The Bearer hereof Mr Daniel Lane Captain in the Provincial Service, now Prisoner of war is at his earnest request, upon the exigences of his family affairs indulged with permission to go home, with his Servant to Buxton County of York, for the space of Two Months, having solemnly engaged upon his parole not to serve against his Majesty, nor otherwise as- sist the Kings Enemies during his absence, and having moreover engaged to return at the time above limited, or sooner if called upon, to Ticondero- ga, or such other place as Lieutenant General Burgoyne shall appoint. mr Lane and his Servant are to be permitted to pass all Outposts and parties of the army without Molestation.
Given at head Quarters near Saratogha September 16 th 1777. -

The Deposition of Jabesh Lane of Lawfull age Testifieth and Saith that in the year one Thousd Seven hundred and Seventy Seven He was Com- mander of a Company of Soldiers belonging to ye united States of america and at a Place Called Stillwater there was a horse belonging to Capt Daniel Lane who was made Prisoner by the Enemy - that was Delivered me by major Whiting Whilst the Said Daniel Lane was Prisoner with the Enemy and Said horse I put into a Pasture. I John Woodman of Buxton being engaged in the Continental Service in the Year 1777 & being at the Same time in Capt Daniel Lines Company in Colo aldens Regt In the Retreat with General Schuyler from fort Edward before Gent Burgoynes army, In which time had oportunity of knowing thi t the Said Capt Daniel Lane then had a horse in Camp. he then being a prisoner, in which time there was orders from the General to put all horses which was not engaged otherways, into the public Waggons, In Conse- quence of which the day after Capt Lanes horse was not to be found at the paster where it was left. I being on the way of our Retreat Came across the Said horse Dead in the Road which horse was Said to be Killed in the public Waggons
