QUESTION No. 1 PROPOSED AMENDMENT TO THE CONSTITUTION


Shall an amendment to the constitution relative to the apportion- ment of senatorial, representative and councillor districts, further de- scribed as follows:


The proposed amendment of the Constitution provides for the annulment of Article XXI of the Articles of Amendment of the Con- stitution and the substitution therefor of a new Article XXI, and for the annulment of Article XXII of the Articles of Amendment of the Constitution and the substitution therefor of a new Article XXII. The proposed amendment embodies in substance the following changes in and additions to said Articles XXI and XXII:

TOWN OF LYNNFIELD


1. In proposed Article XXI, towns of twelve thousand inhabitants or more may be divided in forming representative districts. No pre- cincts, however, in such towns may be divided. In taking the census the special enumeration of legal voters shall specify the number residing in each precinct of such towns. Under existing Amendment XXI no . town may be divided and no specification of the number of voters in a precinct is required.


2. The division of a county into representative districts and the. apportionment of representatives to districts therein is to be made by "The county commissioners or other body acting as such or, in lieu thereof, such board of special commissioners in each county as may for that purpose be provided by law, . ." Under Article XXI as it now stands the division and apportionment is made by "The mayor and aldermen of the city of Boston, the county commissioners of other counties than Suffolk,-or in lieu of the mayor and aldermen of the city of Boston, or of the county commissioners in each county other than Suffolk, such board of special commissioners in each county, to be- elected by the people of the county, or of the towns therein, as may for that purpose be provided by law, .


= The time for assembling of such commissioners, board or body for the purpose of making, such division and apportionment is also changed, from the first Tuesday of August next after each assignment by the Legislature of the number of representatives to each county, to a time within thirty days after cer- tification by the Secretary of the Commonwealth to such commissioners, board or body of the number so assigned, or within such other period as- the General Court may by law provide.


3. Under the proposed Articles, each special enumeration shall be the basis for determining the districts, senatorial, representative and councillor, for the ten-year period beginning in the fourth January following said special enumeration and the present division of districts is to remain in effect until January, 1939. Under the existing amend- ments the ten-year period is the period between the taking of each census. (Thus, the next redivision based upon the next census in 1935 would, under the proposed Articles, affect those elected in 1938 to hold office beginning in January, 1939, instead of affecting those elected in 1936 to hold office beginning in January, 1937. Under existing amend- ments representation of newly created districts begins in January of the second year after each ten-year census, whereas under the proposed article it would begin in January of the fourth year thereafter.) The number of representatives (240), senators (40), and councillors (8) is not changed.


4. The Legislature may limit the time within which a division of representative, councillor or senatorial districts may be questioned hy judicial proceedings. The existing amendments contain no provision that. itself limits or authorizes the Legislature to limit such time.

Shall the proposed law which amends General Laws, chapter 131, by inserting therein a new section number 59A, which in substance makes it a misdemeanor punishable by a fine of fifty dollars for anv person to use, set or maintain any trap or other device for the capture of fur-bearing animals which is likely to cause continued suffering to an animal caught therein and which is not designed to kill the animal at once or take it alive unhurt, except traps or other devices for protec- tion against vermin, set or maintained within fifty yards of any build- ing or cultivated plot of land to the use of which the presence of vermin may be detrimental, which law was disapproved in the Senate by a vote of 12 in the affirmative and 24 in the negative, and in the House of Representatives by a vote of 48 in the affirmative and 167 in the neg- ative, be approved?

RECOUNT OF VOTES CAST FOR REPRESENTATIVES IN GENERAL COURT


A petition being filed asking for a recount of the votes cast for Representatives in General Court, Nov. 4, 1930, as provided by Chapter 54 of the General Laws, a recount was held Wednesday, November 12, 1930, at 8 o'clock P. M. in the Town Hall.


Those assisting in the recount included the Board of Registrars and Clarence A. Hall, Clerk of the Election Officers in Precinct 1. The candidates or their representatives were present.


The recount showed a loss of one vote for Fred A. Hutchinson, two for Daniel J. O'Connor, Jr., fourteen for C. F. Nelson Pratt, and a gain of one vote for Michael H. Cotter, one for Tony A. Garofano, and four for Harriett Russell Hart.

SPECIAL TOWN MEETING HELD DECEMBER 16, 1930


The meeting was called to order at 8 o'clock by the Moderator and the warrant and Contables' return were read.


Article 1. To see if the Town will vote to appropriate a sum of money to care for the expense of the Fire Department for the balance of the year, or what it will do about it.

REPORT OF TOWN CLERK


A motion was made by G. W. Peavey, that $1.000.00 be appropriated from the Excess and Deficiency Fund to the use of the Fire Department to care for the expense for the balance of the year, and it was so voted.


Article 2. To see if the Town will vote to appropriate a sum of money for the use of the School Department, or what it will do about it.


On motion by C. A. Studley it was voted to appropriate the sum of $200.00 from the Excess and Deficiency Fund, for the use of the School Department.


Article 3. To see if the Town will vote to appropriate the sum of $250.00 for the Reserve Fund, or what it will do about it.


Voted: On motion by N. B. Todd, to transfer $250.00 from the Excess and Deficiency Fund, to the Emergency Fund.


Article 4. To see if the Town will vote to amend the zoning by- laws by changing from a residence district to a business district, that. portion of the Town on Salem Street now a residential district, from a line commencing at the northwest corner of Salem Street by the Saugus River, running east along Salem Street, รก distance of 870 feet; thence south by land owned by Montrose Greenhouse, Inc., a distance of 867 feet; thence west by land owned by the Montrose Greenhouse Inc .; a distance of 765 feet; thence north, running along the Saugus River, a distance of approximately 1100 feet to the point begun at, or to see what action it will take thereon.


Motion by R. E. Cox, that action on the Article be indefinitely post- poned, was withdrawn, and a motion by P. J. Walsh, that the Town vote to amend the zoning by-laws, by changing from a residence district to a business district, that portion of the Town on Salem Street, now a res- idential district, as defined in Article 4 was unanimously carried.


Article 5. To see if the Town will vote to amend the building by- laws, or which otherwise may be known as, "building regulations" as were adopted on March 8th, 1926, by adding the words to Section 2 thereof, "all buildings which are erected, which are to be used or erected to be used for residential purposes, shall be erected upon foundation walls composed of either stone or cement"; so as Section 2 shall read as follows:


All buildings which are erected, which are to be used or erected to be used for residential purposes, shall be erected upon foundation walls composed of either stone or cement, foundation walls of buildings here- inafter erected, if built of stone, shall be no less than sixteen inches (16 in.) thick and laid in good strong lime and cement mortar; if con- crete foundation is used, it shall be ten to twelve inches thick below grade, depending on size and weight of structure resting thereon, and no less than eight (8) inches thick above grade in no case shall the mixture be less than 1-2-5, or to see what action it will take thereon.

R. E. Cox's motion to adopt the article as printed, was amended by G. W. PERAMBULATION OF TOWN LINE, OCT. 16, 1930


BETWEEN LYNNFIELD AND LYNN FOR THE YEAR 1930


In compliance with Chapter 42 Section 2, of the General Laws, and with an invitation from the City Clerk of Lynn, the Board of Selectmen met a delegation of the Lynn City Government at a granite monument,. marking the Lynnfield and Saugus line on Broadway, Lynnfield, Oct. 16, 1930, and proceeded to view the markers between Lynn and Lynn- field. All markers viewed were found to be in satisfactory condition with the exception of one on Salem Street, which had evidently been hit by an automobile. It was thought advisable to have some sort of a marker in the road where the Lynn and Lynnfield line comes to an: apex, at the junction of Lynnfield Street and Salem Street.

Gentlemen:


The undersigned inhabitants of the Town of Lynnfield respectfully represent that that portion of the way known as Main Street in said town which lies between the Wakefield town line and a point about one- half (1/2) mile north of Lynnfield Centre at the end of the alteration as made by the County Commissioners in 1929, is unsuited to the present requirements of traffic, and in parts narrow and the lines thereof un- certain, so that common convenience and necessity require that the said way within the limits above named be altered or relocated and that specific repairs be made thereon.


Wherefore, they pray that after due notice and a hearing, you may alter or relocate the said way and discontinue any portions thereof which by reason of your action may no longer be required, and that you may order specific repairs to be made on the said way, all as in your- judgment may be necessary.

And also by serving the Town Clerk of Lynnfield with an attested copy of said petition and of this order thereon, thirty days at least; and by posting up an attested copy thereof in two public places in said town, fourteen days at least, before the said 20th day of June, at which time and place said Commissioners will proceed to view the premises and make such order in relation to the prayer of said petitioners as by law they may be authorized to do.

And at the present term the County Commissioners did adjudge that common conveniences and necessity, require that specific repairs

be made on said way from the end of the macadam roadway built in 1929 southerly about forty-six hundred fifty (4650) feet to a point be- yond Chestnut Street, and thence said petition has been continued to this time and now the said Commissioners make return of their pro- ceedings in the matter as follows:


At the time of the view upon the petition for alteration, etc., to be made on said highway no person interested having objected, we the County Commissioners for said County did proceed and order specific repairs to be made on said road in manner following, viz .:


The inhabitants of Lynnfield, in which town said way is laid, shall on or before the first day of January A. D. 1931, build a bituminous macadam roadway from the end of the macadam roadway completed in 1929 southerly for a distance of about forty-six hundred fifty (4650) feet. said macadam roadway to be at least (20) feet in width and at least six (6) inches in depth, properly crowned and graded and provided with proper shoulders and they shall make necessary provisions for sub-soil and surface water and erect guard rails wherever necessary and com- plete the said road so that the same may at all times be safe and con- venient for travel, all to the reasonable directions and requirements and to the acceptance of the said County Commissioners.


And the Commissioners acting under authority of Section 16 of Chapter 82 of the General Laws will reimburse the town of Lynnfield in a part of the cost of the work herein authorized :


And the petition in so far as it relates to further specific repairs and to alteration or relocation, etc., of said way is left open for further action.

It was voted unanimously to amend the zoning by-laws, by chang- ing from a residence district to a business district, that portion of the Town on Salem Street, now a residential district, from a line commenc- ing at the northwest corner on Salem St. by the Saugus River, running east along Salem Street, a distance of 870 feet; thence south by land owned by the Montrose Greenhouse, Inc., a distance of 867 feet, thence west by land owned by the Montrose Greenhouse, Inc., a distance of 765 feet; thence north running along the Saugus River, a distance of ap- proximately 1100 feet to the point begun at.

REPORT OF TOWN CLERK


AMENDMENT TO THE BUILDING REGULATIONS


adopted by the Town of Lynnfield the sixteenth day of December 1930, acting under article 5 in the warrant:


"All buildings which are erected, which are to be used or erected to be used for residential purposes, shall be erected upon foundation walls composed of either stone or cement or brick, foundation walls of build- ings hereinafter erected, if built of stone, shall be no less than sixteen inches (16 in.) thick and laid in good strong lime and cement mortar; if concrete or brick foundation is used, it shall be twelve inches thick below grade, depending on size and weight of structure resting thereon, and no less than eight (8) inches thick above grade, in no case shall the mixture be less than 1-2-5"; the motion receiving a unanimous vote.
