Articles of Agreement made and Concluded upon this first Day of April 1751 By and Between John Killam of Wenham in the County of Essex in New England weaver on the one Part and Samuel Poland yeoman and Nathanael Poland yeoman Both of Ipswich in the County aforeSaid on the other Part are as follows namely Where- as the above named Samuel & Nathanael Poland are Pos- sessed of a Certain Parcel or Tract of Medow Land Ly- ing in Wenham aforesaid and have no convenient way thereto without Passing over a Part of the above Said Killams Land the said John Killam for himself his Heirs Executors Administrators and assigns Doth hereby Covenant Promise and Engage to and with the said Samuel and Nathanael Poland their Heirs and Assigns forever that they & either of them may from time to time and at all times forever Hereafter Quietly and Peacably

Pass and Repass with a Cart or Team over that Part of Said Killams Land that Lies Directly Between the South Eastermost Part of James Dodges home Lott and the above said medow (the Length whereof is by Estima- tion about Six Poles and the Bredth one Pole be it more or Less) So often as they Shall have ocassion either to bring the Produce of their Lands home or Convey Stuf to fence the same and the said Sam11 & Nath Poland for themselves their heirs Executors Administrators & assigns do covenant Promise and Engage to and with the Said John Killam that so Long as the said Killam shall allow the Liberty of Passing as above free from any Encum- brance we the said Sam" and Nath Poland neither for our Selves our heirs or assigns nor any Person or Per- sons by from or under us Shall Ever hereafter Demand or Require any way to the said medow over any other Part of said Killams Land In Witness whereof we the Parties above named have hereunto Set our hands the Day of the Date above written

viz Beginning at a White oak tree in Raymonds Land in Birch Plain so Called Marked WB with Stones about it thence to a stump on the Northerly Side of Alfords hill thence to the Corner of of the wall on the Easterly Side of the Countrey Road three foot and half Southward from an apple tree Standing to the northward of Freeborn Balchs Barn marked WB thence to a Stake & Stones in Peter Woodburys Land Three feet & half northward of a Poplar Tree marked WB thence to the Bounds by Amos Dodges which we could not agree to Renew by Reason the Records of Said Towns not agreeing as we found by Comparing Sd Records then to the Stake and Stones marked W: B near Larcums Corner thence to a Stake and Stones marked WB on the Easterly Side of Longham medow thence to a Stake and Stones on the Easterly side
