The petition of the Subscribers iu behalf of the Proprietors of the Town of Buxton


Humbly Shews -


That upon the Petition of the Towns of Falmouth, Gorham & Pearsontown with a number of others Concern'd therein in the Year 1762, The then Gerl Court of the Province of the Massachusetts Bay raised a Committee & authorized them with full power to Run the lines and Fix the boundaries of the Towns of Biddeford Scarborough & Falmouth : also to fix the boundaries of the Townships Narragansett Nº 7. (alias Gorham) Narragansett Nº 1 (alias Buxton) and Pearson Town (alias Standish with a number of Other Towns Concern'd therein - Consequent thereunto the said Committee proceeded in the execution of their Commission, and run the lines & Fixed the bounds in conformity thereto, and made report there- of to the acceptance and Confirmation of the General Court of said Prov-

ince of the Massachusetts Bay-which Runing the said lines as it effected the said Town of Buxton, Consequent to her wanting about 1400 acres (exclusive of what was taken off the Town of Gorham to Compleat the Grant originally made to the said Town directed their proceedings so as to include to the said Town of Buxton to make up to them their deficiency a Certain Goar of lands to the Contents of about 1400 acres, lying between the said Towns of Scarborough & Buxton It being Lands then the proper- ty of the sd Province of Masstts Bay. and not included in the Limmits Grant- ed to Searbor which Lands the said Town of Scarborough Claims & pos- sesses as a part of their Town - The Proprietors of the Town of Buxton however Conceiving themselves secure in the said Lands proceeded imme- diately to lot them them out and number them in their Third Division and dispose of them with other lands by draughts (as was usual) among those having a right thereto - The Proprietors of the Town of Scarborough per- sisting in their right to possess the said lands, & refusing to relinquish their Claims - of Course it became necessary for the proprietors of Buxton to have recourse to Law as their remedy, and have had final Issue therein. which terminated in a failure of the recovery thereof - The event of which was founded principally in an objection to the authority of the Gen- eral Court, to Interfere with private property in establishing Bounds be- tween Towns without the consent of the parties interested therein where such circumstances exists ; and in case the lands in dispute was the proper- ty of Government at the time it was Ceeded To the proprietors of Buxton, being previously in the possession of Scarborough, that no proprietor of Buxton as such can appear Plaintiff in the cause But under the agency of Government whose right it then was - These being a Statement of facts which as they relate to the proceedings of the said Genl Court therein, are Coroborately set forth by the papers accompaning this memorial, and ob- viated by the plan of the said Towns therein concerned, refferance there- unto being had. - and that the Documents of the supreme Judicial Court of this Commonwealth will Sufficiently evidence what is above related of the Proceedings of the Proprietors of the sd Town of Buxton in the prose- cution & Event of their Cause, which can be adduced if Necessary - and we think furthermore it may not be amiss here to observe to this hon. Court - That Consequent to the establishment of the Boundaries of the said Town of Buxton as before recited, and describing the Contents there- of The assessors of the sd Town Conceiv'd themselves requird by Law and have included in the Genil Valluation of the Town those lands of the Gore in dispute as aforesaid and Returnd the same to the Gent Court of this Commonwealth, and have Likewise been Taxed therfor ever since the sil [town] of Buxton has been incorporated which was in the year 1762 [1772] which perhaps is not an inconsiderable Object, Considering the cir- cumstances in which Taxation has since that time existed -
