Recount on the election of Library Trustee for one year term


In response to a petition submitted in regular form, a Recount was held Wednesday evening, March 13th, at 8 o'clock, on the election of Library Trustee for one year term, held March 4th.


Those assisting in the Recount included the Board of Registrars and Clarence A. Hall, Franklin W. Freeman, Carl H. Russell, of the Election Officers, a representative of Harry E. Maynard and George A. Cornet being present.


The result of the Recount showed a loss of 9 votes for George A. Cornet, and a gain of 20 votes for Harry E. Maynard, which assured the election of Harry E. Maynard.

REPORT OF TOWN MEETINGS


ANNUAL TOWN MEETING HELD MARCH 11, 1929


The meeting was called to order at 7.35 o'clock p. m. by the Town Clerk, and on motion by Nelson B. Todd it was voted to omit the read- ing of the articles in the warrant.


After the reading of the call for the meeting, and the Constable's return, the meeting proceeded to act upon the articles.


Article 1. To choose a moderator to preside at said meeting. Nom- inations were called for and there being but one nominee motion by Nelson B. Todd that the Town Clerk be instructed to cast one ballot for Joseph F. Smith the nominee for moderator was carried, and the instructions being carried out he was declared elected.


Article 2. To act upon reports of town officers as published and special committees.


On motion of W. W. Moxham it was voted to accept the reports of town officers as published and special committees.


Article 3. To choose all town officers not required to be chosen by ballot.


On motion of C. W. Pratt it was voted that James D. McNamara, Daniel J. McCarthy and Joseph F. Smith serve as field drivers, Joseph F. Smith as pound keeper, and George M. Roundy, William E. Roundy and Albert G. Tedford as wood measurers.


Article 4. To see if the Town will vote to authorize the Treasurer, with the approval of the Selectmen, to borrow money in anticipation of revenue of the financial year beginning January 1, 1929 and to issue a note or notes therefor, payable within one year, any debt or debts in- curred under this vote to be paid from the revenue of said financial year.


On motion of John Ward, it was voted unanimously, that the Town authorize the Town Treasurer, with the approval of the Selectmen, to borrow money in anticipation of the revenue of the financial year be- ginning January 1, 1929, and to issue a note or notes therefor, payable within one year, any debt or debts incurred under this vote, to be paid from the revenue of said financial year.


Article 5. To see if the Town will vote to authorize the Treasurer with the approval of the Selectmen, to borrow money on and after Jan- uary 1, 1930, and to issue a note or notes therefor, payable within one year, any debt or debts incurred under this vote to be paid from the revenue of the financial year beginning January 1, 1930.


Motion by John Ward was carried unanimously, to authorize the Town Treasurer, with the approval of the Selectmen, to borrow money on and after January 1, 1930, and to issue, a note or notes therefor,

payable within one year, any debt or debts incurred under this vote, to be paid from the revenue of the financial year, beginning January 1, 1930.


Article 6. To see what disposal the Town will make of the money refunded by the County from the dog tax for the year 1928.


On motion of Charles Payzant, it was voted that the Town appro- priate the money refunded by the County from the dog tax for the year 1928 for the use of the Public Library.


Article 7. To see if the Town will vote to raise and appropriate a sum of money for the observance of Memorial Day and determine how the same shall be expended, or what action it will take thereon.


Recommend $150.00.


On motion of C. H. Russell, it was voted to raise and appropriate the sum of $200 for the observance of Memorial Day, the same to be expended by a committee to be appointed by the American Legion, Post No. 131.


Article 8. To see if the Town will vote to raise and appropriate the sum of $38,345.00 for the general expense of the School Department, or what action it will take thereon.


Recommend $38,345.00.


W. M. Riggs moved that the Town raise and appropriate the sum of $35,300.00 for the general expense of the School Department.


On an amendment made by L. B. Tuck, it was voted unanimously, that the Town raise and appropriate the sum of $38,345.00 for the general expense of the School Department.


Article 9. To see if the Town will vote to raise and appropriate a sum of money for the general expense of the Highway Department or what action it will take thereon.


Recommend $13,000.00.


Motion was made by Ralph E. Cox that the Town raise and appro- priate $12,000.00 for the general expense of the Highway Department.


An amendment was made by E. P. Lane, that the Town vote to raise and appropriate the sum of $13,000.00 for the general expense of the Highway Department and the motion as amended was carried.


Article 10. To see if the Town will vote to raise and appropriate a sum of money to cover the expense of the General Government of the Town, viz: Town officers' salaries and expenses, care of municipal buildings; elections and registrations, or what action it will take thereon.


Recommend $7,200.00.


George S. Harvey made a motion, that the Town raise and appro- priate the sum of $7,200.00 to be used to cover the expense of the Gen- eral Government of the Town, viz: Town Officers' salaries and expenses, care of municipal buildings, elections and registrations, and it was so voted.

Article 11. To see if the Town will vote to raise and appropriate a sum of money to cover protection, including Police, Sealer of Weights and Measures, Inspection of Animals, Inspection of Milk and Sanita- tion, and specify how this money is to be divided among the aforesaid departments.


Recommend: Police, $4,750.00; Sealer of Weights and Measures, $150.00; Inspector of Animals, $75.00; Inspector of Sanitation, $75.00.


Motion was made by R. E. Cox, that the Town vote to raise and appropriate $3,000 for Police, 150.00 for Sealer of Weights and Mea- sures, $75.00 for Inspection of Animals, $75.00 for Inspection of Milk and Sanitation.


An amendment was made by N. B. Todd that the Town vote to raise and appropriate the sum of $4,750.00 for Police, $150.00 for Sealer of Weights and Measures, $75.00 for Inspection of Animals, $75.00 for Inspection of Milk and Sanitation, and the motion as amended was voted unanimously.


Article 12. To see if the Town will vote to raise and appropriate a sum of money to cover Department of Charities or what action it will take thereon.


Recommend $1,500.00.


On motion of G. S. Harvey, it was voted that the Town raise and appropriate the sum of $1,500.00 to cover the Department of charities.


Article 13. To see if the Town will vote to raise and appropriate a sum of money to be known as the Reserve Fund, or what action it will take thereon.


Recommend $1,500.00.


On motion of George H. Bancroft, it was voted unanimously, that the Town appropriate $1,500.00 from the Overlay Reserve Fund and transfer it to the Reserve Fund.


Article 14. To see if the Town will vote to raise and appropriate the sum of $3,567.00 for the operation of street lighting for the ensuing year.


Recommend $3,567.00.


Motion made by John Ward, that the sum of $3,567.00 be raised and appropriated by the Town, for the operation of street lighting for the ensuing year, carried unanimously.


Article 15. To see if the Town will vote to raise and appropriate the' sum of $4,100.00 for the maintenance expense of the Fire Department for the ensuing year, or what action it will take thereon.


Recommend $4,100.00.


Motion by W. W. Moxham, that the Town raise and appropriate the sum of $4,100.00 to carry out the purposes of Article 15. Was carried by a unanimous vote.

Article 16. To see if the Town will vote to raise and appropriate the sum of $1,125.00 to be used for hydrant rental in Lynnfield Water District, for the year 1929.


Recommend $1,125.00.


On motion of G. S. Harvey, it was voted that the Town raise and appropriate the sum of $1,125.00 to be used for hydrant rental in Lynn- field Water District for the year 1929.


Article 17. To see if the Town will vote to raise and appropriate the sum of $2,700.00 to cover payment of interest on debts and loans becoming due the current year or what action it will take thereon.


Recommend $2,700.00.


Voted: On motion of John Ward that the Town raise and appro- priate the sum of $2,700.00 to cover payment of interest on debts and loans, becoming due the current year.


Article 18. To see. if the Town will vote to raise and appropriate the sum of $7,000.00 to cover payment of notes maturing the current year, or what action it will take thereon.


Recommend $7,000.00.


Motion was made by Franklin W. Freeman, that the Town raise and appropriate $5,226.06, that $1,773.94 be appropriated from the Essex County Sanitarium Fund to cover the payment of notes maturing the present year, and the motion received a unanimous vote.


Article 19. To see if the Town will vote to raise and appropriate the sum of $96.00 to cover payment of State Aid during the ensuing year or what action it will take thereon.


Recommend $96.00.


Motion made by C. H. Russell that the Town raise and appropriate the sum of $96.00 to carry out the purposes of Article 19 was so voted.


Article 20. To see if the Town will vote to raise and appropriate the sum of $1,354.57 to cover payment of State Moth Assessment for the ensuing year, or what action it will take thereon.


Recommend $1,354.57.


Motion was made by Franklin W. Freeman, that articles 20, 26, 29 be taken up collectively, that the Town raise and appropriate the sum of $1,354.57 to carry out the purposes of these articles. Tellers were appointed and as 88 voted in the affirmative and 92 in the negative the motion was lost.


George S. Harvey made a motion that articles 20, 26, 29 be taken up separately and the same tellers acting, the count showed the motion was carried, 112 having voted in the affirmative and 42 in the negative.


On motion by G. S. Harvey it was voted that the Town raise and appropriate the sum of $1,354.57 to cover payment of State Moth Assessment for the ensuing year.

Article 21. To see if the Town will vote to raise and appropriate the sum of $731.46 to cover the Town's share of expense incurred during the year 1928 in maintaining the Essex Sanitarium under the provisions of Chapter 111 of the General Laws, or what action it will take thereon.


Recommend $731.46.


Motion by W. W. Moxham was carried, that the Town raise and appropriate the sum of $731.46 to carry out the purposes of Article 21.


Article 22. To see if the Town will vote to raise and appropriate the sum of $800.00 for the use of the Cemetery Commissioners for the caring for and laying out of the Town Cemeteries for the ensuing year, or what action it will take thereon.


Recommend $800.00.


Voted: On motion by Seth H. Russell, that the Town raise and ap- propriate the sum of $800.00 to carry out the purposes of article 22.


Article 23. To see if the Town will vote to raise and appropriate the sum of $900.00 for the general expense of the Public Libraries, or what action it will take thereon.


Recommend $800.00.


Voted: On motion by Charles Payzant, that the Town raise and appropriate the sum of $900.00 for the general expense of the Public Libraries for the ensuing year.


Article 24. To see if the Town will vote to raise and appropriate the sum of $650.00 for special expense of the Libraries, said sum to apply as follows:


$350.00 estimated expense to raise, install wall under the Branch Library, and to defray incidental expense in connection therewith.


$300.00 estimated expense to paint the exterior of Center Library two coats and for replacing, if necessary, rotted sill or sills, or what action it will take thereon.


Recommend: Branch Library, $350.00; Center Library, painting, etc., $200.00.


R. O. Fraser moved postponement of Article 24 and that Article 41 be acted upon.


Charles Payzant offered an amendment that we take up Article 24. Amendment was lost.


Original motion, that Article 41 be acted upon was carried.


Article 41. To see if the Town will vote to appoint a committee to investigate the conditions of Old Meeting House, at the Center, and report not later than the next annual town meeting on the advisability and cost of restoring it as nearly as possible to its condition prior to its use as a Chemical House: this committee to consist of three persons to be appointed by the moderator.


Motion by Charles E. Pearson that a committee of three be appoint-

ed by the moderator, the committee to consist of citizens of the Town of Lynnfield, to carry out the purposes of Article 41 was so voted.


Voted: On motion by G. S. Harvey, that the committee appointed to carry out the purposes of Article 41 be instructed to ascertain from the Town Counsel, his opinion regarding the title to the property.


Motion of W. N. Ober that the purposes of Article 41 be carried out was voted affirmatively.


The moderator appointed Harry A. Worthen, John H. Hewes and Peter J. Walsh.


Article 24 was taken up and on motion of C. W. Pratt it was voted to divide the article acting first upon the first section; that the Town vote to raise and appropriate the sum of $350.00 estimated expense, to raise and install wall under the Branch Library, and to defray inciden- tal expense in connection therewith. On motion of C. W. Pratt it was voted to indefinitely postpone the second section of Article 24, calling for an appropriation of $300.00 for repairs on Center Library as it was considered unnecessary.


Article 25. To see if the Town will vote to raise and appropriate the sum of $600.00 to cover the expense of caring for the Town Parks dur- ing the ensuing year, or what action it will take thereon.


Recommend $600.00.


Voted: On motion by H. B. Nesbitt, that the Town raise and ap- propriate the sum of $600.00 to carry out the purposes of Article 25.


Motion by C. W. Pratt that the meeting adjourn at 10.30 until Tuesday, March 19th, at 8 o'clock p. m., was lost.


Article 26. To see if the Town will vote to raise and appropriate the sum of $700.00 for private moth work, or what action it will take thereon. Recommend $700.00.


On motion by G. S. Harvey, it was voted that the Town raise and appropriate the sum of $700.00 to carry out the purposes of Article 26.


Article 27. To see if the Town will vote to raise and appropriate the sum of $1,000.00 to be used by the Tree Warden to cut the bushes along the highways, or what action it will take thereon.


Recommend $500.00.


On motion by C. H. Russell, it was voted that the Town raise and appropriate the sum of $500.00 to carry out the purposes of Article 27, the appropriation to be expended under the direction of the Superin- tendent of Streets.


Article 28. To see if the Town will vote to raise and appropriate the sum of $1,000.00 to be used by the Tree Warden in trimming and caring for shade trees along the highways, or what action it will take thereon.


Recommend $400.00.


Motion by G. H. Bancroft that $400.00, as recommended by the Finance Committee, be raised and appropriated by the Town, to be

used by the Tree Warden in trimming and caring for the shade trees along the highways, was carried.


Article 29. To see if the Town will vote to raise and appropriate the sum of $25.00 to be used by the Moth Superintendent in the sup- pression of Satin Moths on Parsons Ave .; and other trees infested, or what action it will take thereon.


Recommend $25.00.


Voted: On motion by N. B. Todd, that the Town raise and ap- propriate the sum of $25.00 to be used by the Moth Superintendent in the suppression of Satin Moths on Parsons Ave. and other trees infested by Satin Moths.


Article 30. To see if the Town will vote to raise and appropriate the sum of $13.50 to install one electric street light on Howard Ave., near the home of Charles W. Tyacke.


Recommend $13.50.


On motion of Edward A. Russell, that the Town raise and appropri- ate the sum of $13.50 to install one electric street light on Howard Ave., near the home of Charles W. Tyacke, it was so voted.


Article 31. To see if the Town will vote to raise and appropriate a sum of money, not to exceed $10,000.00, to be used in continuing the re- construction of Main St., as recommended by the Public Works Depart- ment, or what action it will take thereon.


Recommend $10,000.00.


Motion was made by F. W. Freeman that the Town vote to raise and appropriate the sum of $10,000.00 for the purpose of continuing the reconstruction of Main St., as recommended by the Public Works De- partment, said sum to be used with sums allotted by the County of Essex, and by the Commonwealth for said purpose, one-third of the total cost to be borne by each, and that for the purpose of meeting said appropriation, there be raised in the tax levy of the current year the sum of $2,000.00 and that the Treasurer, with the approval of the Select- men, be and hereby is authorized to borrow a sum up to, but not to exceed $8,000.00, and to issue bonds or notes of the Town therefor, said bonds or notes to be payable in accordance with the provisions of Sec. 19 of Chap. 44 of the General Laws, so that the whole loan shall be paid in not more than (4) years from the date of the issue of the first bond or note, or at such earlier date as the Treasurer and Select- men may determine. The motion was carried unanimously.


Article 32. To see if the Town will vote to raise and appropriate the sum of $375.00 to be expended by the Selectmen in the purchase of additional seats for the Town Hall, or what action it will take thereon.


Recommend $375.00.


Voted: On motion by R. E. Cox, that the Town raise and appro- priate the sum of $375.00 to carry out the purposes of Article 32.

Article 33. To see if the Town will vote to accept as a public way, Brook Drive as laid out by the Board of Selectmen and shown on a plan filed with the Town Clerk, or what action it will take thereon.


Voted: On motion by G. H. Bancroft, that the Town accept as a public way, Brook Drive as laid out by the Board of Selectmen and shown on a plan filed with the Town Clerk.


Article 34. To see if the Town will vote to raise and appropriate the sum of $500.00 for a continuation of the Town Survey, or what action it will take thereon.

Article 35. To see if the Town will vote to approve the Regulations as printed in this Annual Town Report adopted by the Board of Cemetery Commissioners on January 24, 1929.


On motion of Seth H. Russell, that the Town approve the Regula- tions as printed in the Annual Town Report, adopted by the Board of Cemetery Commissioners on January 24, 1929, it was so voted.


Article 36. To see if the Town will vote to appoint a committee of five persons, to consider the needs of the Fire Department with regard to Engine House No. 2, which is badly in need of repairs and that the committee shall make a report to the next annual town meeting with its recommendations, or what action it will take thereon.


Moved by G. S. Harvey, that the town vote to appoint a committee of five to carry out the purposes of Article 36, Nelson B. Todd moved as an amendment that the Town vote to instruct the moderator to appoint a committee of five, that this committee be instructed to consider the needs of the Fire Department and report the results of their findings with their recommendations, at the next annual town meeting. The motion as amended was carried. The committee appointed follows, Franklin W. Freeman, Charles M. McCarthy, Clarence A. Studley, Daniel M. Killoran, William W. Moxham.


Article 37. To see if the Town will vote to raise and appropriate a sum of money for the repair of and painting Chemical House No. 1.


Recommended $500.00.


Walter N. Ober made a motion that the Town vote to raise and appropriate the sum of $50.00 to make necessary repairs on Chemical House No. 1.


Voted : On amendment by Ralph E. Cox that the Town raise and appropriate the sum of $150.00 to make necessary repairs on Chemical House No. 1, the work to be done under the direction of the Selectmen.


Article 38. To see if the Town will vote, hereafter to elect a Mod- erator for a term of one year, at the same time and in the same manner as in the case of other town officers elected by official ballot.

Voted: On motion of G. S. Harvey, that the Town adopt the sub- ject matter, as set forth in Article 38.


Article 39. To see if the Town will vote to appropriate the sum of one hundred dollars, to be expended by the Town Planning Board, said sum to be taken out of the surplus moneys of the Town.


Recommend $100.00.


Voted: On motion by Nelson B. Todd, that the Town vote to appropriate the sum of $100.00 to be expended by the Town Planning Board, said sum to be taken out of the surplus moneys of the Town.


Article 40. To see if the Town will vote to accept a deed from the Town of Wakefield, conveying to the Town of Lynnfield, a parcel of land in said Lynnfield, on the westerly side of Main St., at the boundary line of Wakefield and Lynnfield, being a part of the premises conveyed by Harriet Potter to the Town of Wakefield.


Voted: On motion by Franklin W. Freeman, that the Town vote to accept a deed from the Town of Wakefield, conveying to the Town of Lynnfield, a parcel of land in said Lynnfield on the westerly side of Main St., at the boundary line of Wakefield and Lynnfield, being a part of the premises conveyed by Harriet Potter to the Town of Wakefield.


Article 42. To see if the Town will vote to raise and appropriate a sum of money to remodel and enlarge the storage shed at the rear of the Town Hall.


Recommend $1,200.00.


Voted: On motion by George S. Harvey, that the Town raise and appropriate the sum of $1,200.00 to remodel and enlarge the storage sheds at the rear of the Town Hall, the work to be done under the direction of the Selectmen, an amendment by F. W. Freeman that the money be taken from the highway appropriation being lost.


Article 43. To see if the Town will vote to raise and appropriate the sum of $13.50 for additional street light on Salem St., near Fairview Avenue.


Recommend $13.50.


Motion by R. E. Cox, that the Town vote to raise and appropriate the sum of $13.50 for an additional street light on Salem St., near Fairview Ave., was amended by Peter J. Walsh, that the light be located near the home of William Lewis, and the motion as amended was carried.
