A PETITION of Shubal Gorham Esq' for himself and the other Proprietors of the Narraganset Township Number Seven, SHEWING that pursuant to a Vote of the General Court he convened a Meeting of the said Proprietors in the Year 1736, which Meeting was adjourned for further Business, but failed by the absence of the clerk ; PRAYING that he may be impow- ered to convene the said Proprietors and Grantees, for tran- sacting their necessary business and agreeing upon a method of calling future Meetings.

A PETITION of Shubal Gorham Esq' in behalf of the Pro- prietors of the Narraganset Township Number Seven SHEWING that the said Proprietors at their last Meeting made choice of M' Moses Pierson to be their Moderator, but by reason of his attending his duty in the General Court he will not be able to attend at the adjournment of the said Meeting, which will be on the Twenty seventh Instant ; and therefore PRAYING that this Court wou'd adjourn the said Meeting to some further day.


In the House of Represent's; Read and ORDERED that the prayer of the Petition be granted, and that the Meeting of the Proprietors of the Township within mentioned, which was to be held by adjournment on Tuesday next, be continued to Wednesday the nineteenth Day of May next, at Ten of the clock before Noon, then to be held at the Dwelling house of M' Moses Pierson at Falmouth ; the Petitioner causing the said Proprietors to be notified of this Order by publishing the same in the next publick prints and by posting a Notification thereof in some publiek place in Falmouth, fourteen days be- fore the day here assigned for holding said Meeting.

THE PETITION of Us the Subscribers, Inhabitants of Bidde- ford & Scarborongh


HUMBLY SHEWS


That whereas this Hon' Court did in the year 1733, grant to a Company of Narraganset Soldiers a Township lying on the Easterly Side of Saco River adjoining partly to Biddeford & partly to Scarborough aforesa called Narrhagansett Number one, under certain conditions of Settlement to be compleated within the Term of seven Years from that Date ; as by a copy of sd Grant & Plann annexed may appear, which Term of years is long ago expired, yet not above Ten or a Dozen of the sd Grantees have made any Beginning towards Settling their Lotts in sd Township,-& sundry of those who did sea- sonably begin to settle and improve the same have left their Settlements by (Reason as your Pet humbly conceive) of the Backwardness of the other Grantees-And WHEREAS the Land contained in sd Grants is capable of making a good Town were these People admitted & encouraged to go upon and improve the Same-The want of which is a great Detri- ment not only to the Towns whereto we belong but also to all the Rest of ye Towns & Settlements in this Eastern Fron- tier -- and the Pets having been for some years past employed in getting Masts for his Majestys Service were necessitated to expend considerable Costs & Labour in clearing Roads mak- ing Bridges & Causeys &c in and near sd Township which will be of great advantage in Settling the same : And y" Pet' hav- ing met with considerable Losses & Discouragements in the Business of Masting & being desirous to assist in bringing for- ward a regular and defensible Town, in this exposed Frontier- We BEG LEAVE to pray That yo Excellency & Hon" would in y' Great Wisdom & Goodness take effectual Care that the

gether with a Number of Others, who were all equally with Us obliged to fulfill certain Terms & Conditions of Settlement within the Term of Seven Years from the Date of Sd Grant ; as by a Copy thereof, hereto annexed may appear; which Sd Term of Years, is long since expired, Yet none of yº Sd Grantees have fulfilled y® Sd Conditions of the Sd Grant, ex- cept Such of yo Pet's only as were Grantees & those whom the Rest of Us Represent-Who have by reason of the Negligence, & Default of the Sd Delinquent Grantees, been put to very extraordinary Costs & Charges in Carrying on Our Settle- ments thus far,-have been obliged to live without any Set- tled Publick Worship of God among us-School For our Children-Publick Buildings or Necessary Fortifications ; Whereby Our own Lives & the Lives of our Families, with our Substance have been in continual Jeopardy, in this ex- posed Frontier ; & our Children under the Disadvantage of a Wilderness Education, Which Y' Pet® should in no wise have Submitted to, had we not expected, that the Rest of the ad- mitted Settlers would have been obliged to fulfill the Sd Tern s of their Sd Grants ; Yet after our repeated Invitations & In- treaties, Yº Pet® have not had the Happiness of Seeing any of our Sd Partners making any Improvements on, or attempt to comply with y Terms of their Sd Grants ; and they living mostly at a Distance, & having So long refused-Y' Pet have no Reason to think They will by any Means be compelled to it-and unless there be other Settlers admitted in their Room, We shall be obliged to leave Our Habitations very Soon, & yield up our Improvements to the wild Beasts, or Salvage Natives.

Land in the Narraganset Township called Number Two, hay- ing considered the said Petition and the nature and circum- stances of the affair, are HUMBLY OF OPINION that the speedy Settlement of the Township lately granted on certain condi- tions, is the thing proposed by this Court, as well as granting Relief in the present case ; and the Committee do not appre- hend that by Vertue of the Order on said Petition they can make a just Representation of the affair; they are therefore FURTHER OF OPINION that it is advisable that a Committee be appointed (at the charge of the Proprietors of the above said Township) and ORDERED to repair to the Lands men- tioned in said Petition and view the lands, and how far the Conditions of the Grant are complied with, as also to send for the Clerk of the Proprietors to lay before them such Records Papers and Accomptes as they may judge necessary and to report as soon as may be. The Committee appointed to take under Consideration .- the Petition of Philip Bemus & others & to make Report, Having fully considered the same, are of OPINION that a Com- mittee for the purposes hereafter mentioned be chosen by this Court in their present Session ; & THAT said Committee on the first Wednesday in January next, or as soon after as may be, repair to Narraganset Number Two, & view the Settlement there made ; and the said Committee are fully authorized, & are required to commence & prosecute to Effect, a Suit & Suits

in behalf of the Province, against any and every Person or Persons, whom it concerns for recovering the Possession of all such Lots or shares as shall not be settled; agreeable to the terms or Conditions of the Grant of said Township ; and the said Committee are impowered to agree with such Person or Persons as shall appear to purchase the same, & will en- gage, in a reasonable time to bring forward a Settlement thereof, for all such Lots or Shares, Possession of which shall be secured as aforesaid ; and as soon as such Person or Persons shall have complied with the Terms of their Agreement res- pectively, the said Committee are hereby authorized & required to give a good & sufficent Deed or Deeds of Conveyance of all & any such Lots of Shares ; & the Produce thereof they are required to pay into the Province Treasury. The Com- mittee are also of OPINION that the Proprietors of Narragan- set Number Two be obliged to hold all their future Meetings within the Bounds of said Township .- The Committee are FURTHER of Opinion that it is necessary an Act should pass this Court, Enabling Courts of General Sessions of the Peace to give Relief to Ministers in new Townships when the inhab- itants fail of their Contracts, in such manner as may be direct- ed or proscribed in said Act. all which is humbly submitted
