MINUTES OF THE


To the Honorable the Representatives of the Freemen of the Province of Pennsylvania, in General Assembly met.


" The Memorial of the Committee of Safety :


"The Committee have, ever since their appointment, applied themselves with the greatest Zeal and Fidelity to the important trust confided to them, in providing Means for the defence of this Province; they were, however, such means only as were thought more immediately requisite for our security against the attempts made by a Naval armament, and were besides, necessarily confin'd within the Limits of the Funds alloted to them by your Honorable House, but they beg leave to represent, that as every day brings with it fresh proofs of the Violence of the British Ministry, and of their fixed purposes to subdue the free Spirit of America, that has yet given much Obstruction to all their Schemes of Tyranny and Despotism, a purpose assisted too by an obsequious Parliament, which may not speak the Genuine Sense of the Nation, that it was unhappily the direction of its Force, it truly becomes us to prepare seriously for the Storm gathering over the Colonies, and which in the uncertainty of its course, may in a few weeks fall upon this Province ; this being the Idea of the Committee, they have come to the following Resolution claiming the most earnest attention of of your Honorable House thereto :


" Resolved, That application be made to the Honorable the House of Representatives, praying that they will take order for raising two thousand Men to act in the defence of this Province, and this Board will represent it as their opinion, that it will be most for the Public Service, that one Battalion of Regular Troops be formed out of that number, and the remainder be a body of Rifle Men.


" 'The Committee beg leave to solicit your attention to another Object, also of extensive importance, the Military association, the general sentiments concerning which, they have in the recess of Assembly had an opportunity of collecting, and tho' such numbers already have, and we hope will still engage in it, under its present form, as may prove a considerable addition to our Strength, yet as there are material objections made to it, and as they un- derstand, are to be laid before your Honorable House by divers Bodies of respectable Men, they Submit to you whether it will not be highly expedient and consistent with good policy, immedi- ately to remove every cause of discontent on this Head from the minds of the associators, who, under an apprehension of partial and unequal Burthens imposed on them, have nevertheless had the Vir- tue not to refuse their services to their Country. In confidence that your Honorable House will reconsider the several Provisions and Regulations complained of, and give them satisfaction therein,

Resolved, That the sum of £50 be lent to Henry Huber, and £150 be lent to Thomas Heinburgher, to enable them to erect powder Mills, they having given Bonds with security, for the same, to the Committee of accounts, and that orders be drawn for the said several sums in favour of the said Huber & Heinbergher, re- spectively.


Agreeable to the above Resolve, the orders therein mention'd were drawn, and deliver'd to Mr. Christopher Ludwick.


Resolved, That Mr. Owen Biddle & Capt. Robert Whyte, be a Committee to go to the Barracks, and Muster the Men belonging to the Armed Boats in the Service of this Province, and make Re- turn of the same to this Board.


Upon application of Peter Dehaven for 100 lbs. Brass, for the use of Mr. Parker, for mounting Firelocks made by Lewis Prahl- By Order of the Board, Rob't Towers, Commissary, was directed to deliver the said 100 lbs. Brass.


Resolved, That the following Notice be published in the differ- ent papers of this City, Viz't :


"A Muster Master is wanted to the Naval Armament belonging to this Province; any Associator disposed to serve the publick in

Resolved, That Capt. Procter make use of Seven Rooms in the Pest House on Province Island, for quartering part of the Artillery Company.


That there be Six 18 pound Gun Carriages made for the use of the Battery at Fort Island, and that Mr. Nevil be employed in mak- ing one of the said Carriages, and furnish this Board with an ac- count of the same.


That Capt. Procter have the use of as many Firelocks as he may have occasion for, and a 6 pound Canon to exercise the Men under his Command, and that Robert Towers be directed to deliver the same.


That Commodore Caldwell & Capt. Procter fix upon proper Sig- nals for the Fleet, Merchantmen & Battery, and that the same be communicated to the Pilots employed in Navigating Vessels through the Chevaux de Frize.


That Capt. Proctor procure a Flagg Staff for the Fort, with a Flagg of the United Colonies.


That Robert Towers put up 50 Rounds of Cartridge, with differ- ent kinds of Shot, for each of the six 18 pound Canon on the Bat- tery at Fort Island.


That Mr. Owen Biddle & Capt. Whyte, order a Smith's Shop and Forge to be erected on Fort Island, and to furnish the same with proper Smith's tools.


That the said Committee see that the necessaries wanting at Fort Island for the use of the Battery, and for Capt. Procter's Company, not mention'd in the above Resolves, be supplied.


Resolved, That Jeremiah Simmons, now a Lieut. on board one of the armed Boats, be appointed 1st Lieutenant in Capt. Procter's Company of Artillery.

Resolved, That Mr. Owen Biddle write to Mr. Benj'n Ritten- house and desire that he will remove to this City as soon as possi- ble, and that he send a man express with said Letter, informing him this Board accept his proposals, & that they allow him £250 annum for Carrying on the Gunlock Manufactory, on account of this Board.

The following Resolve of Assembly was sent to this Committee the 17th inst., and order'd this day to be inserted in the Minutes of this Board :


" Upon Motion, Respecting the Utility & Expediency of immedi- ately erecting a Powder Mill for the use & on account of this Pro- vince, and requesting the sentiments of the House on this Measure, the said Motion was taken into consideration, and after some Debate thereon,


"Resolved, That it is the Opinion of this House, that the erecting such Powder Mill is a Necessary and proper Measure, and that the same ought to be immediately carried into execution, under the direction of the Committee of Safety; upon the best terms that can be had as to the place, Materials & persons to be employed in such undertaking.

The following Letter was this day sent to the Committee of In- spection and Observation of this City, & sign'd by the Chairman : " This Board have taken into Consideration the publication of your Committee handed to us, respecting Thomas Rogers & Joseph Sermon, who are convicted of refusing to receive the Continental Bills of Credit, and are of Opinion, that whatever is further necessary for the carrying into full execution the Resolve of Congress against such offences, should proceed from the Committees of Inspection and Observation. The Reason of the interposition of this Board in the Case of John Drinker, and Thomas & Sam'l Fisher, is set forth in the resolution accompanying this, and would have been unneces- sary, but in the particular Circumstances of a Dissolution of your Board.


Resolved, that the Commissary be directed to prove the Firelocks of all such Associators as shall bring an order from their respective Captains to him for that purpose.


It appearing to this Board that the Business of Commissary of Stores has been attended with more labour and fatigue than was at first expected ; therefore


Resolved, That Robert Towers, Commissary, be allowed at the rate of one hundred & Eighty-two pounds ten shillings # annum, for his services, from the time he undertook that Office of Com- miss'y of Military Stores, until the further Resolution of this Board.


Upon application of Benja. Town for some Brass for making the mounting to Firelocks now making for the use of this Province, by Nicholson & Dunwick, By order of the Board, Robt. Towers, Com- miss'y, was directed to deliver said Town 200 lbs. of Brass, taking his receipt to be accountable for the same.


Upon application of Messrs. Clt. Biddle & Jos. Cowperthwaite, for a sum of Money for the payment of a tract of Land & a Mill seat purchased by them for account of Congress, and for erecting a powder Mill, &c. on the same, for account of Congress ; By Order of the Board, an order was drawn on Mr. John Nixon & others, the Committee of Accounts of this Board, for ££1500, which is to be charged to account of Congress.


Capt. Henry Alles, of Colo. Shee's Battalion, having by Letter to this Board resign'd his Commission,


Resolved, That Mr. Isaac Melcher be appointed Captain to said Company, in the Room of Capt. Alles.

Resolved, That David Rittenhouse & Mr. Owen Biddle be re- quested to go with Capt. Cowperthwaite & Mr. Clem't Biddle to the place purchased by the latter Gent'n, on which it is intended to erect a powder Mill on account of Congress, and that they Survey and View the Seat on which said Mill is to be erected.


Stephen Horn & Adam Mewdy having come from Northampton Co'y, in order to be instructed in the Manufactory of Salt petre, & having produced an account of their expences, By order of the Board, the Committee of accounts was directed to pay the same, amounting to £8 1 5, say Eight pounds One Shilling & five pence.


WHEREAS, Many persons have been employed in purchasing Fire arms, in order to carry them into other Provinces; and as a Practice of this kind may be of pernicious consequence, unless they are intended to be employed in such places as from their situation are most exposed to the Danger of an Attack, of which this Com- mittee, in this Case, reserve to themselves a right of Judging; Therefore,


Resolved, That no Person or Persons whatever do presume to purchase or Carry out of this province any Fire Arms without ap- plication to and Licence from this Committee being first obtained.


Upon Application of Jn'o Lewis for the payment of his account for Bayonets & Repairs to Firelocks, belonging to Cap't Le Mars' Company of 1st Penn'a Bat'n, an order was drawn on Messrs. Mease & Caldwell for the same, amounting to £5 17.


Upon application of Mr. Afflick for some Brass for making of mountings to firelocks agreed for by Cap't Wilcocks and others,


Robert Towers was directed to deliver him 100 lbs. of Brass, taking his Receipt to be accountable for the same.


Upon application of Co'l John Shea for a sum of Money for the use of his Battalion in the service of the United Colonies, By order of the Board, an order was drawn on Messrs. Mease & Cald- well for five hundred pounds, in favour of Colo. Shea, for the use aforesaid.


Resolved, that the Captains of the Armed Boats be directed to see that their respective Crews are properly Cloathed, and apply to Mr. Jn. Nesbitt, Paymaster, for such necessary apparel as shall be

Order'd, That the following advertisement be published in the. papers of this City :


" In Committee of Safety.


" All persons who are willing to supply the Officers & Men em- ploy'd in the Naval Armament & Artillery of this Province with the following Rations, Vizt :


"For each Man per Week, Seven pounds of Bread, or Six pound's of flour, one-fourth at least, to be in flour if required ; ten pounds of Beef, Mutton, or Pork; the Value of Six pence in Roots & Ve- getables; a Sufficient proportion of Salt & Vinegar; three pints and an half of Rum, or Beer in proportion ; are desired to send in their proposals to this Committee, on or before the 8th day of March instant; the Contract to commence on the 11th inst., and continue in force for three Months, if the Men are not sooner dis- charged."


Mr. Nixon Reports, that the Bill sent Colo. Miffin the 30th No> vember last, is Returned, the Colo. having had an interview with Major Small, who inform'd the Bill could not be paid, as Mr. Franks of this City, had directions to furnish the Officers taken prisoners with Money ; therefore, Mr. Nixon is desired to return the Bill to. Mr. Symes.


Morgan Bustead not having performed any part of his Contract with respect to his engagements with this Board for the Casting of Canon,


Upon motion,


Order'd, That his written agreement be put into the hands of a Lawyer, in order to his being prosecuted for damages.

Agreeable to the above Resolve, an order was drawn on Jno. Nixon & others, the Committee of Accounts, in favor of said Lorch, for £150.


Resolved, That John Brice be appointed first Lieutenant to the Armed Boat Warren.


The Committee of Correspondence of Bedford County having drawn an order on this Board for the payment of 161 lbs. powder, & 118 lbs. Lead, purchased by them,


Resolved, That an order be drawn on Mr. John Nixon, & others, the Committee of Accounts, in favour of Miles & Wister, for £40 3 3, the amount of said Powder & Lead, and that the same be ta- ken proper care of by the Committee of Correspondence of said County 'til the further orders of this Board.


Resolved, That this Board lend 100 Firelocks to Colo. Shea, to exercise his Men. In case any of them should be damag'd, the Colo. is to have them repair'd at his own cost, and to deliver them to the order of this Board on demand ; agreeable to which Resolve, an order was sent to Mr. Towers to deliver the said Firelocks.


Abel Morris having Resign'd his Commission as Ensign in the 2nd Battalion of Pennsylvania Troops in the Service of the united Colonies,


Resolved, That George Ross be appointed Ensign in said Bat- talion, in the place of said Able Morris.


Resolved, That Mr. David Rittenhouse, the Engineer to this Board, be desired to make Experiments in rifling Canon & Musket Balls, at the expense of this Board, and to this end that he be al- lowed to employ any person or persons under him for that purpose, and that Robert Towers, Commissary, shall deliver to the order of Mr. Rittenhouse sufficient ammunition for that. purpose.


Matthias Keely having engaged with Colo. Miles to make 100 Firelocks, for the use of this Province, and having deliver'd 31 Firelocks to Mr. Towers; By order of the Board an order was drawn on Messrs. John Nixon & others, the Committee of accounts, in his favour, for seventy-five pounds, towards the payment of said firelocks.

Resolved, That Colo .. Hockley be desired to use all the Muskets; made by Matthias Keely & Comp'y, by order of this Board, proved with a weight of powder equal to the weight of the Ball, and cause. the Muskets so proved to be stamp'd with the Letters P. P.


By order of the Board Robert Towers, Commiss'y, was directed to deliver Matthias Keely as much powder as will prove one bun- dred Firelocks, making by him for the use of this Province.


This day the Congress sent the following Resolve to this Com- mittee :


"In Congress, 26th Feb'ry, 1776.


" Resolved, That the Committee of Safety for Pennsylvania, agreeable to the offer made by them of their service, of which the Congress have a proper sense, be authorized to distribute the ofi- cers, prisoners in Lancaster, in such places within the province of" Pennsylvania as to that Committee shall seem most proper, taking their parole, which if they refuse to give, the said Committee are empowered and directed to confine them, and that in executing this. Resolve, the said Committee have & regard to the Resolutions hereto- fore made by the Congress with respect to prisoners & their Resi- dence. Extract from. the Minutes.

Slough for the payment of George Eberly's account for subsisting John Brooks in the Gaol of Lancas- ter County, confined there by order of this Board; an Order was drawn on Mr. John Nixon & others, the Committee of accounts, for £8, being the amount of said account, & in favour of said Slough, which sum is directed to be charged to the Continental Congress.


Lieu't Thompson & Webb appear'd before the Committee and gave information that a certain Henry Yelverton Price had fre- quented the places of Rendevous of the Crews belonging to the armed Boats, that by words he endeavour'd to discourage the ser- vice, That he had declared himself a Tory, & inimical to the American cause ; That he Damned the Congress and wished that the waggons carrying Powder for the Continental Service were blown up ; and the said Henry Yelverton Price appearing before the Com- mittee and having the said Charge made known to him, did not deny the same.


Resolved, That it would be unsafe to permit the said Henry Yelverton Price to go at large ; therefore,


Resolved, That he be Committed to the Gaol of the City and County of Philad'a; agreeable thereto, Thomas Dewees, Gaoler of this County, was commanded to receive him into his Custody, and to keep him safely confined 'til he is discharged by this Board.
