Thus we have in as brief & Concise a Manner as we are capable, set forth the circumstances and conditions upon which this Petition is founded, The event of which is the real Loss to the proprietors of the said Town of Buxton of 1400 acres as good lands as avy in the Town, Togather with the full sum of Sixty [ ], the Cost & Charges in the event of the Issue of their prossecution against Scarboro - With also the loss to the Town of Buxton of the Taxes on said Lands as before recited -


This being the case Your petitioners therefore are under the Disagreable necessity of Imploring the assistance of the hon. Proceed by the 10th article of the foregoing Warrant and Voted that Capt Joseph Woodman Jur be a Committe with full power to appear by him Self & Substitute at the Suprem Judasial Cort next to be holden at Ipswich in the County of Essix then and theire in Said Cort to Shew Cause why Cer- tian Person or Persons named in a Petition to said Couurt with there order thereon praying that there Parts of Land as proprietors in the Town of Buxton may be Set off to them in Severalty Cannot have any further provision made to them then what has been already made and to transact any other matter refering to the said order of Cort as may appear neces . sary -

We have this Day Returned from our Journey to the States Lands - have taken a view of the Territory adjoining Waldos & Plymouih Pattents, which has been Recommended by mr Chase - we have advised with him on the Expediency of viewing the Lands on what is adjacent the Great East pond - he supposes that the Sittuation of the Land would not be agreeable, & therefore thinks, that the first Towuship will best suit us - we should have been Glad to have gone further towards Penobscot River for Lands, but as we cannot find any real probability of Accommodat- ing our selves there, -- we should take it as a favour you would reserve the sd First Township (adjoining the plymo pattent on the West, & the Waldo's on the South) untill the Setting of the Genl Court as mr Chase expects one Square mile Laid Out in that territory for him - We should been happy to have conversed with you On the Subject, but, being in hurry to return home, must beg to be Excused -

We the Subscribers Proprietors in the Town of Buxton Request you to Call a meeting of the Said Proprietors on

In the name of God, amen, I Thomas Bradbury in the county of York, gentleman, being weak of body but of sound and perfect mind and mem- ory, blessed be Almighty God for the same, do make and publish this my last will and testament in manner and form following, that is to say.


First, I give to my beloved wife Ruth Bradbury, the use, occupation and improvement of all the real and personal estate which I may die seized of ; which said one half, my will is should after the decease of my said wife de- scend to my two daughters Botsey and Anna Bradbury to be divided between them the said Betsey and Anna by and according as it shall be directed by the written will of Ruth Bradbury my said wife.


I also give to my two oldest sons Jabez Page Bradbury & Daniel Bradbury twenty dollars each to be paid them by Ruth Bradbury my said wife and Thomas Bradbury herein after named my executor


And I do also give and bequeath to my two daughters Betsey and Anna Bradbury the one half of all the real and personal estate wherever it may be found which I may die seized of excepting & reserving to Ruth Bradbury my said wife the use, occupation & improvement of said one half of said real and personal estate during the course of her natural life.


And lastly as to the rest, residue and remainder of my real and personal estate of what kind and nature soever I give & bequeath the same to my beloved son Thomas Bradbury Junr whom I hereby appoint sole executor of this my last will and testament, hereby revoking all former will by me made, In witness whereof I have hereunto set my hand and seal this seventeenth day of September in the year of our Lord eighteen hundred and three

4thly to see if the proprietors will appropriate the Lands lying near pleasent point (so Called) adjacent to Saco River, to make up the deficiency of (B) range of first Division ac- cording to the original Interst of sd Proprietors


5thly To see what the Proprietors will do with Sundry pieces of Common Land not already appropriated -


6th To accept the Committees Report in Settling & Trans- ferring Treasurer Bradbury's accounts &c


7thly To Choose an agent to Prossecute in a due course of law any Person or persons who are or may be Trespassers on any part of the lands Called the Seven hundred acres, or any other of the Proprietors Lands -
