By order of the Board, Mr. Rob't 'Towers, Commissary, was de- sired to deliver to Mr. Robert Martin & others, Delegates in Con- vention for Northumberland County, 750 wt. of Powder & 1500 wt. of lead, to be delivered to the Committee of Inspection for that County, & by them distributed to the Militia in such quantities as they may stand in need of, for the defence of said County.


On motion,


Resolved, That all such workmen as are necessary to be em- ployed at the Iron works in casting of Cannon or Shott for the Public, be ordered not to leave their Respective works, nor to March with the Militia, unless by special direction of the Conven- tion or this Board.


By order of Board, Mr. R. Towers was directed to deliver Capt. Jos. Blewer a sufficient Quantity of ammunition to Prove 10 six. pound & 10 four pound Cannon.


By order of the Board, Mr. Towers was desired to deliver Capt. James Hindman, of the Maryland Independant Company, Twenty three Rounds of ammunition for each man in his Company, & Twenty Hatchets, to be charged to Congress.


On Motion,


Resolved, That all such workmen as are necessary to be employed at the Iron Works, in Casting of Canon or Shott for the public, be ordered not to leave their Respective Works, nor to march with the Militia of this State, unless by special direction of the Convention or this Board.


The Deposition of John Walker.


"On the 31st day of July, 1776, Before the Council of Safety of the State of Pennsylvania, came John Walker, of the City of Philadelphia, and being sworn on the Holy Evangelists of Almighty God, did depose and say : That about six or Eight days after the time of Colonel Kirkland's escape from the Goal, Mr. John Hale ordered this deponent to fill a Pair of new Saddle Bags with Oats, and Mr. John Hale himself put into the Saddle Bags a Bottle, which this deponent apprehended to be a Bottle of Brandy, or other spirits, and put a Cloth over it: That the Saddle Bags thus filled was put on a Horse belonging to John Hale & the Horse delivered

to a son of Arthur Thomas, and the Horse was (in the evening, about 4 or 5 o'Clock) taken away by Mr. Thomas's oldest appren- tice ; That some time afterwards, this deponent heard Arthur Thomas, Jun'r say that he had assisted Col. Kirkland in his escape, and also that this deponent did hear the said Arthur Thomas, jun'r say to Mr. John Hale, that Col. Kirkland rode the first night after his escape Forty miles, to the House of a man in New Jersey, who (Mr. Thomas said) had been taken up the day before, for having entertained a soldier at his House : that Mr. Kirkland made his es- cape thro' some surprise, out of a window ; That Mr. Kirkland was lost for several days, and when he was found he did not know the person who found him, and drew his Knife, charging him to keep off, but that on his giving the watchword, Kirkland went with him : That Col. Kirkland had attempted to go on board the man-of-warr, by means of a Boat, but the man-of-warr was gone too far off, and the Boat was obliged to return : That he also heard the said Arthur Thomas tell Mr. Hale that Capt. Bouger refused to break his word of Honor which he hat Pledged for the Liberty he enjoyed : That the said Thomas Damned him for talking of Honor to or among Thieves & Rogues, and that the said Arthur Thomas said to Mr. Hale, that it was not the thing for him, (meaning Capt. Bouger) not to go off after the Trouble they had taken to send him & Horse: That Mrs Ash told this deponent that she had heard one of the Thomas's say to Mr. Hale that he (Mr. Thomas,) had fur- nished Col. Kirkland with a Rope, for the Purpose of making his escape from Goal : That this deponent understood the Horse above- mentioned was intended for the use of Col. Kirkland, to facilitate his escape; and further this deponent saith not.

Martha Ash was brought before the Board by order, & being examined, made & Subscribed the following deposition :


" In Council of Safety for the State of Pen'a.


" Pennsyl'a, ss.


"On the 31 day of July, 1776, appeared Personally before the Council of Safety for the said State, Martha Ashe, who being duly Sworn on the Holy Evangelists of Almighty God, did depose, and say, that sometime after the escape of Col. Kirkland, she heard one of Arthur Thomas's Sons inform John Hale, that he had assis- ted Col. Kirkland with a Ladder of Rope, for to make his escape from the Jail, (but which of the said Thomas's Sons it was she cannot recollect,) and she doth further depose and say, that some- time after the said escape, a boy returned a Horse to the said Hale's, which had been obtained from him, with a pair of Saddle Bags, that 1

contained some oats & Biscuit, and, that this deponent believed that the said Kirkland made his escape with the same Horse ; that this deponent mentioned such, her Suspicion, to the said Hales, who re- plied that he believed he had.

By order of the Board, Mr. Robert Towers, Commissary, was desired to deliver to Mr. Henry Wynkoop of Bucks County, a Quarter Cask of Powder, to be by him delivered to the Associators, as he shall see convenient.


Moved, That Jacob Barge be requested to attend this Board to- morrow morning at 7 o'clock, otherwise, Mary Hutton may remove her Goods to such place as she may think proper within the City, & Subject to the Claims of Rent, as if the same were not removed.


Resolved, That it is the Opinion of this Council of Safety, that the Rules & Regulations of the late House of Assembly respecting the Association, ought to be complied with; and that no Company or Companies ought to be permitted to leave a Battalion, so as to leave less than six Companies in a Battalion, nor be permitted to leave their respective Battalions untill at least six Companies of supernumeraries can agree to form a new Battalion.


By order of the Board, John Maxwell Nesbitt, Esq'r, Treas'r, was desired to Pay an order drawn on this Board by James Pollock & Sam'l Laird, Commissioners of Cumberland County, in favor of John Pollock for £600 towards purchasing Muskets, to be charged to their Acco't.


By order of the Board, Mr. R. Towers, Commissary, was desired to deliver to Dan'l King, one of the old Cannon in the State House Yard, to Bore.


By order of the Board, Commodore Davison was desired to de. liver to Col. Matlack, 12 Riffes from on board the ship Mont- gomery.


By order of the Board, Mr. Robert Towers was directed to deliver Col. Clement Biddle, D. Q. M. G. or his assistants here, one Ton of Grape Shot, & one Ton of Buck Shott to be forwarded to the Camp in Jersey, to be charged to Congress.

Col. James Moore, of Chester County, made application for 50 Bayonets or Tomhawks, 30 Hatchets, 100 screws, & 100 worms, for the use of his Battalion; Mr. Robert Towers, Com'y, was de- sired to supply Col. Moore with the above Articles, taking his re- ceipt.


By order of the Board, Joseph Ferree, Esq'r, of Germantown, was desired to deliver to Mr. Carpenter Wharton 20 Bushels of the Salt Stored under his direction, on Mr. Wharton's Producing John M. Nesbitt's, Esq'r, Certificate of his having accounted with him for the same, at 7s 6 $ Bushel for the Salt, & 6d + Bushel for Carriage & Storage.


By order of the Board, John M. Nesbitt, Esq'r, Treas'r, was desired to pay to Col. Kirkbride £138 15 6 for 72 Arms, pur- chased for the use of his Battalion.


Resolved, That an application be made to Congress for 1100 Stand of Arms, for the Service of the Flying Camp.


A Letter was received from Capt. John Hamilton, of the Con- gress, and Capt. James' Montgomery, of the Chatham armed Boats, Resigning their Commissions in the Service of this State, as they expected to Serve in a larger Sphere of action, whereby they may have opportunity of rendering their Country some more essential Service than they have any prospect of doing Here; therefore,


Resolved, That their said Resignation be accepted, and they are hereby discharged from the Service of this State.

Kirkland, (whom this Board has reason to suspect is still in Jersey,) and in so doing this shall be your sufficient War- rant.

" Gent'n :


"In the course of our enquirey into the case of Kirkland's escape from the Gaol of this City, evidence appears against John Hatton of your County, and his Son, sufficient to induce us to request you will exert your utmost endeavours to secure them.


" We have sent you an officer in whom we can confide, who will assist in taking him, and also bring to this City, if you shall think it Proper to send him here.


" We apprehend that Col. Kirkland is still in your County some- where about Morris's River, as it appears Probable from Circum- stances given in evidence before us, that he failed in his Attempt to get on board the man-of-Warr. We make no doubt but that you will use every means in your Power to secure a Man so dan- gerous to the Liberties to this Country. The reward which is offered for taking him is Considerable, and Perhaps may excite some, who would not from other Motives, to endeavour by all Means to secure him. From your attachment to the cause of Liberty we expect exertions of a more extended kind and on more generous Principles, and firmly hope your endeavours will Meet with Success in securing two Men who are enemies to our Country & dangerous spies upon our Actions.

Mr. John Hubly appeared, took & Subscribed the Qualification directed by Convention.


Resolved, That an order be drawn on Mr. Nesbitt in fav'r of Mr. Lodowick Lauman, for £200, to be delivered to the Committee of Inspection and Observation of Lancaster County, & by them distributed to the Wives & families of Poor Associators who are now in Actual Service, and an order was drawn accordingly.


A letter was Received from John Mckinley, Esq'r, Chairman of the Committee of New Castle County, dated 2 Aug't, 1776, Col. Bedford, informing this Board that they had sent a Certain Alex'r Maurice to this City, under Col. Bedford's care, he being a Person strongly suspecting of Practices Inimical to the States of America, whereupon the Board ordered the said .Maurice to be committed to the State Prison. The Following order was sent to Col. Bedford for that purpose :


"In Council of Safety, Aug't 5th, 1776.


" Sir :


" You are hereby required and empowered to send the Body of Alexander Maurice, in your Custody, to the State Jail in this City, he being Charged with being Inimical to the American States, for which he is to answer, and for so doing this shall be your sufficient warrant.


" And the said Jailer is hereby required to receive the Body of the said Alex'r Maurice, and keep him in Safe Custody untill Pro- perly discharged.

The Board Proceeded to the Choice of President & Vice President by Ballot, when Mr. Thomas Wharton, jun'r, was chosen President, & Mr. David Rittenhouse Vice President, and Mr. Wharton took the chair accordingly.


Resolved, That the Town of Lancaster shall be supplied with 60 Stand of Arms, as soon as it is in the Power of this Council.


Resolved, That 23 Bundles of Blankets which Col. Miles left at Chester, in the Public Stores under the Care of Mr. Nicholas Fair- lamb, be delivered to Clement Biddle, D. Q. M. G. of the Flying Camp, for the use of the Pennsylvanians in New Jersey, to be for- warded to him by his Assistants Immediately.

By order of the Board, an order was drawn on J. M. Nesbitt, Esq'r, 'Treas'r, in fav'r of Col. Thomas Smith, for £13 7 6, for Carriage of Ammunition to Bedford County.


By order of the Board, Mr. R. Towers was directed to deliver Major Fullerton 20 stand of Arms, for the use of Col. Crawford's Battalion of Lancaster County, taking his receipt.


Resolved, That the Muster Master do Pass Col. R'd Thomas's - Battalion of Chester County, with the Present number of Officers and Men.


By order of the Board, an order was drawn on Mr. J. M. Nes- bitt, Esq'r, in fav'r of Mr. John Britton for £662 10, being for 50,000 feet of 3 Inch Plank, purchased by order of the late Com.

COUNCIL OF SAFETY.


mittee of Safety ? Resolve of 21 June last, for the fortification at Billingsport, to be charged to Congress.


An Application froin Col. Richard Thomas of Chester County, for accoutrements, was laid before the Board. Mr. Robt. Towers was ordered to supply him in his Possession, if not, Col. Thomas was desired to purchase them, and bring his acco't to this board.


By order of the Board, Mr. Rob't Towers was directed to deliver 60 Stand of Arms for the use of his Battalion.


Resolved, That so many workmen employed by Col. Wm. De- wees, as will keep one fire at work in Making Gun Scalps for the Public Service, be detained from Marching to Camp in New Jersey.


Resolved, That the D. Q. M. General's Assistants be authorized to Quarter Troops in the several Places of worship in this City, in turn, Provided they cannot procure suitable quarters elsewhere.


Order'd, That the said Assistants furnish the Wardens or Elders of the Several Places of Worship, with a Copy of the above re- solve.


Resolved, That Col. Matlack lay before the Convention the Ne- cessity of Raising the Flying Camp, and to request them to take the most effectual Measures to encourage the same, by allowing what may be esteemed a sufficient Bounty.


As any delay to the Marching of the Associators of this State, now in this City, will be attended with Great Inconvenience to the Public service ; be it, therefore,


Resolved, That Col. John Bull be Requested to examine into the State of all the Companies of the said Associators, and that all such as are sufficiently Provided, are hereby ordered to Proceed for- ward to the Camp, without delay.
