RECORD OF THE ANNUAL TOWN MEETING, HELD MARCH 10, 1941


The meeting was opened at 7:35 P. M., by the Town Clerk, Moder- ator Smith being unable to be present. George Peavey was elected Moderator for the evening, who read the call for the meeting and the Constable's return. As by vote of those present the reading of the Articles was dispensed with until taken up for action.


Article 1. To choose all town officers not required to be chosen by ballot, viz: Three Field Drivers, one Pound Keeper, and three Wood Measurers.


Voted: On motion by Everett Webster that Joseph F. Smith, Vincent Nutile and Everett Webster be appointed as Field Drivers; Joseph F. Smith as Pound Keeper; and George M. Roundy, Daniel Kelleher and Joseph F. Smith as Wood Measurers for the ensuing year.


Art. 2. To act upon reports of Town Officers and Special Com- mittees as published.


Voted: On motion by M. Doremus, to accept the report of Town Officers and Special Committees as published.


Art. 3. To see if the Town will vote to authorize the Town Treas- urer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1942, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period

of less than one year in accordance with Section 17, Chapter 44, General Laws.


Voted: On motion by W. Grace, to authorize the Town Treasurer with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1942, and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Art. 4. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of General Government of the Town, viz: Town Officers' salaries and expenses, care of Municipal Buildings, and Elections and Registrations, or what action it will take thereon.


Voted: On motion by E. Webster that the Town raise and appro- priate the sum of $10,645.00 to cover the expense of General Govern- men of the Town, viz: Town Officers' salaries and expenses (to in- clude a $50.00. increase in salary for each Assessor), care of Municipal Buildings, and Elections and Registrations.


Art. 5. To see if the Town will vote to raise and appropriate a sum of money for the expense of the Police Department.


Motion was made by E. S. Webster that the Town vote to raise and appropriate the sum of $6,400.00 for the expense of the Police Department. An amendment was offered by E. P. Lane that the sum of $6,200.00 be raised and appropriated for the purpose stated. The amendment was defeated and the original motion by E. S. Webster was voted upon and carried.


Art. 6. To see if the Town will vote to raise and appropriate a sum of money for the expense of the Fire Department.


Voted: On motion by W. W. Moxham that the Town raise and appropriate the sum of $5,000.00 for the expense of the Fire Department.


Art. 7. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Hydrant Rental for Fire Protection for the ensuing year.


Voted: On motion by E. A. Smith that the Town raise and appro- priate the sum of $2,950.00 to cover the expense of Hydrant Rental for Fire Protection for the ensuing year.


Art. 8. To see if the Town will vote to raise and appropriate a sum of money to cover Other Protections of Persons and Property.


Voted: On motion by M. Doremus that the Town raise and appro- priate the sum of $410.00 to cover Other Protections of Persons and Property

Art. 9. To see if the Town will vote to raise and appropriate a sum of money to cover the State Moth Assessment.


Motion was made by G. Trayers that the Town raise and appro- priate the sum of $3,000.00 for State Moth Assessment, was amended by E. P. Lane that $2,500.00 be raised for purpose stated, and the amendment was carried.


Art. 10. To see if the Town will vote to raise and appropriate a sum of money for Private Moth Work.


Voted: On motion by W. Wilkinson that the Town raise and appro- priate the sum of $300.00 for Private Moth Work.


Art. 11. To see if the Town will vote to raise and appropriate a sum of money to be used by the Tree Warden, for trimming and caring for trees along the highways.


Voted: On motion by G. Roundy that the Town raise and appro- priate the sum of $500.00 to be used by the Tree Warden, for trimming and caring for trees along the highways.


Art. 12. To see if the Town will vote to raise and appropriate a sum of money to be used by the Tree Warden to purchase and plant Shade Trees along the highways.


Motion was made by M. Doremus that Article 12 be indefinitely postponed, which was lost by vote taken, 81 voting to postpone and 91 opposed.


Motion was made by C. E. Comstock that the Town raise and appropriate the sum of $200.00 to be used by the Tree Warden to pur- chase and plant trees along the highways, was amended by E. P. Lane that $100.00 be appropriated for said purpose, which was defeated. The original motion by C. E. Comstock was then voted upon and carried.


Art. 13. To see if the Town will vote to raise and appropriate a sum of money to be used for Health and Sanitation, including Board of Health, Inspection of Animals and Inspector of Milk.


Motion was made by E. A. Smith that the Town raise and appro- priate the sum of $555.00 to be used for Health and Sanitation, in- cluding Board of Health, Inspection of Animals and Inspector of Milk was amended by J. MacNamara that $370.00 be raised and appropriated for purpose stated and was carried.


Art. 14. To see if the Town will vote to raise and appropriate a sum of money to cover the General Expense of the Highway Department.


Voted: On motion by M. Carter that the Town raise and appro- priate the sum of $12,500.00 to cover the General Expense of the High- way Department.

Art. 15. To see if the Town will vote to raise and appropriate a sum of money to be used in co-operation with a sum allotted by the Com- monwealth of Massachusetts, under Chapter 90 for the maintenance of Chapter 90 Roads.


Voted: On motion by M. Carter that the Town raise and appro- priate the sum of $1,500.00 to be used in co-operation with a sum allotted by the Commonwealth of Massachusetts, under Chapter 90, for the maintenance of Chapter 90 Roads.


Art. 16. To see if the Town will vote to raise and appropriate the sum of $3,750.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachusetts in reconstructing Summer Street, in accordance with the provisions of Chapter 90 of the General Laws.


Voted: On motion by M. Carter that the Town raise and appro- priate the sum of $3,750.00, said sum to be used with sums allotted by the County of Essex and the Commonwealth of Massachusetts in reconstructing Summer Street in accordance with the provisions of Chapter 90 of the General Laws.


Art. 17. To see if the Town will vote to raise and appropriate a sum of money to be used under the supervision of the Selectmen for cutting brush along the Highways.


Voted: On motion by J. MacNamara that the Town raise and ap- propriate the sum of $350.00 to be used under the supervision of the Selectmen for cutting brush along the Highways.


Art. 18. To see if the Town will vote to raise and appropriate a sum of money to cover the Expense of the Welfare Department.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $5,500.00 to cover the expense of the Welfare Depart- ment.


Art. 19. To see if the Town will vote to raise and appropriate a sum of money to cover the Expense of Aid to Dependent Children.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $700.00 to cover the Expense of Aid to Dependent Children.


Art. 20. To see if the Town will vote to raise and appropriate a sum of money to cover the Expense of Old Age Assistance.


Voted: On motion by E. Smith that the Town raise and appropriate the sum of $10,650.00 to cover the Expense of Old Age Assistance.


Art. 21. To see if the Town will vote to raise and appropriate a sum of money to cover the Expense of Soldiers' Relief.

Art. 22. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the School Department.


Voted: On motion by N. C. MacKillop that the Town raise and appropriate the sum of $51,500.00 for the General Expense of the School Department.


Art. 23. To see if the Town will vote to raise and appropriate a sum of money for the Memorial Park to be spent under the super- vision of the School Committee.


Voted: On motion by W. DeWilde that the Town raise and appro- priate the sum of $350.00 for the Memorial Park to be spent under the supervision of the School Committee.


Art. 24. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the Public Libraries.


Voted: On motion by M. Eaton that the Town raise and appropriate the sum of $850.00 for the General Expense of the Public Libraries.


Art. 25. To see what disposal the Town will make of the money refunded by the County from the Dog Licenses for the year 1940.


Voted: On motion by R. P. Schlinker that the Town appropriate the money refunded by the County from the Dog Licenses for the year 1940 for the support of the Public Libraries.


Art. 26. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the Park Department.


Voted: On motion by G. Roundy that the Town raise and appro- priate the sum of $500.00 for the General Expense of the Park De- partment.


Art. 27. To see if the Town will vote to raise and appropriate a sum of money for the Observance of Memorial Day and determine by whom it shall be spent.


Voted: On motion by C. Russell that the Town raise and appro- priate the sum of $200.00 for the Observance of Memorial Day, same to be expended under the direction of the American Legion Post No. 131, Inc.


Art. 28. To see if the Town will vote to raise and appropriate a sum of money to cover the Town's Share of the cost incurred during the year 1940 in maintaining the Essex County Sanatorium under the Provisions of Chapter 111 of the General Laws.

Voted: On motion by G. Trayers that the Town raise and appro- priate the sum of $1,633.75 to cover the Town's share of the cost in- curred during the year 1940 in maintaining the Essex County Sana- torium under the provisions of Chapter 111 of the General Laws.


Art. 29. To see if the Town will vote to raise and appropriate a sum of money to be used as the Reserve Fund.


Motion was made by E. Smith that the Town raise and appro- priate the sum of $2,000.00 to be used as the Reserve Fund, was amended by E. P. Lane that $1,500.00 be raised for purpose stated and was carried.


Art. 30. To see if the Town will vote to raise and appropriate a sum of money for use of the Cemetery Commissioners for the care of the Town Cemeteries.


Voted: On motion by R. Pearson that the Town raise and appro- priate the sum of $750.00 for use of the Cemetery Commissioners for the care of the Town Cemeteries.


Art. 31. To see if the Town will vote to raise and appropriate a sum of money to cover the payment of notes maturing the current year.


Voted: On motion by C. Russell that the Town raise and appropriate the sum of $3,000.00 to cover the payment of notes maturing the current year, said sum of $3,000.00 to be transferred from the Excess and De- ficiency Fund.


Art. 32. To see if the Town will vote to raise and appropriate a sum of money to cover Payments of Interest on Debts and Loans be- coming due the current year.


Voted: On motion by C. Russell that the Town raise and appropriate the sum of $600.00 to cover Payment of Interest on Debts and Loans be- coming due the current year, said sum of $600.00 to be transferred from the Excess and Deficiency Fund.


Art. 33. To see if the Town will vote to raise and appropriate a sum of money to be used for Government and Relief Projects.


Voted: On motion by E. Webster that the Town raise and appro- priate the sum of $2,500.00 to be used for Government and Relief Projects.


Art. 34. To see if the Town will vote to raise and appropriate a sum of money to cover the Expense of Street Lighting.


Voted: On motion by E. Webster that the Town raise and appro- priate the sum of $4,172.00 to cover the Expense of Street Lighting.


Art. 35. To see if the Town will vote to approve the installation of one (1) additional street light on Ward Terrace and Broadway.


Art. 36. To see if the Town will vote to approve the installation of four (4) new street lights on Phillips Road.

Art. 37. To see if the Town will vote to approve the installation of four (4) new street lights on Salem Street near Library.


It was voted on motion by C. Russell that Articles 35, 36 and 37 be taken collectively.


Voted: On motion by C. Russell that the Town approve the installa- tion of one (1) additional street light on Ward Terrace and Broadway; four (4) street lights on Phillips Road; four (4) new street lights on Salem Street near Library.


Art. 38. To see if the Town will vote to raise and appropriate a sum of money for the purchase of a truck for the Highway Department and to permit the turning in of an old truck in part payment of same, $500.00 to be raised in the 1941 Tax Levy and $700.00 to be transferred from the Machinery Account.


Voted: On motion by M. Carter that the Town raise and appro- priate the sum of $1,200.00 for the purchase of a truck for the Highway Department and to permit the turning in of an old truck in part pay- ment of same, $500.00 to be raised in the 1941 Tax Levy and $700.00 to be transferred from the Machinery Account.


Art. 39. To see if the Town will raise and appropriate a sum of money for the finishing of the boys' and girls' toilets in the new part of the Center School.


Motion was made by E. Averell that the Town raise and appropriate the sum of $7,100.00 for the finishing of the boys' and girls' toilets in the new part of the Center School, $2,100.00 to be raised in the 1941 Tax Levy, $5,000.00 on notes payable each year, $2,000.00 to be raised on the 1942 Tax Levy, $2,000.00 on the 1943 Tax Levy, and $1,000.00 on the 1944 Tax Levy, was amended by E. P. Lane that $7,100.00 be raised for said purpose, $2,100.00 to be transferred from the Excess and De- ficiency Fund, $2,000.00 to be raised in the 1942 Tax Levy, $2,000.00 in the 1943 Tax Levy, and $1,000.00 in the 1944 Tax Levy.


Tellers were appointed and a vote taken, with a result of 163 voting in the affirmative and 16 voting in the negative.


Art. 40. To see if the Town will vote to raise and appropriate a sum of money for the purchase of the property on Main Street, known as the Walter H. Perry estate, for use as a High School site, and to pro- vide for the payment therefor by borrowing in accordance with the provisions of Chapter 44 of the General Laws.


Motion was made by C. Russell that the Town vote to raise and appropriate the sum of $10,000.00 for the purchase of the property on Main Street, known as the Walter, H. Perry estate, for use as a High School site, and to provide for the payment therefor, the sum of $2,000.00

to be transferred from the Excess and Deficiency Fund, and that to provide for the balance of $8,000.00, the Treasurer, with the approval of the Selectmen, be and hereby is authorized to borrow the sum of $8,000.00, and to issue notes payable $2,000.00 annually in accordance with the provisions of Chapter 44 of the General Laws, so that the whole loan shall be paid in not more than four years from the date of issue of the first note.


Tellers were appointed and a vote taken with a result of 142 voting in the affirmative and 68 in the negative. Total vote cast 210.


Art. 41. To see if the Town will vote to raise and appropriate a sum of money for printing copies of the Zoning and Building Laws.


Voted: On motion by L. B. Tuck that the Town raise and appro- priate the sum of $88.00 for printing copies of the Zoning and Building Laws.


Art. 42. To see if the Town will vote to raise and appropriate a sum of $2,000.00 for the purchase of a new Forest Fire Truck, $1,000.00 to be raised in the 1941 Tax Levy, and $1,000.00 in the 1942 Tax Levy.


Voted: On motion by W. W. Moxham that the Town raise and ap- propriate the sum of $2,000.00 for the purchase of a new Forest Fire Truck, $1,000 to be raised in the 1941 Tax Levy, and $1,000.00 in the 1942 Tax Levy, (and to permit the turning in of Dodge Truck in part payment of same.)


The following committee was appointed to purchase the new Forest Fire Truck, W. W. Moxham, J. Donovan, and C. I. Cheever.


Art. 43. To see if the Town will vote to raise and appropriate a sum of money for the purchase of a Police Car, and radio equipment.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $2,500.00 for the purchase of a Police Car and Radio equipment. The motion was carried by a two-thirds vote.


Art. 44. To see if the Town will vote to raise and appropriate a sum of money for an Insurance Survey.


Voted: On motion by E. S. Webster that the Town raise and appro- priate the sum of $100.00 for an Insurance Survey.


Art. 45. To see if the Town will vote to purchase from Susan B. Taylor a parcel of land, for playground purposes, as an addition to Memorial Playground, so-called, situated in Lynnfield Centre, bounded and described as follows:


Beginning at the northwesterly corner at the southwesterly corner of land of McCarthy; thence running southwesterly by land of the Town of Lynnfield, the same being Memorial Playground, so-called, three hundred (300) feet more or less to the brook; thence turning

and running northeasterly on the brook to land formerly of Mary M. Nash, subsequently of Taylor but now said to be of Haskell; thence turning and running northwesterly by said land formerly of Nash three hundred (300) feet more or less to land of McCarthy; thence turning and running westerly by said land of McCarthy two hundred (200) feet more or less to the point of beginning. Con- taining approximately one acre.


and to raise and appropriate the sum of five hundred dollars ($500.00) in payment therefor.


Motion was made by N. B. Todd that the Town vote to purchase from Susan B. Taylor as an addition to the Memorial Playground, so-called, and for playground purposes, a certain parcel of land belonging to her, situated in that part of Lynnfield known as Lynnfield Centre, adjacent to said Memorial Playground, and bounded and described as follows:


Beginning at the northwesterly corner at the southwesterly corner of land of McCarthy; thence running southwesterly by land of the Town of Lynnfield, the same being Memorial Playground, so- called, three hundred (300) feet more or less to the brook; thence turning and running northeasterly on the brook to land formerly of Mary M. Nash, subsequently of Taylor but now said to be of Haskell; thence turning and running northwesterly by said land formerly of Nash three hundred (300) feet more or less to land of McCarthy; thence turning and running westerly by said land of McCarthy two hundred (200) feet more or less to the point of beginning. Con- taining approximately one acre.
