Article 27. Motion made by Burton Barrows that $98,709.52 be raised and appropriated to cover the general expense of the School Department.

Article 30. Voted: On motion by Malcolm Eaton that the Town raise and appropriate the sum of $1,675.00 for the general expense of the Public Libraries.


Article 31. Voted: On motion by Malcolm Eaton that the money refunded from Dog Licenses be used by the town for the support of the Libraries.


Article 32. Voted: On motion by Carl Russell that the Town raise and appropriate the sum of $250.00 to be used for the observance of Memorial Day, said sum to be spent under the direction of a com- mittee appointed by the American Legion Post 131, Inc., of Lynnfield.


Article 33. Voted: On motion by Stanley Heath that the Town raise and appropriate the sum of $3,705.73 to cover the Town's share of the cost incurred during the year 1947 in maintaining the Essex County Sanitorium under the provisions of General Laws, Chapter III.


Article 34. A motion was made by Theodore Palizzolo that the Town raise and appropriate the sum of $3,000.00 to be used as the Reserve Fund.

Voted: On motion by Arthur Hawkes, to accept as a public way the way known as Rockwood Road, now leading in a north- easterly direction from Summer Street, as shown on a plan of land entitled "Section B-Lakewood Section of Lynnfield" by Shay and Shay, C. E., dated April 1938 for Samuel B. Donovan, for a distance of four hundred eighty four and 58/100 (484.58) feet, to within two (2) feet of Pillings pond, for a width of forty (40) feet.


Article 38. Voted: On motion of Arthur Hawkes, that the Town raise and appropriate the sum of $800.00 to put Rockwood Road in condition.


Article 39. This Article was read in its entirety to the people, by Moderator Harry Jackson, as follows:

That the Town Zoning By-Law be and it hereby is amended by

(a) The Town of Lynnfield is hereby divided into four classes of districts, designated as:


1. Residence districts,


2. Single residence districts,


3. Business districts,


4. Industrial districts,


and which are as shown on the map or plan entitled "Zoning Map of the Town of Lynnfield, Massachusetts, 1928, Revised as to zone areas 1948" and which together with all explanatory matter thereon is hereby incorporated in and made a part of this By-Law.


That the Town Zoning By-Law and the map or plan incorporated in and made a part thereof be and they hereby are amended by al- tering said map or plan so as to establish a single residence district comprised of all the land within the following boundaries:


Beginning at the intersection of Main Street and the boundary line between the Towns of Lynnfield and Wakefield, thence along the center line of Main Street to its intersection with the center line of Chestnut Street, thence in a straight line to the intersection of the center lines of Lowell and Main Streets, thence along the center line of Lowell Street to its intersection with the boundary line of the Town of Lynnfield and the City of Peabody, thence in a general northerly di- rection along said boundary line to the boundary line of the Towns of Lynnfield and Middleton, thence along the boundary line of the Towns of Lynnfield and Middleton to the boundary line of the Towns of Lynnfield and North Reading, thence along the boundary line of the Towns of Lynnfield and North Reading, to the boundary line of the Towns of Lynnfield and Reading, thence along the boundary line of the Towns of Lynnfield and Reading to the boundary line of the Towns of Lynnfield and Wakefield, thence along the boundary line of the Towns of Lynnfield and Wakefield to the point of beginning.


That the Town Zoning By-Law be and it hereby is amended by in- serting the following Section 2A between Section 2 and Section 3.


Section 2A. Single Residence Districts.


In a single residence district: -


(a) No building, structure, or premises shall be erected, altered, or used for any other purpose than:


1. One-family detached houses;


2. Parks and playgrounds;


3. The office of a professional person located in the house in which he resides;

4. For such other purposes as are customarily incidental to any of the foregoing, including private garage and private stable.


That the Town Zoning By-Law be and it hereby is amended by inserting the following paragraph (b) in Section 2A.


(b) No building or structure shall be constructed, altered, en- larged, reconstructed, or moved, in a single residence district, so that any part except uncovered steps, is less than forty feet from the street boundary line, or less than twenty-five feet from any side boundary line, or less than twenty feet from any rear boundary line; provided that the Board of Appeals may, after public notice and hearing, give permission for a lesser distance to be used in spe- cific cases where, in their opinion, such exception will not cause sub- stantial injury to property in the neighborhood.


That the Town Zoning By-Law be and it hereby is amended by inserting the following paragraph (c) in Section 2A.


(c) The buildings on a lot in a single residence district shall not occupy more than twenty percent of the lot area.


That the Town Zoning By-Law be and it hereby is amended by inserting the following paragraph (d) in Section 2A.


(d) No dwelling shall be erected or placed on a lot in a single residence district unless the lot has a street frontage of at least two hundred feet upon the frontage street or way, public or private, and an area of at least forty thousand square feet; no lot with a building thereon shall be changed in size so as to violate the provisions of this paragraph or of paragraphs (b) and (c) of this Section; and in the event of such change in violation hereof, the house on such lot shall not be used until sufficient land is restored or added to said lot so that it will contain an area equal to its original area or equal to the area hereby required to be provided for such house; and no lot area or frontage shall at any time be considered as the required area or frontage for more than one dwelling; pro- vided that the Board of Appeals may, after public notice and hearing, give permission for a lesser street frontage and lot area in specific cases where, in their opinion, such exception will not cause sub- stantial injury to property in the neighborhood. Nothing contained in this paragraph shall prevent the construction or placing of a building on any lot containing a smaller area or street frontage than herein required, provided such lot on the effective date hereof does not adjoin other land of the same owner available for use in con- nection with said lot.


That the Town Zoning By-Law be and it hereby is amended by inserting the following paragraph (e) in Section 2A.

(e) Only the following signs may be displayed in a single residence district:


Real estate signs advertising the sale or rental of only the premises on which they are located; park or playground signs on the prem- ises of a park or playground; and signs advertising the profession carried on on the premises. No sign advertising a profession shall exceed six inches in width and twenty-four inches in length, and no other sign shall exceed nine square feet in area.


Before action was taken on this article, a report of the Planning Board was read by Theodore Ferren.


Motion to indefinitely postpone action on this Article, by Ernest Lane was voted on and lost.


Motion made by Theodore Feren that Article 39 be adopted as read but with these changes and additions:


That the minimum lot size be 30,000 square feet and the mini- mum street frontage be 150 feet;


And that in Section 2A farms be included as a permitted use.


A rising vote was taken on this motion with count of Tellers show- ing 212 in favor and 33 opposed.


At this time a motion by Milton Doremus to adjourn was voted on and lost.


Article 40. Motion made by Bernard Sleeper that the sum of $1,000.00 be raised and appropriated to be used to build and maintain ice skating rink or rinks under the supervision of the Park Department.


An amendment was offered by Norma McKillop that the money be spent equally between the two sections of the Town and that a com- mittee be chosen by the Moderator to select a site in the south part of the Town.


The amendment was voted on and lost.


The original motion was then taken up for action and carried.


Article 41. Voted: On motion by Roger Lummus, that the Town transfer from the so-called "Compensation Fund" the sum of $1,500.00 for the payment of the annual estimated premium for the Workmen's Compensation Policy.


Article 42. Voted: On motion by Theodore Palizzolo, that the Town pay the Plumbing Inspector a salary equivalent to 50% of the fees collected by him for plumbing inspections, said salary to be paid monthly.


Article 43. Voted: On motion by Stanley Heath that the Town raise and appropriate the sum of $5,514.69 for the expense of Street Lighting and to authorize the Selectmen to install new street lights.

Ahticle 44. Voted: On motion of Arthur Nelson that the Town raise and appropriate the sum of $2,400.00 to be used for the payment of collection of garbage for one year commencing April 1, 1948, this being the second year under a three year contract.


Article 45. Voted: On motion of Everett Webster that the Town raise and appropriate the sum of $3,000.00 to be used for the payment of collection of rubbish for one year, commencing April 1, 1948, this being the second year under a three year contract.


Article 46. Voted: On motion of Roger Lummus, that the Town raise and appropriate the sum of $1,800.00 to cover the cost of renewal premiums during 1948 on the blanket fire insurance on town buildings.


Article 47. Voted: On motion of Stanley Heath, that the Town raise and appropriate the sum of $160.00 to be used to refinish the floor in the upper hall of the Town Hall under the supervision of the Se- lectmen.


Article 48. Voted: On motion of Wesley Munroe, that the Town raise and appropriate the sum of $1,000.00 for the payment of board and room for patients at the Essex County Sanitorium under the su- pervision of the Board of Health.


Article 49. Voted: On motion of Louis Tuck, that the Town raise and appropriate the sum of $948.31 to cover the expense of lia- bility and property damage insurance on the motor vehicles of the Highway, Police and Fire Departments.


Article 50. Voted: On motion of Theodore Palizzolo, that the Town raise and appropriate the sum of $750.00 and transfer from the Excess and Deficiency Fund the sum of $2,250.00 until reimbursed by the County and State, for Chapter 90 construction on Main Street drainage.


Article 51. Voted: On motion of Theodore Palizzolo, that the Town raise and appropriate $1,500.00 and transfer from the Excess and Deficiency Fund the sum of $1,500.00, until reimbursed by the State to be used under Chapter 90 for the maintenance of Chapter 90 roads.


Article 52. Voted: On motion of Benjamin Cox, that the Town raise and appropriate the sum of $300.00 to be used for the purchase and erection of new street signs.


Article 53. Voted: On motion of Milton Doremus, that the sum of $500.00 be transferred from the "sales of lots and graves" for the grad- ing of the cemetery.


Article 54. Voted: On motion of Everett Webster, that the Town raise and appropriate the sum of $875.00 to paint the outside of the Town Hall.

Article 55. Voted: On motion of Stanley Heath, that the Town raise and appropriate the sum of $385.00 to be spent under the super- vision of the Selectmen for repairs and painting in the inside of the Town Hall.


Article 56. Motion made by Theodore Palizzolo, that the sum of $2,608.50 be raised and appropriated for the use of the Park Depart- ment, and that the rate of pay be $1.00 per hour.


An amendment was made by Everett Webster that the rate of pay be $1.25 per hour. The amendment was voted on and lost. The original motion was then voted on and passed.


Article 57. Voted: On motion of Milton Doremus, that the Town raise and appropriate the sum of $1,300.00 for the general expense of the Town Cemeteries, rate of pay to be $1.25 per hour and to authorize them to perform duties in the cemeteries.

RECORD OF SPECIAL TOWN MEETING HELD APRIL 12, 1948


The meeting was called to order at 8:00 P. M., by the Moderator who read the call for the meeting and the Constable's return. Three Hundred and Seventy-five persons present.


On motion by Everett Webster, it was voted to dispense with the reading of the Articles until taken up for action.


Article 1. Voted: On motion of Theodore Palizzolo, to rescind and revoke action taken on Article 42 at the regular Town Meeting of March 8, 1948 and transfer from Excess and Deficiency Fund the sum of $300.00 to cover compensation of the Plumbing Inspector, or additional inspector as of January 1, 1948, said compensation to be fifty percent of each fee collected for plumbing inspections.


Article 2. Voted: On motion of Everett Webster to raise and appropriate the sum of $600.00 to paint the outside of Chemical House No. 1.


Article 3. Voted: On motion of Joseph Cassidy that the Town transfer the sum of $125.00 from Roofing of Town Hall Account to the Auxiliary Light Account.


Article 4. A motion was offered by Charles Wilkins that the Town raise and appropriate the sum of $5,000.00 to install proper drains and catchbasins to take care of surface water on Laurel Road, Sylvan Circle and Fairview Road.


An amendment to the motion was made by Frank Lichtenberg that action on this article be indefinitely postponed. A voice vote being doubted, tellers were appointed by the Moderator and the count was as follows:


164 in favor of indefinitely postponing action. 146 opposed


Article 5. A motion was made by Leon Cobb that the Town raise and appropriate a sum of money to provide for an increase in salary of ten cents an hour for Moth Department and Highway De- partment.


An amendment to the motion was made by Mr. Webster, that the Town raise and appropriate the sum of $1,648.00 to cover the salary

increases for Moth and Highway Departments, said sum to be divided as follows: $400.00 for Moth Department and balance of $1,248.00 for Highway Department, said salary increases to be, Supt. of Moth De- partment $1.20 per hour, laborers $1.10 per hour and $1.10 per hour for all Highway men.


The amendment was voted on and carried.


Article 6. A motion was made by Everett Webster, that the sum of $1,722.00 be raised and appropriated for the use of the Police Department, and that $260.00 of that amount be used to provide an increase in compensation for the Chief, said increase to be retroactive to January 1, 1948.


An amendment was offered to this motion by Roy Sorli, that the sums asked for by Mr. Webster be divided and voted on separately.


A second amendment was offered by Allen Rideout, that the sum of $260.00 be raised and appropriated to provide an increase in com- pensation for the Chief, retroactive to January 1, 1948 and that the balance of this article be referred to a committee, to be appointed by the Moderator, consisting of two members of the Finance Com- mittee and three citizens-at-large, who shall study the needs of the Police Department and report to the Town by the next Annual Meet- ing.


A vote was taken on the second amendment with tellers being ap- pointed by the Moderator. The result was 168 opposed to amendment and 138 in favor. The amendment of Mr. Sorli was then voted an and was not carried. The original motion was then voted on by voice vote, and also by hand vote, Moderator appointing tellers and final count being as follows:


222 against motion.


101 in favor. Motion was lost.


Article 7. A motion was made by Henry Haskell, that Article 7 "to see if the Town will vote to raise and appropriate a sum of money to provide for the purchase of a second cruiser for the Police Department and to equip and operate same" be indefinitely postponed. This motion was seconded, voted on and carried unanimously.


Article 8. Voted: On motion made by John Caldwell, that the Board of Selectmen be and they hereby are authorized and directed to petition the Great and General Court of the Commonwealth of Massa- chusetts at its regular session in 1948 that the Town be authorized to borrow outside the debt limit the sum of Two Hundred Thousand Dollars ($200,000.00), the amount so borrowed to be used for the con- struction of an elementary school in Precinct 2 of the Town, and to obtain original furniture and equipment for such school.


An amendment by Mr. Doremus for vote by secret ballot was de- feated.

RECORD OF SPECIAL TOWN MEETING HELD MONDAY, JULY 19, 1948


The meeting was called to order at 8:10 P. M. by the Moderator Joseph Smith who read the call for the meeting and the Constable's return.


It was voted, on motion of Everett Webster, to omit the reading of the articles of the Warrant until taken up for action.


Article 1. This Article was read in its entirety to the people by Moderator Joseph Smith, as follows:


"To see if the Town will vote to amend the first sentence of Section 5A of the Zoning By-Law by adding after the words "for sale" the words "or otherwise," and by adding after the words "residence dis- trict" the words "or a single residence district" so as to read as fol- lows:


The removal, for sale or otherwise, from a residence district or a single residence district or from one place to another in such district, of sod, loam, clay, sand, gravel or quarried stone forming a part of the real estate in such district, except when necessarily incidental to or in connection with the construction, at the site of removal, of a building for which a permit has been issued, or for grading or otherwise improving the premises of which such building is a part, shall be per- mitted only if written permission of the Board of Appeals be first ob- tained.


Before action was taken on this article a report of the Planning Board was read by Theodore Ferren.


A motion was then made by Mr. Ferren that Article 1 be accepted as read. This motion was seconded and attention was called by Mr. Grant that a two-thirds vote would be necessary. Moderator then ap- pointed three tellers, Mr. Coon, Mr. Grant and Mr. McIntire. The re- sulting vote being 101 in favor, none opposed, Moderator declared the motion carried.


Article 2. This Article was read in its entirety to the people by Moderator Joseph Smith, as follows:


"To see if the Town will vote to amend Section 5 (e) of the Zon- ing By-Law by adding after the words "residence district" the words "and in a single residence district" and by adding after the words "section 2" the words "or Section 2A respectively," so as to read as follows:

In a residence district and in a single residence district when a building, structure or premises has been used for a purpose not per- mitted under the provisions of Section 2 or Section 2A, respectively, and the use of such building, structure or premises has been or shall be discontinued for a period of one year, it shall not be re-established, and future use of said building, structure or premises shall be in con- formity with this by-law."


Before action was taken on this article a report of the Planning Board was read by Theodore Ferren.


A motion was then made by Mr. Ferren that Article 2 be accepted as read. This motion was seconded and attention called by Mr. Grant that a two-thirds vote was necessary whereupon Moderator requested tellers to take the count with resulting vote being 88 in favor, 2 op- posed, Moderator declared the motion had carried.


Article 3. This Article was read in its entirety to the people by Moderator Joseph Smith, as follows:


"To see of the Town will vote to amend the description of the boundaries of the single residence district by inserting the words "to the boundary line" following the words "thence in a general northerly direction along said boundary line," so as to read as follows:
