REPORT OF TOWN CLERK


RECORD OF THE ANNUAL TOWN MEETING HELD MARCH 9, 1942


The meeting was called to order at 7:35 P.M. by Moderator Joseph Smith, who read the call for the meeting, and the Constable's return.


On motion by George Peavey it was voted to dispense with the reading of the articles in the warrant, and Article 1 was taken up for action.


Article 1. To choose all town officers not required to be chosen by ballot, viz: Three Field Drivers, one Pound Keeper, and Three Wood Measurers.


Voted: On motion by George Peavey, that Joseph Smith, Vincent Nutile, and Everett Webster be appointed as Field Drivers; Joseph Smith as Pound Keeper; and George M. Roundy, Daniel Kelleher and Joseph Smith as Wood Measurers for the ensuing year.


Art. 2 To act upon reports of Town Officers and Special Commit- tees as published.


Voted: On motion by George Peavey, to accept the reports of Town Officers and Special Committees as published.


Art. 3 To see if the Town will vote to authorize the Town Treas- urer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1943 and to issue a note or notes therefor, payable within one year, and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, Gen- eral Laws.


Voted: On motion by Carl Russell to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1943 and to issue a note or notes therefor payable within one year and to renew any note or notes as may be given for a period of less than one year in accordance with Section 17, Chapter 44, General Laws.


Art. 4 To see if the Town will vote to raise and appropriate a sum of money to cover the expense of General Government of the Town, viz: Town Officers' salaries and expenses, care of Municipal Buildings, and Elections and Registrations, or what action it will take thereon.


Voted: On motion by Ernest Lane that the sum of $11,064.00 as recommended by the finance committee, be raised and appropriated to cover the expense of General Government of the Town as outlined in the Article; that this amount be apportioned as follows:


Selectmen $1,000.00, Accountant $790.00, Treasurer $685.00, Clerk $581.00, Collector $1,520.00, Assessors $1,872.00, Other finance officers and accounts $80.00, Counsel $280.00, Municipal Buildings $2,467.50, Elec-

tions-Registrations $838.50, Planning Board $500.00, Board of Appeals $100.00, Town Reports $350.00.


And that the following salary adjustments be made :-


Accountant increase of $150.00 per year


Clerk increase of $50.00 per year


Collector increase of $150.00 per year


Assessors increase of $50.00 Each per year


Counsel decrease of $250.00 per year.


Art. 5 To see if the Town will vote to raise and appropriate a sum of money for the expense of the Police Department.


Voted: On motion by Ernest Lane, that the sum of $10,733.00, as recommended by the Finance committee, be raised and appropriated to cover the expense of the Police Department.


Art. 6. To see if the Town will vote to raise and appropriate a sum of money for the expense of the Fire Department.


Motion was made by Ernest Lane, that the sum of $6,560.00, as recommended by the finance committee, be raised and appropriated to cover the expense of the Fire Department.


An amendment was offered by Everett Webster, that the sum of $2,450.00 be added to the sum of $6,560.00, which was recommended by Mr. Lane, for the purpose of purchasing two air horns. This sum, $2,450.00 to be spent under the supervision of the selectmen. Total appropriation $9,010.00.


The motion as amended, was carried.


Art. 7. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Hydrant Rental for Fire Protec- tion for the ensuing year.


Voted: On motion by Everett Webster, that the Town raise and appropriate the sum of $3,225.00 for Hydrant rental for Fire Protection for the ensuing year.


Art. 8. To see if the Town will vote to raise and appropriate a sum of money to cover Other Protections of Persons and Property.


Voted: On motion by Ernest Lane that the sum of $567.00, as recom- mended by the Finance Committee, be raised and appropriated to cover the expense of Other Protections of Persons and Property, and that this amount be apportioned as follows:


Inspector of Buildings $250.00, Sealer of Weights $117.00, Dog Of- ficer $200.00 which includes a salary increase of $50.00 per year.


Art. 9. To see if the Town will vote to raise and appropriate a sum of money to cover the State Moth Assessment.


Motion was made by Gordon Tuttle that the Town raise and ap- propriate the sum of $3,216.00 to cover the State Moth Assessment.

This motion was amended by Ernest Lane that the sum of $2,000.00 be raised and appropriated for purpose stated, and was lost. The original motion was then voted upon and carried.


Art. 10. To see if the Town will vote to raise and appropriate a sum of money for Private Moth Work.


Voted: On motion by Albert E. Brown, that the Town raise and ap- propriate the sum of $500.00 for Private Moth Work.


Art. 11. To see if the Town will vote to raise and appropriate a sum of money to be used by the Tree Warden, for trimming and caring for trees along the highways.


Voted: On motion by Ernest Lane, that the sum of $650.00, as recommended by the finance committee, be raised and appropriated for the use of the Tree Warden, as outlined in the article.


Art. 12. To see if the Town will vote to raise and appropriate a sum of money to be used by the Tree Warden to purchase and plant Shade Trees along the highways.


Voted: On motion by Ernest Lane, that action on this article be indefinitely postponed.


Art. 13. To see if the Town will vote to raise and appropriate a sum of money to be used for Health and Sanitation, including Board of Health, Inspection of Animals and Inspector of Milk.


Voted: On motion by Everett Webster, that the Town raise and appropriate the sum of $480.00, to be used for Health and Sanitation, including Board of Health, Inspector of Animals and Inspector of Milk.


Art. 14. To see if the Town will vote to raise and appropriate a sum of money to cover the General Expense of the Highway Dept.


Motion was made by Ernest Lane, that the sum of $14,807.00, as recommended by the finance committee, be raised and appropriated to cover the general expense of the Highway Department, and that the salary of the Superintendent be increased $100.00 per year.


This motion was amended by Albert Riggs that $600.00 of the sum be used for repairing Salem Street sidewalk. The motion as amended was carried.


Art. 15. To see if the Town will vote to raise and appropriate a sum of money to be used in co-operation with a sum allotted by the Commonwealth of Massachusetts, under Chapter 90 for the mainten- ance of Chapter 90 Roads.


Voted: On motion by Minot Carter, that the Town raise and ap- propriate the sum of $2,000.00 to be used in co-operation with a sum allotted by the Commonwealth of Massachusetts, under Chapter 90 Roads.

Art. 16. To see if the Town will vote to transfer the sum of $775.00 from the machinery account, for the purchase of a highway truck and permit the Selectmen to turn in one truck in part payment of purchase price.


Voted: On motion by Minot Carter, that the Town transfer the sum of $775.00 from the Machinery Account, for the purchase of a highway truck.


Art. 17. To see if the Town will vote to raise and appropriate a sum of money to be used under the supervision of the Selectmen for cutting brush along the Highways.


Motion was made by Everett Webster that the sum of $300.00 be raised and appropriated, to be used under the supervision of the Select- men for cutting brush along the Highways. An amendment was of- fered by Edward Phillips that action on Article 17 be indefinitely post- poned. Tellers were appointed and a vote taken, with a result of 83 voting for postponement and 117 opposed. The original motion was then voted upon and carried.


Art. 18. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the Welfare Department.


Voted: On motion by Everett Webster, that the Town raise and ap- propriate the sum of $7,206.00 to cover the expense of the Welfare De- partment.


Art. 19. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Aid to Dependent Children.


Voted: On motion by Everett Webster, that the Town raise and ap- propriate the sum of $1,350.00 to cover the expense of Aid to Depend- ent Children.


Art. 20. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Old Age Assistance.


Voted: On motion by George Peavey, that the Town raise and ap- propriate the sum of $16,745.00 to cover the expense of Old Age As- sistance.


Art. 21. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of Soldiers' Relief.


Voted: On motion by Carl Russell, that the Town raise and ap- propriate the sum of $1,400.00 to cover the expense of Soldiers' Relief.


Art. 22. To see if the Town will vote to raise and appropriate a sum of money for the General Expense of the School Department.


Motion was made by Ernest Lane, that the Town raise and appro- priate the sum of $53,029.00, (to include $25.00 per week for school jani- tors); for the General Expense of the School Department. This mo- tion was amended by Edward Averell, that the Town raise, and ap-

Art. 23. To see if the Town will vote to raise and appropriate a sum of money for the Memorial Park to be spent under the supervision of the School Committee.


Voted: On motion by Edward Averell, that the Town raise and ap- propriate the sum of $250.00 for Memorial Park, to be spent under the supervision of the School Committee.


Art. 24. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the Public Libraries.


Voted: On motion by Ernest Lane, that the Town raise and appro- priate the sum of $975.00 as recommended by the finance committee, for the general expense of the Public Libraries, and that the salary of the librarians be increased $.50 per week.


Art. 25. To see what disposal the Town will make of the money refunded by the County from the Dog Licenses for the year 1941.


Voted: On motion by Carl Russell, that the Town appropriate the money refunded by the County, $477.94, from the Dog Licenses for the year 1941, for the support of the Public Libraries.


Art. 26. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the Park Department.


Voted: On motion by George Peavey, that the Town raise and appropriate the sum of $500.00 for the General Expense of the Park Department.


Art. 27. To see if the Town will vote to raise and appropriate a sum of money for the Observance of Memorial Day and determine by whom it will be spent.


Voted: On motion by Carl Russell, that the Town raise and ap- propriate the sum of $200.00 for the Observance of Memorial Day, to be spent under the direction of the American Legion Post No. 131, Inc.


Art. 28. To see if the Town will vote to raise and appropriate a sum of money to cover the Town's Share of the cost incurred during the year 1941 in maintaining the Essex County Sanatorium under the Pro- visions of Chapter 111 of the General Laws.


Voted: On motion by George Peavey, that the Town raise and ap- propriate the sum of $2,348.57 to cover the Town's Share of the cost incurred during the year 1941 in maintaining the Essex County Sana- torium under the Provisions of Chapter 111 of the General Laws.


Art. 29. To see if the Town will vote to raise and appropriate a sum of money to be used as the Reserve Fund.


Voted: on motion by Edward Averell, that the Town raise and ap- propriate the sum of $2,500.00 to be used as the Reserve Fund.

TOWN OF LYNNFIELD


Art. 30. To see if the Town will vote to raise and appropriate a sum of money for the use of the Cemetery Commissioners for the care of the Town Cemeteries.


Voted: On motion by Raymond Pearson, that the Town raise and appropriate the sum of $750.00 for the use of the Cemetery Commis- sioners for the care of the Town Cemeteries.


Art. 31. To see if the Town will vote to raise and appropriate a sum of money to cover the payment of notes maturing the current year.


Voted: On motion by Edward Averell, that the Town raise and ap- propriate the sum of $5,000.00 to cover the payment of notes maturing the current year.


Art. 32. To see if the Town will vote to raise and appropriate a sum of money to cover Payments of Interest on Debts and Loans.


Voted: On motion by Everett Webster that the Town raise and ap- propriate the sum of $650.00 to cover Payments of Interest on Debts and Loans.


Voted: On motion by Carl Russell that Articles 42, 43 and 44 be taken at this time and Article 34 prior to 33.


Art. 42. That the Town will vote to accept as public way, the right of way known as Laurel Road, running from land now or formerly of Laura G. Reeg, in a generally westerly direction to a point intersecting Fairview Road for a distance of 600 feet more or less, as laid out by the Board of Selectmen and shown on a plan filed with the Town Clerk by Otis W. McIntosh, C. E., and agreeable to a petition of Laura G. Reeg and others.


Voted: On motion by George Peavey, that the Town accept as a public way, the right of way known as Laurel Road, running from land now or formerly of Laura G. Reeg, in a generally westerly direction to a point intersecting Fairview Road for a distance of 600 feet more or less, as laid out by the Board of Selectmen and shown on a plan filed with the Town Clerk, by Otis W. McIntosh, C. E. and agreeable to a petition of Laura G. Reeg and others.


Art. 43. That the Town will vote to accept as a public way the right of way known as Sylvan Circle, running from Laurel Road in a general southwesterly and northerly direction to a point intersecting Laurel Road, said road being more or less circumferential in character, a distance of 1290 feet more or less as laid out by the Board of Select- men and shown on a plan filed with the Town Clerk by Wm. H. Ritchie, C. E .; agreeable to a petition of Laura G. Reeg, and others.


Voted: On motion by Nelson B. Todd, that the Town accept as a public way the right of way known as Sylvan Circle, as set forth in Article 43 of the warrant.

Art. 44. To see if the Town will vote to accept as a Public Way a certain section of Phillips Road, and being the unaccepted portion thereof, running Northwesterly a distance of (600) Six Hundred Feet more or less as laid out by the Board of Selectmen and shown on a plan filed with the Town Clerk, Davis and Abbott, Civil Engineers, and recorded in Essex South District Registry of Deeds, Book 3059.
